Read the Fine Print in Insurance Policies It’s common for an owner to require the general contractor to name the owner as an “additional insured” under the general contractor’s commercial general liability (CGL) policy. Likewise, a general contractor typically requires subcontractors to name it as an additional insured under their CGL policies. Doing so helps protect the additional insured against liability in connection with activities of the “named insured” (the contractor or sub that purchased the policy). But if you haven’t read the fine print of the insurance policy, you may or may not be covered as an additional insured to the extent you expect.

Don’t rely on a certificate of insurance

To confirm that you’re protected as an additional insured, obtain certified copies of the policies and endorsements that confer additional insured status. Don’t rely on certificates of insurance to determine whether you’re covered as an additional insured. They generally provide little detail about the scope of coverage. Plus, they typically contain disclaimers stating that they’re informational only, confer no rights upon the certificate holder, and don’t expand or otherwise change coverage provided by the underlying policy. In other words, a certificate of insurance that lists you as an additional insured may be worthless if you’re not properly named as such pursuant to the underlying policy. Generally, there are two ways to name an additional insured: 1) by listing the party in a “named entity” endorsement, or 2) by using a blanket additional insured endorsement. The latter automatically confers additional insured status on a party if the named insured is contractually obligated to name that party as an additional insured. If the construction contract doesn’t clearly spell out the types of policies for which the con-

Check the policy language Even if you’re satisfied that you’re an additional insured, examine the policy language. Often, the coverage available to additional insureds is narrower than that provided to the named insured. For example, some policies provide coverage to additional insureds only for bodily injury or property damage for which the named insured is at least partly responsible. If the additional insured is solely responsible, coverage may be denied. Some policies exclude additional insured coverage for claims that arise after the project has been completed.

Consult a professional The law surrounding additional insured coverage is complex and court cases in this area are often inconsistent. INSECT AND SPIDER BITES Each year many workers experience insect and spider bites serious enough to make them lose time off the job. If you are stung by a bee, remove the stinger gently (with tweezers, if possible) and avoid squeezing the poison sac. Apply an ice pack or a cloth dipped in cold water to reduce swelling and itching. A sting from a yellow jacket can be deadly. These insects feed on dead animals and can cause blood poisoning. If you have an allergic reaction to a bite, get medical help immediately. Of spiders causing serious medical problems only the black widow and brown recluse are considered serious threats. The black widow has a shiny black body, about the size of a pea. With legs extended, it’s about an inch long. Females have a red or yellow hourglass mark on their underside. The black widow spider is partial to outdoor latrines and other places that attract flies. The black widow spider will attack with even the slightest provocation. Its bite is less painful than a pinprick, and does not cause a hole in the skin, but soon, intense pain and stiffness set in. Symptoms also may include fever, nausea, abdominal pain and chills. For children and the elderly, black widow bites can be lethal. Also beware of the brown recluse spider. When it comes to insect bites, the bite of the brown recluse spider is one of the most feared. This yellowish-tan to dark brown spider is 1/4-1/2 inch long. It has a characteristic fiddle-shaped mark on its upper body. Its bite can have painful, disfiguring, and even deadly results. Within hours of a bite, victims may suffer severe pain and stiffness, fever, weakness, vomiting or a rash. The recluse’s venom destroys cells and clots blood, blocking blood vessels and leading to gangrene. Within 24 hours, the wound erupts into an open sore ranging from the size of a thumbnail to that of an adult’s hand. Anyone bitten by either spider should seek medical help immediately. Experts say, spiders typically don’t go looking for human prey. Spiders are generally shy and try to avoid contact with humans. Leave them to their dark, secluded spaces – under rocks, in debris piles, sheds, closets and attics, and there’s no worry. Invade their space, though, and risk a bite. Spiders will attack if trapped or if pressed against the skin. Not all people react the same way to these spider bites. The variation may be due to the amount of venom injected or the person’s physiology or immune system. The first line of treatment, if you suspect a bite is to apply a cold compress. However, if you have a bite and experience other side effects, get medical treatment immediately.

PICADURAS DE INSECTOS Y ARAÑAS Cada año muchos trabajadores sufren picaduras de insectos y arañas lo suficientemente serias como para hacerles perder horas de trabajo. Si lo pica una abeja, sáquese el aguijón con cuidado (con unas pinzas de cejas, de ser posible) y evite hacer presión sobre la vejiga del veneno. Aplique una bolsa de hielo o un paño mojado en agua fría para reducir la inflamación y la picazón. La picadura de una avispa puede ser mortal. Estos insectos se alimentan de animales muertos y pueden ocasionar envenenamiento del sistema sanguíneo. Si usted es alérgico a las picaduras, obtenga atención médica de inmediato. Working in pairs will help to reduce the chance of worker injury and strain. Seam taping and sanding tools with springassisted or powered systems can help to make overhead finishing work easier and ergonomically safe. Completing work one task at a time (hanging, taping, finishing, etc.) may be efficient, but is harder on the body. Instead, workers should focus on completing one area at a time, this will allow them to rotate tasks and give their muscles a break.

Tailgate/Toolbox Topics TT-7: Feb 2006

Setting Up a Tailgate/Toolbox Safety Meeting Tailgate or Toolbox safety meetings are 10-15 minute on-thejob meetings held to keep employees alert to work-related accidents and illnesses. Tailgate/toolbox safety meetings have proved their worth by alerting employees to workplace hazards, and by preventing accidents, illnesses and on-the-job injuries. Why Have Them? In both the tunneling and construction industries, tailgate safety meetings are required by Title 8, Sections 8406 and 1509 of the California Code of Regulations. While tunneling and construction are the only industries that specifically require tailgate safety meetings, all California employers must have a safety program that includes employee training in safe work practices. Tailgate/toolbox safety meetings can be used to address actual problems on the job or in the shop. The supervisor leading the meeting can draw on the experience of workers, and use that experience to remind all employees –especially newer ones – of the dangers of working with particular kinds of machinery, tools, equipment and materials. What to Talk About? Talk about work practices, machinery, tools, equipment materials, attitudes, and anything else that may cause or contribute to a work-related accident or illness. Keep the topic relevant to the job or tasks at hand. An excellent source for construction related topics is the publication Cal/OSHA Pocket Guide for the Construction Industry. Supervisors can choose individual sections or topics and relate them to their specific site requirements. Copies can be ordered from the Division of Occupational Safety and Health. Choose a topic you think needs safety review. If you notice that spills aren’t being cleaned up promptly, discuss it. If there has been an accident or a near-accident on the job, talk about it. What happened? Where did it happen? How can it be prevented from happening again? Encourage employees to suggest topics. They often know best - what and where the dangers are. How to Run a Good Meeting 1. Hold the meeting on the job, preferably where everyone can sit and relax. 2. Hold meetings at the beginning of shift or after a break. 3. Choose the topic carefully. Topics should be about health and safety problems on the job. Research the problem before the meeting. For machinery, consult the manufacturer’s operations manual. For handling toxic substances, get a copy of the material safety data sheet. Your company’s insurance carrier is another good source

Sample Topic for Tailgate/Toolbox Safety Meetings: Why are guards left off machines? Guards are placed on machines to prevent workers from contacting moving parts. They are required by Cal/OSHA regulations. Many California workers are killed or injured every year because guards are removed and not replaced. Why are guards left off? Ask the group to give reasons. Some common ones are: ♦ I didn’t have time to replace the guard. ♦ I wanted to make sure the machine was working okay. I just never got around to replacing the guard. ♦ I put on a new drive and the old guard didn’t fit. ♦ I had to remove the guard to adjust the machine. ♦ I couldn’t work with the guard on. It slowed me down. ♦ Listen I’ve run these machines for years without guards and I’ve never been hurt. These excuses have been given countless times. After the accident has happened, the guard is replaced and strict rules are enforced. Of course, it’s too late for the victim. The purpose of meeting on this topic is to make sure rules are enforced before an accident can happen.
