Scotland experienced a long winter and a hot, dry summer in 2018 which took its toll on the grouse and deer population and also affected the salmon fishing season. There were however some record catches reported at the end of season. For those purely enjoying Scotland as a family holiday destination, the fine weather helped create some magic memories and some breathtaking photographs.

Each year brings a new excitement and the urge to explore and discover a new part of Scotland. Knock House has approximately 40,000 acres of some of the finest stalking grounds in Argyll. Two stalking parties can be accommodated on the hill each day from mid-August onwards. The Benefits of Ownership For many, owning a Scottish estate is the ultimate aspiration and this market is increasingly driven by the European buyer.

Estates can be hugely complex businesses with diverse revenue streams. However, many more are lifestyle businesses for which rental or sporting income is largely incidental. Getting the appropriate tax structure is important. While it is customary for UKowned estates to be taxed under income tax, many foreign buyers prefer corporate structures, which may better suit their wider tax planning within family-owned business groups.

However, the government has sought to disincentivise residential property held in corporate structures. From 2013, the Annual Tax on Enveloped Dwellings (ATED) placed flat-rate levies on properties held by ‘non-natural persons’ based on bands of property valuation. Importantly this value is for the house and

immediate curtilages, not the value of the wider estate land holding. There are also exemptions, including houses let on a commercial basis and farmhouses occupied by agricultural workers. The lowest banding is for house values between £500k and £1m, which currently results in the minimum flat rate charge of £3,600 per annum.

Corporate structures can cause a number of other complications. There is the enhanced requirement for disclosures and statutory filings. There are also issues where the directors of a company are receiving benefits from company assets. Her Majesty’s Revenue and Customs (HMRC) treats this as a form of payment and taxes this as a Benefit In Kind (BIK). Often family members are appointed as company directors; however, if a director enjoys the benefits of that house then there is likely to be an accommodation benefit charge, which can either be based on actual usage or when available for use. This would extend to include charges for

provision of furniture as well as payments of utilities, and council tax. Another consideration is sporting benefits, which can carry a high value and is often a key driver for owning such a property.

Cars are an area in which accountants typically have to disappoint their clients. The customary Range Rover is the perfect accompaniment to a Highland sporting state but this is not an opinion shared by HMRC. The BIK for the private use of company owned cars is based on CO2 g/km emissions, so there is no tax advantage to putting such gas-guzzlers through the business. There is a more favourable flat-rate charge for vans and most twin cab pick-ups can fall within this definition. With the modern trend for high-spec pick-ups, this may be a low tax alternative.

While this may seem like an argument against incorporation, many of the same issues exist where the property is held individually or in a partnership, where profits would be assessed under income tax. While the tax treatment is less prescriptive, there is still a requirement to adjust for personal use under ‘a just and reasonable basis’.

Another lifestyle consideration with a tax implication is whether you require someone to look after the house when you are not in residence. Pragmatically, this often requires staff accommodation to be provided on the estate. Specific advice is required to ensure such accommodation is not taxed as a BIK received by the staff member.

Taxation of employees aside, ultimately many of the above issues can be avoided should the estate be run purely as a private residence. However, where this is not the case, you require specialist advice to ensure tax efficiency is maximised and that you are not unwittingly avoiding charges on taxable benefits.

Novar Estate, By Evanton, Easter Ross The River Alness is one of the most picturesque salmon rivers in the Highlands, running for just 11 miles from Loch Morie into the Cromarty Firth with varied scenery throughout its length. The Novar Fishings offer six rotating beats; the average length of each being about a mile, with typically fifteen to twenty named pools. There is a small run of spring salmon in May and June and good runs of salmon and grilse from July to the end of October. Annual river catches are typically in the range of 300-600 salmon and grilse, of which about two thirds are caught on the Novar waters. This is a hunter’s river, long casting is rarely needed and ‘rivercraft’ and persistence are generally rewarded. Great for beginners with typically 10-20 ‘first salmon’ caught each year.
