Employers Alert: New I-9 Form

All Employers Must Complete Form I-9 for Each Employee Hired in the United States On March 8, 2013, U.S. Citizenship and Immigration Services (USCIS) published a revised Form I-9, Employment Eligibility Verification. The timing of the release of this form is an emotionally charged point of discussion in political circles. All opinions aside, here are the Facts Employers Need to Know: • Employers “should” immediately begin using the revised Form I-9 for all new hires and reverifications. • Note: employers may continue to use previously accepted versions, dated 02/02/09 and 08/07/09, until May 7, 2013. • After May 7, 2013, employers must only use the just released Form I-9, dated 03/08/13. • It is important to note that, after May 7, 2013, employers must use the revised Form I-9 for new hires and to reverify the employment authorization of current employees. • If a current employee requires reverification after May 7, 2013, employers must complete Section 3 of the new form and attach it to the employee’s existing Form I-9.

Revising Section 1 to make it “easier to read Simple. Toss the old I-9 form and use the new I-9 • Form immediately. and understand” • Adding an area for a 3D barcode to “proWhy did the form change? mote the modernization of USCIS forms” Giving employers more space The government has indicated that the form was • Making the instructions clearer and easier changed because the old form “expired,” and the • expiration gave USCIS an opportunity to impleto understand ment the following improvements to the form: • Adding “helpful” fields such as the employ- Source: California Employers Association CEA, Website www.employers.org. ee e-mail address and telephone number

The revised Form I-9 includes new fields, formatting, and instructions for both employees and employers. The revised Form I-9 is available here. http://www.uscis.gov/files/form/i-9.pdf. Technically speaking, employers have until May 7, 2013 to make a change. We say, Keep It

Sexual Harassment Training April 1, 2013 Presented by: Naomi R. Dewey, Principal Buynak, Fauver, Archbald & Spray LLP Harassment training for supervisors has always been a good idea; now it is required by law. AB 1825 (Now Government Code Section 12950.1) requires that all California employers with 50 or more employees provide at least two hours of harassment avoidance training to all supervisors once every two years. Moreover, new supervisors or newly promoted supervisors must receive the required training within six months of hire or promotion. For smaller employers, providing harassment training for employees can also help protect you against harassment claims and lawsuits. This training is mandatory for any supervisor who hires, fires, disciplines, and/or directs the work of one or more other employee. The seminar will cover the following topics: • Discrimination • The laws against illegal sexual harassment • The costs and remedies of harassment • Identifying unlawful sexual harassment • Preventing and stopping sexual harassment • Retaliation • Hypothetical situations Naomi is a principal at Buynak, Fauver, Archbald & Spray, where she represents contractors and business owners in employment and business law matters. An experienced litigator, she focuses on helping clients manage risk and avoid litigation wherever possible. For employment clients, she provides advice on all aspects of the employer/employee relationship, handling issues ranging from pre-employment screening to employment agreements, employee handbooks and workplace policies, disciplinary matters and release from employment.

Contractor Alert: March 2013 – The CSLB reminds contractors that they must call 811 before beginning a project that will disturb the ground surface – whether by digging, drilling, boring, etc. You must contact either the Northern or Southern California regional notification center at least two working days (but not more than 14 calendar days) before beginning your excavation project. According to the bulletin, “the regional notification center call is free by dialing 811. If you fail to register, your excavation will be considered unauthorized digging and you may be subject to a fine of up to $50,000, held responsible for any repair costs, and potentially lose your contractor license.”

Is there a license for that? You may be surprised at what work actually requires a CA contractor’s license. Always better to check first rather than get surprised without it. You can always call us at any time to discuss your issue, we may later share it to help others learn from your lesson, but don’t hesitate to ‘drop the dime’ to Capitol Services. First, a quick answer for a guy in a real hurry…
