GENERAL TERMS AND CONDITIONS 1.

General Terms and Conditions

This General Terms and Conditions are a component part of the agreement between tourist agency Tournesol j.d.o.o., Ćirila i Metoda 2, Split, OIB: 98697981964, ID CODE: HR-AB-21-060367744 (hereinafter Agency) and the customer (hereinafter: the Customer) and defines the rights and obligations of all parties involved. By booking services, the Agency and the Customer is legally bound to respect the general terms and conditions of travel. The Agency guarantees the implementation of the program according to the description of all services that can be found on internet on webpage www.soltravelcroatia.com . 2.

Day excursions and trips

The Agency guarantees the implementation of booked excursion and trip according to the description of all excursions and tours that can be found on internet. The content of the day excursion and trip Agency will be realized in full and as described above, except in case of exceptional circumstances (social unrest, strikes, acts of terrorism, war, natural disaster, local authorities interventions etc.). 3.

Accommodation

The Agency is mediator between Customer and accommodation and helps the Customer to find appropriate accommodation offered on webpage of Agency while ensuring chosen accommodation for the Customer for booked period in full and as described above, except in case of exceptional circumstances (social unrest, strikes, acts of terrorism, war, natural disaster, local authorities interventions etc.). 4.

Min van, car, speedboat transfers

The Agency guarantees the implementation of booked transfer on set route that can be found on internet. The content of the transfer with car, van or boat will be realized in full and as described above, except in case of exceptional circumstances (social unrest, strikes, acts of terrorism, war, natural disaster, inadequate weather conditions on the sea, local authorities interventions etc.). 5.

Reservations and bookings, payment

Reservations and booking of excursions and trips, transfers and accommodation can be made on the website of the agency Sol Travel Croatia, Tournesol j.d.o.o. or through websites and retail outlets of our partners and intermediaries a) When registering Customer defines the date and type of excursion, transfer or accommodation, while the Agency sends quotation for chosen service as soon as possible and in case of accepting the quotation, Agency confirms dates and booking b) With booking confirmation, Agency sends the invoice for booked service c) The Customer when receiving the invoice for excursions, trips and transfers is obliged to pay 25% of total price in order to confirm booking and receive voucher for chosen service d) The Customer when receiving the invoice for accommodation is obliged to pay 30% of total price in order to confirm booking and receive voucher for chosen service e) When paying full invoice or part of the value of chosen service prior to departure or check in date, the Agency will refer him to possible forms of payment: ·

Credit/Debit cards - Visa Credit, Visa Debit, Visa Electron and Master Card - If you choose Credit/Debit cards as your way of payment you will receive to your email address a quote with all necessary information for payment, including the online quotation with instructions on how to pay deposit. PayPal – If you choose PayPal as your way of payment you will receive to your email address a quote with all necessary information for payment, including the account name to which you should pay the value of the order.

Bank transfer - If you choose Bank Transfer as your way of payment you will receive to your email address a quote with all necessary information for payment, including the account number to which you should pay the value of the order. Payment can be made using internet banking. Bank information for bank transfers:

Changes of the reservation and booking for day excursions and trips

Changes in registration and booking of excursion or trip have to be reported to the Agency by e-mail info@soltravelcroatia.com or by phone +385989739194. The Agency reserves the right to change prices in case of changes in the number of passengers. Prices are defined on webpage of Agency and are based on calculation of minimal number of passengers of 5, while smaller groups are considered private groups and price is calculated having in mind this. In the case of boat excursions and other excursions conditioned by weather Agency reserves the right to change the departure time in case of bad weather conditions and will organize another excursion in adequate time or provide a refund. 7.

Changes of the reservation and booking for transfers

Changes in registration and booking of transfers have to be reported to the Agency by e-mail info@soltravelcroatia.com or by phone +385989739194. The Agency reserves the right to change prices in case of changes in the number of passengers. Prices are defined on webpage of Agency and are based on calculation of minimal number of passengers of 1. In the case of boat transfers, Agency reserves the right to change the departure time in case of bad weather conditions and will organize another transfer in adequate time or provide a refund. 8.

Changes of the reservation and booking for accommodation

Changes in registration and booking of accommodation have to be reported to the Agency by e-mail info@soltravelcroatia.com or by phone +385989739194. The Agency will try to find suitable accommodation for new booking period, but reserves the right to cancel accommodation in case of fully booked accommodation units. 9.

Content and pricing for day excursions, trips and transfers

Contents of day excursions, trips and transfers define everything what is included in the price and Agency stated in the travel programme. Special services are not included in the price and Customer is obliged to pay them separately. Optional and special services made on Customers request during excursion or the trip must be paid to tourist guide or representative of the Agency. Prices of excursions, trips and transfers are published in Croatian kuna and euro, and are calculated according to the prices of services in the reference currency at the selling rate of commercial bank of the Agency on a particular day. In the case of exchange rate change by more than 3% Agency reserves the right to change prices. The Agency reserves the right to change the prices in case of changing prices for accommodation, food, transport and other services, or updates to the value of the currencies that are the basis for calculating the price. Increasing the package price up to 10% does not require the approval of the customer (the increase is calculated on all parts of the payment). In the case of price increase of more than 10%, the buyer has the right to cancel the excursion, trip or transfer without liability for damages. 10. Content and pricing for accommodation units



Content of accommodation define everything what is included in price and Agency stated in the accommodation description. Price of accommodation includes daily rent, air condition, bed linen, towels, use of water and electricity, free WiFi, use of available facilities in accommodation unit (e.g. kitchen, safety deposit box), parking and tourist tax. Price of accommodation is published in Croatian kuna and euro, and is calculated according to the prices of services in the reference currency at the selling rate of commercial bank of the Agency on a particular day. In the case of exchange rate change by more than 3% Agency reserves the right to change prices. The Agency reserves the right to change the prices in case of changing prices for accommodation, tourist tax, utilities and other services, or updates to the value of the currencies that are the basis for calculating the price. 11. Changes of Programme for day excursions, trips, transfers and accommodation The Agency has the right to change the programme if circumstances occur that cannot be predicted, avoided or removed (see point 2, 3, 4). 12. Cancellation policy for day excursions, trips and transfers The Agency may cancel a day excursion, trip or transfer completely or partially if, before or during the service, occur circumstances which cannot be avoided or eliminated. The agency shall notify all Customers of the cancellation at least 24 hours before the start of the trip, and will repay the full amount paid. If the Customer cancels or does not show up for excursion, trip or transfer, he must notice Agency by email at info@soltravelcroatia.com or call +385989739194 • For cancellation from 20-11 days before the trip Agency does not charge package price • For cancellation from 10-4 days before the trip Agency will charge 20% of the price • For cancellations from 3-1 days before the trip Agency charged 40% of the price • For cancellations made less than one day, or for a "no show", or for cancellation during the trip that was created by the customer, the organizer will charge 100% of the price. When the actual costs are higher than those in the above chart, the agency has the right to charge the difference. If the Customer who cancels the trip finds a replacement, the organizer will charge only the cost of the replacement if any. 13. Cancellation policy for accommodation The Agency may cancel accommodation completely or partially if, before or during the service, occur circumstances which cannot be avoided or eliminated. The agency is obliged to find appropriate replacement accommodation for all Customers or in case that is not possible, Agency shall notify all Customers of the cancellation at least 48 hours before the check in date, and will repay the full amount paid. If the Customer cancels or does not show up accommodation, he must notice Agency by email at info@soltravelcroatia.com or call +385989739194 • For cancellation up to 30 days before the check in date Agency will charge 30% of accommodation price • For cancellation from 29-15 days before the check in date Agency will charge 50% of the price • For cancellations from 14-5 days before the check in date Agency charged 60% of the price



• For cancellations made less than 5 days, or for a "no show", or for cancellation during accommodation period that was created by the customer, the Agency will charge 100% of the price. If the Customer who cancels the trip finds a replacement, the organizer will charge only the cost of the replacement if any. 14. Liabilities of Customer during day excursions, trips and transfers The Customer is obliged to respect departure and arrival time and set itinerary with exclusion of free time and parts of tour arranged after the departure. Customer is obliged to have all necessary ID and travel documents in case tour requires the same. Customer needs to pay full respect to Agency employees and other tour participants. 15. Liabilities of Customer for accommodation Customer is obliged to have all necessary ID and travel documents in case tour requires the same. Customer needs to pay full respect accommodation rules and during use of available facilities pay attention for keeping everything clean and tidy. In case of caused damage in accommodation unit, Customer needs to cover all the expenses. Customer is obliged to respect check in (from 14h) and check out (till 11h) time. In case that is not possible, Customer needs to inform the Agency in advance by email or phone (info@soltravelcroatia.com ili +385989739194). 16. Liability of Agency The Agency is not responsible for lost, damaged or stolen luggage or belongings during the day excursions, trips, transfers or while staying in chosen accommodation. Stolen or lost luggage must be reported to the tour guide or representative of Agency who will report to the issue to the police or by going directly to the local police station. 17. Complaints resolving Customer has the right to file in complaint relating to undelivered services for which he paid for. Customer has right no later than 8 working days upon return from trip to send a written complaint to the agency on info@soltravelcroatia.com or by post send to address Tournesol j.d.o.o., Ćiril Metodova 2, 21000 Split. The agency is obliged to reply to written complaint within 14 working days. 18. Arbitration All potential disputes that cannot be resolved by mutual agreement, will become subject to the decision of the Split Court jurisdiction.
