Hurricanes & Closings Hurricane season is often something we forget about or only react to when there is cause for concern. Don’t let this be the case with your real estate transaction. Hurricane season is about being proactive and prepared. Where should you be proactive in your closing during hurricane season? INSURANCE. Proof of insurance is required by lenders at the time of closing (and is advisable for cash transactions, too). But many buyers do not know to bind the insurance policy prior to closing. While this is another upfront cost, it could be a big savings in the long run.

Insurance companies rue the presence of hurricanes and will stop writing policies when a named storm is offshore. Yes – STOP! What happens to your closing if this occurs? If you are using a lender, your closing will fail to occur even if the storm is gone. If it is a cash purchase, the deal may close but it will take on liability due to no provisions for insurance.
How else can hurricanes be a ﬁnancial danger to the purchaser beyond normal closing hurdles, planning expenses, packing, and moving? Your interest rate with a lender is time sensitive. Insurance companies may be down for weeks, depending on the nature of the storm. Your rate lock could expire. If your “locked in” rate does expire, the lender’s underwriting and processing must start over again. Additionally, if the property you are purchasing is “distressed property,” you could have additional ﬁnancial consequences. With short sales, approval times usually expire the day after the closing date given by the lien holder. So if you miss your closing you will be at the lien holder’s mercy to extend your closing date. If you are buying a foreclosed property, the seller’s addendum, which is required to purchase the property, likely includes a clause that has a per diem fee for buyer closing delays. These fees are typically $50 - $200 for every day the closing date is delayed. Hurricane-related delays can cause you to clutch your heart and your wallet. Just as with hurricane preparations, home buyers need to be prepared and be proactive. Make sure a hurricane doesn’t make a disaster of your closing! Bind your insurance! showed a $3.75 tool, a hollow brass cylinder, used to loosen the nut, but no clip. Trips to the store were fruitless. No one had heard of the tool or clip. The homeowner found the tool online and ordered it. Still, unlike the animation, the valve nut didn’t turn when he used the tool. He feared the clip on the valve base might be why. Moen’s representative, Kristi Stolarski, contacted Jerry Capasso of Moen technical support for me. He said the clip only held the “valve body to the top of the deck and does not need to be removed to change the cartridge.” The nut removal tool is used to “unthread” the cartridge nut, he said. If it didn't budge, pliers could help. His advice: Turn off the
water to the faucet; be sure it’s drained. Remove the cartridge nut; pull the blue stem extension up. The cartridge should come out. Loosen the screw in the blue stem extension to remove the old cartridge; attach the new one. Note the “tab” on the new cartridge. Insert the cartridge and stem extension into the valve body. Pushing down, rotate the stem extension until the cartridge engages into a slot inside the valve body. Tighten the nut, replace the handle and turn on the water.

Phoenix sees dramatic drop in empty houses By Catherine Reagor The Arizona Republic
PHOENIX — More than 100,000 houses stood vacant across the Phoenix area three years ago — roughly one of every 10. Today, it’s more like one of every 100. Where have all the empty houses gone? In 2009 and 2010, houses were vacant for months. Now, properties generally are vacant because they are between owners. The turnaround is credited to investors, who streamed in to buy cheap properties. In many cases, these houses were turned into rentals for those who had lost properties to foreclosure. “Metro Phoenix’s foreclosure problem was fixed faster than expected, thanks to investors. It’s great not to see so
many empty houses,” said Mark Stapp, executive director of real estate development at Arizona State University. “Now, we have another problem. We don’t have enough houses for sale.”

Remodel challenge: Save history, brighten style
Custom home needs an update By Kathleen Lynn The Record – Hackensack, N.J.
HACKENSACK, N.J. — As an artist, Roberta Russell had a vision for the house that she and her husband built in 1971. It had to be sleek, one story, with modern touches like an intercom and mirrored walls. Oh yes, the kitchen had to be round — with a circular island and a curving wall of windows that allowed a panoramic view of the yard. Now, more than 40 years later, the Wyckoff, N.J., house has passed to
new owners who want to respect its late-midcentury pedigree while updating it to a brighter, more open style. The new owners, Les and Sue Fox, have their own colorful history. They’re art dealers, as well as home builders and renovators, who wrote and self-published a bestselling guide to Beanie Babies at the crest of the Beanie craze in the late 1990s. They had long admired the house Roberta Russell built, which is just up the street from their home, and after Russell’s death last year at 75, they bought it. “We thought this house deserved to be saved,”
Les Fox said. “There were four or five builders that were competing with us to buy it. They would have knocked it down and built one of these McMansions there.” Roberta and Martin Russell were living in River Edge, N.J., with their two sons when they bought the Wyckoff property, which had been carved out of an old apple orchard. Martin Russell worked in the garment industry, and Roberta Russell was an artist who stayed at home to raise her children. Roberta was deeply involved in the home’s design and construction, her son, Andy, recalled in a re-
cent walk through the house. “For the time, it was a pretty modern house,” said Andy Russell, a marketing consultant who lives in Connecticut. “It looks like an anachronism now.” Roberta Russell stuccoed the living room walls and ceiling herself and covered the walls in other rooms with fabric from her husband’s textile business. A perfectionist, she burst into tears when she first saw the marble stones on the family room fireplace; the gray veining was too dark. The workmen ripped them out, and Roberta “went to the quarry and hand-
picked each stone,” her son said. The house’s geometry is tricky, with the bedroom wing set at an angle to the rest of the house. The most unusual feature, of course, is the round kitchen — which her sons’ friends always found funny and eccentric. But it made sense to Roberta Russell, who worked as a theatrical set designer after her children had grown up. “She liked the idea that you could circulate around the kitchen and have a wider panorama to the outside,” Andy Russell said. “It was definitely a very unique creation.”

He’s glad that he and his brother ended up selling to the Foxes rather than to builders who would have knocked it down. At the same time, he understands that the Foxes need to make it their own. As he and the Foxes walked through the house with their architect, the Foxes threw him the occasional apologetic glance as they discussed the changes they’re planning. He shrugged. “It was beautiful — in 1971,” he said. “I’m not offended.” For the Foxes, the biggest challenge of the new house is to open it up and let in more light. They also want to extend the rooflines, to emphasize the horizontal nature of the design and link it to the Frank Lloyd Wright Prairie houses that were an inspiration for the ranch style. The round kitchen is staying, though the dated counters and cabinets will be replaced. But walls will come down to create an open flow from the living room, family room and eat-in area of the kitchen. “We need to get light in,” said their architect, Michael Scro of Z+ Architects in Allendale, N.J. “The strength of the house is it’s got a solid brick facade, but it’s got relatively limited windows.” Breaking into the brick would be difficult and would also change the home’s exterior too much. “You have to be respectful of its era,” Scro said. “We’re going to tear the roof off and get light from above.” The Foxes plan to keep many original touches — for example, by framing and displaying pieces of the dated wall coverings. “This is a part of history here,” said Sue Fox, pointing to the black, blue and silver geometric wallpaper in the hall bathroom.

Latest in lock technology Kwikset’s new Kevo deadbolt lock can be unlocked with a smartphone and a simple touch. The
Bluetooth-enabled door lock communicates with the smartphone via an app that essentially turns the phone into an electronic key. When the phone comes within range of the lock, the lock recognizes it and can be unlocked with a touch. You don’t even have to take the phone out of your pocket or purse. You can send “eKeys” to others with compatible phones to give them access to your home, and you can disable or delete those eKeys if necessary. The app is available only for iPhone 4S and 5, but apps for Android and Blackberry phones are being developed. A fob can be used by people who don’t have a compatible device. more functional and aesthetically pleasing. Originally, the bathroom was open to the bedroom which didn’t offer much privacy. Larry’s plans included adding a door to separate the spaces. This simple addition drastically improved the universal design and functionality of both rooms.
In the master bedroom, a single closet with accordion doors was extended by approximately two feet to create dual walk-in closets. The size and shape of the room allowed this conversion without sacriﬁcing any signiﬁcant square footage. Custom-built shelving and organizers maximized the use of the new closet space to the delight of the homeowners.

Plans for a curb-free shower and new ﬁxtures required Capital City Builders to dig into the foundation to move sewer and plumbing lines. A small closet located in the bathroom was removed to allow for a new dual sink vanity with custom cabinets and a striking granite top. Top-ofthe-line Delta faucets were used at the request of the homeowner to attempt to conserve water.
The resulting master suite maximized functionality in a very limited space. With his and hers walk in closets and dual vanities in the bathroom, everyone has their own space – and plenty of it – and Capital City Builders had another award winner.

Question: I have been in foreclosure for the past several years and have been unsuccessful in getting a loan modification because I don’t make enough money. My attorney just told me that the case is going to trial in two months. What can I do? – Clarisse Answer: Foreclosure
lawsuits can seem to last forever, but they, like all things, eventually come to an end. Many people have been able to work with the bank to keep their home, but in some circumstances, like yours, the numbers will never work out for a loan modification. At your trial, the judge will make a final determination on the foreclosure, and the bank wins a large
majority of the time. You should concern yourself with your future living arrangements and with trying to get the bank to waive any deficiency judgment — the difference between what you owe and what your house is worth. The reason that most lawsuits settle before trial is that neither side is positive of the outcome, no matter how strong the

case may be. You can use this uncertainty to your advantage by negotiating with the bank to forgive your remaining debt and give you money for moving expenses. You may also want to look into completing a short sale. You should speak to your attorney about the possibility of filing for bankruptcy to potentially save your home
or at least allow you a fresh start without the dark cloud of debt hanging over your head. Now is the time to start looking for your next place to live, because it can take a while to find a suitable rental, especially with a low credit score. While you may win your foreclosure case or get a last-minute loan modification, it is time to face the realities of your situa-
tion and get a head start on the next phase of your life.
