When is it Okay to Work Under Someone Else’s Contractors License? Never. You knew that, right? But one of your licensed friends says that you can subcontract a job for him or her and just work under their license number. Flip that scenario over and you’re a licensee who needs someone to complete trade-specific work on a contract and a worker tells you he or she can do it as though they were an employee under your license. Nope, any way you try to work it, it’s still illegal for you to contract for construction or home improvement work over $500 in labor and materials without having your own state contractor license. All too often, CSLB’s Statewide Investigative Fraud Team and Enforcement division representatives hear a variety of twists and turns in stories about why an individual has used someone else’s contractor license. None of them works. That’s the law in California. It’s no different than if you tried to use someone else’s driver license. In case you think we’re kidding, here’s the legal language from the state Business and Professions Code: 119. Any person who does any of the following is guilty of a misdemeanor: (a) Displays or causes or permits to be displayed

or has in his or her possession either of the following: (1) A canceled, revoked, suspended, or fraudulently altered license. (2) A fictitious license or any document simulating a license or purporting to be or have been issued as a license. (b) Lends his or her license to any other person or knowingly permits the use thereof by another. (c) Displays or represents any license not issued to him or her as being his or her license. (d) Fails or refuses to surrender to the issuing authority upon its lawful written demand any license, registration, permit, or certificate which has been suspended, revoked, or canceled.

MULTI-EMPLOYER WORKSITES When more than one employer operates at a single site, Cal OSHA considers it a multi-employer worksite. A construction site is an example of a multi-employer worksite with multiple contractors assigned the work, but not all at the same time. Employers at multi-employer worksites need to know their responsibilities, assigned roles, and accountability for employee health and safety. Note that a multi-employer worksite differs from a dual-employer worksite, where an employee has two employers at the same time. For example, a temporary agency employee that is assigned to another employer’s worksite. On multi-employer worksites, all of the employers must work together to identify and control hazards to meet Cal OSHA standards for employee health and safety. Property and project owners have the same responsibility for employee safety. When Cal OSHA identifies safety violations at a worksite, the agency evaluates the owner and employer hierarchy to determine which owner and/or employer(s) is/are responsible for the violation. Cal OSHA identifies four categories of employers at a multi-employer worksite:

 The Creating Employer creates the violation condition.  The Exposing Employer employs the workers exposed to a violation, regardless of whether that employer created the condition.  The Controlling Employer is responsible, by contract or practice, for the safety and health conditions at the worksite and has the authority to correct the violation.

 The Correcting Employer has the specific responsibility to correct violation conditions. Worksites may contain several or all of the employer categories. A single employer may also fit into more than one of the categories. For example, an employer may be both a creating and a correcting employer or a correcting and a controlling employer. The hierarchy on a multi-employer worksite is generally from the owner/employer to general/prime contractors and then to subcontractors. Contractors often hire subcontractors to work on construction sites. If the subcontractor creates a health and safety violation, is the contractor subject to a Cal OSHA citation? Both the contractor and the sub may be responsible. Even if the general contractor did not contribute to the hazard and had no employees in the area, as the top of the employer hierarchy, the contractor is still responsible for overseeing the overall health and safety on the worksite. Owners/contractors should pre-qualify subcontractors before hiring them. They or the controlling contractor should examine the Injury and Illness Prevention Program (IIPP), insurance loss runs, and a three-year history of Cal OSHA citations for all subcontractors. Safety planning should be done before a new project and before each new phase. The plan should identify site-specific hazards, safety precautions, and the responsible party; this information should be written into the site contracts. The controlling employer must ensure that each contractor/subcontractor understands and agrees to follow the safety requirements in the contract. Conducting periodic safety inspections based on the hazard level and daily meetings between site safety managers and subcontractors can help keep everyone informed about changing worksite conditions and potential problems. The responsibility of the controlling employer does not end with communicating required safety precautions, or notifying the other employers about unsafe conditions or behavior. The controlling employer must do everything within his/her power, up to and including terminating the contract, to maintain a safe workplace and protect all employees on site. SITIOS DE TRABAJO CON EMPLEADORES MÚLTIPLES Cuando más de un empleador opera en un mismo sitio de trabajo, Cal OSHA lo considera como sitio de trabajo de empleadores múltiples. Un sitio de construcción es un ejemplo de un sitio de trabajo con empleadores múltiples, con diferentes contratistas asignados a sus trabajos, pero no al mismo tiempo. Los empleadores en este tipo de sitio necesitan conocer sus responsabilidades, los papeles que tienen asignados y sus responsabilidades con respecto a la salud y la seguridad de los empleados. Cabe notar que un sitio con empleadores múltiples es diferente de un sitio con empleadores dobles, en el cual los empleados tienen dos empleadores al mismo tiempo. Por ejemplo un empleado de una agencia temporal de empleos que se encuentre asignado a un sitio de trabajo de otro empleador. En sitios de trabajo con empleadores múltiples, todos los empleadores deben trabajar en conjunto para identificar y controlar los peligros con el objeto de cumplir con las normas de Cal OSHA para la salud y seguridad de los empleados. Los propietarios y encargados de los proyectos tienen la misma responsabilidad con respecto a la seguridad de los empleados. Cuando Cal OSHA identifica infracciones de seguridad en un sitio de trabajo, dicha agencia evalúa la jerarquía del propietario y el empleador para determinar si el propietario y/o el(los) empleador(es) son responsables de la infracción. Cal OSHA identifica cuatro categorías de empleadores en sitios de trabajo con empleadores múltiples:

 El Empleador Creador (Creating Employer) crea la condición de la infracción.  El Empleador Exponedor (Exposing Employer) emplea a los trabajadores expuestos a la infracción, independientemente de si ese empleador haya creado la condición.

 El Empleador Corrector (Correcting Employer) tiene la responsabilidad específica de corregir las condiciones de infracción. El plan debe identificar los peligros específicos al sitio, precauciones de seguridad y la parte responsable; esta información debe indicarse en los contratos para el sitio. El empleador controlador deberá asegurar que cada contratista/subcontratista entienda, y esté de acuerdo con cumplir los requerimientos de seguridad contenidos en el contrato. One of the bigger changes made by Towbes was the replacement of their old A/C system with an evaporative cooler. They also installed A/C economizers with the new system to further improve efficiency. In part by simply replacing existing T-12 fluorescent light bulbs with more efficient T-8 models, Towbes achieved an incredible 25% reduction in energy consumption.

Beginning on April 22, 2010 renovation, repair and painting contractors must: • be “RRP certified” • use lead safe work practices when working in homes built before 1978. The RRP rule affects contractors, property managers and others who disturb known or presumed lead-based paint during renovation activities done for compensation. The includes most repair, remodeling and maintenance jobs, such as window replacement, weatherization and demolition. The rule applies to any work that disturbs painted surfaces in residential houses, apartments and child-occupies facilities such as schools and day-care centers built before 1978. Fines for violating RRP Rule requirements can be up to $37,500 per incident.

All renovation workers must be trained. They can be trained to use lead safe work practices on-the-job by a Certified Renovator if the work is not HUD regulated, or they can become Certified Renovators themselves.

Firms performing renovation, repair or painting work must also become certified. This can be accomplished by applying to EPA and paying a fee.
