John Randall QC

Approach John’s personal style when working with clients is to be reasonably informal. The combination of his genial approach and many years of experience as a QC reduces some of the stress of disputes for his clients. However, in court he is a very forceful and effective speaker and makes full use of his extremely high level technical knowledge. Not only does his technical excellence add to his power as an advocate, but it is also invaluable in accurately assessing the best way forward and potential outcomes when advising clients. Practice John acts in a variety of high value commercial disputes, including contractually based property work, where he generally represents major regional and national developers. He also acts in many company law disputes – particularly shareholders’ disputes and claims by or against insolvency practitioners. Other significant areas of practice concern the enforceability of bank securities and professional negligence where, over the years, he has done a significant number of cases. The judicial review work that John undertakes arises in a commercial context, often linked to property development. On a different tack, he has acted in a variety of sports law matters involving rugby, motorcycle racing, football and boxing. John welcomes instructions in all categories of contractual and commercial disputes where he has such extensive experience.

He is renowned for his extensive and meticulous preparation both before and during the course of a trial, devoting a huge amount of time to discussing and assessing the issues in dispute. Practice Avtar’s clients are generally major institutions for whom he conducts high value commercial litigation. He has a very strong focus on insolvency where he is an acknowledged expert. His insolvency work includes directors’ breaches of duty, administration of football league clubs, as well as EU cross-border cases. He also acts for banks mainly in the recovery of money from directors who have misused factoring facilities, and he frequently acts in multi-million pound shareholder disputes. Other areas of Avtar’s practice include VAT tribunals, franchise disputes, and the representation of solicitors and accountants before their regulatory bodies and when professional negligence is alleged. Lance Ashworth QC

Approach Lance has a very intellectual and thorough understanding of the law and is recognised for his skill in dealing with complex technical matters. He is known for his aggressive and detailed cross-examination skills in the courtroom. His approach involves close co-operation with the parties he represents as he appreciates that working as a team is very important. He has a calm and easy manner and understands the nature of the pressures solicitors are under. He is described as an exceptionally able, user-friendly and commercial advocate, who displays great attention to detail and extremely high-quality legal analysis. If a case is complex and requires a long consultation, he will spend whatever time is necessary working with the client and solicitor. Lance also makes himself available at very short notice, and out of hours, to all departments of law firms when needed. In short, he describes himself as ‘ready and willing to go’. Practice High value commercial litigation is Lance’s main focus - matters such as share warranty disputes and major commercial contractual disputes, or acting for or against directors and fraudulent senior employees. The many insolvency cases in which he is involved can arise out of the commercial litigation undertaken, or may arise simply out of directors’ breaches of their duties. Within the context of insolvency, he regularly

assists in the restructuring of companies, using his technical expertise to identify procedures that are sometimes obscure and which enable the required outcome to be achieved. Franchising is an additional area of expertise where Lance generally acts for franchisors. He works for major developers and house builders; particularly in connection with development agreements. He also represents clients in professional negligence cases. “Lance Ashworth QC is highly esteemed on the Midlands circuit and his forte lies in providing top-quality solutions to all manner of hard-hitting insolvency and commercial issues including share warranties, breaches of fiduciary and bribery allegations.” Chambers UK Guide 2011 “Lance Ashworth QC has a fantastic reputation for his expertise in commercial and insolvency law. Sources say he is ‘extremely responsive, charming with clients and very sharp’. He is acting for the former directors of Krug International (UK) and its American parent company in a £1.3 million claim for breach of fiduciary duty and transaction to defraud creditors.” Chambers UK Guide 2011 "Lance Ashworth QC is 'exceptionally responsive, sharp as a pin, and a fearsome advocate'." Mohammed Zaman QC

Approach Mohammed is known as one of the leading cross examiners in the Midlands. As a courtroom advocate, he brings an overriding presence which gives the parties he represents a huge advantage, and leaves opposing parties in real difficulty. Not only does this approach serve him well in the courtroom, it also benefits clients in negotiations and ADR presentations where Mohammed is never a lawyer to ‘settle at any price’. He sees each case from the perspectives of all the parties so that he can engage with them to a greater extent than if operating purely on a lawyer-to-lawyer basis. Practice He has an eclectic commercial litigation practice that covers many categories of company work, such as shareholder disputes and breaches of duty by directors, with a particular expertise in restraint of trade. He regularly acts in insolvency cases (acting both for and against insolvency practitioners) and has wide experience of pursuing and defending directors accused of fraud. Linked to this, Mohammed acts in regulatory matters involving company investigations and directors’ disqualification proceedings, typically acting for directors accused of wrongful conduct. More recently he has started to develop an international arbitration practice and has been appointed to sit as an arbitrator by the International Chamber of Commerce in Paris on an international contract dispute.
