Bidders are hereby notified that pursuant to provisions of Section 1770, et seq., of the Labor Code of the State of California, the Contractor shall pay its employees the general prevailing rate of wages as determined by the Director of Department of Industrial Relations (DIR). In addition, the Contractor shall be responsible for compliance with the requirements of Section 1777.5 of the California Labor Code relating to apprentice public works contracts. Contractors and Subcontractors must be registered with the DIR pursuant to Labor Code 1725.5. This project is subject to compliance monitoring and enforcement by the DIR. The City of Santa Barbara requires all contractors to possess a current valid State of California C-12 Earthwork and Paving Contractors License. The company bidding on this must possess one of the above mentioned licenses at the time bids are due and be otherwise deemed qualified to perform the work specified herein. Bids submitted using the license name and number of a subcontractor or other person who is not a principle partner or owner of the company making this bid, will be rejected as being non-responsive. Bidders are hereby notified that a Payment Bond in the amount of 100% of the bid total will be required from the successful bidder for bids exceeding $25,000. The bond must be provided with ten (10) calendar days from notice of award and prior to the performance of any work. The bond must be signed by the bidder and a corporate surety, who is authorized to issue bonds in the State of California. Bidders are hereby notified that a separate Performance Bond in the amount of 100% of the bid total will be required from the successful bidder for bids exceeding $25,000. The bond must be provided with ten (10) calendar days from notice of award and prior to the performance of any work. The bond must be signed by the bidder and a corporate surety, who is authorized to issue bonds in the State of California. Bidders are hereby notified that they shall furnish a Bid Guaranty Bond in the form of a money order or a cashier’s certified check, payable to the order of the City, in the amount of 10% of the bid, or by a bond in said amount and payable to said City, signed by the bidder and a corporate surety, who is authorized to issue bonds in the State of California. When submitting a bid via PlanetBids™, the Bid Guaranty Bond must be uploaded as part of your submittal AND the original Bid Guaranty Bond of the (3) lowest bidders must be received by Purchasing within 3 City business days of the bid acceptance deadline in order to be considered responsive.
