A. Purchasing a property through a private treaty might be slightly less stressful than buying at auction, but there’s still a lot to do. Follow the steps below to get ready to purchase a property through a private treaty. STEP 1: Arrange a home loan pre-approval, so you know how much you can afford. This may be a conditional finance approval, subject to a satisfactory valuation of the property, amongst other conditions and it’s usually valid for 90 days. STEP 2: Contact local real estate agents and start looking for a property. Make sure you are on their database for email alerts for upcoming properties that meet your criteria and are in your price range. STEP 3: Attend various open home inspections. Even if you are not interested in the property, it will help you get a feel for the buying and inspection process, what to ask the agent and what to look out for in a house. It will also give you an indication of how much property is going for in your preferred location. STEP 4: Before you make an offer, make sure you have funds available to pay the deposit, should you be successful. The deposit amount varies in different states. It can be as low as $1,000 or up to 10 per cent of the purchase price. A cheque or

deposit bond are common methods of payment. Ask your RAMS office about these. STEP 5: Once you have found a property, make an offer verbally through the agent or in writing through a solicitor. There may be some negotiating that occurs, so make sure you decide beforehand what your maximum offer will be. This will prevent you from offering more than the property is worth or more than you can afford. Make sure that your offer includes a 14-day finance clause and uses the maximum settlement period allowed in your state. STEP 6: If your offer is accepted, a Contract of Sale will be issued. Ensure that you instruct a solicitor to check it for you. You will usually be required to pay a holding deposit. STEP 7: Advise your home loan lender of the property details. Your lender will usually want to conduct a valuation of the property before finalising your finance. You should also arrange for building and pest inspection reports. STEP 8: Pay the full deposit and sign the contract. Even if your offer was initially accepted, it will not be legally binding until you exchange contracts. It’s best to move quickly to avoid being gazumped (out bid). STEP 9: There is usually a cooling-off period

after exchanging contracts. Use this time to make sure that you really want to purchase the property. You should also get written confirmation that you have unconditional loan approval from your lender. STEP 10: Advise your lender of the settlement date to ensure that it takes place within the period stated in the contract. Now’s a good time to arrange matters such as insurance. STEP 11: Arrange a final inspection just prior to settlement to ensure all is as noted in the contract. STEP 12: Move into your new home. Please note that each state may have different rules for purchasing through a private treaty. Make sure you check your State’s conditions before purchasing and talk to your lender about what you need to do. Certainty in an uncertain economy BY DANIEL HAYDEN Managing Director, Hayden Real Estate, Torquay IN THESE uncertain times, wouldn’t it be useful to bring some certainty into the future of real estate? Rational investors understand that nothing can be guaranteed, at least not without paying for it. Market conditions are such that everyone can have a plausible theory, but when we come across someone who ‘knows what is going to happen’, they are plainly lying or just deluded. Nevertheless, investing in real estate is simple, although not easy of course. Investing is fundamentally simple because it is just the exchange of a deposit of capital – such as money or time – for a payback, which is received directly or indirectly. It is not easy because of the price barriers to entry that most of us face and the stress that goes along with a decision to put so many of our eggs in the one basket. A capital idea The physicality of a property investment, its simplicity and the high ticket price – which gives it a badge of wealth and success – make it attractive to amateur (as opposed to full time professional) investors. Successful long-term investors display wisdom by focusing on income. It is often ‘forgotten’ that investors never need to realise or sell their investment to generate the full return. Capital is paid back automatically through income and the higher the risk, the quicker the payback.

The creative, trader types are more interested in the capital. While some of these make loads of money in short periods, there are many more you won’t hear about who find themselves out of sync when the market cycle takes a downward turn and often lose not only whatever gains they might have foreseen but also their capital investment as well. That, of course, is the risk side of the equation. Investors can be aggressive, defensive, active, passive, rational, behavioural – the psychology of investors is possibly more interesting than investing itself. However, there are dangers in long-term passive investing in real estate other than land, particularly commercial property, because buildings grow older and become less productive. Buildings themselves become functionally obsolete – there are not many horse stables left in our city centres. Additional ongoing investment is essential and any property in this class needs to be actively assetmanaged to maintain your investment value. Partly as a result, home ownership is one of the most sought after investment categories in Australia. The active asset-management of your home is straightforward because you live there, take pride in your surroundings and make sure it is maintained – and often improved. Additionally, your ‘income’ is found in the opportunity cost of not paying rent and while there is always going to be a market for residential rental property, you are not beholden to tenants to deliver a return.

So home ownership is the easiest property investment for most of us to obtain and build wealth from. Going to town The world’s population is growing and becoming more urbanised. This we can clearly see along the coast as people gravitate towards towns like Torquay and Ocean Grove. And the increasing population means increasing demand for a limited supply of housing. While the supply of housing might adjust itself to demand over time, at any one moment it is still likely to be either oversupplied or undersupplied. The latter is bound to result in a rapid rise in the cost of housing. Certainly we have witnessed this undersupply over the last decade (or more) and the rapid rise in the value of coastal land that has gone along with it. The style and type of housing that is needed will change as populations age and technology advances, but most changes will be easily accommodated within existing buildings. Transportation changes may have an effect on location preferences, but people’s desire to congregate and to seek entertainment is a powerful secondary driver – after the need to find work – of urbanisation. Across the world, real estate mainly comprises buildings to live in – one leading academic suggests 80 per cent. Human endeavour has rendered most old non-residential buildings redundant, and that remains a problem for the future. It is a fair bet that the owners of shopping centres,

office buildings and even hospitals will have to face up to rapid changes, not only in terms of configuration but in the very need for their property. No-one knows how we will shop or work in 50 years, or the amount of space needed by the robots that will make everything. But it is a sure bet that we will still wish to live under a roof. In previous articles I have touched on the population projections for our region and there is little argument that such an increase in the number of residents will have a twofold effect; firstly driving up prices for the limited available property and secondly, when the market cannot withstand the price pressure any longer, push out the boundaries of our townships through redevelopment. These demand pressures can only be withstood for so long and it is imperative that long-term planning strategies are put in place to cater for growth. Like a river in flood, we cannot stop the demand but it can be directed in ways that balance community preferences with economic realities. Simple economic theory states that where demand exceeds supply, prices will rise. Therefore with the obvious imbalance along the coast in particular, the overall demand for residential property makes the sector compelling for both investors and developers. So, in answer to the question posed at the beginning, the long term trend of property is always up – although cycles within the trend may result in abrupt rises or falls in value – and for this reason, good returns are ‘guaranteed’ for an intelligent, long-term participant in residential property.

WITH the bulk of the First Home Owners Grant behind us and interest rates returning to a healthy economic level, can a first home buyer still get into the market without needing to travel miles away from family and work? Contrary to popular belief, the answer is yes.
