Marin Builders Association Scholarship Application ELIGIBILITY High school seniors pursuing a college, university or trade school education are eligible to apply for a scholarship award. While we emphasize the need for trained professionals in the construction industry, scholarship applicants may choose an advanced course of education in any field. A grade point average of 3.0 or better is required. Applicants who do not meet the above eligibility due to extraordinary circumstances may submit an appeal including supporting documentation along with the application. APPLICATIONS Applications, including the necessary records, must be received by the Association on or before the close of business on Friday, April 6, 2012. Incomplete applications and applications received after that date will not be accepted. To be assured of mail delivery, applications should be sent by certified mail. Applications may also be hand-delivered to the Marin Builders Association, 660 Las Gallinas Avenue, San Rafael, CA 94903. Records Needed – Records required with the scholarship application include: Certified transcript of high school grades Certified SAT or other school entrance exam test scores College, University or Trade School Admission – Scholarship applicants must be eligible to begin scholastic work in the year that scholarships are awarded. Three Letters of Recommendation – Contact those who know you and have worked with you (such as coaches, educators, employers, ministers/priests/rabbis) for a letter of recommendation to include with the application. Applicant Statement – On a separate sheet of paper provide a brief personal statement (about 200 words) why you should be considered for a scholarship award. Be sure your name, address and phone number are Included on the statement and submitted with your application. Interviews – Personal interviews are required as part of the application process. All interviews will be held at the Marin Builders Association. Selected applicants will be notified by mail and scheduled for a personal interview. Non-Discrimination – Applicants will be considered for scholarship awards without regard to race, creed, color, national origin or sex.

SELECTION COMMITTEE No member, member representative or employee of the Marin Builders Association is permitted to participate in any phase of the scholarship selection process except in an administrative or clerical capacity. The Selection Committee at this time is comprised of a member of the public, a representative of the Marin County Office of Education and a representative of the Marin Independent Journal. The interviews are conducted by this Committee and their award decisions are final. SCHOLARSHIP AWARD WINNERS Scholarship award applicants will be advised of the Selection Committee’s decisions. Scholarship winners and a guest will be invited to attend the Scholarship Awards Event to receive their awards. Scholarship winners will be required to submit a pledge, counter-signed by his or her parents or guardians, that the award will be promptly repaid if the promised scholastic course is not taken, if the course is not completed or, if appropriate, if enrollment is not undertaken in the award year. Exceptions to this will be granted if there is a medical situation which prevents this requirement being fulfilled or if there is military service involved.

Payment/Performance Bonds For P3’s? BY Phil Vermeulen Governmental Relations

With one week to go until the deadline for new bill introductions (which is Friday, February 24th), I expect the volume to increase significantly over the next few days. Indeed, if history is my guide, I expect the number of new bills to reach somewhere between 2,700-3,000! Stay tuned as we learn what new laws will be proposed to save ourselves from each other! One potential bill that has been sent to me (seeking our support), but that has not been officially introduced yet, deals with Public- Private Partnerships. In growing numbers, public agencies are turning to Public - Private Partnership construction projects (PPP’s, or P3’s) to obtain needed public construction for such projects as roads and schools. In one typical P3, the public entity leases public land to a private developer who finances and constructs a facility serving a public need. The developer then leases back the completed project to the public entity for rent, which pays for the cost of construction and profit for the developer. These projects can make public construction possible, especially in times of bare public coffers, however, they carry risks that need to be fixed legislatively. First, unlike traditional public projects, these projects have unspecified protections for the public entities to ensure that the project will be completed if the developer backs out or fails to pay. Second, unlike traditional public projects, these projects have no protections to ensure contractors will be paid for their work. The proposed remedy is to require Payment and Performance Bonds on such projects. As the sponsors state: “These projects are not covered by either the federal Miller Act, state/local “little Miller” Acts or even state lien laws This means that, since no public money goes into these projects, P3’s are not required to obtain Payment and Performance Bonds from the developers. The provisions authorizing P3’s by local public entities are found at California Government Code sections 5956-5956.10. These sections vaguely require “(2) Security for the construction of the facility to ensure its completion, and contractual provisions that are necessary to protect the revenue streams of the project.” To provide clarity needed to protect the public, such security should

be specified to be performance bonds for the anticipated cost of the construction. Further, these sections provide no protections to guaranty that the persons performing the construction are paid for their work. Typical payment bonds would provide the needed protections. Absent performance bonds, if the private developer fails or otherwise refuses to pay to complete construction, the P3 must itself fund any shortfall in needed construction funds. Absent payment bonds, if the private developer runs out of money or goes out of business and fails to pay contractors for their work, the contractors have no remedy. In P3’s, payments come from the private developer, which is often a company from a foreign country. When the developer goes out of business there is no one to pay contractors, subcontractors and suppliers. The land is owned by the public and thus cannot have a lien placed on it, and there is no public fund that could be attached with a stop payment notice. So too, the general contractor may be paid and then go out of business. Again, this leaves the subcontractors without payment. California needs to require that private developers in P3’s post performance bonds to ensure that construction projects are completed. California further needs to require that BOTH the private developer and the general contractor provide payment bonds to ensure that California’s contractors are paid for their work on P3’s. Public Agencies should actually support this concept, keeping the public’s interest and money in mind! They don’t want to have halffinished projects on their land, and they don’t want to have to pay for projects that they have no budget to complete. ################################################### So, should we come on as a co-sponsor on this measure? I certainly think this bill is good public policy, both for the public agencies and for all contractors. Expect our association’s name and logo to be listed shortly. As usual, I will keep you posted on this measure as it winds its way through the legislative process. So too, I will be reporting on all of those other soon to be introduced measures that are “trying to save mankind!” Stay tuned!

Kalb's Q&A for Contractors

You have to walk before you can run, as some younger aspiring contractors must learn. Apprentice is only the first step towards a license. Winning contracts in the market is always hard work, but on those bids involving government or special districts there are additional challenges. For our first contractor there is little room to maneuver between a ‘rock and a hard place’…

Q: I contacted your office today to discuss whether or not the Home Improvement Salesperson (HIS) certification is applicable for our service and repair technicians. On the bottom of the HIS application, it states “a bona fide service repairperson who is in the employ of a licensed contractor and whose repair or services call is limited to the service or repair initially requested by the buyer is NOT required to be registered.” My concern is what happens if our technicians go to a customer’s house and sell something beyond the initial requested service call. We certainly are not going to pass up an opportunity if there is a legitimate need. Is this something you recommend we pursue? Is it a big deal and cost? Your thoughts?

A: I would contend that a license is necessary since a portion of the work is on county land. If the ENTIRE project were on federal property a contractor’s license would not be required. This being said, in either case it will be up to the awarding authority whether they want to see a license number on the contract. Being they are not the low bidder, this may be a moot point.

A: This situation puts you in the ‘middle’. On the one hand only doing the repair means no salesperson registration is required; however, since sales are part of your goal, I believe this would trigger the need for HIS registration. Look no further than the CSLB quote: “…whose repair or services call is limited to the service or repair initially requested by the buyer”. I would recommend having all your service/sales folks register. The HIS application is only 1 page, no testing is needed and the fee is just $75.00. Live Scan fingerprinting will be necessary at an additional cost of approximately $70.00. I hope this helps. Contact Capitol Services with any further questions. Q: If you were an apprentice for a licensed contractor for a number of years can you file to get a contractor’s license?

Q: I have an “A” contractor’s license; however the second lowest bidder does not. This is a Federal project and they’re contending that a license is not needed. Since some of the project is on county property wouldn’t the license be required?

Q: I have a CA contractor’s license and have been asked to do a small job in NV. Do I need a license there or can I simply use my existing CA number? What are the costs? A: Unfortunately, you may not use your CA license. A NV contractor’s license is required for projects over $1000 (including material and labor). As we discussed, since this is the only job you anticipate doing in this state, it may not be worth your while. Total fees for the license application, corporate registration, bond, fingerprinting and testing will likely exceed $2,000. Please note this minor work exemption does not apply to plumbing or electrical jobs or any project that requires you to pull a permit.
