Mayor slaps subordinate with R1 million rand lawsuit REITZ/PETRUS STEYN: Nketoana’s mayor is suing one of her general workers for R1 million over a story that appeared in Sunday World in July. Nketoana Local Municipality mayor Maditswako Mokoena slapped her subordinate Mangaliso Hlongwane with a hefty lawsuit for defamation of character. To add salt to injury, Hlongwane has also been suspended from work after leading a service delivery march against his employer three weeks ago. Mokoena’s lawyers, Alberts Attorneys sent a letter of demand to Hlongwane three weeks ago demanding a payment of R1 million within 10 days for soiling the reputation of their client. The letter, which we have seen, reads in part: “A statement was made by yourself to a journalist Boitumelo Kgobotlo from a national newspaper, Sunday World, and as a result the following was publicized in a local newspaper Reitz, Petrus Steyn & Lindley Rekord: “Assault victim and municipal worker, Mangaliso Hlongwane,

told of how Maditswako slapped him across the face and punched him following a legal dispute. “The mayor targeted me because even though I worked for the municipality, I am still a community activist, helping raise service delivery issues. They gave me this job to try and gag me, but I refuse to be bought.” Hlongwane, 40, from Mamafubedu township outside Reitz, said he was shocked when he read the letter that was handed to him by the sheriff on Wednesday. “I don’t understand how they can even say that I have lied under oath because we haven’t even appeared before the court of law. “There are no developments in my case but they are already claiming that I lied under oath. They based their claims on the statement I made to the police and the information I gave to Sunday World,” he said. He claimed that the mayor is trying to find ways that will make him drop the assault case he opened against her. The municipal employee and community

activist said he led a peaceful march to hand over a memorandum to the municipal office for service delivery in the town. He then received a suspension letter from municipal manager Mzwandile Manzi, which he said was suspicious. “The signature on the letter does not appear to be Mr Manzi’s and the messenger who came to give me the letter seemed restless,” he said. Hlongwane said the messenger would normally show up with two letters, the original and a copy. “The messenger only presented one letter which I refused to sign,” he said, adding that he was currently on leave. The suspension letter, which we have seen, gave him 48 hours to present reasons why he should continue to be employed by the municipality. Man stabs ex to death, injures daughter A man killed his ex-partner and injured his four-year-old daughter following a domestic dispute in Reitz, Free State police said last week Thursday. He had recently separated from Nthabiseng Mokoena, 35, and stabbed her multiple times during an argument on Tuesday, said Captain Zweli Mohobeleli. He also stabbed his daughter in the arm. She received stitches at hospital and was later discharged into the care of her mother's family. Mohobeleli said the man, 33, was traced to a hill near Petsana where he was arrested. "He was found in possession of a rope which we suspect he intended to hang himself with.“ He was expected to appear in the Reitz Magistrate's Court on Friday, to face charges of murder and attempted murder. Acting Bethlehem Cluster Commander Brigadier Nkaise Molefe extended his condolences to the Mokoena family. "I would also like to applaud members of the community for making it their business to call the police when they witnessed the stabbing." The police have pleaded for people who have protection orders against their abusers to report any contravention immediately.

Global petroleum company brings fracking threat to Lindley An international petroleum exploration company has fired up a fresh application to explore for products in prime farmland in the central Drakensberg and Free State. This follows a government decision to dismiss an appeal by farmers, environmentalists and rural dwellers against earlier controversial applications in the provinces last week. But the firm is likely to face fierce legal opposition from farmers and environmentalists who are bracing for a fight both in and out of court. Rhino Oil and Gas Exploration South Africa (Pty) Ltd announced this week that it had lodged an application for an exploration right with the Petroleum Agency of South Africa (Pasa). The application was received on October 11. The application, which covers 6060 farms over 1 million hectares, could eventually result in environmentally harmful “fracking” to extract gas, environmentalists have warned, although the company will have to get further approvals for this if the exploration right is granted and the resources are discovered. Fracking poses the potential risk of earth tremors and the contamination of underground and surface water. Areas affected in the latest fracking application extend from Mooi River and Estcourt North to Winterton, Bergville and Van Reenen, to south of Memel in Free State. The application also covers the Lesotho border, Phuthaditjhaba and Clarens to beyond Bethlehem and Lindley. Rhino Oil and Gas

Exploration South Africa said in its application documents that the exploration work programme was “aimed at indicating if there is an oil or gas resource in the area that would warrant further exploration”. The company said the proposed exploration activities included “data acquisition and processing through a comprehensive desktop study” and “a full tensor gradiometry gravity survey”, which would be done from the air using survey aircraft. “No seismic surveys, well drilling, pressure testing, hydraulic fracturing or water abstraction is proposed in the exploration work programme,” the company said. Matthew Hemming, African manager for SLR Consulting, the environmental assessment consultancy handling the scoping and environmental impact assessment (EIA) for the application, said the exploration right would only entitle the firm to explore using methods set out in an approved exploration work programme. “Any further exploration work to evaluate an identified resource or the future production of oil or gas would require further approval in terms of the MPRDA (Mineral and Petroleum Resources Development Act) and Nema (National Environmental Management Act). Such approvals will be subject to the relevant legal requirements, which include further public consultation and environmental impact assessment,” Hemming said. Janse Rabie, AgriSA head of natural

resources, said the farmers’ organisation would oppose fracking “anywhere in South Africa”. He said AgriSA was preparing to lodge a review application in the North Gauteng High Court in Pretoria to set aside acting environmental affairs minister Derek Hanekom’s dismissal of 39 appeals - from environmental groups like the World Wide Fund for Nature, groundWork, AgriSA, the Bakoena Traditional Council and the Amahlubi Traditional Council - against the granting of four exploration authorisations to Rhino Oil and Gas in September last year. Hanekom issued his decision in support of the Department of Energy’s earlier approval of the expropriation rights, which cover about 2.4million hectares in the North West, Free State, KwaZulu-Natal and the Eastern Cape, on November 9. Rabie said it was feared that the applications “may lead to large-scale shale gas developments in South Africa, including by means of hydraulic fracturing or ‘fracking’.” “Agri SA appealed against the granting of environmental authorisation due to the prevailing uncertainty regarding the availability and possible pollution of water, as well as the air and soil pollution associated with oil and gas developments,” Rabie said. No blackouts expected despite Free State’s R7,6 billion Eskom says there are no plans in place to switch off the lights this festive season despite some municipalities in the Free State defaulting in payments. Parliament gives go-ahead for land expropriation without compensation The National Assembly has adopted the constitutional review committee's report recommending a constitutional amendment to expropriate land without compensation. 209 MPs voted in favour of the report, with 91 voting against it and no abstentions. This means that parliament can start a process of amending the constitution, The committee received 449,552 “authentic” written submissions and Maila conceded that 65% of them opposed a constitutional amendment. He said, however, that this was “of no significance”. Written submissions have become a subject for litigation. AfriForum tried but failed last week to interdict the parliamentary debate and the DA has announced intentions to take parliament to court over a flawed procedural process. Maila said written submissions were in the main made by those who were resourced. He said that while being resourced was not a problem,

the problem was whether written submissions meant meaningful public participation. “Is the production of a computer-generated template designed by one person, populating the template with his views and then allowing other people to factor in their names and contact numbers - to be referred to as meaningful public participation? “Is the mass production of templates merely saying yes or no aimed at inflating numbers so that the committee may not be able to do its work meaningful public participation?” he asked. He sought to clarify that the work of the committee was not to conduct a referendum and “anyone who makes an over-emphasis on numbers would be grossly out of order”. The committee held public hearings, written submissions were sent to parliament and oral submissions were also made in parliament.

Penalties for outstanding corporate income tax returns to kick in soon The South African Revenue Service (SARS) will soon impose penalties on outstanding Corporate Income Tax (CIT) returns. In a statement, SARS said “the penalties will range from R250 to R16 000, depending on the company’s assessed loss or taxable income”. The revenue service said the set penalties would be for each outstanding return, and would increase by the same amount for every month that the noncompliance continued. “Penalties will be imposed on companies that fail to submit an income tax return from 2009, where SARS has issued a final demand, and the company fails to submit the outstanding return within 21 business days of the final demand.” SARS said it was compulsory for all registered companies, big or small to submit their income tax returns within 12 months of the end of the company’s financial year. It said this could be done via eFiling.
