The events brought about during the height of the real estate market – risky and questionable lending practices, the lack of appropriate disclosures by some lenders, and the disregard for the well being of consumers, have resulted in a tightening of regulatory requirements in the mortgage lending industry. Many of these changes are being channeled through changes in the Real Estate Settlement Procedures Act (“RESPA”). What should you expect from your mortgage lender regarding proper disclosure of costs related to your mortgage loan? The first is a Good Faith Estimate (“GFE”). In simple terms, the revised “GFE” under RESPA reform is intended to clearly disclose key mortgage terms and closing costs, which allow consumers to more easily shop for a mortgage and compare costs at different lending institutions prior to completing

an application. Under the new regulations, the lender is responsible to deliver the costs they disclose on a Good Faith Estimate. When a borrower meets with a Seacoast Loan Officer, they will be given a Good Faith Estimate that shows all charges that are typical in the applicant’s market. The Loan Officer will explain the charges and how they can be affected based on different criteria such as loan amount, interest rate, property type and specific sales contract. Once the borrower signs a contract, our loan officer will review the actual charges specific to the transaction and, if appropriate, issue a new Good Faith Estimate. The regulation does not permit a change to the lender’s origination charges for the interest rate chosen, or transfer taxes unless it benefits the borrower or there is a valid change of circumstances. words, what is shown on the GFE must be what the borrower actually pays at closing. And there are further tolerances based on whether the borrower uses a “Preferred Settlement Service Provider” recommended by the lender, or they choose one that is not. All of this can be explained by a Seacoast Loan Officer. In light of this new regulation, some lenders are avoiding this requirement of locking in the Good Faith Estimate by providing what they refer to as a “worksheet” or “loan scenario form”.

These forms do not have to meet the new government accuracy standard and therefore are a loophole to complying with tighter regulations.
