6. LEGAL ASPECTS There are no legal obstacles in Canada to the organization of the Olympic Winter Games and Winter Paralympic Games and no new laws are required. Canada has already successfully hosted the Games of the XXI Olympiad in Montreal in 1976 and the XV Olympic Winter Games in Calgary in 1988. E X I S T I N G A N D P RO P O S E D L AWS I N R E L AT I O N TO S P O RT The Fitness and Amateur Sport Act, passed in 1961, provided the basis for federal funding of sport and recreation in Canada, and has served as a catalyst to encourage, promote and develop fitness and amateur sport throughout the county. On April 10, 2002, the Government of Canada tabled a Bill on Physical Activity and Sport. The objects of the proposed legislation are to encourage, promote and develop physical activity and sport. Furthermore, it establishes an alternative sport dispute resolution centre and entrenches in law the Government of Canada’s policy regarding physical activity and sport. The Bill is consistent with the new Canadian Sport Policy which has the sport goals of enhanced participation, excellence and capacity building. The proposed legislation would replace the existing Fitness and Amateur Sport Act.

The Policy is not set in law or legislation, nor does it criminalize doping infractions involving the use of a banned or restricted substance. Canadian legislation (not sport related) exists that supports the Policy by committing to law matters of importation, manufacturing and distribution of many of the substances on the IOC Banned List. I S O 9 0 02 C E RT I F I C AT I O N The Federal, Provincial and Territorial Governments have together adopted a Canadian Strategy for Ethical Conduct in Sport, including a comprehensive policy framework for drug-free sport and a rigorous domestic doping control program. This program has been certified under the ISO 9002 Publicly Auditable Specification 18873:1949 and conforms to the Framework and Requirements of the International Standard for Doping Control. CANADIAN POLICY ON DOPING Doping in Canada is regulated by the Canadian Policy on Doping in Sport, (the Policy), adopted by sport governing bodies in January 2000. It is important to note that this Policy explicitly recognizes that those subject to it may be subject to other anti-doping rules and policies (such as those of the IOC and international federations). The Policy in no way excludes the application of the other relevant anti-doping rules and policies. The Canadian Centre for Ethics in Sport (CCES) is a national, non-profit organization committed to a fair and ethical sport system. The CCES manages Canada’s doping control program, including the appeal, arbitration and reinstatement systems that are in place to protect athletes’ rights. Canada’s sport stakeholders collectively adopt and incorporate the Policy into their respective internal by-laws. The COC requires any person wishing to participate in the Olympic Movement either as athlete, coach or sport-governing

Canada, through the Secretary of State (Amateur Sport), is a member of the WADA Board and represents the Americas on the WADA Executive Committee. As well, Canadian experts are members of WADA Working Committees (Legal, Finance & Administration, Ethics & Education, Health, Medical and Research,) In August 2001, the WADA Foundation Board voted to locate the WADA permanent headquarters in Montreal, Canada. The official opening of the Montreal WADA headquarters and the inaugural Executive/Board meetings in Canada will take place in June 2002. Canada is leading the development of an international instrument on anti-doping in sport and actively participating in the development of a WADA Code. The instrument, and the Code are expected to be tabled in February 2003 and implemented for the 2004 Olympic Games.
