Diplomacy: You are much better talking to the officer before the hearing and asking nicely if he will reduce the ticket to a non-moving violation, like “impeding traffic.” You will still have to pay the fine but nothing will go on your driving record, saving you money on insurance. Advantages of hiring a lawyer: You will not need to appear in court. Your lawyer can work out a deal and pay the fine for you.

Traffic Tickets* $149 Having a lawyer represent you in court can lead to: • Reduced points on your license • Reduce Fines • AND you may not have to appear in court * Civil Infractions

CAN YOU PASS

Politely say to the officer that you refuse to answer any questions without your attorney present.

Answer: “d.” They can’t legally search your car without your permission. If the police violate your rights by searching your car and find the drugs, you should act surprised and deny knowing that the drugs were there. Go to www.streetsmartlaw.com to see the video “Don’t Talk to the Police.”

“Let’s say that a detective calls your husband/son and wants him to take a polygraph so that he can clear himself from a false allegation of sexual assault. What should he do?”

a. b. c. d.

schedule an appointment because he wants to clear himself. go in for an interview and try to convince the cops of his innocence. tell the detective you need to think about it. tell the detective to “get bent”

d. Polygraphs are not admissible in court but a prosecutor will use your failure to charge you, even if they have NO OTHER EVIDENCE verifying your accuser’s story. Many people are pressured into confessing - yes, even innocent people - after a cop tells them that they have failed the test, and that the machine doesn’t lie. Never talk to police. For a more comprehensive explanation, go to www.streetsmartlaw.com and watch the video “Don’t Talk to Police.”

How it works: polygrapher scores the test by comparing physiological responses (breathing, blood pressure, heart, and perspiration rates) to these probable-lie control questions with reactions to relevant questions such as, “Did you ever commit an act of espionage against the United States?” (commonly asked in security screening). If the former reactions are greater, the examinee passes; if the latter are greater, he fails. If responses to both “control” and relevant questions are about the same, the result is deemed inconclusive. 22
