RESOLUTION DIRECTING THE HOUSE COMMITTEE ON CIVIL, POLITICAL AND HUMAN RIGHTS TO CONDUCT AN INVESTIGATION, IN AID OF LEGISLATION, ON THE KILLING OF FOUR FARMERS IN SITIO SAN YSIRO, SAN JOSE, ANTIPOLO CITY LAST OCTOBER 21, 2001 ALLEGEDLY COMMITTED BY ELEMENTS OF THE SPECIAL ACTION FORCES OF THE PHILIPPINE NATIONAL POLICE BASED IN TAGUIG, METRO MANILA, AND RECOMMEND TO THE HOUSE OF REPRESENTATIVES APPROPRIATE MEASURES TO PREVENT AND PENALIZE SUCH VIOLATIONS, AND PROVIDE FOR THE INDEMNIFICATION, REHABILITATION AND RESTITUTION FOR THE VICTIMS' FAMILIES WHEREAS, Article III, Section 1 on the Bill of Rights of the 1987 Constitution states, “No person shall be deprived of life, liberty or property without due process of law, nor shall any person be denied the equal protection of the laws”; WHEREAS, on October 21, 2001, four farmers of Sitio San Ysiro, Barangay San Jose, Antipolo City, while hunting for food in the mountains of Antipolo, were tortured and summarily executed allegedly by elements of the Special Action Forces (SAF) of the Philippine National Police (PNP) based in Camp Bagong Diwa, Taguig, Metro Manila led by Police Senior Inspector Erickson Dilag, according to reports by the human rights organization KARAPATAN; WHEREAS, elements of the PNP-SAF allegedly responsible for the killing of the four farmers include Police Inspector 2 Ronald Cuya, PO2 Ernesto Bautista; PO2 Gatmar Jatalis, PO2 Pablito dela Cruz, PO2 Glen Salcedo and PO1 Crispin Colinio; WHEREAS, the said victims, Reynaldo dela Rosa, 26; Emiliano dela Rosa, 48; Jose Raul Maguiza, 40; and Dominador Anaceto, 36, were hunting in the mountains of Antipolo on the morning of October 21, 2000 when the said PNP-SAF elements met them and mistook them to be members of the New People’s Army; WHEREAS, Police Senior Inspector Dilag executed an affidavit last October 23 stating that his troops killed members of the New People’s Army based in the area; WHEREAS, a fact-finding mission led by KARAPATAN and other people’s organizations last October 23 revealed that the four farmers were legitimate residents of the area and that Emiliano dela Rosa was a sitio chief and Maguiza a tanod of Sitio Tanod in Antipolo City; WHEREAS, Emiliano and Reynaldo dela Rosa and Dominador Anaceto were all Dumagats, while Maguiza was a settler in the said area; WHEREAS, at around 9:30 in the morning of October 21, successive gunshots were heard by local residents which lasted for 15 minutes; WHEREAS, according to Leopoldo dela Rosa, elder brother of victim Emiliano, between 2:00 and 3:00 in the afternoon of October 21, six (6) elements of the military bearing no nameplates were looking for the sitio chief because they said there were some things that needed to be carried but did not say exactly what these were; WHEREAS, since the sitio chief was not around, Leopoldo dela Rosa, along with others, went with the military elements to the site and there found the bodies of his brother, his nephew Reynaldo, and Anaceto and Maguiza;


WHEREAS, Jonathan dela Rosa, son of Emiliano and brother of Reynaldo, stated that around 6:30 p.m. of October 21, he was told about four casualties in their area and in the house of a certain Ka Totoy, he found the bodies of his father and brother, along with two others, peppered with bullets; WHEREAS, victim Reynaldo dela Rosa, left behind his wife and two children who depended on him solely for their livelihood and other basic needs; WHEREAS, victim Emiliano dela Rosa, father of Reynaldo, left behind his wife and brood of eight children; WHEREAS, victim Maguiza left behind his pregnant wife and a child; WHEREAS, victim Anaceto left behind his wife and seven children who likewise depended solely on him to keep body and soul together; NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, that the House Committee on Civil, Political and Human Rights, conduct an investigation, in aid of legislation, on the killing of Reynaldo dela Rosa, Emiliano dela Rosa, Jose Raul Maguiza and Dominador Anaceto, all of Sitio San Ysiro, Baranagay San Jose, Antipolo City; FURTHER RESOLVED, that the Committee, based on its investigation, recommend appropriate legislation that will address, prevent, monitor and penalize violations of human rights and international humanitarian law as in this case; FURTHER RESOLVED, that the Committee, based on its investigation, recommend to the House of Representatives appropriate measures for the indemnification, rehabilitation and restitution of the victims’ families. FURTHER RESOLVED, that this resolution be consolidated with House Resolution No. 295 which likewise calls for an investigation into human rights violations committed in the Southern Tagalog region. Adopted, 21 November 2001.
