Contractors State License Board Makes New Mechanics Liens Forms Available Forms (attached) took effect July 1, 2012 SACRAMENTO – The

Contractors State License Board (CSLB) wants to inform licensees of changes in the state’s mechanics lien law effective July 1, 2012. While these changes don’t substantially change the laws, they do change the wording and formats of the notice and lien release forms required to protect contractors’ lien rights. The new law replaces the 20-Day Preliminary Notice with the Preliminary

Notice. Sub-

contractors and materials suppliers should use the newly-worded forms. The Preliminary Notice should be delivered to the homeowner in person or by certified, registered, or first-class mail, with a receipt of the mailing as proof. You may give notice any time before work starts or product is delivered and up to 20 days after. If the Preliminary Notice is given more than 20 days later, you are only able to receive payment for work or products supplied 20 days before notice was given, and anytime thereafter. The Notice of Mechanics

Lien wording is also changed in the new law. This notice must ac-

company the claim of lien and be sent via certified, registered, or first-class mail, with the receipt as proof of mailing. Failure to send the notice with the claim could result in the lien being unenforceable. The conditional and unconditional lien release forms have also changed. Make sure you have subcontractors and suppliers sign the new conditional forms as progress payments are owed and when the project is finished before they are given final

payment. Have them sign the new

unconditional release forms when they receive progress payments and their final payment. The new law gives the homeowner 15 days instead of 10 to file a notice of completion with the county recorder. If notice is filed, the contractor has 60 days and subcontractors 30 to record a lien. If there is no notice filed all parties have 90 days to record a lien.

Kalb's Q&A for Contractors

We ‘heat’ up the discussion with contractors as a warning reminder to stay cool on the job this summer. Another contractor is concerned about what happens if his Qualifier gets thrown ‘under the bus’. A general gets advice on ‘covering’ his base, and more on the statewide crackdown on the economic ‘underground’…

the heaviest work first thing in the morning when heat exposure is less. Use mechanical equipment whenever possible to eliminate or reduce manual labor in the heat. Schedule frequent rest breaks in a cool spot or shade; have plenty of drinking water available (i.e. stay hydrated), and stay away from caffeinated drinks and alcohol. Finally, take precautions to protect your skin (hat, long sleeve clothing, etc.), eyes (sunglasses), and use sunscreen.

Q: I am President of this company and as we discussed, we intend on using “Bob” to be our qualifying person for our CA contractor’s license. That being said, what happens if “Bob” gets hit by a bus or leaves the company for any reason? What is the typical protocol for companies in dealing with this issue? Look forward to your response.

Dubbed, “Operation Underground”, investigators from the Contractors State License Board (CSLB), Department of Insurance (CDI), Employment Development Department (EDD) and county District Attorneys’ offices partnered for a series of sweeps at suspected illegal construction sites on June 20 and 21, 2012. Sweeps were conducted in 11 counties, where over 100 enforcement actions were issued for, among other things: failure to carry Worker’s Compensation insurance; under-reporting the number of workers to obtain cheaper insurance premiums; and cash payments to avoid payroll withholding taxes.

A: The State of CA has a procedure in place should your qualifying individual (in this case “Bob”) leave or be unable to continue as your Qualifier for any reason. The Contractors Board will give a company 90 days to replace this individual, during which time the license remains in good standing as if the Qualifier were still there. Q: We are bidding a public works project for new construction. The question came up: Can an “A” License contractor install exterior fire service items or does it require a “C-16” license? What research I found, I don’t see where the “C-16” license is necessary because I hold an “A” general license, but I want to make sure I’m covered. A: Your covered! General Engineering (“A”) contractors can self-perform the installation of exterior fire service items like water mains, fire hydrants, and other related fixed works requiring specialized engineering knowledge and skill. WARNING! It’s the time of year when temperatures can rise to over 100 degrees. The summer sun is more direct and radiant heat from the sun and ground (concrete, asphalt, etc.) can take its toll on construction workers. MOST IMPORTANTLY, know the symptoms of heat stress, heat exhaustion and heat stroke.

“Participants in the state’s underground economy are harmful to everyone,” said CSLB Registrar Steve Sands. “Anyone who neglects their responsibility to comply with state contracting, insurance, and payroll requirements drives up premiums. At the same time, legitimate licensed contractors struggle because illegal operators underbid them.” According to Insurance Commissioner Dave Jones, “Operation Underground is a result of the partnership under the Joint Enforcement Strike Force to aggressively combat the underground economy”. Jones stated, “Legitimate businesses that play by the rules are often forced to close their doors because illegal businesses are cheating the system.” While knowledge is power, knowing where to go for the answers is half the battle. California lawmakers may have given their OK to what would be the nation’s first high-speed rail line, but the project is still a long way from leaving the station (if it ever does in the first place). Among the challenges project supporters must overcome are environmental concerns, clashes with local leaders over land use, a $68 billion price tag with no funding guarantees and an increasingly disenchanted public.

I provide this to you as a “Take Heed!” Far and away the number one citation filed against businesses was for not having an Injury and Illness Protection Plan [IIPP]. It should be noted that the fine can reach up to $5000 for being cited for this violation. The next largest number of citations were written for the lack of content in the IIPP. Go to Cal OSHA’s website: http://www.dir. ca.gov/DOSH/etools/09-031/index.htm ARB Off-Road Regulation: Two engine vehicles and labeling updates - Revised Many diesel on-road vehicles with twoengines are subject to the Off-Road Regulation and must be reported to the Air Resources Board (ARB), and all vehicles subject to the regulation must be labeled on both sides by January 1, 2013. Amendments to the Off-Road Regulation approved in 2010 make both engines of many on-road two-engine vehicles subject to the regulation. The following two-engine vehicles and their engines are subject to the Off-Road Regulation and should already have been reported to ARB. If not yet reported, they must be reported immediately or face enforcement action: • Not already subject to the Fleet Rule for Public Agencies and Utilities; • Not a two-engine on-road sweeper; • Have a gross vehicular weight > 14,000 pounds; and • Have an auxiliary engine

≥ 50 brake horsepower that is permanently attached and integrated into the design of the vehicle. All two-engine cranes and water well drilling rigs continue to be subject to the regulation. Effective January 1, 2013, all vehicles subject to the Off-Road Regulation will be required to have both sides labeled with their Equipment Identification Number (EIN). All vehicles newly reported to ARB must now be labeled on both sides within 30 days of receiving the EIN and all previously reported vehicles must be labeled on both sides by January 1, 2013. Also effective January 1, 2013, Captive Attainment Area Fleets are required to label their vehicles with EINs that have white lettering with a green background (rather than white on red). All Captive Attainment Area Fleets newly reported to ARB must now be labeled on both sides within 30 days of receiving the EIN, and all previously reported vehicles must be labeled on both sides by January 1, 2013. Captive attainment area fleets are treated as small fleets even if their total horsepower (hp) exceeds the small fleet threshold of 2,500 hp. The regulation for In-Use Off-Road Diesel Vehicles first became effective under California law on June 15, 2008. This regulation is intended to reduce harmful emissions from diesel powered construction and mining vehicles operating in California and having propulsion engines that are 25 hp or greater. Fleets were required to initially report their off-road diesel vehicles to ARB in 2009 via the Diesel Off-road On-line Reporting System (DOORS). In addition, fleet owners are currently subject to restrictions on unnecessary idling, and will be subject to accelerated replacement/ repower requirements beginning January 1, 2014, If you have any questions regarding offroad reporting, please contact the DOORS hotline at (877) 59-DOORS (877-593-6677) or by email at doors@arb.ca.gov. Safety Matters California Builders Insurance Program: Your construction workplace safety partner

Manual Material Handling For construction workers and contractors, repetitive motions, poor lifting and unsafe handling injuries are some of the most common. Coincidently, they are also usually preventable by practicing safe lifting techniques. Use these helpful ergonomic guidelines to lift any size load without causing injury to yourself or others. Pre-Lifting Techniques Determine whether or not you will need assistance to do the job. Consider the size or shape of the load – bulky or odd-shaped building materials could create additional challenges. Determine if you will have to turn or change direction while carrying the load. Find out if the route you will take with the load is clear of obstructions and slip, trip or fall hazards. Make sure your route is not dangerously close to vehicular traffic, especially if it is traveling at high speeds. Make sure you have a back support belt and are wearing it properly. Determine what kind of personal protective equipment (PPE) you will need to protect your hands and prevent slippage during lifting. Lifting Techniques Get as close as possible to the load and keep it close to your body. Always bend from the knees and not the back, and lift using your legs. Be aware of your balance. Stand on a stable, even surface, and wear proper foot protection to prevent slips and other injuries. Bring the load down to waist level if lifting from above, and wear a hard

hat to prevent head injuries from dropped materials. No matter what you are carrying, always avoid reaching and lifting at the same time. Carrying Techniques Look ahead instead of down to make sure your path is clear. Watch out for terrain changes, and avoid carrying up stairs if possible. Have someone else open doors, gates or other closed entries for you. Keep shoulders, hips and feet aligned – do not twist at the waist or change direction by moving your hips. Set the load down on a firm surface if it becomes too heavy or unstable. Watch for pinch or shear points on carts, dollies and hoists. When you are finished transporting the load, set down the corner or edge of the object closest to you first, keeping your fingers out from underneath.
