RESOLUTION DIRECTING THE HOUSE COMMITTEE ON HEALTH AND APPROPRIATE COMMITTEES TO CONDUCT AN INQUIRY, IN AID OF LEGISLATION, INTO THE REPORTED NONPAYMENT OF BENEFITS OF PUBLIC HEALTH WORKERS, OR THE REDUCTION AND IRREGULAR PAYMENT THEREOF, ALTHOUGH SUCH BENEFITS ARE MANDATED BY REPUBLIC ACT 7305 OR THE MAGNA CARTA OF PUBLIC HEALTH WORKERS AND DIRECTING THE COMMITTEE ON APPROPRIATIONS TO ENSURE THE INCREASED ALLOTMENT FOR SAID BENEFITS IN THE NATIONAL GOVERNMENT BUDGET FOR FISCAL YEAR 2003 IN ACCORDANCE WITH RA 7305 AND IN THE INTEREST OF IMPROVING THE WELFARE OF OUR PUBLIC HEALTH WORKERS AND THE EFFECTIVE DELIVERY OF HEALTH SERVICES TO THE PEOPLE W HEREAS Republic Act No. 7305, otherwise known as the Magna Carta of Public Health Workers, was approved on March 26, 1992 and took effect on April 17 of the same year; W HEREAS Section 2 of RA 7305 states that: "The State shall instill health consciousness among our people to effectively carry out the health programs and projects of the government essential to the growth and health of the nation. Towards this end, the Act aims: 1) to promote and improve the social and economic well-being of the health workers, their living and working conditions and terms of employment; 2) to develop their skills and capabilities in order that they will be more responsive and better equipped to deliver health projects and programs; and 3) to encourage those with proper qualifications and excellent abilities to join and remain in government service"; W HEREAS after 10 years of the existence of RA 7305, the 74,000 public health workers nationwide still do not enjoy the benefits it mandates because the government has not fully implemented and followed the provisions of the law; W HEREAS the Alliance of Health Workers reports that the overtime pay and night shift differential pay of government health workers have not been granted while the subsistence allowance of P1,500 per month


has been reduced to P1,100 per month and subjected to many deductions. Hazard pay amounting to 25% of basic pay (minimum of P1,265/month) is not fully implemented and given regularly; an estimated 44,000 public health workers under the local government are given P200/month only or nothing at all; W HEREAS the apparent failure to implement the law granting these benefits stems from the inadequate amount being allocated for it every year in the national government budget. In the 2002 appropriation, only P357,015,000 for such benefits were allotted – which are not even enough to cover for the subsistence allowance of the 74,000 public health workers amounting to P1,332,000,000 or the subsistence allowance of the 30,000 public health workers retained under the DOH amounting to P540,000,000; W HEREAS the benefits specified under RA 7305 are reportedly subjected to the availability of funds or made dependent on the savings of government hospitals or health agencies, which however are almost impossible to raise due to the meager budget of government health units; W HEREAS the lack of funds for the benefits of public health workers and for government hospitals and local health facilities reflects the falling priority given by government to the health budget as a whole. In the 2002 appropriations, the share of health was only P11.4 billion or 1.8%, amounting to P0.40/person/day. This is far short of the World Health Organization’s recommendation to allocate 5% of the Gross National Product for health, or about P170 billion, in order to provide adequate health services to the citizenry; W HEREAS the benefits under RA 7305 are supposed to help alleviate the financial needs of ordinary health workers who receive an average monthly take-home pay of P5,000 and of health professionals who get P9,000 – which are way below the monthly salary level of P15,042 which the NEDA prescribes to make both ends meet; W HEREAS the government’s continuous disregard of the plight of these public servants who are already overworked yet sorely underpaid has resulted in demoralization and brain drain, especially among nurses who choose to go abroad to seek higher paying jobs and better working conditions; W HEREAS it is the people, especially the majority poor who lack basic health care, who ultimately lose out as a result of the government’s distorted budget for health services and blatant neglect of the welfare of government health workers who are the pillars of the public health care system; NOW THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, to direct the House Committee on Health and appropriate committees to conduct an inquiry, in aid of legislation, into the reported nonpayment of benefits of public health workers, or the reduction and irregular payment thereof, although such benefits are mandated by Republic Act 7305 or the Magna Carta of Public Health Workers; RESOLVED FURTHER to direct the House Committee on Appropriations to ensure the increased allotment of funds for the benefits of public health workers in the national government budget for fiscal year 2003 in accordance with the requirements of RA 7305 and in the interest of improving the welfare of public health workers and the effective delivery of health services to the people Adopted, 7 May 2002.
