我三歲開始接觸報紙,我爸每天看完日報新聞, 就要我跟他一個一個字的唸一個專欄,唸完後我 跟我姐到報攤,加五分錢換一份兒童畫報。後來 家裡有了收音機,再有了電視機,專注的節目少 不了新聞報導。 一九八四年開始,參加香港回歸工作,作為受眾 的同時,也是新聞的採訪對象。二、三十年來, 在工作和生活中,結交了不計其數的文字和廣播 記者朋友,每個人對新聞行業都有一份熱忱、執 着和拼勁,這是眾口一詞,海內外有口皆碑的事實。 香港記者協會創辦四十一周年,我衷心致賀,並祝願協會會務蒸蒸 日上,再創佳績。

Message From LEUNG Chun-ying Convenor of the Non-official Members of the Executive Council Hong Kong Special Administrative Region Government

As we celebrate the 41st anniversary of the Hong Kong Journalists Association (HKJA), I am also celebrating slightly older media anniversary of my own. I have spent 50 years hidden behind newspapers, immersed in radio broadcasts, appearing in front of the media, and in every other way, being thoroughly stimulated, enlightened and informed by journalists who make Hong Kong's media scene so vibrant and free. I started my interaction with the Hong Kong media at the age of three. Every day, my father would guide me to read a column word by word after him. My reward was to go with my older sister to the newsstand and exchange the newspaper for a children's picture magazine for an extra 5 cents. Since then, I have voraciously consumed news reports, first on radio and then TV. In 1984, I began my association with the return of Hong Kong to China, and found myself not only a follower of news but also a source of news. Over the last two to three decades, I have never ceased to admire the dedication of the numerous print and broadcast reporters whom I have had the privilege to know well. On this special occasion of the 41st anniversary, I wish you all the very best for the future of the HKJA.

Defend Freedom of Expression and of the Press, Maintain the Status of an International City 【Dr. Tam Chi-keung, Camoes ‧ Chairperson of Hong Kong Journalists Association】

Hong Kong is a cosmopolitan city within China, in software conditions, apart from its clean civil service, fair judicial system, English language skills and business management efficiency, the transparent policies which were brought about by a high degree of freedom of expression and freedom of the press, is also a necessary and important factor. Freedom of expression and freedom of the press encourage the provision of sufficient information to the general public and business investors. Then, people will have sufficient information to make the right judgment. These factors have also put Hong Kong far ahead of other cities in Mainland China. In order to maintain the stability and prosperity of Hong Kong, when the PRC government enacted the "Hong Kong Basic Law", it specifically added these words to Article 27: ‘Hong Kong residents shall have freedom of speech, freedom of the press, and freedom of publication.’ However, since the handover of Hong Kong in 1997, even though the Basic Law expressly guarantees freedom of speech and freedom of press, nevertheless these areas continue to shrink. There are a lot of reasons for this. Until now, the freedom of expression and freedom of the press in Hong Kong have generally been upheld in a normal environment but the pressure of layoffs and pay cuts, which were caused by recent global financial tsunami, indeed, has weakened local journalists’ ability to resist outside pressures. For many journalists in Hong Kong the past 12 months have been a very unfortunate period.

To r e s o l v e t h e i r financial problems many major mass media laid off staff, forcing journalists, including senior ones, out of their jobs. The Hong Kong Journalists Association (HKJA) strongly opposed these lay-offs to solve their operational problems, which were triggered by the Global Financial Tsunami. In addition, even though for the aim of increase income and reduce expenditure, only in the last resort, then, the administrators of mass media may consider the following options: cutting pay, take a short nopay leave, take a long no-pay leave, preserve the post with no-pay, etc. Mainland Chinese officials recently launched an "anti-vulgar action" on the Internet, comparable to the Hong Kong Legislative Council’s "foul language issue". I am rather concerned about this. I object to the use of “vulgar language” in any legislature but I also disagree with some senior officials’ way of handling the controversy. So if our media industry is not alert to the HKSAR government officials’ "talk black into white" approach, many unreasonable media restrictions of China may quickly be transplanted to Hong Kong. If that happens even though media workers may be regretful, it would be too late!

Macau’s “patriotic” Article 23 cause for concern

【Stanley Leung ‧ Convener, Press Freedom Sub-committee】 In the last few months, what happened in Macau has aroused concern among Hong Kong journalists over the press freedom. Following a short consultation and brief deliberations, the Macau legislature passed the controversial national security law (Article 23 of the Basic Law) in March, only five months after the publication of a consultation paper on the crucial legislation. On the eve of Macau’s passage of the law, HKJA released a statement questioning the promulgation of a law intended to provide a demonstrating effect on Hong Kong where a similar attempt in 2003 created a worldwide storm of protests and contributed significantly to a 500,000-strong protest march in July. The HKJA shared the views of the press freedom sub-committee that Mainland China is not under any threat from Hong Kong or Macau. There is absolutely no justification for introducing, now or in the foreseeable future, laws that will accentuate differences within our community and sharpen conflicts at a time when Hong Kong is facing a global economic crisis. While the national security law was being processed, the denied entry of a SCMP photographer to Macau shocked the two communities. Although the photographer had been given official approval to cover a major court case in the territory, the Macau authorities, nevertheless, applied “internal security rules” to deny him entry. In a press statement, the HKJA expressed deep regrets over the incident and urged the Macau authorities to give an open explanation for denying the entry to the photographer who was covering an officially approved assignment. Earlier this year, the sub-committee drafted a submission on the review of the Control of Obscene and Indecent Articles Ordinance which was deliberated upon and endorsed by the HKJA executive committee. According to our submission sent to the Government before the end of the consultation period, the HKJA found legislating on matters of a moral nature a difficult area, requiring a liberal approach towards this complex subject, rather than imposing further restrictions on obscene and indecent articles.

The Beijing Olympics took place in August last year. Despite repeated assurances of the Chinese leadership that there would be no interference with the media’s coverage of the Olympic Games and other news in China, violations occurred. In July, the Hong Kong Journalists’ Association noted with dismay the interference of news coverage in Beijing by a Ming Pao reporter and the confiscation of his digital camera card. The HKJA urged, in the strongest possible terms, a full and open explanation from the relevant authorities about this incident and to immediately return the digital camera card confiscated by the public security officers to Ming Pao. In early July, HKJA wrote to the Central Government to express our regret over the denial of entry into Beijing of Norman Choy, reporter of Apple Daily newspaper in Hong Kong, to cover the Olympic Games in spite of his having applied for proper press accreditation for the Games. The action against him was a total departure from the Service Guide for Foreign Media Coverage of the Beijing Olympic Games and the Preparatory Period, issued in 2007. We urged the Beijing authorities to clarify this matter and to immediately return the confiscated Home Visit Permit to the reporter. At the end of July, Hong Kong reporters were obstructed and even detained by public security officers while covering the sale of Olympic tickets in Beijing. A total of four media outlets were affected by such actions. The HKJA condemned the Beijing Public Security personnel for their wanton violation of Press Freedom on the Mainland and in Hong Kong. The association also urged the central authorities to give a full account of the incidents and prevent any recurrence especially during the Olympics.

給會員的講座、熊貓和足球 【郭家傑‧會員、培訓及福利小組召集人】 (一)仍然記得去年十二月的一個周末晚 上…… 七點鐘,尖沙咀青年會酒店,四十多位對新 聞工作有興趣的人,聽台上三位講者發表他們對傳 媒報道金融海嘯的意見。 台下發言踴躍。八點半,我坐在台上,肚子 很餓,忍不住要打完場,不如先吃飯,席間再談, 多謝大家…… 於心有愧!厚著臉皮向信報的練總,及抱病 的老友阿戚,要他們加場,結果傾到差不多晚上 十一點才完場。 說過什麼,己經不甚了了。大扺都是傳媒應 多作深入的報道(如雷曼,中信泰富),也應提高 行業的專業水平(最好能一早拆穿雷曼迷債陷阱和 查出更多中信的問題)等等,只記得那晚很多人好 像都說,這類型講座應要再多搞。 我想,晚上搞講 座對記者這群貓頭鷹來說會更合適…… 去年十二月份是記協的講座月,先有同樣由 友會國際記者聯會贊助的有關採訪災難新聞的工作 坊,反應迴響都是一樣熱烈,後有一次與廉政公署 合辦的講座,探討切身收受利益的問題……

(二)談起今年會員的切身問題,應該離不開 一個P&L。 一場金融風暴,差不多每家傳媒不是減薪 (Pay cut),便是裁員 (Layoff)。 作為業界團體,記協反對傳媒在有盈利的情 況下向員工開刀,當然我們明白,傳媒跟其他行業 一樣,都沒有例外。去年底在傳媒還正醞釀大動作 之前,我們還向所有主流傳媒老闆發信,希望他們 能竭力保護旗下新聞工作者的利益。 我們一向有為會員提供失業保障津貼,會員 在連續失業三個月後,可向記協申請每月三千元的 補貼,每次成功申請為期三個月,上限申請兩次共 六個月的津貼。

此外,我們倣效英國的記者組織,在記協網 上提供自由傳媒工作者名錄,希望可替越來越多的 傳媒自由人尋找多一點賺外快的機會。 在金融風暴中,我們能做的有幾多?

(三)天公造美。二月初春的一個早上,我們 一行四十多人參觀海洋公園。 威威司令和兩隻鸚鵡早在門口迎接我們,海 洋公園的朋友先給我們一個簡介,講解他們近年起 死回生的故事。之後再帶我們參觀海豚訓練場,又 帶我們走一轉平時不開放的水母培植室。 樂園總裁 Tom更與我們共晉午餐,坐在纜車廂內,一位行家 前輩告訴我,原來三十年前海洋公園開幕時,她也 來過探訪,今次同家人重遊舊地,份外高興…… 開心的旅行總有一點遺憾。身為這個活動的 策劃者,我竟然忘了帶會旗。一般人可能會忘記帶 一些小東西,我記得帶膠紙,卻忘了幾磅重的錦 旗……

(四)波真是圓的!一向雄霸記協盃的東方A, B兩隊,今年意外地未能進入冠軍爭奪戰,收到同 事電郵時,我還以為是手民之誤,特別是決賽隊伍 中有一隊是我們接獲投訴後,重判賽果後才出線 的…… 結果今年冠軍終由有線電視奪得,決賽時更 由該台現場直播。銀雞一吹,終於結束長達四月的 周末比賽。 同樣獲得另一電視台拍攝的比賽,是記者聯 隊首次出戰明星足球隊。結果由身穿25號球衣的譚 校長十二碼球宴客,雙方握手言和。 不知不覺看了三年這些全男班比賽,仍然覺 得很過癮。常常想,有什麼能令這群波友寧願放棄 休息時間,一早來到跑馬地球場踢波?更奇怪是, 他們之中其實甚少是會員。 足球原來是蠻好的溝通工具!

Workshops, pandas and football for members 【Ben Kwok ‧ Convenor, Membership, Training and Welfare Sub-committee】 I am pleased to report that we arranged the following activities during the past year.

In December we organised a series of workshops aimed at highlighting two of the most important stories of the year namely the financial crisis and the Sichuan Earthquake for members.

On February 7th a group of more than 40 members and friends spent a day at Ocean Park visiting panda Ying Ying and Le Le watching dolphin shows and a presentation of how Hong Kong’s largest theme park had been transformed into a success story. Ocean Park Chief Executive Tom Mehrmann hosted a lunch at the Bayview restaurant.

On November 29th, a group of journalists, Cheung Chui Yung, Lui Ping Kuen, Poon Siu To, Choi Chi Yuk, Lam Yu Cheung and Ho Kit Ling shared their experience at the front line reporting the Sichuan Earthquake and other great breaking news. More than 40 people attended. On December 6th Hong Kong Economic Journal chief writer Joseph Lian Ming Pao assistant chief editor Ernest Chi and former SFC lawyer Laurence Li spoke on the Financial Tsunami. More than 40 people attended. On December 20th the ICAC gave us a talk on ethics and corruption. 12 representatives of major media organisations attended. The first two workshops were sponsored by the International Federation of Journalists to which we are affiliated.

4) Membership The No.1 issue of most concern to our members is job security. Under the financial crisis almost all major media outlets resorted to cost-cutting measures that included staff redundancy and pay cuts. In letters to every major media employer in December 2008 particularly those companies that are still making money, we urged leniency in treating the news practitioners We also reminded our members that they were entitled to a three-month unemployment subsidy of HK$3,000 if they were out of job for three months. To allow our members more job opportunities we are about to launch a freelancer directory for our members to post their own curriculum vitae and other relevant information about themselves on our website. We are also exploring ways to conduct an industry survey aimed at improving the health of our news practitioners. We have currently around 400 members. 今年,至少16名新聞工作者在世界各 地被殺害。這數據肯定還會上升,殺害新 聞工作者將成為愈來愈多國家政權的”運 動”。菲律賓在這方面已連年領先,尼泊爾 亦在快速追上。近年的數據如下:2008年 70宗;2007年95宗;2006年110宗;2005年 58宗;2004年72宗。 新聞工作者已成為高危人種,因此是香 港記者協會當有需要或被邀請時,一直聯同 國際記者聯會及其他友會譴責對新聞工作者 的殺害。 香港記者協會在前主席胡麗雲成為國際 記者聯會的中港聯絡人後,與國際記者聯會 的合作關係更加密切。 國際記者聯會的亞太區總裁Jacqueline Park與及國際記者聯會的執委成員 Christopher Warren 也在不少工作坊上給予 同業在這課題上提供更寬廣視野。 去年十月,亞洲記者聯會在韓國首爾舉 行會議,三位記者會員包括前主席張炳玲、 今屆執委唐納德 及岑亞志參與了由國際記

Journalists becoming an endangered species? 【Jackie Sam ‧ Convener, International Relations】

At least 16 journalists have been killed worldwide so far this year. The figure will definitely rise: killing newsmen is fast becoming a “sport” of the political class in a growing number of countries. In our corner of the world the Philippines has been consistently in the lead, with Nepal rapidly catching up. The figures in recent years: 2008: 70; 2007: 95; 2006: 110; 2005: 58 and 2004:72. Journalists may yet become an endangered species, which is why, whenever necessary or called upon, HKJA has joined the International Federation of Journalists (IFJ) and other fraternal organizations to condemn such murders. HKJA has worked more closely with IFJ on these and other issues of late, especially after IFJ’s appointment of our former chairman Serenade Woo Lai Wan as its Hong Kong-China co-ordinator. IFJ regional director Jacqueline Park and IFJ Executive Committee member Christopher Warren have also contributed a lot to a widening of perspectives among our members through these workshops. During last October ’s Asia Journalists’ Association meeting in Seoul, South Korea, three of our members – a former chairman Cheung Ping-ling, ExCom members Donald Gaspar and Jackie Sam – joined an IFJ-organised demonstration at the YTN in support of the television station’s staff campaign for editorial independence.

The YTN campaign ended with an amicable settlement only in March this year. Incidentally this was the last AJA liaised directly with journalists’ associations to select delegates. To avoid entanglements in regional politics, AJA is in the process of setting up its own chapters in all Asian countries and territories. It was at this meeting that feelers were received from the East-West Centre for a joint effort with HKJA to host an international media conference in March 2010 in Hong Kong. The Centre had held its first such meeting in Bangkok in January 2008 on “Changing Dynamics in the Asia-Pacific: Power Politics, Economic Might, Media Challenges.” A meeting was subsequently held between Susan Kreifels, Media Programs Coordinator of the Centre, and HKJA chairman Tam Chi-keung. Further discussions are expected. Our International Relations team is made up of King Cheng, Stanley Leung Kam Hung, Don Gasper and Jackie Sam.

為中國的新聞自由奮鬥 【譚志強‧中國關注小組召集人】

自二零零九年一月開始,中國有關部門 便以「反粗俗」、「反色情」之類的理由, 對互聯網上的訊息進行審查,勒令關閉許多 著名的網站,嚴厲地限制中國內地的言論及 新聞自由。

本港新聞界的基本採訪需要(特別是涉及中 國內地大型突發性新聞的採訪),而且有關 部門也可能通過某些行政手段,如拒絕發 證、延遲發證等等,干擾本港記者在中國內 地的正常採訪活動。

最近幾年以來,部分中國內地網絡傳媒 的確出現某些不健康的內容。但是,本會認 為,如果中國政府希望改善這些不良現象, 絕非執行一些犧牲言論及新聞自由的行政措 施去達成。

二零零八年十月十七日,本會己發表聲 明,促使中國有關當局應該:

二月,國務院香港澳門事務辦公室頒布 《香港澳門記者在內地採訪辦法》,其第五 條表示:「香港和澳門記者來內地採訪,需 向中央人民政府駐香港特別行政區聯絡辦公 室或中央人民政府駐澳門特別行政區聯絡辦 公室領取中華全國新聞工作者協會製發的港 澳記者採訪證」,對港澳記者加以比北京奧 運會期間更多的採訪限制。

(2)把上述規定的實施對象擴大至內 地新聞工作者;

北京奧運會期間,港澳記者在中國內地 採訪並不需要事先『申請』領取採訪證。 本會認為,到中國內地採訪必須事先 『申請』領取採訪證的規定,不但不能滿足

(1)無限期延長中央在奧運期間針對 港澳台記者實施的採訪規定;

(3)把有關政策,加強對各省市的宣 傳,使有關政策得到全面落實; (4)停止壓迫協助記者採訪的新聞助 理人員、消息人士和市民。 今日,我們的立場未有改變。


Fighting for press freedom on the Mainland 【Dr. Tam Chi-keung, Camoes ‧ Convener, China Concern Sub-Committee】

Since January the Central Government has been using the excuse of “anti-vulgarity” and “antipornography” to censor messages on the internet in Mainland China, ordering many well-known websites to close. This has severely restrained freedom of expression and freedom of the press in Mainland China. It is true that in recent years some Chinese websites have been awash in un-healthy content. H o w e v e r, H K J A i n s i s t s t h a t i f t h e C h i n e s e government wishes to clean up this undesirable phenomenon, the most effective way is not to execute some unreasonable administrative measures which will severely harm the freedom of expression and freedom of press.

HKJA considers that if a journalist going to the Mainland for interviews has to obtain prior accreditation, it will not only fail to meet the basic needs of HK media industry (especially in covering Mainland China's major breaking news), but may also be interfered with by certain authorities’ administrative measures, for example, refusal or delay in issuing the press card, even though our local journalists have been covering news in Mainland China without such requirements or hindrance. On Oct 17 of 2008 HKJA urged the Central Government to widen press freedom in the following ways: 1. E x t e n d i n g t h e S p e c i a l R e p o r t i n g Regulations during the Beijing Olympic Games to Hong Kong, Macau and Taiwan journalists indefinitely;

In February the Hong Kong and Macao Affairs Office of the State Council promulgated the “Interview Regulations for the Hong Kong and Macau Journalists in China Inland”. The 5th Article of these regulations stated: “When Hong Kong and Macau journalists go to mainland China for interviews they must take a Hong Kong and Macau Journalists Press Card, issued by the All-China Journalists Association, from the Central People's Government Liaison Office in Hong Kong Special Administrative Region or the Central People's Government Liaison Office in Macao.” Compared with the Beijing Olympic Games period, this requirement has imposed more restrictions on the Hong Kong and Macao journalists.

2. Extending these regulations to the local journalists in Mainland China; 3. Disseminating to and educating the local officials about these regulations to ensure full implementation of the regulations; 4. Stopping oppressing media assistants, sources and citizens who assist the journalists in their reporting. Our stand remains the same.

During Beijing Olympic Games period, HK and Macau journalists go to the Mainland for an interview did not need any prior accreditation.

我們是否認真看待專業守則? 【梁麗娟‧操守委員會成員】

2008年在國內及香港都爆發了不少轟 動的新聞事件,卻較少涉及令公眾嘩然的嚴 重違反新聞操守的行為。去年公眾對傳媒 的投訴有所下降,操守委員會一共收到55 宗投訴,表面數字比2007/08年度的22宗 上升。但實際涉及的案數卻是減少了,因為 前年22個投訴中,實際涉及6件不同事件, 但今年的55宗投訴,其實只涉及5個不同事 件,主要與侵犯私隱與失實報道有關。 首宗投訴有牙科醫生投訴幾份報章法 庭版報道失實,但為免妨礙司法公正,操守 委員會未能處理;另一宗涉及有國內宗教人 士投訴於2006年受本地《東周刊》記者誤 導,我們嘗試就事件向《東周刊》了解,但 未獲對方回應,而單靠投訴者提供的表面資 料亦未足夠成立專案小組調查事件,決定對 投訴不作處理。 另有一宗投訴涉及無線電視6點半新 聞,就一則消費者委員會調查報告的新聞報 道手法提出質疑,認為報道不公及失實,委 員會比較無線與報章的報道後,認為無線未 有違反專業操守,裁決投訴不成立。 另一宗投訴《蘋果日報》於二零零九年 一月二十四日A4版的報道,不必要地訪問 及間接傷害落馬州六死車禍其中一名死者湯 偉明的一對年幼子女,操守委員會經調查後 裁決投訴成立。 投訴成立這個案件由於涉及兒童的私 隱,委員會認為傳媒報道涉及兒童私生活

的題材時, 必須要有合 理理由;而 新聞從業員 應 以 正 當 手段取得消 息、照片及 插圖。而記 者在拍攝意 外事件時, 應顧及受害 人及其家屬 的感受,盡 量對他們的 心理影響及傷害減到最低。 此外,記協亦在零九年三月期間收到至 少50個有關電視廣播《志雲飯局》訪問鍾 欣桐的投訴,主要批評節目為鍾欣桐復出造 勢,由於投訴欠缺理據,因此委員會未有處 理。55個總投訴中,實際涉及宗數為5宗。 其中三宗為不作處理,一宗投訴不成立,最 後一個案投訴成立。 整體而言,本會近年錄得的投訴案件數 字下降,卻不一定表示本地新聞媒體專業操 守有所改善,更令人擔心的是公眾對新聞媒 體的監察可能已經失去動力。至於有些被投 訴的新聞機構對本會去信詢問時不作回應, 亦令人懷疑有關新聞機構是否有誠意正視 操守問題。若市民因成效不彰而缺乏監察興 趣,會否造成傳媒操守下滑的惡性循環?

Are we sincere about ethics? 【Grace Leung ‧ Member, Ethics Committee】

2008 saw a lot of major newsbreaks in Hong Kong and China. However, the public notices less serious violations of professional code of ethics. So far such complaints seem to be on the decrease. The Ethics Committee received 55 complaints about unethical practices, less than in 2007-2008. Even these 55 complaints referred to only five incidents and they concerned disclosure of private information and inaccurate reporting. In the previous year there six cases drew 22 complaints. One of the complaints was made by a dentist against the reporting of legal proceedings news by several major newspapers. The issue remains subjudice so the Committee could not pursue the matter. Another complaint was lodged by a monk against the inaccuracy of a cover feature of East Week in 2006. The committee tried to seek a response from East Week but they have not done so. As the complainant could not provide sufficient information the committee had difficulty probing this matter and eventually decided against further action. Another complaint was against the TVB news reporting on the report of Consumer Council. After comparing with other reports, the committee found that TVB news did not violate the code of Ethics of HKJA. The reporting was not inaccurate or unfair. The committee decided the complaint was not substantiated. Another complaint was against Apple Daily’s reporting in its A4 page of 24th January 2009. It reported a serious accident in Lok Ma Chau in which six people were killed. Apple Daily interviewed the son and daughter of one of the victims. The committee agreed that this was an unnecessary intrusion into private grief and distress. The complaint was upheld. This substantiated complaint reports on the private live of children. The JA reminds journalists to observe HKJA’s Code of Ethics. The privacy of children should be handled with great care. Media

organisations must have fully adequate reasons before intruding into the private lives of children. Journalists should obtain information, photographs and illustrations through proper means. Photojournalists should be concerned about the feelings of victims and their families when taking photographs of accidents and their aftermath. Photojournalists should minimize if not avoid damage to and impacting on the feelings of the victims and their families. We have also received over 50 complaints against Pay TVB’s Be My Guest programme which interviewed Ms Gillian Chung with the aim of promoting her resumption of work in the entertainment industry. However, the committee found that all letters of complaint were completely identical except for the complainants’ names and the fans were merely creating controversies. The committee decided not to take up the case. In recent years, the number of complaints received by the HKJA has decreased. This cannot be due to less violations of professional code of ethics. We are concerned that the general public may simply have lost patience with media monitoring. As media outlets which had been complained against did not bother to reply to the enquiries from the union we doubt that these media outlets themselves are sincere about ethical practices. If the public loses patience with media monitoring due to lack of observable improvements will there not be a vicious cycle resulting in even further decline in media ethics?
