ed by hundreds of miles. They never talk. They rarely listen. They read from printed sheets. They seem incapable of independent thought. They never seem to be around for followup. They are not as heinous as those who urged borrowers to default on their mortgages rather than offer advice about their ability to continue making full mortgage payments on time or in full. There is a rule to stop that, too. As we learned in the mess created by the Home Affordable Modification Program and the Home Affordable Refinance Program, if rules are made, lenders and servicers will always find a way to break them. Even three years after the Obama administration launched HAMP, designed to reduce the foreclosure rate from record levels, mortgage servicers were still disqualifying qualified applicants. Under the new rules, a servicer must wait 120 days after a missed payment before beginning the foreclosure process. “This window of opportunity provides a healthy amount of time for struggling homeowners to adjust their loans without having to worry that their foreclosure is already being processed,” says Lot Diaz, of the National Council of La Raza. Servicers must reach out to troubled borrowers from the get-go, not on Day 119. The extended period should allow enough time for everyone to see whether an alternative to foreclosure can be found — which should eliminate unnecessary costs, as well as increase the likelihood that borrowers can

stay in their homes. The rules include protections for those who apply for foreclosure alternatives after the process has started. A borrower must complete an application for alternative to foreclosure at least 37 days before a house is to be sold. Servicers will be prevented from seeking foreclosure judgments or selling houses until reviews of applications are complete. These are important protections, but it would have been better to require that foreclosure proceedings be paused during reviews. A borrower’s ability to appeal will be limited when a request for an alternative to foreclosure is denied. Critics say that will prevent some borrowers from having improper denials corrected. They also wonder whether servicers will heed the rules. “We’ve already seen servicers ignore the calls to end dual tracking,” Diaz says. “Strong enforcement is key.”

Ask a Designer: Let winter inspire your rooms By Melissa Rayworth Associated Press

It’s cold out there. In much of the country, now’s the time when home serves as a cozy refuge from the ice and snow. We light our fireplaces and wish for springtime. But what if we took the opposite approach, using the inspiration of frosty winter colors and shimmering, icy textures to create rooms that look gorgeous year-round? A winter-inspired room can celebrate the beauty of this season, and also provide a cooling refuge perfect for the spring and summer ahead. “My clients usually

think I’ve lost my mind when I suggest using winter as a source of inspiration for a cozy bedroom,” says designer Brian Patrick Flynn, founder of decordemon.com. But, he says, “when done right, a combination of layered whites, blue-grays and touches of metallic can add a wintry look that’s chic, inviting, surprisingly warm and totally timeless.” Here, Flynn and two other interior designers — Betsy Burnham of Los Angeles’ Burnham Design and Kyle Schuneman of Live Well Designs — offer advice on using winter as a decorating inspiration.

Get reflective

Start with the reflective sheen of ice as your main inspiration, says Flynn. “Use a plethora of reflective surfaces and metallic touches,” he says, including mirrored accent tables and nightstands, as well as mirrored lamps. Flynn and Schuneman both recommend metallic wallpaper. “One bedroom I designed in California was completely inspired by Candice Olsen’s birch bark wallpaper from York Wallcovering,” Flynn says. “The paper is made from white-toned birch bark, and has a metallic

backing which just screams ‘winter chic.’” If you’d prefer painted walls, Schuneman suggests choosing a shade of

pale gray or icy blue and buying it in two different finishes — one with a high sheen that almost looks metallic and the other

matte. Paint the walls with alternating stripes of each finish. This use of just a few metallic or mirrored items is a great way to bring in some icy glamour, Schuneman says, “without it becoming the ice princess’ dungeon.”

Use range of colors “The biggest trick to doing a wintry palette right is to layer, layer, layer,” Flynn says. “I like to stick with an overall white palette, but bring in ultrawhite, off-white, cream, blue-white and then add touches of blue-gray. This makes a space soothing and sophisticated, while adding depth.” Burnham’s favorite wintry wall color right now is a shade called “Silver Spoon” by Dunn-Edwards. “It’s a really, really pale gray-blue, and I cannot tell you how many rooms I’ve used it in,” she says. It contrasts well with white for a modern look or with warm shades of brown for a more “organic and earthy” feel. Schuneman loves mixing wintry whites, silvers and grays accented with shades of purple. Or he sometimes pairs “a gray that has blue as its base, and a blue that has gray in its base” and brings in “hard edges, like crystal lamps” for a chic, “wintry feeling.”

The United States Post Office is offering a new online service called Click2Mail. This service offers users the ability to upload or create a document online and mail it online. Users can send the document certified mail without leaving their computer. Since the mail is certified, it fulfills the statutory requirement of certified mail for notices of claims against security deposits. Mail date and costs The mailing date is the next business day for entries before 2pm EST. For those of us who wait until the last day of the thirty-day notice period, it’s too late to use the online service. Off we go to the post office. The cost is the postage plus a service charge (the “production cost”) with a $2.00 minimum. Until the May 11th postage increase, the cost for one certified letter was $5.07 ($3.07 postage plus $2.00 minimum service charge). How does it work? I just couldn’t resist driving it around to see how it worked. I start by creating an account. Unlike many online vendors, no payment information is needed at signup. This is great. I can go through the entire process, and if I find it doesn’t work for me, I leave behind an unused account without my credit card information. Build the template and enter the information. Next I choose a layout or upload my own form. The system will upload Word and Adobe documents with relative ease. Other file formats can be uploaded by following special instructions. I upload the Notice of Intent to Impose Claim on Security Deposit in Word format. Unfortunately, the USPS online editor is not a word processing program. I have to add text boxes to the Notice to prepare it for entry of the information: tenant name, address, security deposit amount, deductions, etc. That’s a lot of text boxes. Once the form is complete, I save it as a template, and it is available in my account for future use. Enter the tenant information, deposit and deduction information, etc. Preview the information. Enter the recipient’s name and address into the address book, which saves them for future use. Since it is unlikely that I will ever need this tenant’s name

and address again for certified mail, saving the name/address in an address book serves no purpose, but is required to use them for mailing. For volume mailers there is an upload mailing list and mail merge option. Check off that I have proofed everything, and the payment screen is next. Select a return address. The payment address and return address default to the account address. Payment options are prepaid credit account or credit card. Review the charges and the mail date. Confirm my order, and I’m done. My receipt is saved in my account, and a hard copy can be printed out. I can track delivery online. If I desire a return receipt, two types are available: electronic and the standard green card for additional postage charges of $1 and $2.20 respectively. Note that a return receipt isn’t required by Florida Statutes for the Notice of Claim. Help There’s an online knowledgebase, program specific help menus and phone support. The phone help line was a pleasant surprise. I called it twice for assistance, pressed 2 (support), pressed 3 (documents), and real people answered immediately. When was the last time that ever happened? Summary My review of the service indicates that the lack of a word processing editor makes the online entry of data difficult. It was quicker to complete the Notice on my computer and upload the completed form each time then to complete the saved template online each time. However, I can see that a template saved on the USPS website, which can be accessed anywhere anytime, could be useful in a pinch. The saving of addresses is unnecessary. This service is targeted toward mass mailers who will upload a brochure or letter, or design a mail-out postcard online, and mail merge their customer list. That’s food for thought for the marketing people who are tired of lugging mail to the post office. For the rest of us, if we don’t have immediate access to a printer, envelopes, certified stickers or postage, sometimes it’s worth $2.00 to finish that Notice and get it mailed.

Analyst Lewis Goodkin marks 50 years in the housing industry By Paul Owers Fort Lauderdale Sun Sentinel

In the early 1980s, a Toronto-based builder planned a handful of condominium projects along the South Florida coast, but first wanted the opinion of local researcher Lewis Goodkin. On Goodkin’s advice, the company killed the deals just before a market meltdown. When he suggested to another builder that a proposed project wouldn’t work, Goodkin remembers the builder telling him he would “make a monkey out of me.” The development failed. “The biggest criticism I ever had — and what I’m so proud of — is people saying, ‘He’s so negative,’” Goodkin said. “The pride factor is that we were right.” Goodkin, 77, celebrates his golden anniversary as a housing analyst this year. A pioneer in consumer research for homebuilders, he remains a go-to source for banks, Wall Street investment firms, the national media and others trying to determine which way the housing winds are blowing. Goodkin advised the companies that developed Weston and Coral Springs and hundreds of gated communities in South Florida and across the country. Although much of southwestern Broward County didn’t sprout until after Hurricane Andrew in 1992, Goodkin was trumpeting that area for growth as far back as the late 1970s. “He doesn’t have a Ph.D, but he might as well have one,” said Chuck Cobb, former head of Boca Raton-based Arvida Corp., Weston’s developer. Goodkin began working full time as a housing researcher in 1963, the year Florida passed a law allowing condos as a form

of ownership. By the early 1970s, condo development was booming, mostly along Collins Avenue in Miami Beach and Galt Ocean Mile in Fort Lauderdale. Thousands of units were built on speculation, just as the nation was heading into a recession in 1974. In Miami-Dade County alone, there were 5,000 unsold units, and buildings were left partially complete. “It was just a royal mess,” Goodkin recalled. But it would be just a relative hiccup to the housing debacle that followed three decades later. In 2004, two years before the bust, Goodkin warned about a wave of easy lending, speculative buying and soaring prices that threatened to create a bubble, particularly in South Florida. The housing market peaked in 2005, then collapsed, devastating developers, buyers and existing homeowners. Goodkin said the crash, easily the worst of his career, was predictable because builders ignored market fundamentals. He initially was based in California, working with his brother, Sanford. They offered some of the first real estate research, helping West Coast builders capitalize on market trends. Builders in Florida took notice and were eager to use that analysis to achieve the same level of success, said Jack Winston, Lew Goodkin’s longtime senior associate. Goodkin met his second wife, Joie, at a Christmas party in Broward and eventually relocated to the Sunshine State, writing reports out of an apartment office above a French bakery in Fort Lauderdale. He later moved Goodkin Consulting to Miami. He said his was one of the first research firms to recommend to clients what kind of homes to

build and drill down to such details as floor plans, appliance brands and roofing materials. Goodkin told developers what types of golf courses would be best for their markets — from course design to the membership structure. “I always took pride in the fact that we not only understood the market, but also how to cater to it

properly,” he said. Deerfield Beach analyst Jack McCabe said Goodkin isn’t afraid to be blunt, even if it costs him business. “He would not pull any punches to keep the gravy train going,” McCabe said. Still, Goodkin is known for his homespun humor and expressions, often saying “you have to count the mice before you can

build the traps.” “We had clients who wouldn’t let us leave meetings without Lew telling us one of his stories,” said Harry Posin, a Fort Lauderdale-based builder who started his career under Goodkin in 1976. “Lew is one of the most respected individuals in the real estate industry, and one of the best loved,” added Winston.

QUESTION: With home prices increasing lately, I am hearing more about people “flipping” properties again. How do I get in on the action? ANSWER: Flipping refers to buying a home at a discount with the intention of quickly selling for a profit. During the housing boom, investors flipped properties in a matter of days, taking advantage of the huge run-up in prices. Today’s investors are more likely to buy and fix up the homes before selling a few months later. Flipping is a perfectly legitimate business – as long as you aren’t lying to a lender about your intentions or otherwise scamming the system. Despite what those infomercials and radio spots may lead you to believe, investing in real estate is risky. If it were as easy as the gurus say it is, they would be too busy investing to teach so many seminars. Be leery of the potential pitfalls. Selling the property may not be as easy as you think. A prospective buyer’s lender may have requirements that the investor (you) own the property for a certain period of time or that the increase in the resale price not exceed a certain ratio. For these reasons, most flips involve an end buyer paying cash. And cash buyers usually are experienced, so you could be stuck with the home for a long time if you don’t purchase it at the right price. The best way to become a successful investor is by learning the marketplace – maybe as a real estate agent, contractor or appraiser. That will give you experience you need in identifying undervalued properties with profit potential.
