QUESTION: I’m renting my home to tenants whose lease doesn’t expire until next spring. With the housing market turning around, I think I can get a good price if I were to sell now. But how do I get the tenants out?
ANSWER: You don’t, unless they agree to leave. When you rent your home to tenants, you allow them to occupy it as long as they follow the rules set out in the lease agreement, such as paying rent and not destroying your property. Some people in your position have used uneth-
ical tactics to try to force the tenants to leave, such as changing the locks or turning off the utilities. But these tactics have stiff consequences, and if you try this, you will end up with the tenants still in the house with a pile of your money. Or they will be out of the house with even more of your money.
I have seen landlords “buy” the tenants out of the lease by negotiating a lump sum payment. You may want to try to offer your tenants several months’ rent to leave and see if they agree. Another option for you is to leave them in place and still try to sell the home. A property with

A common problem for owners of multi-story homes is uneven heating and cooling among the floors. Reasons for temperature variances among floors can include restricted air flow from the furnace to the registers, inadequate or improperly sized and sealed ductwork or a heating-andcooling system that’s not sufficient for the size of the home. Homeowners don’t need to sweat it out, though. Solutions can range from making adjustments that are negligible in cost to investing a few thousand dollars in equipment to better balance your home’s temperature. Heating-and-cooling professionals recommend owners of multi-story homes switch their thermostat fan to the “on” position. “What that does is continuously mix all the air in the house,” Mejean said. “It helps keep the upstairs and downstairs a little bit more of an even temperature. The other thing you would do is, for example in the summer months, you would damper down the downstairs registers. You don’t want to turn
them off, just damper them down halfway or so. If you shut them all the way, you’ll restrict the airflow, which can cause other problems. Then, make sure the upstairs registers are wide open.” Zoning systems allow a homeowner to control the temperature independently from a thermostat placed on each floor. Most zoning systems range in price from $2,500 to $3,500. Improperly sized and leaky ducts are often the culprits. Ultimately, homeowners with temperature variance issues should consult a reputable heating-and-cooling contractor to diagnose the issue.

Mortgage rates have plunged to record lows, below 4 percent. That’s great — but only if you can actually qualify for a loan, and that’s not easy. After giving away the store during the housing boom with disastrous re-
sults, lenders have tightened their underwriting standards, leaving many would-be home buyers out of luck. But there are steps homebuyers can take to find the right mortgage, and qualify for it. Improve your credit score: A credit score below 620, as measured by
the Minneapolis company FICO, will knock most potential buyers out of the running for a mortgage. And even if you can qualify for a loan, lenders reserve their best interest rates for borrowers with the highest credit scores — typically 740 and above. If a bad credit score pushes up your in-
terest rate by even one percentage point, you could end up paying $85,000 more over the life of a $400,000 loan, according to Tracy Becker, president of North Shore Advisory, a credit repair company in New York state. To see where you stand, start by checking

Home Builders Lead Broad Coalition at Homeownership Rally To highlight homeownership’s vital importance to families and to the economy, more than 600 Floridians participated in a Rally for Homeownership last week in downtown Tampa. Speakers at the rally included Tampa Mayor Bob Buckhorn; State Representatives Dana Young and Janet Cruz; Chairman of the Hillsborough County Board of Commissioners Ken Hagan; and Sylvia Alvarez, executive director of the Housing and Education Alliance. “Today, we are demanding that policymakers in Washington ﬁx housing in America,” said County Commissioner Hagan. “Don’t even think about doing away with the mortgage interest deduction. your credit report, which is available free at annualcreditreport.com, preferably at least six months before you’re ready to shop for a home. You can get a free report once every 12 months from each of the three credit reporting companies — Experian, TransUnion and Equifax. Make sure there are no mistakes on the report — for example, if you see incorrect reports of outstanding balances or late payments, you should dispute them with the credit reporting company. If your credit profile is ugly, there are ways to beautify it, though it may take some time. One key step is to make sure to pay your bills on time. Set up email or text reminders from the credit card company to let you know when a payment is due. Pay down your debt as much as you can. Don’t close unused credit cards, but don’t open new cards, either. Decide which type of loan is best for you: Fixed mortgages offer the security of knowing your rate will never rise; since rates are near or at record lows, there’s a pretty good argument to be made for locking them in now. On the other hand, an adjustable-rate mortgage offers even lower rates and might work if you expect to move within a few years. A 30-year loan will keep monthly payments lower, but if you can swing it, a 15-year will have a lower interest rate and will save you tens of thousands of dollars over the life of the mortgage. For example, a $300,000 loan at 3.7 percent for 30 years adds up to about $497,000. Choose a 15year loan at 3 percent instead, and you’ll save more than $120,000. Shop around: Check with several lenders, not just the one recommend-
ed by your real estate agent. Compare interest rates and closing costs like fees for the application, appraisals and so on. These costs generally run around 2 percent of the loan amount, according to Gumbinger. Michael Moskowitz, president of Equity Now, a mortgage lender, encourages home buyers to ask mortgage companies for the names of previous customers and check on their experience. “You need to make sure you’re dealing with someone reputable,” he said. Get a preapproval: Lenders will give prequalification letters — informal estimates of how much house you can afford. But you should go further and get a preapproval letter, which is a tentative commitment from a lender. To get one, you’ll have to show the lender documentation of your income, assets and debts. Though a preapproval is not binding on either the lender or the home buyer, it’s a way of showing sellers and real estate agents that you’re a serious buyer. Be prepared to show lots of paperwork: Fannie Mae and Freddie Mac, the government entities that guarantee loans, are forcing lenders to demand much more documentation these days, including pay stubs, tax returns and bank statements. And they will ask for fresh documents, like pay stubs, just before the closing, to make sure nothing has changed. Because of these tighter documentation standards, Gratalo recommends that you start saving pay stubs, bank statements, canceled rent checks and other paperwork several months before you even start shopping for a house or a mortgage.

Homebuyers trying to decide between new and used haven’t had many choices in the past few years. “Most of the new-home builders have been fishing and hunting because they couldn’t sell homes,” said Jack McCabe, a housing analyst in Deerfield Beach. But the improved housing market means buyers have options again. A national index measuring builder sentiment rose in June to its highest level since May 2007. New homes have the obvious advantages: They come with builder warranties and allow buyers to select colors and floor plans. In some cases, the homes are easier to insure. But an existing property may offer more space for the money and a more convenient location.

Generally, private property insurers are more willing to cover newer homes — those built in 2005 or later — said Rick Bogani, an insurance agent in Royal Palm Beach. “The new construction, with the updated building codes and impact glass, is better, and that’s what the insurers are targeting,” Bogani said. “The carriers are competing for the new homes, and that’s why you get better prices for insurance.”
The case for existing homes To survive the housing crash, builders reduced the size of homes and cut down on amenities to make the properties less expensive in hopes of attracting buyers considering foreclosures and short sales. While custom builders are seeing increased demand for larger luxury homes, the majority of builders are sticking with more modest-size properties, McCabe said. So people who buy new may pay 10 percent to 20 percent more for comparable square footage.
In some cities, available land is in the suburbs, which means buyers choosing new construction face longer commutes to work. Some buyers prefer the charm of older homes in established neighborhoods rather than the sterile newness of cookiecutter developments, real estate agents say. In addition, building a home takes several months or longer — not ideal for somebody who wants or needs to move right away. Steve Braverman and his wife, Jen, are moving to South Florida from Chicago.
They decided against buying new and now are looking at homes in the Woodfield Country Club in Boca Raton. Constantly having to monitor the progress of construction and coordinating other details of a new home is too much of a hassle, said Steve Braverman, 43, who owns a telecommunications company. “There’s always something that goes wrong,” he said. “I think moving into an existing home that has the ‘guts’ you like is better than buying new. It doesn’t take as long as starting from scratch.”

THE TENANT AND THE ELECTRIC BILL by Harry Anthony Heist, Attorney at Law
In most annual rentals, the tenant is responsible for paying the electric bill. In addition to being responsible for paying the bill, the tenant is often given instructions by the landlord and agrees in the lease agreement to place the electric bill into their name upon move-in. This requires the tenant to make a call into the electric company and/ or go to the electric company ofﬁce to give the relevant information and pay a utility deposit, which varies by company providing the electric. In a perfect world, the tenant does just that. Prior to move-in they get the electric placed into their name and pay the bill. What happens when they do not pay the bill? In many places, the electricity is simply shut off and the tenant is without electricity. This is the tenant’s problem, and no liability to the landlord occurs. The tenant may then pay the bill and have it reconnected, steal the electricity from an adjoining tenant, put jumper wires on the electric meter or completely live without electricity. In some areas of Florida and in many apartment communities, the electric will revert back into to the name of the apartment community, and the apartment community will later be notiﬁed that this has occurred, sometimes weeks later. This is to prevent a unit from being without electricity. While we cannot control what the tenant is “supposed” to do, we can take action, but must be careful that we do not fun afoul of the law.
The case for new homes
Florida Law and Electric Florida law speciﬁcally states that a landlord shall not directly or indirectly cause interruption in the tenant’s electric service. FS 83.67 Prohibited practices. (1) No landlord of any dwelling unit governed by this part shall cause, directly or indirectly, the termination or interruption of any utility service furnished the tenant, including, but not limited to, water, heat, light, electricity, gas, elevator, garbage collection, or refrigeration, whether or not the utility service is under the control of, or payment is made by, the landlord. Direct Interruption

So a friend suggested they consider new construction, and they ended up buying a five-bedroom home in the Monterra development in Cooper City. “I thought it would be so much easier to move into somebody else’s house,” said Rebecca Bratter, 34, an attorney with two children. “But we found out that designing a house to our taste was very appealing.” Builders often have their own financing divisions, so getting a mort-
Finally, buyers of new homes will have a significant resale advantage in five or 10 years, said Ken H. Johnson, an economist and finance professor at Florida International University in Miami. Because of the lack of construction recently, the new homes bought today will be competing against an older stock when it comes time to sell, Johnson said. “I can’t tell you you’ll get the price you want when you do sell down the road, but I’m deadly sure your home will sell faster,” Johnson said.
Direct interruption would be when the landlord shuts the electric off by actually disconnecting it from the rental unit (this is rarely done but happens!), or more commonly instructs the electric company to shut the electric off. A landlord who discovers that the tenant has not placed the electric in the tenant’s name could easily feel that it is correct to tell the electric company that the electricity is not to be in the name of the landlord, but rather that it must be in the name of the tenant. However, this can lead to a direct shut off. Further, the landlord may have had the electric bill revert back into the landlord’s name, as is often the case in apartment communities; notifying the electric company that this is not proper and that it should be in the tenant’s name will result in a direct shut off to the tenant. In the single family home setting, sometimes the property owner who lives out of state receives an electric bill, is furious and calls the electric company for a shut off. Does it seem fair to the landlord who now is stuck paying the bill? No, but we never said the law was always fair.
Indirect Interruption An example of indirect interruption occurs if the landlord receives an electric bill on an account that should have been in the tenant’s name, and the landlord simply fails to pay it. Here the landlord has full knowledge that the tenant failed to place the account in his or her name, and by the landlord not paying it, the account will get shut off. Again, this seems unfair to the landlord, but is the law. Steps to take if it is discovered that the tenant is not paying the electric Once it is discovered that the tenant is not paying the electric bill, the tenant needs to be notiﬁed immediately by the use of a 7 Day Notice of Noncompliance with Opportunity to Cure. The notice may state the following: You have failed to place the electric utility service account into your name as required by your lease agreement, and you owe the landlord the sum of $__________ at this time for outstanding electric bill(s). Steps the Landlord can take While it is beyond the landlord’s immediate control if the tenant steals electric, or in the event of reversion of the account back to the landlord, there is one thing that often occurs which is indeed completely in control of the landlord, but is often missed, because of the landlord’s forgetfulness or misplaced trust that the tenant will do what the tenant is “supposed” to do. Due to the need for electric to operate pools and a/c units, most landlords do not wish to have a time period when the electric is off. The result is that the electric is in the landlord’s name until such time as either the landlord directly has it shut off, OR the tenant directly has it placed in the tenant’s name. When a tenant moves into a rental unit and the electric is on, they will often happily sit there until the electric is shut off. But wait. How can the landlord have it shut off? Did not we just say that was illegal? The answer lies in timing. If the tenant is notiﬁed in writing that the landlord will be taking the electric out of his or her name no later than a ﬁxed date, and the landlord does indeed do this, it is doubtful that a prohibited practice or indirect termination as envisioned by the statute will occur. We recommend the following wording in a notiﬁcation to be given to the tenant prior to move-in. This can be placed directly on the INFO SHEET that the tenant should receive from the landlord, stating the names, phone numbers and addresses of the utility company, garbage pick up days, etc. Here is some recommended wording: Tenant understands and agrees that the electric service is currently on in the Landlord’s name. Tenant agrees that the Landlord shall order the electric service be taken out of the name of the Landlord within 3 days, and Tenant shall place the electric service in Tenant’s name and pay all necessary deposits. So you notiﬁed the tenant prior to move-in. Now, don’t forget to notify the electric company immediately in writing, and get a conﬁrmation from them!! Property managers who use checklists rarely, if ever, forget to do this. As a friendly reminder, if you shut off someone’s electric after they have taken occupancy in violation of the law, WE WILL NOT REPRESENT YOU!!

Chalkboards may be oldschool, but they’re the newest accent in home decor. “Look what I made,” said Kelly Sims of Liberty, Mo., holding up her smartphone during an unofficial show and tell during a chalkboard paint class at Be Here Now, a store in Independence, Mo. She flipped through pictures: A picnic basket with a chalkboard top for playfully listing its contents. An old mirror converted into a message board. The fronts of a few kitchen cabinets for meal planning and writing quotes. Sims finds pieces in thrift stores, garage sales and even the trash, then transforms them with chalkboard paint into gifts and home-entertaining accessories. Sims may be a kindergarten teacher, but she was a pupil that Thursday night in chalkboard paint class. The instructor was Meredith Martin, an interior designer who lectured on how to mix custom colors and what you can make with them. Results included a table setting with a chalkboard-painted paper runner and flower pots with chalkboard labels. Next to her sat a chalkboardpainted desk, storage boxes and a child’s play table. She led the class in a craft project, a large metal charger with the decorative border taped off. With paint, the center of the charger became a chalkboard. ular paintbrush for furniture and walls. For glass bottles, apply thinly. Spray cans of chalkboard paint are available. Black — as in blackboard — is the most typical color of chalkboard paint, but it can be any color. Chalkboard markers, available at craft stores and at Chalk Ink (chalkinkworldstore.com), are an alternative to dusty, smearing chalk. Decals with chalkboard surfaces are another way to go if you don’t want to commit to paint. Large-format shapes include rectangles, squares, airplanes and coffee cups, to name a few at All Modern (allmodern.com). Little labels are available at Martha Stewart Home Office with Avery at Staples (staples.com). Erasers like you had in elementary school are adorable. But if you want the surface to be super clean, see Letter T (clean it with a damp cloth). Furniture, such as the top of a desk or a dining table, works well for
chalkboard paint. But the paint can be used on the entire piece. Artist Tiffini Killgore painted a dresser with chalkboard paint and wrote the names of Kansas City neighborhoods on the drawers in chalk. Good gifts can be made with chalkboard paint. Paint an empty wine bottle, et voila! A vase. Great gift tags, too, can be crafted. The best part: they’re reusable. How to mix your own chalkboard paint: buy your favorite color of latex paint, says interior designer Meredith Martin (she used a no-VOC variety). Buy unsanded grout ($3 from a hardware store). For a gallon of paint, mix in a quart of grout. (The ratio should be two-thirds paint to onethird grout). Stir. Add drops of water to make it thinner. After painting, allow to dry an hour. Often only one coat is needed. Idea for parties: use a chalkboard-style oilcloth as a runner on the table. Give guests chalk or chalk pens and tell them to go to town. Jot down anything on a
chalkboard surface. It can be erased. Kraft paper can be covered with chalkboard paint to create a tablecloth. Great for writing pairing suggestions for tasting parties. Let your kids draw on the walls. No problem with a chalkboard or chalkboard paint. Make a Mondaythrough-Friday message board out of an old fivepanel door using chalkboard paint in the panels. New idea: painting the surface of a deck with chalkboard paint. Obvious choice: cheese trays. Not so obvious: your car. (We’ve spotted a VW Beetle). Pictures on Pinterest.com are inspiring us. We especially love walls with chalk drawings, such as a family tree in a nursery. A hint for precise outlines: rent a projector and create a transparency at a print shop. Understand that when you apply chalkboard paint, it goes on gritty. When it dries, sand surfaces with 150-grit sandpaper before you first write on them. Variety. Think beyond white chalk on a blackboard. Chalk comes in a crayon-assortment of colors these days; Crayola has a 52-count pack. Wet chalk is a secret for creating large-format designs, says Annie Huff, 18, the daughter of Resto-
ration Emporium owner Chrysalyn Huff. Annie Huff does chalkboard creations on doors and walls at the store. She dunks sidewalk chalk in a bucket of water. “It doesn’t look like anything when it’s wet on the surface, but then it dries vibrantly.” Xpiration date of chalkboard paint: Six months from date of purchase or after it’s mixed. (Yes, creative spelling is permitted on creative chalkboards.) Yummy surface for appetizer trays? To be on the safe side, use a nontoxic food-safe clear coat (available at craft stores) on top of chalkboard painted plates and platters. Zero writing. Chalkboard surfaces look great even with nothing on them. They’re full of possibilities.
