As I have reported many times in the past, the best way to fight the myriad employer-impacted “bad bills” that move through the Legislature each year is to form coalitions. Thankfully this strategy works more often than not, particularly during these times when the Democrats, who tend to introduce these “turkeys,” have a super majority. Following is a draft copy of the letter that was sent to the governor the other day urging his veto of a very dangerous safetyrelated bill that undermines the due process for employers who have been cited by Cal OSHA for workplace safety violations. Keep your fingers crossed that the governor realizes that virtually the entire employer community has banded together on this dangerous measure in urging his veto. I will report on the outcome in my forthcoming Year End Legislative Report. The final version that was sent to the governor contains the logos of all of the coalition members. September 23, 2013 The Honorable Edmund G. Brown, Jr. Governor, State of California State Capitol Sacramento, CA 95814 SUBJECT: AB 1165 (SKINNER) – OCCUPATIONAL SAFETY AND HEALTH – VIOLATIONS REQUEST FOR VETO Dear Governor Brown: The California Chamber of Commerce and the below named organizations respectfully REQUESTS your VETO of AB 1165 (Skinner), which proposes a costly bifurcated appeal process that presumes guilt for employers, undermines due process with regards to citations for workplace safety violations and is unnecessary in light of a new regulation adopted through a collaborative process for an expedited appeals process. Current law provides for a stay of abatement for issues on appeal regarding citations for workplace safety violations. AB 1165 requires employers to abate safety hazards for which they have been cited prior to due process of an appeal. In other words, while the employer exercises its right to contest the existence of a violative condition, the Division of Occupational Safety and Health (Division) under AB 1165 could order

the employer to fix the alleged violative condition before the Occupational Safety and Health Appeals Board (Appeals Board) has determined whether that alleged violative condition even exists. Ignores Collaborative Process. In response to concerns about serious hazards to which employees could be exposed while a citation is on appeal, the Appeals Board adopted an expedited appeal process (mentioned above) where hazard abatement has not occurred and is at issue (California Code of Regulations, title 8, section 373), effective July 1, 2013. This new process was adopted based on a successful pilot project and extensive stakeholder input over the course of several years to address the challenge of workers exposed to hazards while a citation is on appeal. It is a carefully and thoughtfully balanced solution crafted to catch and reverse bad behavior by employers gaming the system and exposing workers to risk, without undermining employers’ right to a fair adjudication process. According to the Appeals Board statement of reasons for the creation of the expedited appeal process: These proposed changes to section 373 establish a uniform, expedited procedure for cases wherein the employer has not abated the alleged violation, and the alleged violation is classified as serious, willful, repeat, or any combination thereof. These changes increase worker safety

by creating a more rapid hearing process in particular cases. Moreover, the changes remove gamesmanship or outcomes based on technicalities rather than the merits of the alleged violation. These rules remove some limitations on the flexibility and authority of the administrative law judge to control the proceedings in a manner best suited to the unique needs of each case. The labor code provides an employer the opportunity to challenge any citation and the automatic stay protects employers from the expense of implementing changes to its operations that ultimately are not required if the citation is successfully appealed. Most employers voluntarily abate as ordered in the citation because doing so allows for an abatement credit of a 50% reduction in the proposed penalty. The Appeals Board concluded that a shortened procedure for addressing requests by employers for a stay of abatement without addressing the merits of the underlying citation would not be an effective alternative. Yet contrary to the Appeals Board’s conclusion, the procedure proposed by AB 1165 would specifically require two hearings or two determinations (the bill is unclear as to the process it proposes) increasing resources devoted to complete two determinations. The expedited process not only hastens cases where abatement is truly at issue, but it also tends to encourage employers to abate hazards to avoid the shorter appeals process. In other words, when faced with the alternatives of either abatement

The bill creates a potential conflict of interest because the citing authority is also the authority to rule on whether to uphold or reverse their own order to abate. We question the jurisdictional appropriateness of the Division ruling on requests to stay abatement orders it has issued. The Appeals Board has the statutory authority to adjudicate citations issued by the Division and appealed by an employer, following the wisdom of separation of powers and in accordance with due process. We assert that vesting the power to determine a stay of abatement should not be within the authority of the Division when an appeal is pending with the Appeals Board. The amendment of September 3, 2013 restores a provision from a previous version of the bill that further adds to the potential conflict of interest and compromises the integrity of the citation process within the division. The restored provision would require the division to stay an abatement order if the division determines that “there is a substantial likelihood of success by the employer on the contested matters.” We would question why the citation was issued if the employer is expected to successfully contest the citation. Given that the citation is on appeal, the appropriate entity to determine whether abatement should be stayed is the entity that would determine the appeal, rather than the entity that issued the citation. Undermines Due Process. In many instances the merits of ordering a stay of abatement rest on whether a violation even occurred. Without a hearing on the appeal of the citation’s validity, an employer could be essentially ordered without due process to abate a hazard where no violative condition exists as borne out on the full appeal of the citation. The bill does not provide for an appeal of the division’s Denial of a request to stay abatement nor does it require a stay of abatement while a request to stay is pending. This creates an abatement order by default with the employer essentially found guilty without due process once a citation is issued. The employer has no safe harbor or recourse.

The expedited appeals process adopted by the Appeals Board, effective July 1, 2013 requires an employer to enter into the expedited process if abatement has not occurred, and the alleged violation is classified as serious, willful, repeat, or any combination thereof. In contrast, AB 1165 merely allows an employer to request an expedited process, in conflict with existing and newly adopted regulations. It is unclear how the process in AB 1165 would be integrated with the expedited appeals process. It appears that the expedited process would be moot and not available to the Appeals Board or the employer. Confusing Requirements. The bill reverses the right of an employer to stay abatement while an appeal of the citation is pending. It requires an employer to specifically request a stay of abatement when issued a serious, willful, repeat, or failure to abate citation. Other than bifurcating the abatement from the underlying citation, it is unclear specifically what the bill is proposing to do procedurally: Would Cal/ OSHA administratively rule on a request for a stay of abatement? Would there be a hearing, and if so, who would conduct the hearing? If not, how would an employer be assured of a fair and complete consideration of its request? How would the abatement stay request be considered without regard to the merit of the alleged underlying violation? If the underlying violation is considered, is this within the authority and jurisdiction of the Division? Cost. The bill sets up a new administrative process / hearing process (the bill does not clarify which). In either case, a new process requires staffing, setting up processes and procedures, and regulations must be developed and adopted. The Senate Appropriations committee has anticipated the cost to exceed $1,000,000. For these and other reasons, the California Chamber of Commerce and the below named organizations requests your VETO of AB 1165 (Skinner) when it comes before you.

Back Safety - Think Before You Lift Before you lift something, ask yourself these questions: How heavy is the load? Will it be awkward to control? Should I ask for help? Can it be moved mechanically with available equipment? Is it in an accessible position? Does it have sharp edges? Will it be slippery? Do I need gloves or other protection? Is the new location accessible and ready to accept the item? Is my pathway clear? Will I be able to see where I am going? Is there a safe way to grip the load?

Get a Better Grip!

Lift correctly: Your footing is a very important part of lifting. Your feet should be: Close to the object. Shoulder-width apart for good balance. Kept with one foot slightly ahead of the other to help keep your center of gravity under control. Bend your knees and go down to a crouch - not to a full squat. It takes double the effort to stand up from a full squat as it does from a crouch. Keep your back as straight and vertical as possible. Get a good, firm grip. Do not lift until your hold is strong and slip-proof. Lift up by straightening your legs. Keep the load close to your body. If you have to change direction, don't twist your body; move your feet as you turn. When setting the load down: Keep your back straight. Bend your knees just as you did when you lifted the object. Be extra careful if you have not lifted recently: Muscles can weaken and tighten while you are away on weekends, vacations, or sickdays, so use extra caution on your first day back. Your physical condition and muscle stretching and toning are important before lifting begins each day. Be smart: If your load can be moved mechanically or if you can simply ask someone to help you, take that advantage and don’t risk injuring your back. It’s not worth it!
