I had a question awhile back from a reader who had a smart meter installed and checks online for usage. The reader reported that usage was normal for one or two days, then surged for the next day or two. There is no pat-

tern to the surges. She said it was almost like a timer was turning on. I published some of your responses almost a month ago, but because “Your Place” gets published in newspapers throughout the country, more have come in since. So here goes: Lee Edelberg in Leverett, Mass., says I was

REA#2252 V.P., Timberlane Appraisal I was talking to a fellow REALTOR® a few weeks ago; it had rained all day Saturday and Sunday during an open house he was hosting. He was surprised that he even had four couples come through the door. I told him they were smart buyers—a rainy day is one of the best times to look at a home. Assuming driving conditions are safe enough, I always encourage potential buyers to go out and look on a rainy day. Many people hunker down; they stay home and read a book or go see a movie on a rainy day. But what a great time to see an

open house—low traffic lets you take your time to find out more about the house. Even better, you can be on the lookout for active leaks in the roof by inspecting the ceiling. It is also a good idea to check out the gutters and see if they are doing their job, that they are not clogged with debris. Finally, camp out in front of the home and notice how the water drains off the lot. Many homes are plagued with drainage issues, eroding landscaping from the lot or undermining the foundation or driveway. While some drainage issues can be remedied by calling in a drainage expert, I would want to know what I am up against before I bought the home. So get out the umbrella this summer and get ready to get your feet wet. Our market is getting better, and if you wait for a sunny day the good deals in real estate just might dry up.

leak,” he says. Every other time it was due to an electrical load in the house that the owner hadn’t considered, Edelberg adds. Joe Riggins, an electrical engineer who lives outside Ithaca, N.Y., asks if the reader is sure she is looking at kilowatt hours? “The rate can be more than twice that of a previous day resulting in a variation in cost,” he says. John Walker spent many years working in customer service in the bill-inquiry area for a large utility company. “This involved field trips to determine high usage to rule out overreadings, previous estimates,” he says, adding that “newer electronic meters rule out most of the old problems.” Walker has found “many strange reasons for sporadic use increases, but this sounds like it could be due to underground wiring to an outbuilding with a twoway switch, one leg of which is exposed to dissipation conditions.” (Turning on a light in the house and off in the garage could create this situation. If the action is reversed, it will clear.) Byron Goldstein suggests that most modern refrigerators and freezers have automatic defrost cycles – “the defrost coils are electric, and then the unit has to rebound from the heat, requiring more cooling. “It’s always a good idea to check the refrigerator coils, in back or underneath,” Goldstein says. “Even with supposedly self-cleaning coils, they need to be cleaned once or twice a year of dust and dirt for efficiency.” Here’s where we are so far: The reader says she has oil heat, although it is likely electric-fired.

However, “I did find out one solution to the perplexing surges in power usage,” she says. Apparently, the monitoring website has not yet been officially launched, and there are some glitches, the reader says. “We have two meters – one was an off-peak meter,” she says. “The computer is picking up total usage for both meters on some days and the usage for the off-peak meter on others, hence the low-tohigh readings.” But “this does not alter the fact that my electric usage has almost doubled on the main meter since the smart meter was installed,” she says. The utility's initial response is that the old meter was not measuring true power usage. “The off-peak meter is maintaining the same usage as in the past,” she says, adding, “I have registered a dispute to see if they will check the meter.” Let’s see how this one plays out.

The Fair Housing Act protects disabled individuals, including those with mental illness, but it does not protect a tenant who is a “direct threat” to the health or safety of other tenants or who causes substantial physical damage to the property of others, unless a reasonable accommodation can alleviate the situation. It is wrong to exclude applicants or evict tenants based on fear, speculation, or stereotype about mental illness. Instead, a determination that a person poses a direct threat must be founded on an individualized assessment that is based on reliable objective evidence. That assessment has three parts: • What is the nature, duration, and severity of the risk of injury? • What is the probability that the injury will actually occur? • Are there any reasonable accommodations that will eliminate the direct threat?

A tenant is arrested for threatening his neighbors while swinging a baseball bat. You issue a seven day notice of termination due to the criminal behavior, but you then get a phone call from the tenant’s attorney. The attorney says that the tenant should be given another chance because the tenant is starting a new medication that will control his behavior. Management should grant this accommodation if the attorney can provide satisfactory assurance that the tenant will receive appropriate counseling and periodic medication monitoring so that he will no longer pose a direct threat during his tenancy. Homeowners who have chosen a high hurricane deductible are saving money every year on homeowners insurance. That may be a good strategy when tropical storms remain far from Florida, but it could prove otherwise when a hurricane actually strikes.

As the height of hurricane season approaches, the Insurance Information Institute and Florida Insurance Council suggest that Floridians review their hurricane deductibles to make sure they understand what that decision will cost them and have a plan to pay for it. Florida homeowners

insurance policies have two deductibles — one for damage from hurricanes and another for damage related to other perils covered under the policy, including non-hurricane windstorms. Deductibles are the amount of a loss paid by a policyholder, and a high deductible always makes annual premiums lower.

Paying less for insurance — even a few dollars a year less — seems right when the weather is calm. But high deductibles mean a policyholder takes on the extra risk, and that is not something many people consider. Policyholders should make sure their deductible decisions are affordable.

SEATTLE — After 9/11, Rich Ormbrek bought the biggest flag he could find — one about 16 feet wide — and nailed it to the eaves of his bright orange house in Ballard, Wash. “We wanted to let the terrorists know they can’t intimidate us,” said Ormbrek, now 70. But there was a little problem with Ormbrek’s show of patriotism: Wind constantly blew the flag to the ground or swept it atop his home, sometimes tearing it. Not even attaching the bottom of it to 10 strong stakes stabbed into the lawn worked. “My son got really tired of getting the flag off the roof,” he said. Daniel Ormbrek — one of Ormbrek's four kids — is in the Army Reserve now after a tour in Afghanistan. So, in 2002, father and son found a way to display a flag so that the wind would never knock it down again: They painted a 20-foot-wide flag onto

But one of the first tiles painted for the display, the one with “We the People” scrolled on it, has stayed in place at the top for more than 10 years. “That’s the most important one,” Ormbrek said. “It kind of set the tone for the rest of them.” Most of the tiles are painted by Margaret Smart, a foster mother of Ormbrek’s late wife. The Camano Island, Wash., woman perfected a way of painting on the cement tiles first with primer, then with acrylics. Ormbrek tops the tiles off with a layer of spar varnish, then carefully screws the tiles onto the exterior slats of his home.

Question: I live in a large condominium. The association recently foreclosed one of the units and is planning to sell it to the president of the association. In fact, he’s already moved in before the deal has closed. Is this allowed? – Peter Answer: It might be, but it all depends on the details. The association’s board members have a fiduciary duty to the community, meaning they must act for the benefit of the association and its members. While I don’t recommend that the president or other board members conduct business with their own association, there is no specific ban on their doing so. But they must act in a way that is in the best interest of the association and can’t benefit from a “sweetheart deal.” In your case, the president must be buying the property at full market value, and should be paying appropriate rent until he actually buys it. In my opinion, to avoid the appearance of impropriety, the board should fully disclose the details of the sale to the members and seek competing offers for the condo. If the president rented or bought the property for much lower than market value, he would not be protected by the business judgment rule. It is possible for a member of the association to bring this sort of lawsuit, but it’s usually filed by the next elected board after it reviews the actions of its predecessors.
