Darlings, Even though it seems that all’s quiet on the real-estate front, there are still some interesting things going on. First of all, sales are up. But you can always get that info from your own Realtor’s newsletter, as well as Rey Post’s “All Things Real Estate” and Alan Ball’s real estate blog, so I’d rather focus on more obscure facts. A flurry of activity occurred when the Tierra Team (Kurt and Erik Faust and Keith Gorges) joined Sotheby’s last month. Prior to that, they were (and still are) well-known as the design/build company Tierra Concepts, and they are legendary for being 4-time winners of the Grand Hacienda Award in Santa Fe’s Parade of Homes. Nothing obscure about that, but did you know that the Fausts and Keith met on the Ultimate Frisbee Team 23 years ago and have been friends and business partners ever since? And were you aware that Keith Gorges was spotted in a Speedo three times within this last year? Okay, Possums, so it was during the three triathlons he participated in, and he didn’t wear one during the four half-marathons he ran. Sweethearts (Oops, if the FBI started reading my column, would they consider that too “flirtatious?”), I have to work so hard to track down news that you can really use. I caught up with Jama Fontaine the other day to find out what possessed her to come out of early retirement and become the new CEO and team leader

of Keller Williams Santa Fe. Prior to her move to Santa Fe, she had been a Realtor with KW in Albuquerque for 10 years (a Mega Agent at that), and in 2008 — at age 50 — she left to travel the world. Which she did. What she discovered: there’s no place in the world like New Mexico, so Jama came “home.” Her next decision was to return to her career of choice: real estate. Two days later, KW International called her and offered her this position. Her conclusion: Divine Providence was guiding her. (Kittens, I must call her back and get DP’s number… I need help.) Butter Beans, if you missed the 10th Anniversary Gala for Francis Phillips, Michael Piotti, Jane Burns, and Denise DuPont of First Choice Loan Services, Inc., I’m sorry for you. All Francis really wanted to do was give a big thank-you to Santa Fe for 10 great years in the lending business, but he kind of outdid himself. Well, maybe not: he and Michael are always good for pretty outrageous parties. Stellar performances by Tina Turner aka “Hot Chocolate” aka Larry Edwards from Las Vegas (NV, not NM) and Miss Richfield 1981 from Provincetown were the icing on the cake. No, Dear Readers, I’m wrong. They were the cake. The drinks, appetizers, and camaraderie were the icing. I asked Francis if he and his gang would celebrate their next 10th anniversary early, like maybe next year. I swear, I can never get enough of Tina. Another milestone was celebrated this

year. Candy Brenton marked her 25th year as marketing director for Santa Fe Properties. Cupcakes, it was a quiet, under-theradar celebration, because Wally Sargent didn’t want the government to think he’d violated the child labor laws back then by hiring a 12-year-old to work a full 40-hour week. At least I think that’s why Candy is only 37 today. Am I right, Candy dearest? Speaking of Wally, he and his devoted wife, Louanne (a little poetic license), returned the middle of last month from their Montreal-to-South Florida Atlantic cruise on their favorite liner, the Regent Seven Seas. (This is their 12th cruise on this line in the last 10 years!) They got to New York on the tail end of Sandy, so the harbor was off limits. A different view than they had expected. Cranberries, I try very hard to never get too serious when I’m writing to you, but today I can’t sign off without mentioning the hole in my heart left by the passing of two colleagues. Bob Chernock (Sotheby’s) died Oct. 31, age 62, while waiting in vain for a liver transplant. Bob was a character whom you could love and hate simultaneously, BUT he never failed you as a loyal and generous friend. Mark Raddin (Santa Fe Properties) died Oct. 5 after an eight-year battle with cancer. His brief 58 years here on earth were filled with optimism, generosity, kindness, and love for everyone whose lives he touched. I am a richer person for knowing both these men, but sadder because they’re gone. So long, Sweetpeas. Have a Merry Christmas. In his biography at artesanos.com, Leopoldo “Polo” Gómez is described as embodying “a classic Mexican success story.” Born and raised in a mountain village in Oaxaca, Mexico, he worked with Tony Taylor at the Old Mexico Shop (1927-2009) for more than 15 years before establishing his own firm, Artesanos, in 1965. Gómez built a very successful, now even renowned, import business in part because of relationships with architectbuilder William Lumpkins, Rancho Encantado founder Betty Egan, and art collector Alexander Girard. His customers and acquaintances over the years have included Georgia O’Keeffe, Ethel Kennedy, Truman Capote, Jane Fonda, and Jessica Lange. We were shown around the amazingly well-stocked showroom at 1414 Maclovia Street one recent day by the founder’s son, Fernando Gómez. “Some of our light designs are the same since the Sixties and we have 30 or 40 that are newer,” he said. All are made in Mexico and have UL-certified wiring by an Albuquerque contractor. Materials are stamped tin, with a variety of patinas, and also brass. Among the great variety of lights are four sconces designed by Santa Clara Pueblo for its casino hotel in Española and made in San Miguel de Allende.

Form + Function, established in 1994, has a nifty showroom in Pacheco Park. There you’ll see a good spectrum of light designs and prices — at, or near, the top end is the wonderful, elegant Oh Mei Ma chandelier by Ingo Maurer. Composed of floating sections of hand-made paper coated with gold or silver leaf, it retails at a little bit less than $9,000. “We really work with people’s budgets and we’ve been in business so long we know what’s out there,” owner Lette Birn emphasized. She said business slowed down tremendously in line with the home-construction downturn, but it’s picking up. And remodeling has proven a godsend. “If people stay put and they want to change and make the space nicer, there is a lot you can do with lighting. People often spend a lot of money on remodeling the kitchen but then they can’t see what they’ve done. You spend $5,000 for granite countertops and you might say that there’s a lot of wonderful natural light, but when do you entertain? At night. If you have the correct type of lighting, you can really make them pop. I run into this all the time. Everything is so beautiful now, but don’t you want to show it? And it’s amazing how the new bulbs can bring out color.”

Owner Roberto Machado, a native Argentinian, started Alchemy Lights 15 years ago. Located on Avenger Way on the south side of town, this is a wholesale business dealing with lighting showrooms around the United States — including Form + Function, Dahl Lighting Showroom, and Allbright & Lockwood in Santa Fe — as well as with architects and interior designers in the Southwest. Like the ancient alchemists who sought to turn base metal into gold, the artisans at Alchemy Lights transform sheets of copper, tin, stainless steel, brass, and aluminum into magnificent and unique works of art, according to a statement at alchemylights.com. “It was crazy in 2005 to 2007; we were working all night,” Machado said. “Business slowed down, but 2011 was good and this year is even better. All our lights are made here, made in the USA, but it is hard to keep up with all the taxes and UL certifications. We have to pay a UL inspector $700 several times a year.” Alchemy fabricates a gleaming selection of sconces, pendants, vanities, and mirrors in many designs. Recent customers included a pair of new hotels in St. George, Utah, which ordered about 300 lights each.

When we met at Firefly Lighting & Ironwork in Cuyamungué, owner John Zubchenok was just back from a meeting with the Drury Southwest team, which is converting the old St. Vincent Hospital into a hotel. Firefly will do the hotel’s exterior sconces as well as a chandelier for the lobby that incorporates numerous colored glass pendants. “Whenever we use glass, we always use local handcrafted glass from Prairie Dog Glass at Jackalope,” he pointed out. Another recent client was Hotel Chimayó in downtown Santa Fe, and Firefly is doing lighting for Homewise’s new Piñon Ridge development at Las Estrellas. For that, the company is focusing on innovative recycled product: sconces from coffee cans. “This is our 16th year and everything is made here in our studio by people who have been with us a long time,” Zubchenok said. “We use Old World techniques; we hand-forge our lights and they’re made one at a time, with pride and craftsmanship. “I’m really trying to create warm ambience with function for our clients. I feel like I’m part of a renaissance in small, Arts and Crafts manufacturing that this country needs.” HOME

Glorious Frank Rand estate for sale The home of one-time Santa Fe New Mexican owner Frank C. Rand and his wife, Adele L. Rand, is on the market. Located near the end of Camino de las Animas (a few houses beyond the abode built by artist Gustave Baumann in 1923), this is a classic Santa Fe estate that has been in the same family for many decades. Frank Rand, a graduate of the Los Alamos Ranch School, owned The New Mexican from 1940 to 1948, when it was sold to Robert McKinney, father of the paper’s current owner, Robin McKinney Martin. Rand built The New Mexican’s quarters on Marcy Street. In 1947, he started a radio station, KTRC, and built the tower and Radio Plaza building next door to The New Mexican. In a 2003 interview, longtime station manager Bill Hanrahan said KTRC stood for “Keep the Rand Circulating.” It is thought the Rands had the main house built in the 1930s (then had John Gaw Meem design a living-room addition in the 1940s), but it was preceded by today’s guest house, built in the 1920s. Mrs. Rand preferred a New York decorative style and outfitted her new home with antiques from New York City, where the couple maintained an apartment. The house on Camino de las Animas includes some stunning Art Deco lighting and furniture, including several custom card tables. This dazzlingly different style in Santa Fe has been maintained by the Rands’ granddaughter, Santa Fe native Joan Macfarlane, who now lives in San Diego and has kept this as a second home.

The main house, mostly adobe, is approximately 4,000 square feet, with five bedrooms, five fireplaces, and five bathrooms. The living room has wall-to-wall carpeting, blue-painted walls, and stately draperies on the windows. The old living room, now a parlor, boasts carved wooden valances over the windows. The house is filled with wonderful details like hand-painted panels inside a hallway linen closet and, in the master bathroom, painted crown art continued along a custom-made wooden window valance. “It’s from a bygone era,” said Realtor Marilyn Foss. A richly wallpapered sunroom looks out to the parklike rear yard. But the wall covering in the formal dining room is the real standout: it’s Chinese silk. The master bedroom and two guest bedrooms are on the main level; upstairs, there is a library with a fireplace, and two more bedrooms. The utilitarian quality of the kitchen is a contrast, and an evidence that this was the domain of the help, not of the owners. Eminenently and solidly practical, the two-room kitchen is filled with dozens of white Republic Steel cabinets and formica countertops — except for a small area around the Wolf cooktop/oven, which is outfitted with granite tops. The guest house is more Santa Fe Style, complete with viga ceilings. The three-bedroom guest house, also mostly adobe construction, is about 2,800 square feet. It is heated by hotwater radiators, like the main house, and has two fireplaces.

Yes, the end is near It is the single most anticipated event of our time. Respected authorities from every walk of life have predicted it and now there is insurmountable evidence that the end is near. That’s right, the end of the housing market collapse appears to finally be here and we can all find comfort in signs that the housing market, which began its historic downturn in July of 2006, is finally coming back to life. The first sign that the end is here is the stability of the financial sector and their ability to provide liquidity to the housing market. With a variety of measures taken by Congress and a restructuring of the nation’s banks, the ability of creditworthy homebuyers to get a mortgage has improved greatly. With artificially low mortgage rates between 3 and 4 percent, it has now become less expensive to own a house than it is to rent, making home ownership once again the financially wise choice. In November, mortgage bankers reported a national de-

cline in both mortgage delinquencies and foreclosures for the third quarter of 2011. This is great news for both home values and for families hit hard by the collapse of the financial and housing markets. The effect of this news will take a while to see here because New Mexico is a judicial foreclosure state. That means that foreclosures are processed through the courts and the amount of time involved in the foreclosure process is lengthy so banks are still working through a huge backlog of vacant properties that have been sitting in limbo for many years. Another important sign that the end is near is the national increase in sales volume and with it a slight rise in home values. Industry researcher Core Logic reported a 5 percent increase in year-overyear comparisons between September 2011 and September 2012. This represents the largest single increase since July 2006. With increased sales and historically low levels of new construction, inven-

tory levels are coming down rapidly and those conditions will soon create market equilibrium. The most important factor of all is psychological. Everything can be going great but if people do not have confidence in the country, morale will be low and the economy will suffer. Without the belief that tomorrow will be better than today, consumers are less likely to make long-term investments like housing. Last month, the Consumer Conference Board reported that the index rose to 72.2, which is the highest level since February of 2008. We know that we are not the first to predict that the end is near. There are those that predict the world will end in December based on their knowledge of the Mayan Calendar. There are those in Congress that predict the country will go off the “fiscal cliff ” and take all of us with them. But even those focused on the apocalypse, fiscal calamity, or even on

Antique Warehouse celebrating 20th

By Paul Weideman undreds of beautiful, vintage doors and furniture pieces from Mexico fill the cavernous rooms at Antique Warehouse, now celebrating its 20th year in business in Santa Fe. Betty Kaye Gilmore and Michele Graveline established the business on Aztec Street in December 1992. For the past 17 years, the two — who grew up together in Deming and were in the same class in school — have operated out of nearly 9,000 square feet at 530 South Guadalupe Street in the Santa Fe Railyard. “When we started, we didn’t have as many doors,” Gilmore said, “but we’ve always had the same basics: doors, tables, benches, trunks. People love the trunks. They’re easy to use for so many things and they look great.” The vast selection of doors date from the early 1800s to the early 1900s. The majority are mesquite — a hard, dense, insect-resistant wood — so they’re good both indoors and outdoors. There are also some that are made of sabino (Mexican cypress) and pine. “Most of them are the paneled look with the clavos or hand-forged nailheads, and most come in sets, but we also have singles that tend to be gates.” Once in a while at Antique Warehouse you come upon a piece that’s decoratively carved or painted, but the owners prefer the more rustic, natural wood doors and furniture, typically assembled using solid mortise-and-tenon joinery. “The earliest functional pieces, which were mainly tables and benches, tended to have more ornate carving,” according to descriptions at antiquewarehouse-santafe.com. “As styles evolved, attempts were often made to mimic the styles in vogue in Europe and featured more prominent design appliques. Moving from the cities of Mexico to the countryside, the designs became more basic—to simple square legs and very little carving.” The Mexican ranch-style furniture found its way into

homes in Santa Fe long ago because the pieces integrated well with the city’s casual lifestyle and the look and colors of the adobe architecture. “We have worked on tons of houses with architects and designers and contractors,” Gilmore said. “Often if it’s contractors and architects we see them early in the process for sizing doors.” Some of the doors are quite tall, and some of those have normal-size doors within them. Many of the largest doors once provided entrance to sizeable haciendas and government buildings. The business also stocks shorter and smaller doors that can be used for linen closets, entertainment centers, or to make headboards for beds. A long, ramped hallway is lined on both sides with scads of narrow, paired doors and wooden shutters. In one corner is a collection of old iron gates and grilles, available for a more decorative architectural look. You will sometimes run into new pieces, like the nesting side tables of hammered copper and wood. “In the old days we didn’t worry so much about accessories because it was mainly architectural pieces, but we’re selling more furniture and accessories in this day and age,” Graveline said. Now they carry large, colorful Talavera jars;

armadillos carved out of onyx; and beautiful hand-beaded eggs by the Huichol Indians of Nayarit, Mexico. There are also desks, small stools, saddle seats, tortilla presses, wooden boxes, and donkey pads. “These look great on the wall,” Graveline said. “One California designer used these saddles, upside down on a barn wall for coat hooks.” There is a collection of large, wooden morteros — mortars that were used with pestles (manos) to grind coffee and grains. People who buy these use them as planters, maybe a drink cooler, a magazine bin. The morteros are from Mexico, as is everything in the shop. “We don’t do manufacturing,” Gilmore said. “All of our doors are old. But there are exceptions. We use old doors to make dining tables and gates to make coffee tables.” Many of these boast handsome clavos and wonderful black-steel straps. One has decorative, stamped-steel banding inset around the side edges. “Here are some benches where we’ve found really wonderful planks and we add new legs,” she pointed out. “We have a workshop in Guadelajara.” The selection of wooden benches tends toward the very substantial. “A lot of our furniture is heftier because it is the old ranch furniture: more rustic wood than the more refined,” Gilmore said. “What we carry is more about the character and beauty of the wood, so we have a lot of gorgeous mesquite. Many of these benches come from ranches, haciendas, and government buildings, as well.” One really big one — almost 17 feet long — is made of sabino, a wood with a gorgeous butterscotch color. It’s made of single planks for the back, seat and foot rest, and is one of the more expensive pieces: $14,000. “It is from the colonial era, one of a kind,” Graveline said. “A lot of the colonials pieces from Mexico mostly are already with collectors and if we’re lucky enough to find them, we’re dealing with people who know what they are.” How much is known about where such pieces came from? Is it a matter of provenance, as with art antiquities? “No, we might just know what state it came from,” she said. “Maybe that it came from a hacienda in San Luis Potosí, but usually not more than that.” Antique Warehouse is one of Santa Fe’s success stories, lasting through the recent recession. “The last few years have been a challenge, since we’re directly tied to the building industry,” Gilmore said. “We are cautiously optimistic about the future.”

Think beyond irrigation season The metric for comparison of municipal water usage is GPCD — gallons per capita per day — which represents the total amount of water produced divided by the population the water utility serves. Without question, among comparably sized cities in the western U.S., Santa Fe is an exemplary leader in water conservation and we have a right to be proud of the efforts of Sangre de Cristo Water Division customers. But is difficult to say which city is the leader because of the variations in methodologies that are employed to calculate usage for cities outside New Mexico. The New Mexico Office of the State Engineer (OSE) has developed a standardized formula that, starting in 2010, cities must use to calculate GPCD. It includes all categories of use, including commercial, institutional, and even treated effluent. Santa Fe has some rather unique considerations in its calculations, such as the sale of treated water to Las Campanas and the estimate of the population served

outside the city limits. In recent years, the city has used the OSE methodology and has also done its own calculation. For 2011, both methodologies yielded a number of 107 GPCD. The calculation is broken down into several sectors, but single-family residential is the category to which most residents can relate. The average number is 76.2 GPCD, with a low of 47.65 GPCD in March and a peak of 114.54 GPCD in July. While many consumers would say that their household usage is well below the average, they are probably not accounting for the role of irrigation on an annualized basis. That our water use has stayed about the same in another year of drought is a tribute to the city’s overall efforts in water conservation. But let us not lose site of other factors that may impact our water supply: decreased flows in the Rio Grande may affect the Buckman Direct Diversion; fires may increase ash and sediment in the river; and there may be even more

“straws” in surface water (such as the Sipapu ski area proposal to exercise San Juan-Chama water rights to use for snowmaking). Some argue that the Rio Grande would have been dry in Albuquerque this summer were it not for the contribution of San Juan-Chama (Colorado River tributary) water. Anticipate more of the same and practice water conservation on a year-around basis! In April of this year, the City of Santa Fe set a policy to minimize or eliminate the use of emergency water restrictions. Even though we received even less precipitation in 2012 than 2011, the only non-emergency restriction of residential and commercial irrigation is that outdoor watering between May 1 and October 31 is prohibited between 10 a.m. and 6 p.m. Fortunately, many residents believe that other restrictions (such as odd/even, depending on the last digit of your address) were still in effect. The Albuquerque Bernalillo County Water Utility Authority widely advertises its Water by the Num-

bers Program, which is recommended and not mandated by ordinance. I think that most residents of Santa Fe would react favorably to voluntary guidelines for water conservation. Short sale now - or taxes later I read constantly to keep up with the ever-changing mortgage industry. This month, I want to share some important, timely information about the tax consequences of short sales from my good friends at the Keeping Current Matters Blog. As the year winds down, we are getting more and more inquiries about the Mortgage Forgiveness Debt Relief Act of 2007 and whether or not it will be extended past its original expiration date of Dec. 31, 2012. This is important as people who are selling their home through a short sale may be faced with a tax liability if they don’t close by the aforementioned date. Here is the way the IRS explains the tax liability: If you borrow money from a commercial lender and the lender later cancels or forgives the debt, you may have to include the canceled amount in income for tax purposes, depending on the circumstances. When you borrowed the money, you were not required to include the loan 40

proceeds in income because you had an obligation to repay the lender. When that obligation is subsequently forgiven, the amount you received as loan proceeds is normally reportable as income because you no longer have an obligation to repay the lender. The lender is usually required to report the amount of the canceled debt to you and the IRS on a Form 1099-C, Cancellation of Debt. Here’s a very simplified example. You borrow $10,000 and default on the loan after paying back $2,000. If the lender is unable to collect the remaining debt from you, there is a cancelation of debt of $8,000, which generally is taxable income to you. What does the act accomplish? Let’s go back to the IRS for the explanation: normally, debt that is forgiven or canceled by a lender must be included as income on your tax return and is taxable. But the Mortgage Forgiveness Debt Relief Act allows you to exclude certain canceled debt on your principal residence from income.

Debt reduced through mortgage restructuring, as well as mortgage debt forgiven in connection with a foreclosure, qualifies for the relief. This relief also applies to most short sales. Therefore, the question of whether or not the act will be extended is crucial for anyone considering selling their house through the short-sale process. Will the act be extended past the end of the year? CNBC reported — the Senate Finance Committee passed a package of tax extenders right before the recess, including a one-year mortgage relief extension, but leadership in the House of Representatives has not figured out how it wants to handle these extenders. With the looming “fiscal cliff,” tax cuts are an increasingly tough sell. This particular extension does have bipartisan support, but that doesn’t always mean passage in Congress, especially around a presidential election. Without knowing whether the act will be extended, we suggest anyone consider-

A helical pier is comprised of a solid steel shaft with one or more helices attached. A helix is one pitch of screw; imagine a wood screw that instead of having a continuous thread, has only one full turn. The advantage of having individual helices is that, unlike an auger, the soil is not displaced. We screw the piers into the earth beneath a house using hydraulic equipment that can fit in very small spaces. Once in place, a bracket slides over the pier shaft and bolts to the footing. We can then use hydraulic jacks to transfer the load from the bad soils to the shaft of the pier. A pier every 8 feet or so along a concrete footing will support even the heaviest wall. Because piers are installed below grade, the appearance of your home is not altered.

Helical piers are self-engineering in that there is a proportional relationship between the torque it takes to install them (which we measure) and the load they will bear. Thus, if we achieve 5,500 foot pounds of torque at installation, the pier will bear 55,000 pounds of load.

Keeping it green for the holidays If you read my October article, you may have become inspired to do some seasonal decorating, using your back yard as a florist shop. Gathering crimson- and copper-hued leaves, collecting acorns and locust pods, and clipping red dogwood all made excellent choices for your autumn dining and mantle pieces, did they not? Now that those rich autumn colors are behind us, we are encouraged to re-visit

the garden for some winter holiday decorating accents, this time in a chile-sauce theme, where Christmas reds and greens are the top-ordered items. Even if you don’t celebrate Christmas,

Chanukkah or Boxing Day, bringing the outdoors inside can create a lush, foresty feel with evergreens smelling ever-sogood and looking designer chic if you know what to cut and how to display. With New Mexico’s surprising selection of evergreens, there is something for everybody, from Arizona cypresses and Austrian pines to Colorado blue spruces and ponderosa pines. Cutting branches from

these trees is easy; all you’ll need is a good pair of lops or clippers and access (note: permission!) to these beautiful trees. Thanks to the recent cold snap, there is little need to hydrate these cuttings before

using in arrangements. There are many ways to play with local evergreens. You can create beautiful swags to hang from windows and doors or make organic wreaths and garlands. The more varieties you add in, the fuller and more lush the look. When you find the perfect tree that is willing to sacrifice some branches to your decorating cause, just make sure to cut from the bottom or any area that is less visible. Also, be sure to inspect the branches so you don’t cart critters indoors. As a matter of fact, the colder the temperatures, the better chance anything on board has jumped ship, minus those ethereal epiphytes, like lichen and moss. If you don’t have direct access to these splendid evergreens, you can find them in town at most nurseries and large retailers with garden centers, and there are also roadside stands that are starting to pop up around town selling Christmas trees, wreaths and garlands. If you want to make your own varieties, simply ask for the leftover clippings; you can usually get them cheap, if not free. After you gather your pines, you may want to add some leafless branches for height or drama; these can be found on most decidious trees and shrubs. Berries are the perfect finishing touch and can be found all around Santa

On a recent walk downtown, I spotted viburnum, ilex, snowberry, pepperberry, juniper (a sneezer for some, just make sure you’re not allergic), service berry, mountain ash, even some gorgeous fat rose hips. No matter what you cut, remember you are living in the City Different, so feel free to be as creative and outside of the flower-box as you want to be. The most important part of your decoration is that it is green, and you are the master of your creation. Now about that ‘fiscal cliff ’... Why is a”fiscal cliff ” suddenly all the talk? What a dangerous-sounding description of our possible economic future. Could this really be happening? What is it and where did it come from? The idea of a “fiscal cliff ” comes from the land of Washington, D.C., where so many bad ideas originate. Apparently, Washington folks have decided to place a deadline on the enactment of certain tax increases and spending reductions. If this deadline comes and goes and the changes are enacted, all of us will be harmed. If these trillions of dollars in taxes and cuts are not reversed before they take effect early next year, economists predict recession and unemployment. We have seen both houses of Congress and the Executive Branch disagree for many years. Oddly, however, they seem to agree that there is a fiscal cliff wait-

ing for us to fall over. Hopefully, they also agree that something must be done before January 2013 to keep us on safe ground. The very idea that both houses of Congress can and will agree to avoid this disaster tests our level of confidence in our government. After all, they have not put a national budget in place in three years, so why would we think they can work this out? Sound cynical? Well, maybe, but at the same time I remain optimistic. There are so many questions, so many fears about the future. Every client I talk to wants to know whether to buy or wait until we have a resolution. We all want to know how this will play out in our daily lives. What about interest rates and what about the value of our homes? We are nervous. The “fiscal cliff ” was passed as part of the Budget Control Act in the summer

of 2012. It was passed in order to end the Congressional fight over our debt-ceiling increase. The cliff is very complex and has mandatory cuts in defense spending, Medicare, and other non-defense programs. We’re talking $100 billion in cuts for many, many federal programs before we even detail the tax increases. No member of Congress wants these enacted. After researching this unique predicament, my prediction is that interest rates, which are lower then they were in 1945, will continue at a low mark into 2013. Congress and the president will wage an all-out battle over the “cliff ” while stockmarket values suffer and home values remain stable. However, I believe that in the final hour before the deadline, the fiscal cliff will be avoided and our fears put behind us. Until then, until that historic moment when all in power agree to save

On the necessity of title insurance Title Insurance is not as well understood as other types of home insurance, but is just as important. When purchasing your largest investment, instead of buying the actual building or land, you are actually purchasing the title to the property, the land, the right to occupy and use the space. The title may be limited by rights and claims asserted by others, which may limit your use and enjoyment of the property and could even bring financial loss. Title insurance protects against these types of hazards. Other types of insurance that protect your home focus on possible future events and charge an annual premium. Title insurance protects against loss from hazards and defects that already exist in the title and is purchased with a one-time premium. There are two kinds of title insurance that benefit you in two ways: lender or mortgage protection, and owner’s coverage. Most lenders require mortgagee title insurance as security for their investment in real estate. When title insurance is provided, lenders are willing to make mortgage money available in distant 44

locales where they know little about the market. Owner’s title insurance lasts as long as you, the policyholder – or your heirs – have an interest in the insured property. New Mexico regulations require you to pay a premium for an owner’s title policy and a loan policy simultaneous issue charge — a smaller amount for the lender coverage. Title insurance emphasis is on risk elimination before insuring. This gives you the best possible chance for avoiding title claims and loss. It all begins with a search of public land records affecting the real estate concerned. The arrangement and compiling of the land records by a title company are enforced by New Mexico regulations. An examination is conducted by the title company on behalf of its underwriter to determine whether the property is insurable. The examination is intended to fully report all material objections to the title. Some examples may be: • Deeds, wills, and trusts that contain improper wording or incorrect names • Outstanding mortgages and judg-

ments, or a lien against the property because the seller has not paid his taxes • Easements that allow construction of a road or utility line • Pending legal action against the property that could affect a purchaser • Incorrect notary acknowledgements Through the search and examination, title problems are disclosed so they can be corrected, whenever possible. However, even the most careful preventative work cannot locate all hidden title hazards. In spite of all the expertise and dedication that go into a title search and examination, hidden hazards can emerge after closing, resulting in unpleasant and costly surprises. Some examples of hazards are: • Forgery, forged signature on a deed, which translates to no transfer of ownership • Unknown heir, heir of previous owner who is claiming ownership of the property • Instruments executed under an expired or a fabricated power of attorney • Mistakes in the public records All for a one-time charge at closing you

The insurer will pay for defending against an attack on title as insured, and will either perfect the title or pay valid claims.
