The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

A California contractor has a ‘scary’ offer that unlike those made by the ‘Godfather’ he can refuse. We often assist attorneys and industry execs with research and explanation of how contractor’s regulations work. This time the lesson is one everyone can benefit from learning, before it costs you dearly… Q: I have been approached by an out-of-state company wanting to use my CA contractor license number. What they proposed is the following: they want me to add their company name as a ‘doing business as’ or dba on my license. They then want to use my license to contract work. I would be performing the work, and they offered to pay me an hourly wage plus an extra monthly fee for the use of my license number. The company has other employees that will be on site besides me, and the company has Worker’s Comp and a business license. But can this be done or does this sound as bad as it looks? I know I can set up as a Responsible Managing Employee (RME) or Responsible Managing Officer (RMO) and do this but I have never heard of this dba approach before. So is this legal but scary or just plain illegal??

A: In certain circumstances the CSLB will consider granting a waiver of particular trade exams if they are closely related to the current classification on your license, however the “C-16” Fire Protection is not a classification that the CSLB considers closely related to General Building. Your Qualifier will need to show at least four years of experience doing that type of work and sit for the trade exam in order to add that classification.

A: Thank you for contacting us. You are correct in thinking that the method they proposed is not the correct way to go about the process. Another entity cannot simply add their name to your license as a dba and then be allowed to use the license. A license is issued to a particular entity, whether a sole proprietor, partnership, corporation, or LLC, and only that entity can contract with the number. The company who approached you can utilize you as the RME or RMO as you suggested, but they would need to apply for a new license and get a new license number issued for their company. Q: I am an attorney and I regularly read your column. I have a client whose workers compensation policy is currently expired and therefore their contractor’s license is suspended. I’m trying to stress to them the urgency of this and I remember reading one time in your column awhile back about contractors who are not properly licensed not being able to collect money for the entire project, even if their license is only suspended for part of the project. Can you refresh me on this? A: You are referring to B&P Code 7031, which states that one cannot collect for work for which a contractor’s license is required unless that person is duly licensed at all times during the performance of that act or contract. Further, if the project owner brings the action to court, they can recover all compensation paid to the unlicensed contractor during the entire course of the project, even if the license was invalid for only one day! Q: My company currently has a General Building license and we’d like to

CARB Responds To Cleaire “Problem” As if it isn’t bad enough having to deal with the California Air Resource Board’s (CARB) bureaucratic requirements in the first place, now contractors have to deal with vendors going out of business! Read on: The California Air Resources Board has learned that Cleaire Advanced Emission Controls, a manufacturer of diesel particulate filters, ceased operations on Friday, January 18, 2013. This in-turn will likely have an effect on the warranties and parts availability of Cleaire filters until Cleaire’s financial situation is resolved. CARB is committed to ensuring that these impacts are minimized and wishes to make it clear that affected owners and fleets with Cleaire filters, as noted in ARB records, will not be penalized for missing deadlines with applicable ARB regulations until this situation is resolved. Fleet owners who have devices from other manufacturers will not be affected by Cleaire’s closure, and will continue to be subject to applicable regulations. CARB is working closely with Cleaire distributors, installers, and other authorized representatives to meet the current challenge, and to make sure that affected fleets have alternative compliance options if replacement parts are unavailable. To assist fleets affected by the company’s dissolution, ARB has posted a letter to Cleaire customers with helpful information (point, click and press control to access the letter):

Top Three Things Small Businesses Should Know About the Affordable Care Act by Meredith Olafson, Community Moderator The Affordable Care Act will help small businesses by lowering premium cost growth and increasing access to quality, affordable health insurance. Depending on whether you’re a small employer or a larger employer, different provisions of the Affordable Care Act may apply to you as described below. 1. Businesses with Fewer than 25 Employees- Small Business Tax Credits The Affordable Care Act does not require that businesses provide health insurance, but it offers tax credits for eligible small businesses that choose to provide insurance to their employees. To qualify for a small business tax credit of up to 35% (up to 25% for non-profits), you must have: • Fewer than 25 full-time equivalent employees • Pay average annual wages below $50,000 • Contribute 50% or more toward employee health insurance premiums Beginning in 2014, this tax credit goes up to 50% (35% for nonprofits) and is available to qualified small businesses who participate in the Small Business Health Options Program (SHOP) Exchanges. 2. Businesses with 50 or Fewer Employees- Affordable Insurance Marketplaces The Affordable Care Act does not require that businesses provide health insurance, but beginning in 2014, small businesses with generally 50 or fewer employees will be able to purchase coverage

through SHOP , competitive marketplaces where small employers can go to find health coverage from a selection of providers. The SHOP Marketplaces and Individual Marketplaces for those who are self-employed open on January 1, 2014. Open enrollment begins on October 1, 2013. SHOP will offer small businesses increased purchasing power similar to that of large businesses. 3. Businesses with 50 or More Employees- Employer Shared Responsibility Provisions Under the Affordable Care Act, the Federal government, State governments, insurers, employers, and individuals share the responsibility to reform and improve the availability, quality, and affordability of health insurance coverage in the United States. Employers are not required to provide coverage to their employees under the Affordable Care Act. However, beginning in 2014, businesses with 50 or more full-time employees (or full-time equivalents) that do not offer affordable health insurance that provides a minimum level of

coverage to substantially all of their full-time employees (and their dependents) may be subject to an employer shared responsibility payment if at least one of their full-time employees receives a premium tax credit to purchase coverage in an insurance Marketplace. A full-time employee is generally one who is employed an average of 30 or more hours per week. If you meet or are close to this threshold level of full-time employees, it’s important to understand how these rules may apply to you and how the employer shared responsibility payments could be triggered. For more guidance on the employer shared responsibility payments, refer to this FAQ from the IRS. You should also be aware that today, SBA launched www.sba.gov/ healthcare, a page that aggregates all of SBA’s information for small business owners on the Affordable Care Act. SBA is also launching a blog, Health Care Business Pulse, to cover a series of topics related to the Affordable Care Act throughout the year. Additionally, small business owners can sign up for marketplace enrollment updates at signup.healthcare.gov.

Fire Safety and Prevention Home safety tips Fires are the leading cause of home injuries and death. Does your family have a plan if a fire started in your home? Fire Safety The best way to practice fire safety is to make sure one doesn’t break out in the first place. This means being aware of potential hazards in your home. Start by keeping the following tips in mind: Check all electrical appliances, cords and outlets. Make sure they are all in working condition, without loose or frayed cords or plugs. Use caution with portable heaters. Never place one where a child or pet could accidentally knock it over, and keep it at least three feet away from flammable objects. Be careful in the kitchen. Cooking is the leading cause of home fires. Always practice safe cooking habits, such as turning pot handles to avoid being knocked over, and supervising children while cooking. Check the fireplace. It should be kept clean and covered with a screen to keep sparks contained. Burn only wood in a home fireplace and never

leave a fire burning unattended. Beware of cigarettes. They are the number one cause of fire deaths in the U.S. Most are started when ashes or butts fall into couches or chairs, so use caution if you smoke in your home. Use candles safely. Keep them out of the reach of children, away from curtains and furniture, and extinguish them before you leave the room. Do not allow children to use candles when unsupervised by an adult. Be aware of holiday dangers. If you use a cut Christmas tree, be sure to keep it watered daily, and inspect all lights yearly for worn or frayed cords.

Use the smoke alarm’s test button to check it every month and replace the batteries at least once a year. Replace smoke alarms every 10 years. Have at least one working fire extinguisher in your home. Plan escape routes by determining at least two ways to escape from every room. Caution everyone to stay low to the floor while escaping and never open doors that are hot. Select a safe location outside your home where everyone should meet, and practice your escape plan at least twice a year so everyone knows it well.

Fire Prevention Make your home fire safe by following these tips: Install smoke alarms on every level of your home.
