Ensuring Racial Equality – from Classrooms to Workplaces – Depends on Federal Regulations Trump Could Roll Back By Derek W. Black | The Conversation

The Trump administration is considering eliminating one of the federal government’s most basic tools for preventing racial discrimination. When the government runs or funds programs, those programs are obligated to ensure that everyone gets equal access and treatment. This duty comes from something called “disparate impact regulations.” These regulations require the programs to pay careful attention to whether their policies cause racial disparities. From my perspective as a scholar of discrimination law, abandoning these regulations would be a major departure from the federal government’s mission since the 1960s of ensuring racial equality.

Historical Roots In the 1950s and 60s, civil rights advocates challenged racial segregation and inequality in every facet of public life – from schools, buses and bathrooms to employment, housing and restaurants. Congress passed the Civil Rights Act of 1964 to stamp out as much of that discrimination as possible, prohibiting discrimination in all those areas and more.

But Congress went beyond just prohibiting “discrimination.” It recognized that prohibiting policies with obvious or explicit intent to discriminate was not enough to ensure equality. Following Congress’s lead, the Department of Justice concluded in a 1966 report that policies that impact one racial group more than another should also be prohibited. Numerous other agencies agreed and put in place what we now call “disparate impact regulations.” The fact that some policy or practice disproportionately affects a racial group does not alone violate the regulations. The disparity, if serious enough, simply triggers further investigation by a federal agency. That investigation involves two key additional questions. First, does the program have a good reason, or “legitimate justification,” for the policy that is causing the racial disparities? If not, the agency can block the policy because the disparities are unjustified.

2 • The PHOENIX • Friday, March 8, 2019

But if the program has a good reason, which it often does, the second question is: Can an alternative policy achieve the program’s goals without producing egregious racial disparities? If so, the program should pursue the less discriminatory alternative because the disparities are clearly unnecessary.

Regulations Matter Today, discrimination and inequality continue largely due to subconscious racial biases. These biases are rampant and affect everything from who gets a job to who gets suspended from school. These regulations alleviate the need to dig into individuals’ minds and search for very difficult to prove racial motives. These regulations, like in decades past, further racial equality by asking that officials justify disparities and pursue alternative policies when possible.

For instance, a 2014 report from the U.S. Department of Education found that schools were suspending and expelling African-Americans more than three times as often as white students. Most of the time it was for minor misbehavior. While racial bias often plays a role in these disparities, federal agencies focused on the negative long-term consequences of school exclusion — consequences that are unnecessary. The Department of Education asked districts, when possible, to pursue alternatives that would bring down disparities and still maintain school order. This could include programs that prevent misbehavior before it occurs – like student behavioral supports and staff training. Schools that implemented those alternatives saw misbehavior and school exclusion

drop, and saw academic achievement increase. Agencies’ ability to push this change rested solely on the power given to them by disparate impact regulations.

Why Now? Critics, including the Trump administration, claim that disparate impact regulations impose an undue burden on federally funded programs. They say the regulations force programs to focus too much on analyzing data and avoiding statistical anomalies. Implicit in this claim is that racial discrimination and inequality are no longer widespread problems.

But disparate impact was never just about data, and discrimination was never fully eliminated. To the contrary, data shows discrimination has not declined in the past 25 years. Given the evolution of discrimination and the persistence of gross racial inequities, these regulations remain as important today as ever. Derek W. Judges and Court Employees Strut Down the Runway for Black History By Hannah Grossman Special to The PHOENIX

The Brooklyn court system doesn’t suggest thoughts of bright colors and fashion, but for the annual Black History Month Closing Ceremony Fashion Show, the gray lobby of the Kings County Supreme Court is emblazoned with sparks of bright African garments worn by Judges and court staffers as they strut down the runway. On a regular day, Natasha Delille works as an assistant law clerk to Hon. Wavny Toussaint, but on Thursday afternoon both she and Justice Toussaint took a break from the ordinary and joined their colleagues to exhibit their passion for Black History Month, a tradition in the Brooklyn courts that goes back more than two decades. “Everyone was so excited,” said Delille, who wore a Tribal Truth jacket during the show. Afterward, both she and the judge returned to their chambers to go back to work. Justice Toussaint was hardly the only judge to participate. Hon. Deborah Dowling and Hon. Robin Sheares hosted the event, and some of the models included Hon. Sylvia G. Ash, Hon. Sharon B. Clark, Hon. Jacqueline D. Williams, Hon. Connie Mallafre Melendez, Hon. Ellen Edwards, Hon. Genine Edwards, Hon. Kathy King, Hon. Paul Wooten, Hon. Ben Darvil and Hon. Sharen Hudson. Many of the court employees, from clerks to court officers, joined the judges in donning African-inspired outfits and hats. They include Jacqueline Sheppard, Marie Nyman, Taneka Teel, Shalica Robinson, Danielle Noel, Jacqueline Edwards, Natasia Richardson, Erika Jefferson, Latoya Richardson, David Polk, Maris Mike, Lisa Gayle, Cody Paul, Joam Alisme, Tracy Porter, Xaverian Carr and Ahmed Toure, in addition to Delille. The designers that were featured were all local Brooklyn brands including Moshood, Brenda Bunson, Merrill Matthews and The Fashion Fields.

Hon. Genine Edwards.

The designer of Noni, Nonye Anyadiegwu, strutted down the runway which had been sectioned off in one part of the court lobby. She wore a bright blue baby-doll dress with a maroon interlocking pattern on what she describes as “ankara fabric.” She also said it was inspiring that everyone was “happy, smiling and looking good” in her fashions.

All the court employees and judges wore clothes and hats made by Brooklyn designers.

Assistant Law Clerk Natasha Delille.

As the fashion show took place during the court lunch hour, dozens of employees, and even some jurors, crowded the lobby and watched from the floor above. They hollered and cheered on their colleagues as each was announced. Even a few retirees returned for the day to experience the day that marks the end of a month-long list of programs hosted at the courts.

“We came through a lot and we are still going through a lot,” said Beverly Richards, a retired Family Court law secretary, about the current and past black experience in America. Thursday’s fashion show was a break from all of that. “It’s just celebrating our culture and who we are.” Some models twirled, others clapped, or put up black power fists as they pranced down the runway to the rhythm of afrobeats music by DJ Cedric Williams. “Fashion epitomizes the spirit of AfricanAmericans,” Justice Dowling said. “We always put our best foot forward. We are positive about the next step,” This year’s theme of Black History Month is “The Great Migration.” The event at the Court marks the last day of Black History Month which runs through the entire month of February. At nearly every event for Black History Month the Black National Anthem is sung. One line reads, “Let us march on until victory is won.” The event has become such a big deal in the courts that it even has attracted the occasional politician. Brooklyn District Attorney Eric Gonzalez was one of those who stopped by on Thursday. “Black History Month is an opportunity to celebrate the past but we’re also looking forward to celebrate the future,” he said about the spirit of the show. “Once again we show that this borough is forward-thinking.”

What does it mean to be in love? For eight years, in images, writing and life, plain and simple, we have tried to tease out the answer. Love is a cliche, an idea so easy to imagine but impossible to grasp. Like an overripe fruit, it collapses with a bit of pressure into cloying sweetness and the faint sense of something lost. At its most basic, falling in love means cleaving away something of yourself and becoming something else. It’s painful and hard, but also carries the potential for profound transformation. When We Were Strangers is the first part of a lifelong project deconstructing love through the prism of our relationship. This first chapter is a love poem of sorts, one that charts

what happens when two people attempt to become something more and less than that, when we are more unknown stranger to each other than anything else. But love is an ouroboros that eats the past that came before it. Who was I before you? We are interested in the frayed edges, the messy intersections, the elements of ourselves lost and new facets gained in the process, and the limits to all of that. OTHER WAYS OF

KNOWING In our modern society, imagery is read instantly and without question. Other Ways of Knowing looks at how we see in order to challenge how we acquire knowledge. By questioning our relationship to images, we can look at the ways we’re fed imagery on a daily basis and teach us how to discern for ourselves what that imagery means to us. Other Ways of Knowing references illusion and misdirection traditionally designed to influence choice and transforms them into a new visual language. This digital iteration of Other Ways of Knowing features new additions to the series never exhibited before. The screens in the Made in NY Media Center will challenge the viewer to interact with a screen – a daily routine part of our lives – within a new context, one where you’re asked to stay for longer. This exhibition explores the narrative of the series in a new and refreshing way, accomplished by the unique collaboration of the space and the artist. HOROSCOPES march 7 - march 13, 2019 ♈ ARIES  Mar 21/Apr 20 Aries, there’s always ample opportunity to learn from past mistakes. You can make amends for previous miscues this week when you're reunited with someone from the past. ♉ TAURUS  Apr 21/May 21 Others seem to be feeding you information on a need-to-know basis. This may be frustrating, Taurus. But a little extra patience is required for the time being. ♊ GEMINI  May 22/Jun 21 Gemini, the need to delegate will present itself throughout the week. Don’t take on more than you can handle. Trust that those around you are up to the task. ♋ CANCER  Jun 22/Jul 22 The image that you project can be much more important than the work you actually do, Cancer. Have a good public relations team in your corner. ♌ LEO  Jul 23/Aug 23 The good will you demonstrate will come around in time, Leo. Continue to be generous and help others whenever possible. Karma is on your side. ♍ VIRGO  Aug 24/Sept 22 It is not easy to admit when you are wrong, Virgo. When the need to do so arises, be gracious and offer your apologies in a heartfelt way that will resonate with others. ♎ LIBRA  Sept 23/Oct 23 Libra, support is a twoway street. If you boost the confidence of a friend or loved one, in return he or she may help you in big ways. Work as a team to foster communication. ♏ SCORPIO  Oct 24/Nov 22 Take a step back from the rush and pressure that has surrounded you lately, Scorpio. You can use the rest to clear your mind. This break will help you tackle new things. ♐ SAGITTARIUS  Nov 23/Dec 21 Sagittarius, you may be eager to step into a new job right when another is finished. While this can be good for productivity, make sure you avoid burnout. ♑ CAPRICORN  Dec 22/Jan 20 Capricorn, sometimes you are acutely aware of details that others readily miss. This trait comes in handy when you are asked to advise others. ♒ AQUARIUS  Jan 21/Feb 18 It is important to be self-aware of the way you communicate with others, Aquarius. Pushing too hard might shut some people off. Adjust your approach accordingly. ♓ PISCES  Feb 19/Mar 20 Psychic feelings are pronounced this week, Pisces. Try to hone in on what these sensations are attempting to tell you.

The last six months have seen Fontaines D.C. release three hotly received double A-side singles, both of which were named as singles of the week by Rough Trade, and garnered early support from the likes of Steve Lamacq and others on BBC 6 Music, as well as earning feature space from every major Irish publication. Now they’re back with the release of ‘Too Real,’ the fourth two-track and 7″ release from the Irish quintet. Fontaines D.C. met in Dublin, influenced and driven in equal measure by the rich history of their hometown’s counterculture, their response has been to make concise and immediately authentic indie-punk that has done anything but fall on deaf ears. The band have gone from strength-to-strength with each release, and with a vast array of critical acclaim, renowned live shows, a series of sold out releases behind them and their recent signing to Partisan, the new single and forthcoming dates stand as a huge statement of intent, which is not to be ignored. Here’s Your Chance to Speak Up About the Spice Factory March 12 Meeting About Crown Heights South Development By Lore Croghan INBrooklyn

Will you miss the Spice Factory when it’s gone? On weekdays, the powerful scent of Morris J. Golombeck Inc.’s herbs and spices fills the air outside 960 Franklin Ave. If you’re strolling by, you may feel a sudden urge to take a gourmet cooking class so your dinners will smell half this great. The spice importer’s Crown Heights South factory is pleasing to the eye as well. The austerely beautiful redbrick complex has magisterial arched windows and a smokestack. Plus, if you’re a beer drinker, 960 Franklin Ave. is sacred ground. It began its existence as an enormous brewery called the Consumers Park Brewing Co.

OPEN HOUSE

So. If you think the Spice Factory should be adaptively reused and a new apartment building should be constructed on adjacent vacant land, this is your moment to share your opinion with city officials. If you support Ian Bruce Eichner’s plan to tear down the Spice Factory and build a 1.37 million-square-foot development with two towers, each 39 stories tall, now is the time to speak up. If you think Eichner’s firm Continuum Co. and development partner Lincoln Equities should build a more modestly sized apartment complex in accord with current zoning, it’s time to say so. At 1 p.m. on March 12, the City Planning Department will hold a public scoping meeting about the proposed development at 960 Franklin Ave. The meeting room is on the concourse level of 120 Broadway in Manhattan.

If you can’t attend, you can send written testimony to the City Planning Department.

A 1,578-UNIT APARTMENT COMPLEX WHERE A BREWERY STOOD The meeting is a step in the uniform land use review procedure, or ULURP, the Spice Factory project is required to undergo because its developers are seeking zoning changes for it. A draft scope of work for 960 Franklin Ave. says their proposed rental-apartment complex would have 1,578units, 789 of which will be affordable housing if zoning changes are made. There would also be retail space and a community facility. In Community — Continued on page 13INB —

Here’s Your Chance to Speak Up About the Spice Factory — Continued from page 12INB — Board 9 meetings last year, numerous neighborhood residents voiced their disapproval of proposed high-rise development at 960 Franklin Ave.

• Morris J. Golombeck Inc. Importers of Spices moved into 960 Franklin Ave. around 1955, the draft scope of work says.

OTHER DEVELOPMENTS AT THIS INTERSECTION

The intersection of Franklin Avenue and Montgomery Street, where the Spice Factory is located, is quite the development node. On the opposite corner from the Spice Factory, there’s a vast, rubble-strewn site at 40 Crown St., aka 902 Franklin Ave. Last year, Cornell Realty Management sold the site for $41.025 million to an entity led by Dennis Markus, Finance Department records show. He’s the chief financial officer of San Franciscobased Carmel Partners. The site is made up of properties with 135 Montgomery St., 149 Montgomery St. and 40-64 Crown St. as their addresses. The developer got the property rezoned so it can build a 16-story tower. Behind the vacant site, construction is well underway on a 12-story residential building at 109 Montgomery St. Brooklyn Botanic Garden sold this site for $24.5 million in 2015, Finance Department records show. Here’s a glimpse of the Spice Factory with subway tracks in the foreground. Montgomery Street Condominium. In 2017 they bought 962 and 972 Franklin Ave. for $33 million A 2016 DNAinfo story identifies the developers as LIVWRK from HPG Associates, whose president is Zev Golombeck, city in partnership with First Market Properties. Finance Department records indicate. We checked in with Golombeck employees the other day, and they’re still occupying the factory — for now. In 2017 the developers also signed a contract to buy 124 and 130 Montgomery St. from HPG Associates. The memorandum of contract filed in Finance Department records doesn’t reveal the Special price they agreed to pay for these properties.

ON MARCH 5, 1917, the Brooklyn Daily Eagle reported, “George Washington, who celebrates his name by getting in trouble annually around February 22, when patriotic but misguided acquaintances treat him to many drinks, will celebrate the next four birthdays of his illustrious namesake in jail. George was convicted of burglary again and Judge Fawcett, in the County Court today, sent him to Sing Sing for five years. ‘For years you have been disgracing that great name which you have taken unto yourself,’ said Judge Fawcett to G.W. ‘You need only one more conviction to be sent away for life. Let your sentence be a warning to men who think they can commit burglaries without being caught.”  ON MARCH 5, 1949, the Eagle reported, “Washington, March 5 (U.P.) — The Justice Department announced early today that FBI agents had arrested a Justice Department employee and a member of the Soviet delegation to the United Nations for conspiring to remove official United States government records. Attorney General Tom Clark identified the department employee as Judith Coplon, 27, and the Russian as Valentine A. Gubitchev, 32, third secretary of the U.S.S.R. Secretariat of the United Nations. Miss Coplon is employed in the Justice Department’s criminal division. Miss Coplon’s brother, Bertram G. Coplon [of New York City] said she had been employed by the Justice Department ever since her graduation from Barnard College five years ago. He declined comment on her arrest but said she came home from Washington every weekend to visit her parents [on Ocean Parkway] … The section in which Miss Coplon is employed has charge of the registration of agents of foreign countries and companies.”

Josephine Augello, President 5015 New Utrecht Ave. Brooklyn Daily Eagle cover from March 6, 1954

ON MARCH 6, 1954, the Brooklyn Daily Eagle reported, “San Juan, March 6 (UP) – Police besieged Nationalist leader Pedro Albizu Campos in his home today, while authorities elsewhere on the island began a roundup of 37 other ‘dangerous’ members of the fanatic minority party that shot up the U.S. Congress last Monday. A police squad led by Capt. Benigno Soto went to Albizu’s home before dawn to arrest him and was met by a burst of gunfire. No one was hit, but Soto ordered his men back out of the field of fire and settled down to take further action later. Police Chief Salvador T. Roig said the other 37 Nationalists were being rounded up in raids ‘all over’ this U.S. island. It was not certain how many actually had been arrested … Albizu is president of the party that staged an abortive revolt here in October 1950, tried to assassinate President [Harry] Truman early in November of that year, and injured five members of the U.S. House of Representatives in a terrorist attack Monday.”

Brooklyn Daily Eagle cover from March 7, 1940

ON MARCH 7, 1940, the Eagle reported, “The new British superliner Queen Elizabeth, largest ship afloat or ever built, strained at her anchor off Quarantine today, waiting for a rising tide before proceeding to her North River berth later this afternoon. She was expected to dock at 5 p.m., after moving into the harbor past watching crowds on adjacent shores in Brooklyn, Manhattan and New Jersey. The Queen Elizabeth came to an anchorage at Quarantine at 10:50 a.m., after a sensational dash across the Atlantic from the war zones of Europe through a submarine-infested ocean. Ten tugboats were obtained to “break” her into her resting place on the north side of Pier 90, North River, where she is to remain for the duration of the war … The Queen Elizabeth, unfinished and with the interior decorations still to be installed, arrived with a skeleton crew, no passengers and no cargo. She carried only enough lifeboats – 18 – for the crew. On board were few signs of life. The great ship, a fifth of a mile long, with her 12 decks terracing skyward, seemed to be on her own.”
