Metro Transit began construction on the new bus garage near Heywood in May 2020. The new garage is largely expected to replace the facilities that Ruter provided, but there have been construction delays, calling into question what the actual timeline for these job transitions will be.

One might wonder whether increasing wages to counter the losses in staffing might have been an alternative solution to this situation. The Juneteenth Holiday will be handled the same way MLK Day is handled in that it is a working holiday. If an employee would like to take this day in conjunction with vacation, the employee must use vacation by the week and can elect to receive holiday pay or float the holiday. Because of the timing of the implementation of the Juneteenth Holiday all regular services such as customer relations and transit information will operate on a regular schedule while the Mail Room, Overhaul Base, and Radio/Electronic shops will be closed on the recognized Juneteenth day, Monday, June 20, 2022. Workers at the JFK8 Amazon Fulfillment Center in Staten Island have dealt a stunning blow to the corporate giant by voting ?Yes? for the Amazon Labor Union (ALU), 2654 for and 2131 against. This decisive result proves once and for all that one of the richest and most powerful companies in the world can be defeated. Workers are fed up with the deplorable working conditions and wages that allowed Jeff Bezos to become the richest man in the world, launching himself into space in July last year just three months after the first major union drive in Bessemer, Alabama was defeated that April. Amazon?s greed and arrogance finally met a rude awakening. However, further victories aren't going to come automatically. It will be a brutal class struggle to successfully unionize each and every Amazon facility. Despite this victory at JFK8, ALU unfortunately lost the union vote on April 25th at the neighboring LDJ5 facility. In Bessemer, Alabama after Amazon won the initial vote last year by an overwhelming 1,000 votes, the National Labor Relations Board (NLRB) ordered a re-do of it given the public pressure and outcry over Amazon?s many legal violations. While the final result of the election is not yet clear because of a large number of challenged ballots, the Retail, Wholesale and Department Store Union (RWDSU) is down by 118 votes this time around ? a much better result, but a likely loss. We know from experience that Amazon will continue to play dirty and use everything at their disposal to throw up the results, gum up the legal process, and undermine the fight for a strong contract at JFK8 which begins immediately. The company announced their opening line of attack minutes after the election, in a statement accusing the NLRB of tipping the election in ALU?s favor, referencing complaints filed to the board alongside the National Retail Federation and U.S. Chamber of Commerce.

forcing Amazon to recognize a union in the event of a close election if the company is found to have grossly violated labor law. However it?s unlikely that the board will side decisively with workers in Alabama unless RWDSU, ALU and the rest of the labor movement escalate pressure on the NLRB.

This is no time to pull back: we need to keep up the pressure and start building a worker-led movement to unionize Amazon everywhere. With further victories in sight and millions looking toward Starbucks and Amazon workers in their fight for a union, Amazon workers everywhere should take discussions of these historic breakthroughs with their coworkers further by assembling organizing committees across every department in their workplaces to discuss concrete demands like a $30 hourly wage, ending mandatory overtime and abolishing the company?s intensive labor-tracking regime. ALU has a special responsibility to help broaden this fight by calling mass meetings of workers nationally to discuss the lessons of the campaign and help launch organizing efforts in more facilities.

Amazon faces 55 Unfair Labor Practice charges (ULPs) from RWDSU and ALU in the NLRB for violating workers labor rights by surveilling, intimidating, disciplining, and firing workers for pro-union activity. One outright victory, and another close election may give the NLRB enough political cover to act decisively in the union?s favor. Mass pressure is critical for pushing the NLRB to act in workers? favor far more decisively than they have up until this point. And regardless of the NLRB?s policy, workers cannot risk tying themselves to a slow-churning legal process that relies on the courts to defend our rights in the heat of union campaigns at Amazon or the 150+ Starbucks shops that have filed for elections. While the NLRB under Biden has been significantly friendlier to unions than under Trump, hitching labor ?s fortunes to the Democratic Party is a losing strategy given that the party is ultimately beholden to the same big business interests as the Republicans. A relatively tame NLRB one year can easily turn to vicious attacks in the next, even within the same administration if they deem it necessary to more forcefully defend the power and profits of Jeff Bezos and the rest of the billionaire class.

The corporation paid anti-union consultants $4.3 million to undermine organizing in 2021, with many taking home $3,200 a day for their union-busting, more than seventeen-times what Amazon workers are paid daily. Amazon held frequent mandatory anti-union ?trainings? in Staten Island and Bessemer to browbeat workers into opposing the union. In Staten Island, these captive-audience meetings were scheduled daily in the run-up to the election. Management attempted to close-off these meetings to workers that they identified as supporters of the union and removed them from the room when they pushed back on the company?s anti-union smears.

Workers in Staten Island have proven that Amazon is not all-powerful or impossible to defeat, but this is just the beginning. To stop Amazon from further stealing elections ? like they did in both New York and in Alabama ? we need rallies, walkouts, and coordinated days of action across multiple facilities and cities to defend this victory and draw tens of thousands into the fight for a strong contract. Even more critical in that fight for a contract, which will be resisted by Amazon at every turn, will be thoroughly democratic structures that maximize rank-and-file participation and help develop genuine worker leaders on the shop floor. Chris Smalls?individual role as a ALU leader has been overblown in the media, which Smalls himself has rejected by emphasizing how this victory belongs to all the workers and shouldn?t distract workers from the real effort that?s needed to convince their coworkers to take an active part in organizing. Mass meetings of workers at these facilities should be called immediately to solidify the base of

Increased scrutiny of this practice driven by the ongoing wave of Starbucks worker organizing is putting pressure on the NLRB to outlaw captive-audience meetings, but this is unlikely given that corporate politicians have abandoned any serious attempt to pass the more modest labor law reforms in the PRO act. In March the NLRB filed a federal injunction against Amazon to reinstate Gerald Bryson, a JFK8 worker who was fired for participating in the 2020 walkout led by ALU members. Bryson?s reinstatement raises the question of whether the NLRB will begin moving swiftly against employer retaliation after Starbucks fired the ?Memphis 7? workers for their pro-union activism. The growing mass support for unions has pushed the NLRB to adopt a friendlier stance. NLRB general counsel Jennifer Abruzzo has hinted that the board may invoke the ?Joy Silk? standard,

The entire labor movement needs to throw everything it?s got into this fight, mobilize members to actions, and pledge to only endorse candidates who firmly commit to supporting workers and standing up to Amazon?s union-busting. Any elected politician that claims to support workers and organized labor should take initiative in building the fight to unionize Amazon, using their positions as elected officials to wage a fight against the corporation?s union-busting and mobilize their supporters to aid the struggle. Workers should expect more than just passive support, but demand that worker representatives actively struggle alongside workers to further develop organizing efforts with or without the blessing of the major unions or any political establishment. Politicians that claim to support workers should participate in union rallies, walk picket lines with striking workers, and donate significant portions of their salaries to strike funds ? or in the case of Amazon and Starbucks ? grassroot efforts to unionize and win a contract. Un ion ize Am azon Ever yw h er e! ALU shocked the labor movement by pulling off an independent campaign in the heart of one of the richest and most exploitative corporations in the world. Recognizing the weakness of RWDSU?s conventional business unionism in the first election in Alabama, ALU President Chris Smalls insisted on maintaining his group?s independence from the beginning. Smalls correctly pointed to the failure of RWDSU?s approach in their first election which substituted a media strategy based on endorsements from celebrities and star politicians in place of a campaign driven by organizing committees in the workplace and centered on clear demands. The majority of the leadership of today?s unions are the key obstacle to the rebuilding of a fighting labor movement. ALU should work with anyone who is genuinely interested in learning from their incredible victory, and they can play a major role in building networks of activists throughout the labor movement who are committed to both unionizing Amazon and transforming the existing unions by fighting for rank-and-file democracy and adopting the kinds of militant tactics and bold strategy that built the unions in the first place. A vital first step for this would be for ALU to call mass meetings of workers nationally to discuss the lessons of the campaign in order to help Continue to page 6...

Where is management on these occasions? Why do they refuse to hire and properly staff the Union departments, not only to get the job done, but more importantly to be sure everyone is safe and secure when performing their job for Metro Transit. Too often our Union Brothers and Sisters are disciplined for the bad behavior of the public. Enough is enough!!!

On March 29, 2022, well over 100 members braved the cold windy weather to stand up to management for their continued failures that are harming our Union and our entire membership. We were there to show management our anger and displeasure that management continues to fail to provide us with a safe place to work and fails to provide our customers a safe, and secure transit system to use. We were displaying our anger that management fails to hire enough Union workers to accomplish the work they task the Union with. This failure to hire then becomes management's justification to outsource our work. As one glaring example; $12 million and our Union jobs are being shipped to a non Union contractor in Louisiana. We must continue to stand up collectively and let management know that all this is unacceptable to each and every one of us, the membership of Local 1005. We were demonstrating at the LRT Blue Line shop where the upper management of LRT resides. This was chosen as the site of the first of many such demonstrations because the problems are glaring at LRT. The members who took ownership for these problems facing our Union, were not only LRT Operators, Vehicle Mechanic, LRT system maintenance employees, Comm & Signalmen, Traction Power Maintainers, Track Maintainers and LRT Helpers. Members came from all departments. There were members from Bus maintenance, Mechanics and Helpers, Members from Overhaul and Transfer Road showed up. This event even stirred Retirees to show up to support our push for responsibility and accountability for management. We are tired of our customers not having a safe transit system to use

By management's continuing failure to properly staff the maintenance department, they are clearing their way to continue to outsource Union Jobs. Management acknowledges to the Met Council that we are short 21 mechanics at LRT (a number that now exceeds 30) and uses this as justification to outsource $12 million worth of Union work to non Union shops out of state. We have qualified helpers at LRT who are contractually entitled to bid and qualify for these jobs. Rather than promote from within, management continually rewrites job postings and descriptions in such a manner as to exclude our Union Brother and Sisters from being promoted. Our contract with Metro Transit is written in the spirit that everyone of us is entitled to be promoted and better themselves. Not only does this blatant failure to promote from within violate the contract, but is in fact discriminatory. This is just one example of many of management violating the contract, harming not only the Union, but the entire region served by the Met Council, by failing to provide good local jobs. This weakens our community as a whole; good jobs are the cornerstone of a strong community.

Those in our community who rely on public transportation are afraid to use it because management has allowed the criminal element in our society to hijack our system for their exclusive use. There is no attempt by management to enforce its own code of conduct on those who illegally use our system. We must demand with a unified voice that Metro Transit take back its trains and buses and operate a safe system for the community and the employees. They should be doing this on their own, it is disgraceful that we have to fight to try and force them to provide safe and secure service when they are obligated to do that in the first place. We have grown weary of no management support for operators and maintenance personnel in the face of this lawlessness they have allowed to escalate on our system. Management continues to hide in the comfort of their safe offices and homes, (many of them continue to work from home) while they require us to be on site everyday. We toil in the shops, we operate the buses and trains, we maintain vehicles and keep the system up, and somehow we are portrayed as the bad guys by management. They are creating situations where one person in a department is on duty, and this person is expected to work alone in the field. This is a huge safety

Don?t kid yourself, it is not only the qualified helpers who are affected here. Because there has been no hiring, and our headcount continues to shrink, the premium jobs, for example the LRT overhaul jobs, are eliminated and the workers displaced from day shift work with weekends off, to do less

desirable shift work. This in turn leaves overhaul work unable to be completed because there is no workforce to complete it. We can not afford to allow our work to be outsourced. They are so bold, they intend to load all 27 type 1 LRV?s onto Union Pacific flat cars and ship them to Louisiana for repairs. This shipping alone will cost nearly $50,000 per LRV, for a total of $1.35 million. They are negotiating an option to wrap the cars for shipping for an additional $12,000 per LRV, for a total of $324,000. This means they are willing to spend nearly $2 million to transport the cars to an outsourced vendor. Then they are going to spend millions more to store these cars off site while they are awaiting work or shipping back home. This money will all be spent BEFORE any work even starts, the work itself will cost millions more taxpayer dollars. Why not simply hire local Union workers and keep the region strong? They would have control over quality and would save the taxpayers millions of dollars. Management received our message and solidarity loud and clear on March 29th. Management was invited to come and address us as a membership and tell us their response. The word on the street is management had a meeting at Heywood during the time of this demonstration. The purpose of this management meeting was apparently to watch the demonstration on the parking lot cameras because they do not possess the moral fortitude to face us, the large group of us, in person. Management is unwilling to face us when we stand up collectively and demand accountability and responsibility from them. We have to learn from management's actions here, going to Heywood to watch us from afar, and continue to make them uncomfortable to the point that they start acting responsibly and hold themselves accountable. This is everyone?s Union and everyone has ownership in these issues facing us. In a Union, when one member has a problem, every member has a problem. Right now we all have problems because of bad management. Management should never have allowed things to deteriorate to where they are today. launch new organizing efforts off the ground, raising company-wide demands and providing resources and materials like flyers and more that workers can use in conversations with each other to help build for these meetings and mobilize people to them. This victory is also a wake-up call for the leadership of the major unions, who have proven themselves largely incapable of organizing the unorganized: the working class is ready to move with or without you. The victory that ALU led as an independent union also undoubtedly contains important lessons about the need for more worker-driven campaigns centered on clear demands, which should be a key lesson drawn going forward. If the newly-elected O?Brien Teamster leadership is serious about rebuilding a fighting labor movement and organizing Amazon, they should start immediately and in such a way which breaks completely with the conservative business unionist approach of the old leadership they fought to replace. This can also build momentum for a strong fight against UPS, one of the country?s largest employers alongside Amazon, as negotiations

We saw them choose to hide from us rather than face us. Management has told us by their actions here that they are uncomfortable facing us in numbers and confirmed for us that these actions do indeed put pressure on them to do their jobs and right the ship.

One of the biggest problems with the approach of most labor leaders is the unwillingness to put forward clear and specific demands because it might mean ?making promises we can?t deliver on.? ALU broke with this approach, an important reason for their success, but was at times inconsistent in what they were putting forward. At their tables, the group has leafleted for a $30 base wage, an end to ?Time-off-Task? labor tracking (TOT) and hour-long lunch breaks, but those demands were absent from the program of immediate demands published within a week of the election. Strong, clear demands are absolutely vital in any organizing effort from very early on in order to push back against anti-union propaganda, appeal to workers

The decisive victory at JFK8 in Staten Island may well be a catalyst to organizing at Amazon, the logistics industry as a whole, and even well beyond. Combined with the ongoing struggle for a union at Starbucks, today?s victory could be a major turning point for the labor movement and lay the basis for a mass wave of unionization in the months and years ahead, but building on it will require drawing the right lessons from the struggle so far. The incredible courage of the JFK8 workers will be a continual source of inspiration to workers across the country and the world ? let?s go all out to organize the unorganized and unionize Amazon everywhere!

During our last contract negotiations, we made the demand for hazard pay front-and-center. Despite this fact, the Met Council shamefully refused to include any hazard pay in the final contract even after they received additional federal money for pandemic relief. ATU workers have been among the ranks of essential workers who have helped the basic functioning of society during two years of the COVID-19 pandemic. Over this time, the state of Minnesota has increased its budget surplus to over $9 billion! Workers are stronger when we fight together, and therefore we joined a coalition with other unions representing frontline workers to make our demands clear at the state capitol. Our powerful coalition

includes the Minnesota Nurses Association (MNA), SEIU Healthcare, Unite-HERE, Minnesota Association of Professional Employees, IAM local 77, and ISAIAH, representing faith organizations.

If transit workers received the hazard pay we deserve from the Met Council then our portion of the $500 million could have been dedicated towards paying even more front-line workers, covering time to quarantine, testing, childcare for working parents, any number of pandemic related costs. Instead, the Met Council denied negotiating on hazard pay because it would set a precedent for other workers. No doubt this would have emboldened other essential workers in their own negotiations, and even strengthened our coalition?s position to demand more.

Frontline Metro Transit workers, members of ATU 1005, will be among the roughly 667,000 workers in Minnesota who are eligible to apply for the bonus checks. We should be clear, this hazard pay is coming from the MN state government, not our immediate employers. It seems that the Met Council prefers the state to pay its employees, while they squirrel away money for themselves. We should also keep this $500 million for essential workers from the state government in perspective. While this seems like a lot, these same lawmakers wanted to give big business and corporations $2.7 billion. There are a lot more workers than businesses in Minnesota, but it should show you where the priorities

While we should celebrate this victory, we should recognize that because the Met Council refused to pay Metro Transit frontline workers hazard pay, they forced us to demand frontline pay directly from the state with all the other essential workers. This risked the potential for us to be pitted against other frontline workers who also worked through the pandemic like nurses, longterm care workers, grocery and food service workers, and child care workers. However, because ATU 1005 worked together with other unions, we were able to mostly avoid this despite the Met Council

making it as difficult as they could for us. These bonus payments will be administered through the Department of Labor and Industry (DLI). This department will be responsible for making the Frontline Worker Pay application available to us. The application process should be ready by mid-June. As soon as the application process is up and running, it will be announced which will start a 45-day application window that will begin at that time.
