Minutes of the 7th regular session of the 7th Sangguniang Bayan of Magpet, Cotabato held at the SB session hall on the 2nd day of September, 2013. Present: Hon. Efren F. Piñol Hon. Rogelio L. The Presiding Officer called the session to order at 2 o’clock in the afternoon. Hon. Councilor Jun L. Lobaton led the invocation. The singing of the National Anthem and Magpet Hymn followed. The body then recited the Councilor’s creed. In the amendment period, the body unanimously approved to include the agenda the following items: 1. Draft resolution no. 40-2013- Author: Hon. Mamon – A resolution realigning P500,000.00 from grants and aid to travelling expense under the Office of the Sangguniang BayanLegislative. This was approved to be included in the agenda through the motion of Hon. Councilor Mamon duly seconded by Hon. Councilor Marañon 2. Draft resolution no. 41-2013- Author: Hon. Marañon – A resolution approving that the leading of invocation during SB sessions will be rotated among the SB Members. This was approved to be included in the agenda through the motion of Hon. Councilor Marañon duly seconded by Hon. Councilor Lobaton. With no other amendments presented , Hon. Councilor Lobaton moved for the adoption of the agenda as amended. Hon. Councilor Apostol seconded the motion. The body unanimously approved the motion. No one is scheduled to appear before the body during the question hour. In the privilege hour, Hon. Councilor Apostol rose to avail of it. In his speech, he mentioned that he would also like to be clarified why the garbage compactor is not being utilized until now. He would like to know some details of the said unit like its price and whether it is surplus or brand new. He then moved to invite Mr. Dindo Porquiado, the OIC GSO, to answer questions regarding the garbage compactor. The second subject of his speech was about the packing house at Sitio Dulangan. He noted that said structure was constructed in private land so he would like to know if said area was donated or purchased. So he suggested that a communication be sent to the Department of Agriculture or to the OIC Municipal Agriculturist to answer the question. The third subject of his speech was about the traffic at AMCES which is very chaotic during school days because the drivers do not know whether it is one way or two way. He then suggested that a communication be sent to the Chief of Police of Magpet to request for one PNP personnel to manage the traffic flow of the said area. The Presiding Officer reacted on the first subject of the speech of Hon. Apostol. He said that the issue whether the garbage compactor is brand new or not is not relevant to the query of Hon. the second subject of the speech, the Presiding Officer reacted by stating that he has no basic knowledge about the said project because it did not pass through the LGU. He added that it was the Department of Agriculture Region XII that decided on where to construct the said packing house. So he suggested that the communication will be sent to the DA Regional Office XII. On the third subject, he reacted by concurring to the idea of Hon. Apostol to send a communication to the Chief of Police to request for a personnel to manage the traffic flow of the said area. But he added that due to the shortage of our Police Personnel, it would be practical that a traffic aide would be assigned to do the job. Next to avail of the privilege hour was Hon. Councilor Talotalo. The subject of her speech was still about the garbage compactor. She too questioned why the said unit is not utilized until now. She added that if the garbage of our municipality will not be managed properly, it will become a big problem in the future. The Presiding Officer reacted by saying that the lady councilor has a “sound observation”. He then thanked her for her speech. Hon. Councilor Marañon was the next to avail of the privilege hour. He expressed his gratitude to his colleagues for giving him full support in order for him to win in the recent PCL Provincial President Election. He also requested the support of his colleagues to make the PCL a stronger and more effective organization. The Presiding Officer thanked Hon. Councilor Marañon and proceeded to recognize Hon. Mamon. Hon. Councilor Mamon rose to deliver her speech. Her speech was about the participation of the Sangguniang Bayan of Magpet in the Brigada Eskwela. She noted that the Sangguniang Bayan of Magpet has an assigned part in the school which has to be maintained. She ended by stating that this act is one of the ways in which to show the community that the Sangguniang Bayan of Magpet is supporting the education of the children. At this juncture, the Presiding Officer directed Hon. Councilors Lobaton and Marañon to explain why they were late last session. Hon. Councilor Lobaton explained that he was late because at that time he was at his mother’s house to take of her. He noted that her mother is very ill and needs somebody to carry her when it is time to change her diaper. Hon. Councilor Marañon explained that he was late because he went to attend a session in another municipality to do his campaign for his candidacy in the PCL election. Reading of the minutes of the previous session: • August 27, 2013 regular session minutes Hon. Councilor Acupan rose to suspend the reading of the minutes on the presumption that all members were already able to read it because it was given to them in advance. Hon. Councilors Apostol and Aboy seconded the motion. The body unanimously approved the motion. With no corrections presented, Hon. Councilor Porras moved for the adoption of the minutes as presented. Hon. Councilor Labrador seconded the motion. The body unanimously approved the motion. •

Committee report: Hon. Councilor Acupan rose to make their committee report. But Hon. Councilor Mamon rose to state that the report cannot be delivered because such is not in the agenda and it was also not inserted during the period of amendment of the agenda. First reading:

1.2013 Supplemental Budget no. 1 of Barangay Bangkal – Ord no. 1-P29,741.55 This was referred to the Committee on Finance, Budget and Appropriation. 2. Tax ordinance no. 01-2013 of Barangay Imamaling – Imposing fee for the issuance of barangay clearance, lupon clearance, Purok clearance, barangay certifications, cutting permit, transport permit, permit to operate “for hire” motorized vehicles, peddlers, buyers of agricultural projects, securing copies of barangay development plan, and imposing penalties in the form of an amount money for bullying, violations of morals and reputations of other including the cause of spreading malicious information, damage to properties, the pollution of rivers and other water bodies including the improper disposal of solid waste within barangay Imamaling, Magpet, Cotabato and further imposing special fees during barangay anniversary. 3. Application for accreditation to the Local Special Bodies of Magpet AgroIndustrial Resources Cooperative (MAGIRCO) Items 2 and 3 were referred to the Committee on Laws, Ordinances and Legal Matters.

3. Draft resolution no. 40-2013- Author: Hon. Mamon – A resolution realigning P500,000.00 from grants and aid to travelling expense under the Office of the Sangguniang BayanLegislative. Hon. Councilor Mamon rose to suspend the IRP of the body in order to tackle this matter. Hon. Councilor Marañon seconded the motion. The body unanimously approved the motion. The author explained that there is a need to realign the said funds because fund under the traveling expenses was already exhausted. With no clarifications presented, Hon. Mamon moved for the approval of the said draft. Hon. Councilor Marañon seconded the motion. The body unanimously approved the motion. RESOLUTION NO. 2013-127 4. Draft resolution no. 41-2013- Author: Hon. Marañon – A resolution approving that each councilor will be given chance to lead the invocation in the SB Session. Hon. Councilor Marañon rose to suspend the IRP of the body in order to tackle this matter. Hon. Councilor Lobaton seconded the motion. The body unanimously approved the motion. The author explained that what prompted him to draft this resolution is his observation that it is only the Hon. Lobaton who is always leads the invocation. He noted that it is better if all of them will be given chance to lead the invocation. He then moved to approve the draft resolution. Hon. Councilor Lobaton seconded the motion. The body unanimously approved the motion. RESOLUTION NO. 2013-128. •
