Support for the Human ²ç³ÏóáõÃÛáõÝ Ø³ñ¹áõ Çñ³íáõÝùÝ»ñÇ Rights Defender’s Office å³ßïå³ÝÇ ·ñ³ë»ÝÛ³ÏÇÝ The Human Rights Defender of Armenia, Karen Andreasyan comments on some of the points of EU-Armenia cooperation in the sphere of human rights.

What are the main areas of cooperation between the Defender’s office and the EU? - Within EU-Armenia cooperation I attach particular importance to the fact that European institutions are not only critical, but also patiently offer systematic solutions. Financial, professional and technical assistance to the Office promotes improvement in the area of human rights in Armenia.

The Ombudsman’s Office as a national preventive mechanism against torture and violence - With support of the EU a Torture Prevention Expert Council has been established, which has assisted the Defender’s Office for three years, conducting research and monitoring all closed institutions of Armenia where people might suffer from torture and/or violence. As a result, we have taken a positive and significant step forward: appropriate professional potential has been recognised by the Defender’s Office and is evolving, represented by staff and NGO volunteers who will replace the Expert Council founded by the EU.

Support by the EU Advisory Group - The EU Advisory Group significantly helps the Defender’s Office to perform its duties. We have a professional expert helping us strengthen the institution in accordance with the Paris Principles, organise internal management and other processes. With the active intervention of experts of the EU Advisory Group, the Strategy of the Armenian Human Rights Defender’s Office for 20112017 has been developed. The EU also places emphasis on cooperation with public sector. In this regard, we have achieved good cooperation: a large conference has been organised with financial support of the EU, dedicated to the cooperation between the Ombudsman and non-governmental organisations dealing with human rights protection issues in a number

Expected collaboration - From January 2012 a new EU supported project has been planned, the aim of which is to give assistance to all beneficiaries of the electoral process, in case the rights of any person were violated during the election campaign, on election day or later. A hotline will be in operation and mobile ambulance will be deployed anywhere there might be a problem. Within the scope of the same project, several offices in the regions are expected to open to expand the presence of the Ombudsman geographically and make human rights protection more widely available.

Philippe Lefort:

“The South Caucasus is an important region for the EU” On 7 September the EUSR for the South Caucasus and the Crisis in Georgia, Philippe Lefort, visited Armenia. Lefort started his duties on 1 September and came to Yerevan as part of his first visit to the region. During a press conference with Minister of Foreign Affairs Edward Nalbandian, Lefort mentioned that the South Caucasus had great potential for further development thanks to its economic and cultural strength. He also reconfirmed EU support for the establishment of peace and stability in the region. The Nagorno-Karabakh conflict remained one of the main topics for future discussion. Lefort highlighted the need for a peaceful negotiation process between Armenia and Azerbaijan, emphasising the importance of the OSCE Minsk Group. Nalbandian stressed Armenia also wished to reach  a peaceful settlement.

EU Advisory Group supports reforms On 28 June 2011 the 6th EU Advisory Group Board meeting took place in Yerevan. The EU Advisory Group, represented by Team Leader Antti Hartikainen, presented its Quarterly Report and Work Plan for the period of June 2011-May 2012. The meeting was opened by Secretary of the Armenian National Security Council Artur Baghdasaryan. He stressed the importance of the Advisory Group’s contribution to reform processes in Armenia in the fields of the economy, law, human rights and institutional issues. The Board took note of the Needs Assessment Report, analysing gaps between the current and desired situation.

Initiatives taken towards establishing a mobility partnership, as well as future negotiations over EUArmenia visa facilitation and a readmission agreement, were welcomed. Ambassador Raul de Luzenberger stressed that the EU and Armenia had entered a new stage in their relations through the Association Agreement. “The Advisory Group will continue providing tailormade policy advice to support the development of this increasingly close relationship. The EU is ready to support Armenia in pushing forward reforms linked to AA negotiations and to the fulfilment of its national priorities”, said the Ambassador.

Reducing child labour Under the aegis of an EU-funded project, which aims to reduce and, in some instances, wholly eliminate the use of child labour, a discussion on problems in the Armenian private sector was held on 14 June in Yerevan. While participants agreed it was better for children to learn instead of work, they saw a key difficulty in establishing whether a child were employed or not. The specifics of labour regulations for children under 16 years of age were presented by Tadevos Avetisyan, the Head of the Labour and Employment Department of the Ministry of Labour and Social Affairs of Armenia. He said that Armenia appeared to be dealing with this problem better than many other developing countries, mostly because the Armenian mentality refused to accept the exploitation of children. However, much work would have to be done before the end of the year, he added. One of the recent developments was a Code of Conduct for Employers, which was not a legal requirement, but desirable to follow. The project is financed by the European Union and implemented by the Centre of Socio-Economic Research (CSERA). It will run until the end of 2011.

On 31 May 2011 an international conference marking the tenth anniversary of the Stockholm Convention on persistent organic pollutants (POPs) took place in Tsaghkadzor.The results of the EU funded project “Scaling up experience in improvement of chemical safety to contribute to poverty reduction in rural Armenia” were also presented. International and national experts, together with government and civil society representatives, discussed threats to and solutions for environmental protection. While pointing out the main hotspots polluted by POPs, including the chemical waste site in Nubarashen, Yerevan, the conference participants attested that the pending issues could be solved through interaction between governmental bodies, experts and NGOs. “This conference is not only devoted to environmental threats”, said Jean Christophe Gayrand, the Head of Operations of the EU Delegation to Armenia, “but it is also a platform to establish a wide range of agricultural programmes which could be carried out together as international projects. Our colleagues from the Czech Republic, Ukraine and Belarus can assist jointly in work and research”. This project is part of the efforts to help Armenia implement the Stockholm Convention, a global treaty to protect human health and the environment from highly dangerous chemicals and bring about sustainable solutions through the close cooperation of NGOs, governmental bodies and experts in the field. The conference was organised by the Arnika Association from the Czech Republic and the Armenian Women for Health and a Healthy Environment NGO, with financial support from the European Union and the OSCE Office in Yerevan.

On 7 June 2011 the Turn Around Management and Business Advisory Service (TAM/BAS) programmes of the European Bank for Reconstruction and Development (EBRD) officially started in Yerevan. The EU has pledged an additional €5 million to support TAM/BAS programmes, which provide micro, small and medium enterprises (SMEs) with direct assistance from business advisors and consultants, adapting them to the demands of a market economy. These funds should allow the implementation of at least 30 TAM and 500 BAS programmes in the region. The funds are earmarked for use in the Eastern Partnership countries: Armenia, Azerbaijan, Belarus, Georgia, Moldova and Ukraine. The TAM and BAS supported projects bring best business standards and improve SME management skills like planning, production, quality control and marketing, thereby making them more competitive and able to attract external financing.

Promoting European Media Standards The EU and the Council of Europe (CoE) launched a joint project on “Promoting media freedom, professionalism and pluralism in the South Caucasus and Moldova” on 17 June. The project aims to support the development of legal and institutional guarantees for freedom of expression, high quality journalism and a pluralistic media landscape in line with European standards. It is co-funded by the EU and CoE with a total budget of €1.1 m. Leila Dervishagich from the CoE said at a press-conference in Yerevan that the project had been launched in January 2011 and would last two years, during which more than 20 events would be organised. “The EU and the Council of Europe

are also ready to provide consulting and other support to Armenia in the future,” Dervishagich said. JeanChristophe Gayrand, representing the EU Delegation to Armenia, stated that freedom and pluralism of the media were key to the democratic development in Armenia. Among the activities supported by the programme are the improvement of the implementation of media regulatory frameworks in line with CoE standards, better understanding among journalists of their rights and ethical rules, support for public service broadcasters to improve professionalism and better gain the trust of political leaders, civil society, media professionals and the general public.

Smoother, safer and more reliable: Renewed transport cooperation

The European Commission on 7 July published a new Neighbourhood Transport Action Plan to strengthen links with neighbouring regions to the East and South of the EU. The plan proposes more than 20 concrete measures to make transport connections smoother, safer and more reliable. At the same time, it will deepen market integration to the advantage of both the EU and its neighbouring regions. Transport cooperation with the EU’s neighbouring regions has so far taken place under a number of bilateral and regional initiatives. This new action plan builds on the results achieved so far, strengthens in particular connections to the east and brings together regional transport cooperation into a single policy. Key measures for connecting the transport systems of the EU and its neighbours include: Extending the EU’s internal aviation market and Single European Sky to neighbouring regions; Joining up the TransEuropean Transport Network with infrastructure of the EU’s

neighbours through priority transport projects; Making better use of rail freight potential by opening markets and by alleviating technical barriers such as differences in rail gauge sizes; Streamlining the implementation of regional transport cooperation, by establishing an Eastern Partnership Transport Panel to oversee cooperation with neighbours to the east; Making sea transport with neighbouring countries more efficient, including in the longer term, through their inclusion in the “Blue Belt” of free maritime movement in and around Europe; Helping neighbouring countries to improve road safety. Improving transport connections and promoting a safe, secure and environmentally friendly transport system can help EU neighbours to become economically stronger and politically more stable. Actions up to 2013 will be financed with existing resources through better prioritisation of projects and measures.
