MAZA ______________________________________________________________________________________ ___________________ RESOLUTION DIRECTI NG THE COMM I T TEE ON CIVI L, POLIT ICAL AND HUMAN RIGHTS TO CONDUCT AN INVESTIGAT IO N, IN AID OF LEGISLAT ION, INTO THE TEST MISSION OPERATIONS OF CLASS 150 OF THE 9TH INFANTRY BATTALION OF THE PHIL I PP I N E ARMY WHICH CAUSED THE DEATH OF 15-YEAR OLD WITA MONSALAW LAST JULY 21, 2003 AS A RESULT OF STRAFING OF HOUSES IN SITIO BULAK, BARANGAY LOWER OLAVE, BUENAVISTA, AGUSAN DEL NORTE AS WELL AS THE REPORTED MAULI NG, TORTURE, ARBITRARY ARREST AND DETENT I ON OF SEVERAL RESIDENTS, THE DESTRUCTION OF A COMMUN I TY COOPERATIVE, AND LOOTING OF HOUSES IN THE AREA

W HEREAS initial reports from KARAPATAN-Agusan del Norte state that at around 6:00 a.m. on July 20, 2003, an estimated 100 elements of the 9th Infantry Battalion of the Philippine Army, bearing no nameplates, arrived in the remote farming and indigenous communities of Sitio Bulak, Barangay Lower Olave, Buenavista, Agusan del Norte reportedly on a military test mission; W HEREAS the test mission under Class 150 was led by certain officers named 2Lt. Sasing, 1Lt. Baltazar and 1Lt. Dayata. Upon reaching Sitio Bulak, the soldiers accused the residents of harboring members of the New People's Army (NPA). They then ordered them to drop to the ground; W HEREAS the troops then fired at the residents' houses. At that time, 15 year-old Wita Monsalaw was busy cooking breakfast inside their house. She was hit at the left side of her abdomen, causing her to bleed profusely. Monsalaw's family carried her to the forest where other residents already sought refuge; W HEREAS after two hours of hiding in the forest, the refugees brought Monsalaw to the hospital but their trek took all of 12 hours. The group was also repeatedly accosted and interrogated by troops patrolling various areas along the road. They were brought to the headquarters of the 402nd Infantry Battalion in Bancasi, Butuan City before being brought to the Agusan Del Norte Provincial Hospital in Libertad, Butuan City; W HEREAS in the course of bringing Monsalaw to the hospital, several members of the group suffered in the hands of the soldiers: Armando Sigahan was tied to a tree, his head was hit against it and his face repeatedly slapped; Isagani Malipania was repeatedly kicked in the stomach; Malito Segahan had a rifle nozzle pressed against his chest. All were accused of being members of the NPA; W HEREAS the following day, at around 5:00 p.m. on July 21, Wita Monsalaw died due to massive bleeding;


W HEREAS the alleged offenses of the test mission of Class 150 did not end with Monsalaw's death. The troops likewise reportedly destroyed the cooperative store in the area, looted and destroyed houses, as well as detained, interrogated and tortured a resident named Isagani Malipania and later used him as a guide; W HEREAS from July 21 to 23, 2003, Malipania was brought to different areas where alleged sightings of NPA members were reported. During his interrogation where he was forced to admit his ties with the NPA, he was mauled while tied to a tree. His head was covered with a cellophane, and his male organ was kicked and burned with five cigarette sticks; W HEREAS Malipania was also forced into servitude during his subsequent detention at the Buenavista Police Station. He was detained at the said police station on July 23 and was released the following day upon the intercession of his barangay captain who fetched him; W HEREAS the conduct of these military operations leaves much investigating and explaining to do since the incident narrated herein reveal the brazen employment of sheer terror and force by government troops on civilians. In February 2003, a 180-strong Class 148 under a certain 1Lt. Felipe held similar test mission operations in the same area; NOW THEREFORE BE IT RESOLVED that the Committee on Civil, Political and Human Rights, conduct an investigation, in aid of legislation, into the test mission operations of Class 150 of the 9 th Infantry Battalion of the Philippine Army which caused the death of 15-year old Wita Monsalaw last July 21, 2003 as a result of strafing of houses in Sitio Bulak, Barangay Lower Olave, Buenavista, Agusan del Norte as well as the reported mauling, torture, arbitrary arrest and detention of several residents, the destruction of a community cooperative, and looting of houses in the area; RESOLVED FURTHER that appropriate measures be recommended against the perpetrators, including the identified officers, and indemnification and reparations be made to the residents of Barangay Lower Olave, Buenavista, Agusan del Norte.
