I have long said that you have to be persistent and stay in the game to get the results you want. I’m really seeing this advice pay off. Some clients have told me how glad they are that they didn’t give up because they got great deals. If you have not yet received the relief you want, now is definitely the time to try again. Q: My home has gone into foreclosure. How will I know if the lender wants to get money from me after it sells it? How can I protect myself? A: If the value of your home at the foreclosure auction is not enough to pay off your mortgage loan, you will have a deficiency liability. Your lender can have another hearing with the court to determine the exact amount of this liability and have the court issue a judgment that it can use to try to collect this money from you. One of the best ways to avoid this scenario is to try to negotiate with your lender during the foreclosure process to waive the deficiency — through a short sale, a deed in lieu of foreclosure or a consent judgment. Also, certain types of assets are exempt from collection, like most retirement accounts, head of household wages and your homestead property. Q: My wife and I have been married for 16 years. Our house has been in her name for more than 20

years. Her health is poor, and I’m wondering if there may be any legal issues I might face if things take a turn for the worse. A: If your wife passes with the homestead property in just her name, Florida law will determine what happens to the property. If there is a will and no minor children, your wife can leave the house to you in the will. If there is a minor child and a will, or if there is no will and she has a child of any age, you will get the house as long as you live (that’s known as a life estate) and then the property will go to the kids. Whatever the situation, you can avoid all of this and any expenses by having her deed the property to both of you, as husband and wife. This type of ownership is known as tenants by the entireties. Upon her death, the property will instantly transfer to you. The only downside to this type of transfer is that it will be subject to transfer taxes, unless the property is owned outright without a mortgage. — Gary M. Low mortgage rates attracting more short-term borrowers

People refinancing mortgages often debate the merits of 15-year or 20-year loans that may hasten their payoff date but require bigger payments than a 30-year mortgage. At the rates quoted this week by Freddie Mac, the monthly principal and interest payment on a 30-year fixed loan of $315,000 would be $1,458.81, compared with $2,170.79 for a 15-year loan. During the housing boom, few refinancers even considered shorterterm mortgages, which made up just 10 percent of all refis in 2006. To the regret of many, they instead extracted as much bubble-era equity as they could by taking on larger mortgages with long repayment times, and often with risky characteristics. “People were getting 30-year interest-only loans, and they were pulling out all the cash they could,” said Richard T. Cirelli, president of RTC Mortgage Corp., a Laguna Beach, Calif., loan brokerage. “Now it’s just the opposite — they want shorterterm loans, and they’re strategizing to get the mortgage payoff to coincide with their retirement,” Cirelli said. Instead of cash-out loans, some borrowers are even putting cash in when they refinance, he said. Also contributing to the trend: recent changes in the Obama administration’s Home Affordable Refinance Program, which cut the fees for certain borrowers getting new loans if they reduce the term of the mortgage to less than 30 years. By Freddie Mac’s count, 31 percent of the refinancers in the first quarter of this year opted for shorter-term loans.

That is the largest percentage since 2002, when the typical rate for a 15-year home loan ratcheted down over the course of the year from about 6.5 percent to less than 5.5 percent. About 35 percent of refinancing homeowners chose shorter-term loans that year, saving themselves about half a percentage point in interest compared with a 30-year loan, Freddie Mac economist Frank Nothaft said. The type of borrower in both cases was the same, according to Nothaft — people in their 40s and 50s whose incomes had risen enough that they could afford hundreds of dollars more each month to pay off more principal. The Freddie Mac surveys assume that borrowers pay about 0.75 percent of the loan amount to the lender in upfront fees and discount points. Solid borrowers who shop around often find slightly better rates, and homeowners also can lower the rate by paying additional discount points. The survey does not include third-party costs such as appraisals and title insurance. Mortgage rates tend to rise and fall along with the yield, or effective interest rate, on U.S. government debt. The 10-year Treasury note serves as a benchmark for fixed-rate loans. Five years ago, in June 2007, the average yield on the 10-year Treasury was above 5 percent, and late last June it exceeded 3 percent. The yield fell to 1.58 percent on Thursday, as investors troubled by the threat of defaults in European countries crowded into the perceived safety of U.S. government bonds. “It would have been hard to find economists at the beginning of this year who thought we’d see this kind of decline in rates,” Nothaft said. “I certainly did not.”

It’s that time of year again. A tropical storm will cause mischief somewhere and damage someone’s rental premises. The havoc will interrupt the tenant’s possession of the premises as well as the landlord’s income. Here are some important repair matters to keep in mind: Damaged and uninhabitable. If rental premises are damaged in a way that renders them uninhabitable, the tenant is not liable for rent for the period that the premises are uninhabitable. The owner is not obligated to pay for a hotel or move the tenant to another unit (unless the lease specifically says he should). Repairs should be completed as quickly as is reasonable. This is often difficult in a post-hurricane period, given the great demand on services. Documentation is key to show that you are making best efforts to get the premises repaired. Damaged but still habitable. If the premises are damaged but not destroyed, it is wise to work out some “credit” to the rent until repairs are done. How much of a credit depends on the facts of the particular situation. Alternatively, a wise landlord will have a clause in the lease that allows the landlord the right to terminate the tenancy in the event the premises are “damaged”. The tenant cannot refuse to pay rent. However, some compromise should be reached. If you served a three day notice while significant repairs were ongoing, and then filed an TD-0000205984

eviction, it is very likely that a judge would consider the damage to be a “diminution” in value. That’s enough to mess up an otherwise good eviction case. When repairs are completed, you will be on solid footing to demand the full rent. Destruction of premises. If the rental premises are destroyed, the owner might wish to terminate the lease rather than do repairs. Unfortunately, the option to do this is limited. The Florida statute does not entitle the landlord to terminate the tenancy under these conditions. The tenant can do so, but not the landlord. The landlord can terminate the tenancy due to destruction only if the lease says he can. This language is usually found in a paragraph titled “Casualty” or “Maintenance”. If the lease does not contain language that permits the landlord to terminate the tenancy, yet repairs are out of the question, the owner may want to “invite” the tenant to terminate the tenancy. The landlord would suggest to the tenant that the tenant could give notice to vacate and be released from the lease. Data and documentation Sure, everyone knows to take photos of damage after the hurricane, but do you have photos of what the place looks like now? It is sometimes hard to fully appreciate an “after” picture without having a “before”. You should record and document the condition of the rental premises now, before the winds blow.

Contemporary style speaks to many of today’s buyers By Christie Orros Special to Weekly

“So tell me, what kind of a house feels like home to you?” the Realtor asks the couple to get the discussion started. “I want a big gourmet kitchen and he wants a huge garage,” the wife immediately replies. “Wow, what a surprise…” the Realtor thinks to herself. “Oh yeah, and I absolutely [love/hate] contemporary-style houses,” says the husband. This conversation echoes dozens of times a day through Realtors’ offices all over our fine city. As a long-time fellow Realtor often reminds me, “There’s a rear-end for every seat.” This is true, because inevitably someone out there will fall in love with every house in Tallahassee if the price and style are right. Thus, a previously neglected and increasingly sought-after dwelling style for today’s abode hunters is “green, contem-


porary-ish” (Yes, that’s a real word in real estate sales-speak). Thanks to HGTV’s boundary-pushing style influence, our ever-rising utility bills and a growing desire to simplify our over-teched lives, there is a movement toward what most view as “contemporary” architecture and design. What is a “contemporary” house? We can’t exactly define it, but we know it when we see it. To add a more textbook base to the subject, I searched through books and websites from sources one would deem the proper authorities of architectural style definitions. Ultimately, I found what I believe to be the most relatable explanation in an obscure article on (www.wisegeek. com/what-is-contemporary-architecture.htm): “A precise definition of ‘contemporary’ architecture… is not so simple to articulate. “It is generally recognized that contemporary architecture is an evolution of modern archi-

Modern architecture refers to the building style of the early to mid-20th century. It featured clean lines and an emphasis on function. Those elements that characterized modern architecture, however, were also sometimes thought to be cold and impersonal. This belief lead to the creation of the contemporary style as is recognized today. “Like the modern style, contemporary architecture connects indoor and outdoor spaces, but it adds some personal touches and warmth throughout the living space. The use of natural light also plays a big part in defining this style. For this reason, large and expansive windows are a common and easily recognized feature of contemporary homes. “Green building is also becoming a strong component of the contemporary style. Architects today are placing more emphasis on energy efficiency; they also are using sustainable, natural, and recycled

materials, thus creating eco-friendly houses. Contemporary homes are also often thoughtfully integrated into their natural surroundings.” Sounds great, doesn’t it? However, this isn’t Arizona or California. This is North Florida. We love our columns, red brick, tall roof lines and front porches, right? Yes, but if you strolled through any of the amazing houses on display for last month’s Parade of Homes event, you saw a lot of completely open living areas (goodbye, separate formal dining room), green building materials and floor-to-ceiling windows with lots of natural light. In the decade I’ve been working in Tallahassee real estate sales, not once have I heard a buyer say, “You know, this house would be so much better if we added a few more walls to the living area.” We Realtors have helped so many buyers price out wall removals that we ought to give away sledge hammers at closings. Even if buyers do want a more traditional face on their house, they want it to have an open interior and be as

functionally and energyefficient as possible. Locally, there is an invisible polar line for house style. On one far end is “contemporary” and the other is “traditional.” Contemporary — open, clean lines, green, etc. Traditional — separate living areas, less natural light. Buyers and sellers will nearly always express their thoughts on where a house falls on this line, according to their interpretation. Patti Ketcham, a fellow Realtor, adds her thoughts on which way buyers often lean on this line. “I have known buyers who started out wanting traditional and fell for contemporary, but I cannot recall one buyer who started out wanting contemporary and falling for a traditional home,” she says. “Every contemporary home I have sold, the sellers always talked about the great parties and family gatherings they had at their house through the years.” People that grew up in traditional houses often seek out the benefits that a truly contemporary home can offer. Mark Holcomb,

who recently purchased a home in Betton Hills that is easily recognizable as an true contemporary house, had this to say about his flat-roofed 1950s-era “atomic ranch.” “Its style is simple, yet unique. It brings the outdoors into the house in several ways, from the atrium to the large windows in the living room, dining room and family room. I’ve tried to learn a little bit about mid-century architecture, which helps me appreciate these and many other details even more,” Holcomb said. Bypass expansion and tap into your home’s hidden space By Jennifer V. Hughes The Record (Hackensack N.J.)

HACKENSACK, N.J. — When it comes to renovation projects, contractors say homeowners often don’t (pardon the pun) think outside the box. Want a closet? You can steal some space from a neighboring room. Want a room? You can repurpose that little-used closet into something more practical. When your contractor takes a peek behind your walls, you might be surprised to find you have usable space you never knew existed. A savvy contractor can often come up with an innovative solution for home design and construction problems. “People sort of get tunnel vision,” says Richard Graniere, owner of Wayne, N.J.-based Advantage Contracting. “They work in the existing space instead of working within the outside perimeters of the house. They get blinded by the walls.” One of the easiest ways to repurpose space is to take down non-load-bearing walls, and Graniere says most walls in your home are non-load bearing. Even a load-bearing wall can be removed, but it requires support beams to be erected in its place. “You can really open things up,” he says. The contractor Dominic Mangiarelli recalls the case about four years ago of a woman who asked him to renovate a bathroom, but also talked about how much she wanted more closet space for her fivebedroom colonial in Livingston, N.J. In the process of the renovation, Mangiarelli had to take down a wall between the bathroom and the hallway. In the middle, he discovered a cavity between a chimney and the hallway wall. “It was small, only

about 18 inches by 18 inches, but to her it was a gold mine,” he says. Mangiarelli carved out the space for a linen closet in that cavity. A custom door for such a small size would be very expensive, but Mangiarelli came up with a novel idea: He used one panel of a bi-fold door. A little paint and spackle and a carpet remnant completed the job. “She was just as excited about that closet as she was about the weeks of work I put into the bathroom,” Mangiarelli says with a laugh. Since then, Mangiarelli has done the hidden-closet trick at least two more times. About three months ago with a client in Rockaway Township, N.J., he found a tiny space between the bathroom and a hallway landing that was just right for a linen closet that could be accessed from the hallway. “These happy surprises happen all the time,” Mangiarelli says. “You never know what you’re going to find until you start tearing things out.” Newer homes are much more likely to have hidden spaces, Mangiarelli says. With older homes, craftsmen made sure to use every possible space wisely. “They used every nook and cranny they could find,” he says. “It’s sad to say, but in newer homes they often slapped up walls over spaces because it was quicker, rather than to use all the space they had.” He recalled another “happy surprise,” when he was working with a Livingston woman on a bathroom renovation. She wanted to get rid of her bathtub to gain some more space and go with just a shower stall. Mangiarelli advised against it, knowing it would bump down her eventual resale value. Jennifer Scherer got a new, bigger closet at her home in Paterson, N.J., after her contractor removed a built-in and took space from another room. he could swipe some space from an L-shaped closet/ changing room that abutted the bathroom. “She wasn’t using the space in the closet, and it really helped the bathroom,” he says He kept the tub, added the stall shower and made the client happy. “There are always ways to find space,” he says. Shelia Manigault could read between the lines of her house. During a large renovation project on her Washington Township, N.J., home, she knew her family no longer needed the walk-in hallway closet upstairs. Instead, Manigault and her contractor, Glen Lumia, owner of Creative Design Construction and Remodeling, decided to turn the space into a computer/homework nook for her kids. One of the closet’s walls abuts the staircase. They decided to cut

a window-size hole in that wall to make the space more airy. “I wanted them to have a little corner to go study and sit on the computer and still not be in their bedrooms,” she says. “I can go up the stairs and see them; it’s like a cozy corner.” Manigault had advice for other homeowners who are considering renovation jobs. “I made a list of my needs first instead of looking at the space first,” she says. “Once I figured out what I needed, then I could figure out where to put it.” A Glen Rock, N.J., homeowner, Jennifer Scherer, found her hidden space while working with John Wohlberg, owner of JH Renovations of Ridgewood, on the master bedroom. The problem was the closet. Though it had a handy built-in dresser, it

was too small. “There were two racks, one behind the other, and it was impossible to get your clothes,” she says. “My husband kept his clothing in the hallway closet.” Wohlberg suggested removing the built-in dresser and taking about a foot from a daughter’s bedroom to enlarge the closet. At first, Scherer says, the couple was dubious. “My husband originally wanted to take even more space, but John said it would look funny,” she says. “I couldn’t visualize it, but it turned out to be the perfect size. I didn’t know if it would make her room look awkward, but it actually makes it look more interesting.” The wall in the girl’s bedroom juts in about a foot and then runs the length of the closet, about

eight feet, before doglegging back for the rest of the wall. “It looks like a little nook in her room,” Scherer says. “He put in crown molding and a chair rail around the room, and it all tied together. No one would ever walk into her room and say, ‘What is this?’ You’d never know.” The master bedroom closet is now deep and wide, and has room for all the couple’s clothing. Wohlberg also vaulted the ceiling to give more space and light. “It’s really the perfect size,” she says. Wohlberg says more homeowners are starting to think creatively about their space, thanks to the economy. “Most people are not expanding these days,” he says. “They’re looking to get more space in the space they have.”
