A: No. The mortgage insurance that you were required to buy when you got the loan covers the lender from its losses if you default. It does not protect you at all. As a matter of fact, if the mortgage insurance company has to pay out a loss to your lender based on the policy, the insurer may sue you to get the money back. If you are looking for an insurance product to pay off the mortgage when you pass away, you will want to purchase a life insurance policy. You can buy a general policy that will pay money to your designated beneficiaries, who can spend it how they like, or you can buy a policy specifically designed to pay off your mortgage. Q: I listed my home for a short sale in October and recently received a contract from a buyer. I’m waiting for the bank’s approval. At the end of March, I was served with foreclosure papers. How is this possible if I have a contract on the property? A: This happens quite often. It’s a common misconception that the lender won’t file a foreclosure lawsuit against you if you are negotiating a short sale or loan modification. You should expect to get served with a foreclosure lawsuit four months or so after you stop making mortgage payments. When you try to complete a short sale, it often takes

a month or two to get it under contract and 45 to 90 days to get an approval from the lender. If you fail to respond to the foreclosure within 20 days, you will be in default and will have waived valuable rights in defending the lawsuit in case the short sale falls through. I recommend that you see an attorney about responding to the lawsuit. Q: Can I quit-claim my house to my daughter without notifying my mortgage lender? A: No, at least not without breaking the terms of your mortgage loan. Most loans have a “due on sale” clause that states that if you transfer the property, you need to immediately pay back the full balance. So while there is nothing stopping you from deeding the house to your daughter, if your lender finds out, it can sue you and your daughter to foreclose the home. It is a much better idea to try to get your bank’s permission, or have your daughter buy it from you using a new loan. — Gary M. SECURITY DEPOSIT CLAIM AND REFUND TIMING by Harry Anthony Heist, Attorney at Law

A tenant’s security deposit is sacred in the eyes of the law. Specific timing issues are laid out in Florida Statutes which must be followed to avoid the landlord having to refund the entire security deposit to the tenant, even if the tenant owes the landlord money. Many landlords fail to take the law seriously and are surprised when a tenant leaves owing a substantial amount of money to the landlord, only to demand the full security deposit back from the landlord because the landlord failed to send the notice out in time or get the tenant the balance of the deposit if any back in time. When does the notice have to be sent to the tenant? The required timing of the Notice of Intention to Impose Claim on Security Deposit, hereinafter “Notice”, depends on whether you are making a claim against the deposit or whether you are returning the full deposit to the tenant. Timing of Notice when making a claim

If making a claim against the deposit, the Notice must be sent out within 30 days from the date that the tenant vacates the unit and not one day later. Failure to send out this Notice within the 30 days will result in the landlord having to refund the full amount of the security deposit to the tenant, regardless of amount owed to the landlord. The is no excuse for failing to send the Notice out within the 30 day timeframe. A number of years ago, the timeframe was 15 days. Now it is 30 days. Timing of Notice when returning the full security deposit If you are returning the full security deposit, you do not have to send out the Notice at all! Simply get the money in the mail within 15 days of the date that the tenant vacated the premises. Many apartment communities fail to send the money to the tenant within 15 days due to accounting issues and the time delays in requisitioning the money and getting a check from the corporate office. Unfortunately the judge does not care how your system works. The money must be sent out within 15 days period. Returning a portion of the deposit If you sent the Notice out and you are returning a portion of the deposit, you must return this portion of the deposit within 30 days from the date you sent out the Notice.

Examples: 1. Tenant vacates September 5 and you are not making a claim against the deposit. You must return the deposit by September 20. The Notice need not be used. Simply send the money. 2. Tenant vacates September 5 and you are returning some but not all of the deposit. You must send out the Notice by October 5 and you must return the balance of the deposit within 30 days from the date you sent out the Notice. The Security Deposit Law 83.49 (3)(a)- (3)(c) 83.49 Deposit money or advance rent; duty of landlord and tenant (3)(a) Upon the vacating of the premises for termination of the lease, if the landlord does not intend to impose a claim on the security deposit, the landlord shall have 15 days to return the security deposit together with interest if otherwise required, or the landlord shall have 30 days to give the tenant written notice by certified mail to the tenant’s last known mailing address of his intention to impose a claim on the deposit and the reason for imposing the claim. The notice shall contain a statement in substantially the following form: This is a notice of my intention to impose a claim for damages in the amount of ____________ upon your security deposit, due to ________. It is sent to you as required by S. 83.49(3), Florida Statutes. You are hereby notified that you must object in writing to this deduction from your security deposit within 15 days from the time you receive this notice or I will be authorized to deduct my claim from your security deposit. Your objection must be sent to (landlord’s address). If the landlord fails to give the required notice within the 30 day period, he forfeits his right to impose a claim upon the security deposit. (b) Unless the tenant objects to the imposition of the landlord’s claim or the amount thereof within 15 days after receipt of the landlord’s notice of intention to impose a claim, the landlord may then deduct the amount of his claim and shall remit the balance of the deposit to the tenant within 30 days after the date of the notice of intention to impose a claim for damages. (c) If either party institutes an action in a court of competent jurisdiction to adjudicate his right to the security deposit, the prevailing party is entitled to receive his court costs plus a reasonable fee for his attorney. The court shall advance the cause on the calendar.

In some cases, analysts say, the grandparents or adult children help pay the mortgage and housing costs. The number of these households nationwide increased by 30 percent from 2000 to 2010, far more than the 11 percent growth in total households, according to figures from the U.S. Census Bureau. A household is considered multigenerational if three generations live there. Chuck and Jennifer Thomas sold one house in Jupiter last year to buy another that could accommodate Kerns, Jennifer’s 70-year-old mother. In December, the Thomases and their three children found a two-story home home, built by Pulte’s DiVosta division, that offers a floor plan above the garage known as a “grand retreat.” The room is about 700 square feet and includes a private entrance, bedroom, bathroom and a kitchenette.

FORT LAUDERDALE — Jenny Kerns can join her grandkids for dinner almost any night just by going downstairs. Her daughter and son-in-law monitor her health without infringing on her privacy. Those are just some of the benefits Kerns and her family have found since moving four months ago into what is essentially two homes under one roof — a multigenerational property. It’s a growing market that homebuilders are targeting by designing homes with separate living quarters: bedrooms and bathrooms, and sometimes kitchenettes and entrances. Once known as motherin-law suites, the accommodations have come back in vogue as the economy sputters. Aging parents and adult children with young kids are moving in to baby boomers’ homes to help cope with dwindling investments, foreclosures and uncertain jobs. “This is something that’s becoming a necessity,” Miami analyst Lewis Goodkin said of the new housing option. “We’ve had more economic pressure than we’ve had in a long time. And it’s not a temporary thing. I think this is going to be with us for a while.” Pulte Homes and GL Homes say they’ve had success selling the concept at developments in Palm Beach County. Lennar Corp. started building these homes in Phoenix and Las Vegas last year and will do so in the Miami area this summer. Toll Brothers says it offers options for buyers to add kitchens and bedrooms, though the luxury builder doesn’t market those specifically for extended-family members. Multigenerational residences are larger and

It is against state law to provide moving services without being registered with the state. Crossing state lines is considered an interstate move and is regulated by the U.S. Department of Transportation Federal Motor Carrier Safety Administration. Moving companies crossing state lines must obtain operating authority from the DOT. Those who don’t risk shutdown of their operations if they get caught. Verifying whether a moving company has U.S. DOT operating authority is easy to do at http://ai.volpe. dot.gov/hhg/search.asp. Many moving companies operate under an agency agreement with major van lines when crossing state lines and operate under the van line’s authority. Getting started

On-site surveys are vital to the success of your move, specifically when moving large shipments and long distances. A reputable moving company wants to physically inventory what is being moved in order to provide the consumer with an accurate estimate and determine the resources necessary to

execute the move. The estimate for a longdistance move is based on weight and distance. A reputable mover will provide a consumer with a written estimate and as much information as the consumer needs to make an informed decision. Local moves are usually charged by the hour, so be careful with companies who provide a low hourly rate, only to work the clock against the customer. Ask the mover to provide a “not to exceed” figure in the amount of hours the move will take.

Types of estimates

n Binding Estimate: This is a definitive cost for moving services based on the items listed on the inventory. Final charges will not increase or decrease unless you add items or additional services. n Binding “Not to Exceed”: This estimate is much like a binding estimate except in cases where the actual weight and services are less than the estimate. In that instance, you pay the lesser amount. Your guarantee is based on the items listed in the inventory and the services outlined on the estimate. This is the most attractive of the three types of estimates n Non-binding: This estimate is not a guaranteed price. Final costs are based on the actual weight of the shipment and actual services provided at the time of the move. With a non-binding estimate, the mover cannot require you to pay more than the amount of the original estimate plus 10 percent at the time of delivery. You are then obligated to pay any additional charges over this amount within 30 days.

Stricter mortgage standards criticized as too tight By Al Heavens The Philadelphia Inquirer

PHILADELPHIA — During the housing boom, a borrower’s ability to exhale appeared to be the chief criterion for obtaining a mortgage. Six years of record foreclosures later, with millions of borrowers owing more than their properties are worth, the housing market continues to tread water. To prevent this from happening again, the Dodd-Frank financial-reform act of 2010 required that changes be made. The chief targets: such mortgage instruments as “interest-only” and “negative-amortization” loans, both of which allowed marginal borrowers to buy more house than they could have ever possibly afforded. Those were risky loans even in good financial times, but when the market collapsed, failure to meet even interest payments cost hundreds of thousands of borrowers their houses. To meet the reform law’s mandate, the Consumer Financial Protection Bureau, another Dodd-Frank creation, is designing what is known as a “qualified residential mortgage.” With a summer deadline for this new “Ability to Repay” rule, there is concern in the housing industry that a highly restrictive regulation will cut more borrowers out of the market than the situation warrants. “In typical government fashion, they will create a solution to a problem that doesn’t exist,” said Jerome Scarpello, of Leo Mortgage in Ambler, Pa. “The subprime loans and noincome-verification loans are gone. The underwriting criteria currently in place (are) hard enough without smothering the

AnAlysis little improvement I see in the market.” What Dodd-Frank mandated was a rule requiring institutions that place securities in the assetbacked secondary market to have a financial stake in ensuring that mortgage products are quality products. But opponents maintain that by requiring high down payments intended to guarantee quality — thus creating what are called “gold-plated mortgages” — prospective borrowers who don’t qualify for them would be forced into a higher-priced homeloan market lacking the same guarantees and protections. The Center for Responsible Lending, which typically stands on the opposite side of the fence from lenders, has cited research concluding that the government’s proposals might, indeed, end up being too restrictive. That research, conducted by both the center and the Center for Community Capital, found that such rules could push 60 percent of creditworthy borrowers into high-cost loans or out of the market entirely. Their findings were based on an analysis of almost 20 million mortgages made between 2000 and 2008. Government proposals have called for down payments of up to 20 percent, but the research showed that “mandating large down payments would be a mistake for business and consumers.” For example, the centers said, home mortgages requiring a 10 percent down payment would lock 40 percent of all creditworthy borrowers out of the market. A 20 percent down payment would

exclude 60 percent of the same borrowers. “While higher down payments do result in fewer defaults, restricting QRM (qualified residential mortgage) loans to borrowers who can come up with a 10 percent down payment would exclude nine creditworthy borrowers to prevent just one foreclosure,” the centers stated. Substandard underwriting, not low down payments, contributed to the housing industry’s current

woes, the centers maintain. Based on the $172,900 median price of a house in 2010 and adding in closing costs of 5 percent of the purchase price, the centers said, it would take a construction worker earning $40,650 a year 24 years to come up with a 10 percent down payment. A registered nurse earning $64,690 a year could do it in 15 years, while a police officer making $53,540 annually

would make the 10 percent in 18 years. “I think it’s a bad idea all around and will mostly affect first-time buyers, minorities and lowincome home buyers — all the keys to any economic recovery,” Scarpello said. “Down-payment standards are not enough to prevent another housing meltdown,” said Mark Zandi, chief economist at Moody’s Analytics in West Chester, Pa. “Most important to preventing bad

lending (including mortgage lending) are higher capital ratios and tougher liquidity requirements for banks and other creditors.” Zandi said consistent stress testing of financial institutions “is also very important to ensuring they have enough capital and liquidity to weather difficult economic times.” Predictably, the housing industry is unequivocally opposed to raising down payments to 20 percent, or even 10 percent. This month, a letter signed by 33 groups representing real estate agents, builders and lenders, among others, urged the Consumer Financial Protection Bureau to come up with a rule that would not “undermine prospects for a housing recovery and threaten the redevelopment of a sound mortgage market.” “Congress intended that all creditworthy borrowers — especially low- and moderate-income borrowers and families of color — should be extended the important protections of a qualified mortgage,” the letter stated. What the groups seek to help “ensure revival of the home-lending market” is “a broad qualified mortgage, which includes sound underwriting requirements, excludes risky loan features, and gives lenders reasonable protection against undue litigation risk.” Builders, especially, have argued that tighter lending standards not only have kept buyers away but have prevented construction jobs from being created in markets that did not take major economic hits and could do with more houses. “Today’s underwriting standards are too restrictive and are holding back a housing recovery,” the organizations said.

Impatient buyers pursue homes before they go on sale By Jim Buchta Star Tribune (Minneapolis)

MINNEAPOLIS — House hunters frustrated with the current market’s supply of homes have shifted their search from the streets to underground. More buyers are looking for homes that haven’t yet hit the market, a trend agents say will grow as inventory shrinks and the mismatch of what’s available and what’s desired continues. Such back-pocket deals used to involve mostly luxury homes where buyers and sellers wanted to keep the sale hush-hush. But lower-priced houses are becoming a bigger part of the mix because even those are in short supply. Working behind the scenes gives buyers access to the deep well of homeowners who would like to sell, but don’t think the market is healthy enough to list. Agents say they identify these sellers through referrals, as well as track those who listed their homes but backed out when they couldn’t sell. There are also buyers who work with agents to make unsolicited bids on homes they think fit their needs. “There is a shadow market out there with a lot of people who want to sell,” said Joe Grunnet, broker at the Downtown Resource Group in Minneapolis. Homeowners “just don’t know they can sell in this market. They still think the world is coming to an end.” Housing experts say there is a robust stash of homes that aren’t on the Multiple Listing Service. CoreLogic says that for every two houses available in the United States in January, there was one in the “shadow,” or not yet

on the market. There’s also a deep overhang of prospective sellers who have already decided to rent their homes rather than sell at this time. Mike Blood, who struggled to find a $150,000 to $200,000 home in the northern suburbs of Minneapolis, recently caught a break. He spotted a construction Dumpster in front of a house in Blaine, Minn., that he saw during an earlier hunt. After learning that it was being readied for resale, he and his agent made an offer even though the home was months from being listed. “I was so frustrated,” said Blood, who expects to close on the home next month. “And felt like I didn’t have anything to lose.” Blood didn’t disclose the purchase price. He said he looked at about 60 homes, but they needed too much work or he got outbid. Grunnet, whose firm specializes in sales and rentals of urban condos, said the stock of available units downtown is so tight that he often runs down the list of owners who are renting out their units to see whether they would sell. During the first four months of this year, he said his brokerage has already sold more offmarket properties than in the previous three years combined. For Alison and Fred Parks, the decision not to list was a way to test the market and avoid having strangers traipsing through their $1 millionplus condo near the Mississippi River in downtown Minneapolis. “We’re private people, living in a popular neighborhood,” they said. Blood, a branch manager for a heavy truck dealership, hopes for the deal to go through. “I like the floor plan,” he said. “It meets my needs.” Williams agent who says that, on average, 30 to 40 percent of her deals come together before a public listing. The couple gave Froid three months to sell, and it ended up selling within days to someone who already lived in the neighborhood for the full list price of $1.4 million. Unusually low inventory is forcing Froid to get more creative in her efforts to reach prospective sellers. “It is a function of necessity,” she said. “It’s hunting and gathering. If it’s not online, I’m going to try to find it for you.” Edina Realty and other big brokerages often skip the MLS and use internal

listing systems to share information about what buyers want and what’s coming online. A group of agents have also created a Facebook page where they can exchange data about what buyers want and what sellers have. Jim Young, an Edina Realty regional manager and vice president, said that the company’s internal website now has about 1,000 listings, but he cautions that the nonMLS route isn’t always the best option for sellers who want maximum exposure. He said the company discourages its agents from doing private listings unless it’s what a client wants.

WHERE TO FIND A BEHIND-THE-SCENES DEAL n Most real estate companies have an internal, premarket listing service. Some companies also have public forums where buyers can say what they’re shopping for. n Real estate agents who specialize in particular neighborhoods usually know what’s coming on the market long before it’s public. n In condo buildings and townhouse communities, many deals have been done by distributing wish-list letters to residents.

Marshall Saunders, co-owner and broker at ReMax Results, said that his company has a similar internal network that has helped sell 50 upperbracket houses last year. “It’s happening all the time now,” he said. Graham Smith, the agent who helped Blood,

said that in some ways these premarket deals are simply a return to the basics. “It’s good old-fashioned networking, that’s all it is,” he said. “It’s just using the tools available today to make it easier and more efficient to sell houses.”
