PSA: INTI WOULD APPRECIATE OUR HELP!

Inti would appreciate our help! Tucked away in a corner of the San Francisco Zoo sits the Koret Animal Resource Center for educational animals. In his own corner of the ARC lives one of the Zoo's most beautiful cats. He is a big healthy Bobcat named Inti. We say "big" because the fact sheets on bobcats say "normally" a bobcat is 9 to 25 lbs. and 26 to 41 inches nose to the tip of his stubby tail (hence the name "bob"cat). Inti is considerably larger than that and 32+lbs. Bobcats (Lynx rufus) inhabit a range throughout the U.S. They can be found thriving from mountainous to swampy to desert terrain. Bobcats communicate in many respects comparably to a housecat in that they purr, hiss, meow and growl. Their growl, however has been compared to that of their only predator, the cougar. Inti was born in May of 2002 and came to the Zoo as a kitten to replace a beloved predecessor in the Zoo's Summer Wildlife Theatre. Being a cat and, therefore, very much an individual, he unfortunately simply did not take to the leashes and harnesses necessary to make him a star. So, he has languished, pretty much out of sight, well cared for and loved by his keepers and volunteers, in his own little corner of the ARC. Now Inti is peppy, curious and people "friendly" fellow and some time ago his keepers and some volunteers started a movement to find him more suitable and visible quarters for both his and Zoo visitors benefit. The space has been found and the planning is progressing but, of course, the funding is sparse. Can you help the Zoo and Inti with some time and building expertise? Kalb's Q&A for Contractors By David Kalb, President of Capitol Services, Inc. Some contractor licensing ‘arrangements’ are subject to change, others not so much. Learn more about how ‘limited’ some partnerships aren’t. We start with another contractor’s concern about RME’s with a ‘sole’. We also add more ‘fuel’ to the firestorm of controversy about how public agencies can structure their bids… Q: I was hoping to get an opinion on the following scenario. A contracting company is formed as Sole Ownership, however the company has a Responsible Managing Employee (RME) who is the qualifying individual, not the listed owner. Would it be fair to say that this company is at least 51% owned AND controlled by the listed owner? A: Yes, by definition, a sole proprietorship is 100% owned and controlled by the listed owner, even with a RME. The CSLB, as matter of policy, will not recognize a Responsible Managing EMPLOYEE as owning any of the company. Q: If someone is applying for a Limited Partnership (LP) license and they are listing a corporation as the General Partner (GP) and a Limited Liability Company (LLC) as the LP on the application, can they add more General Partners later (after the license is issued)? If so, are they required to inform the CSLB? The original GP and LP won’t change; they will just add additional GP’s. A: Yes, they are required to notify the CSLB. The reason is that by adding a General Partner after the license is issued, this changes the partnership entity thereby requiring the company to apply for a NEW license (and new license number). The CSLB will however, allow an LP to change Limited Partners. Also, for my reader’s information, beginning January 1st the CSLB should begin allowing a LLC to act as a General Partner (something they are now prohibited from doing). Q: We protested a bid on the basis that our competitor did not list a “C-36” (Plumbing) subcontractor to run a new gas line to some furnaces that are being replaced.

Their contention is that their “C-4” (Boiler Hot Water Heating & Steam Fitting) license allows them to install the new line as incidental to the installation of the furnaces and they can therefore self-perform this work. I contend that they are allowed to make the connections to gas service, but aren’t allowed to install completely new gas lines. The school is agreeing with them and has responded to our protest accordingly. What does someone in the know think? A: My opinion is that the school district was within their rights to take the action they did. Of course, I am not familiar with all the details of this bid, but on its face, a “C-4” can perform the work you describe. In part, “a boiler, hot-water heating and steam fitting contractor installs, services and repairs power boiler installations, hot-water heating systems and steam fitting, including ... steam fitting and piping, ... fuel oil tanks, fuel oil lines ... and all other equipment ... associated with these systems”. Therefore, it could be argued that since the primary project was installation of a furnace, this related piping would be “incidental and supplemental” to the job. Second, a public agency can determine which classification is proper as allowed by Code Section 7059(b): “In public works contracts... the awarding authority shall determine the license classification necessary to bid and perform the project (this is the same section that references “incidental and supplemental” language). This being said, I have seen where public agencies, like a school district, get it wrong and therefore should be challenged – just not in this case. CSLB’s Proposed Legislative Package for 2012 BY: Phil Vermeulen, Legislative Advocate I attended a Contractors’ State License Board Licensing Committee meeting yesterday during which they discussed their “wish list” of potential legislation for 2012. Following are the highlights of the six proposals they are looking to have introduced. I am also attaching background sheets which contain more information for each of their proposals in case you would like more information. I would appreciate any feedback anyone has. Remember, several of these proposals are intended to combat the underground economy which is killing legitimate contractors. So too, if you have other ideas on possible legislation for next session, whether with the Contractors Board or on our own, please pass it on to me at phil@pvgov.com I). SUBJECT: Modification to Business and Profession Code - Section 7011.4 BACKGROUND: In 1989, a separate unit, Statewide Investigative Fraud Team (SWIFT), was established to proactively address unlicensed contracting activity and pursue criminal sanctions with local prosecutors. Section 7011.4 provides authority for SWIFT Enforcement Representatives (ER) to refer investigations to local prosecutors for misdemeanor violations of law by issuing Notice to Appear (NTA) citations. PROBLEM/SUMMARY: 1) January 1, 2011, CSLB received authority to issue Stop Orders to construction employers that fail to secure workers’ compensation insurance for employees. In addition to issuing a Stop Order, violators are subject to administrative or criminal sanctions for the underlying workers’ compensation insurance violations. The majority of the 15,000 consumers complaints received each year by CSLB have evidence of a workers’ compensation violation; however, Investigation Center (IC) investigators rarely make referrals to local prosecutors

because they lack authority to issue a Notice to Appear in criminal court for the misdemeanor violation. 2) CSLB receives approximately 3,000 consumer complaints each year against unlicensed contractors. Consumer complaints are investigated at a CSLB Investigative Center (IC), staffed by approximately 70 ERs, rather than the approximate 22 ERs assigned to SWIFT. IC investigators lack authority to issue NTAs and disposition the majority of complaints to an administrative citation, rather than a referral to a local prosecutor for the misdemeanor violation. For the aforementioned reasons, a modification to Business and Professions Code section 7011.4 is needed to provide authority to CSLB investigators assigned to ICs that have completed Penal Code 832 (Basic Peace Officer Standards Training) to work effectively with local prosecutors by issuing NTAs to unlicensed and uninsured contractors. II). SUBJECT: False Complaints Against Contractors BACKGROUND: Business & Professions Code section 7011.8 provides that a person who files a false complaint with the Contractors State License Board (CSLB) is guilty of an infraction, and further provides that CSLB may notify the appropriate district or city attorney that a false report has been filed. Since enacted in 1992, a violation of section 7011.8 has never been pursued. PROBLEM/SUMMARY: A violation of B&P section 7011.8 is an infraction. Prosecutors file criminal complaints for misdemeanor and felony violations, not for infractions, and there is no authority for CSLB staff to issue a “parking ticket” style citation for a violation of B&P section 7011.8. PROPOSED CHANGE (Include the Related Sections of Law): Amend section 7011.8 to instead provide the CSLB Registrar with the authority to take administrative action. ($1,000)” with “the registrar may issue a citation to a person subject to licensure by this chapter.” III). SUBJECT: Jurisdiction over construction managers. BACKGROUND: CSLB’s April 24, 2008 Precedential Decision No. 1 establishes that someone acting in the capacity of a swimming pool consultant is a contractor. The March 27, 2009, Appellate Court decision The Fifth Day v. Bolotin found that someone acting in the capacity of a construction manager is not required to be licensed as a contractor. PROBLEM/SUMMARY: The Fifth Day v. Bolotin decision undermines CSLB’s Precedential Decision. Recently, an unlicensed contractor facing criminal prosecution for violating B&P Code section 7028 claimed to have been a project coordinator and asserted exemption from licensure, citing The Fifth Day v. Bolotin decision. Although the unlicensed contractor was not overseeing a contract between the project owner and a general contractor as in the Fifth Day v. Bolotin case, the defense strategy was nonetheless of concern to the prosecutor and ultimately resulted in a plea bargain dismissing the 7028 charge. PROPOSED CHANGE (Include the Related Sections of Law): Amend 7026.1 to specify that the term “contractor” includes any person not employed by a licensed contractor who acts as a construction manager, project manager or project coordinator. PROPOSED LANGUAGE: SEE (f) 7026.1. The term “contractor” includes all of the following: (following to be added) (f) Any person that meets any of the following criteria relating to residential home improvement as defined by Section 7151: Provides a cost analysis or a bid for a residential construction project, arranges for and sets up work schedules for subcontractors and maintains oversight of the project. IV). SUBJECT: Rental Equipment Providers – Business & Professions Code (B&P) section 7026.1

BACKGROUND: The B&P Code defines the term “contractor.” PROBLEM/SUMMARY: It has become commonplace for contractors, licensed and unlicensed, to attempt to circumvent Contractors’ License Law (CLL) and Public Contract Code (PCC) requirements by asserting they are not subject to licensure as contractors because they are “Renters of Operated Equipment.” Examples include businesses that provide backhoes, tractors, paving and grading equipment, with a full crew to operate the equipment and perform incidental work, i.e., smoothing concrete with hand trowels and raking out asphalt on roads. PROPOSED CHANGE (Include the Related Sections of Law) Amend 7026.1 to include a subsection (f) to define licensing requirements for businesses that provide equipment and operators for works of improvement. PROPOSED LANGUAGE: (f) Owners of operated equipment that provide equipment and an operator, and/or employees that work in conjunction with the equipment, for work covered by this chapter. V). SUBJECT: Events Resulting in Cancellation of License; Continuation of License – Business & Professions (B&P) Code section 7076. BACKGROUND: This section details the cancellation of a license upon the death of the license or disassociation of a partnership. This section was added in 1995 (SB 1061, Chapter 467) and amended in 2010 (SB 392, Chapter 698). SB 1061 repealed the existing B&P Code section 7076 and replaced it with the current language. PROBLEM/SUMMARY: In subdivision (e) of B&P Code section 7076, in the second paragraph, fourth sentence it refers to request for continuance. It should make reference to the document being received within 90 days of the disassociation, as opposed to “within 90 days after the death.” (d) refers to death of a partner and (e) refers to disassociation of a partner. This language has been in place since the current section was added and it appears that this is just a typo that was not noted when the section was added. PROPOSED CHANGE (Include the Related Sections of Law) In B&P Code section 7076 (e), replace “death” with “disassociation.” VI). SUBJECT: Accusations Against Revoked Licenses – Business & Professions (B&P) Code section 7106.5 PROBLEM/SUMMARY: Section7106.5 grants the Registrar authority to proceed with investigation of a complaint even though the license has been expired, cancelled, forfeited, or suspended by operation of law, or voluntarily surrendered. However, the statute does not provide for pursuing an accusation to revoke the license when the license has already been revoked by operation of law. Revoking a license by operation of law occurs when a licensee fails to comply with a citation or arbitration award. The license is revoked for a minimum of one year. To reinstate the license, the licensee must make restitution or comply with the order of correction, pay civil penalties, and post a minimum disciplinary bond in the amount of $15,000.00. Often, the amount of restitution is minimal and the civil penalties cannot exceed $5,000.00. By not having the clear authority to file an accusation when the license is revoked by operation of law, an individual could evade/avoid discipline because the facts of the grounds for the accusation were never established. For example, if the licensee may not re-apply for licensure for five years after the revocation for non-compliance, the witnesses and evidence of the aforementioned case would not be fresh or the witness may not be located. By adding the statute change, the Board could proceed with the accusation hearing, and put the discipline and facts of the case on record, which would require the licensee to comply with the Order of the Registrar prior to getting the license re-issued. The proposed change would protect the public by establishing a financial injury relative to the case, which would allow the consumer to file against the bond. The public would also be more protected when, and if, the licensee re-applied because the egregious act would result in the requirement of a higher disciplinary bond amount, which currently can be imposed up to $125,000.00. In addition, the consumer of the complaint would be entitled to restitution before the license is re-issued.

SAFETY FIRST: REBAR PROTECTION Steel reinforcing bars, or rebar, are a common hazard on construction sites. The thin steel bars can stick out from construction projects and pose a hazard to workers who can cut or scratch themselves on the sharp ends. Workers that stumble or fall onto the exposed steel bars can be pierced or impaled on them, resulting in serious internal injuries and death. To protect workers from this hazard, CalOSHA requires that rebar and other projections on the worksite “be guarded to eliminate the hazard of impalement.” Guarding from rebar impalement hazards must be done when workers will be working around or at any height above exposed rebar. This also includes work situations where rebar is below grade or in a basement. Fall prevention methods such as guardrails and personal fall protection systems are the first level of protection for workers. These should be used any time workers are exposed to potential falls of ten feet or greater; a fall from any height can seriously injure a worker. The next level of impalement protection is to use protective guard systems to cover the protruding ends. Steel reinforced rebar caps provide the strongest and best impalement protection for workers. Proper protective rebar caps should be at least 4” square or, if they are round, they should have a 4.5 inch diameter. Some rebar caps are too narrow or not steel-reinforced. If a worker falls on a standard plastic cap, the impact pressure can push the rebar through the cap and impale the worker, or impale the worker cap and all. Standard mushroom rebar caps and/or covers are only appropriate to prevent cuts, abrasions or other minor injuries when workers are working at grade with rebar and when there is no impalement hazard. Long 2 x 4 wood caps or other manufactured troughs can

be used to effectively protect exposed rebar. Protective rebar caps and troughs must have passed a drop test of 250 pounds from 10 feet above to prove that they can protect against impalement. If you construct protective wood troughs on the job site, they should be built according to a registered engineer’s drawings (keep the plans on site), or to the Cal OSHA specifications set in Appendix Plate C-25, available online at http://www.dir.ca.gov/Images/ t8img/1938-48.gif Workers should be vigilant around exposed rebar ends. Fall prevention is the first defense and covered rebar ends are extra insurance against impalement in case of a fall. With the focus on safety and protected rebar ends, this is one safety point workers will be glad to miss.
