s Austin tops every major top 10 list for its small business friendliness, abundance of green homes, proclivity towards fun and opportunities for job growth, the city’s real estate market grows more susceptible to real estate scams. As more REALTORS learn about the various types of deception that can occur in this industry, they will be better qualified to help clients avoid potentially risky situations. “I think Austin is currently ripe for investor scams because we are the ‘it’ place to be,” says Vanessa Nunez of HomeCity Real Estate.

“Since we are on every major top 10 list of the best places to live, scammers are ready, willing and making their way here. As agents, the most important thing we can do is research diligently, ask all the right questions and put our clients in contact with our trusted team of inspectors, lenders and title officers.”

The Short Sale Scheme In a short sale, the lien holders agree to release their lien on the real estate and accept less than the amount owed on the debt. There are short sale specialists who are not licensed, but understand how the banks work. “They suggest making a low-ball offer to see what the bank will accept,” says Patrick Easter of Easter and Easter REALTORS. “This is bad for the seller, and only delays the bank on making a decision when they are trying to figure out why their appraised value is so much higher than the offer that has been presented.” When one of Nunez’s clients returned from a tour in Iraq, he encountered a short

sale scheme. “A house flipper told my client that he could take the house off his hands, had him sign over the deed and then proceeded to wholesale the property and lease-to-own,” says Nunez. In truth, the house flipper transferred the property to another flipper who was supposed to manage the lease purchase and make payments to the mortgage company. When the soldier was being deployed again, his clearance was denied because the property was headed to foreclosure. In the end, Nunez called the bank and helped administer a short sale to keep him eligible for the military. “The sad part is the flipper had a real estate license and was misrepresenting the way ethical REALTORS are supposed to work,” she says.

The Unnecessary Property Records/ Document Fee After purchasing a property, many homebuyers receive documents from companies stating that they can file homestead exemption and warranty deed paperwork for a fee. “It is

Austin Board of REALTORS®

TM

Putting a Face on Real Estate since 1995

Chairman’s Column By Bill Evans • 2014 President

Change is coming

T

he upcoming weeks will bring lots of changes to Austin and Austin-area REALTORS. On Nov. 18, MLXchange and Fusion will go the way of “The Book” and other outdated MLS solutions, leaving Matrix as the MLS system available to our ACTRIS Subscribers. If you haven’t started transitioning your work to Matrix, now is the time to do so. Nov. 18 will be here before we know it, and you don’t want to spend the week before Thanksgiving dealing with a cold-turkey MLS transition! Visit the “Training & Resources” page of Abor.com/Matrix to register for free MCE courses throughout the Austin area and access online manuals and video tutorials.

Get Out the REALTOR Vote! The Nov. 4 election represents a critical juncture for the City of Austin. Central Texas has experienced tremendous growth in recent years, but inadequate housing supply and stressed transportation infrastructure threaten quality of life and continued prosperity in the region. The upcoming transition to 10

single-member districts gives us a landmark opportunity to improve how Austin is governed and how we empower leaders to meet the challenges we’re facing. The Austin Board of REALTORS is proud to support candidates that will lead our community to a new and better Austin. Each of the candidates below was vetted through the ABoR legislative management team—a hard-working group of your volunteer colleagues—and expressed a willingness to work with ABoR towards policy outcomes that are supportive of homeowners and a healthy housing market in Central Texas. The LMT's endorsement recommendations were then considered by the ABoR Board of Directors for final approval. We hope you will consider casting a vote for and supporting the candidates your colleagues have identified as those best suited to serve the needs of the real estate industry: • City of Austin Mayor - Steve Adler • City Council District 1 - Ora Houston • City Council District 2 - John Sheppard

3

October 2014

• City Council District 4 - Gregorio "Greg" Casar • City Council District 5 - Ann Kitchen • City Council District 6 - Jimmy Flannigan • City Council District 9 - Chris Riley • City Council District 10 - Robert Thomas Download your 2014 Voter Guide at Abor. com/Election to learn more about ABoR-endorsed candidates and ballot initiatives. But most importantly, get out and vote! Exercise your democratic right and cast your ballot during early voting, which runs from Oct. 21-

31, or on Election Day, Nov. 4. Please also remember: it is expected that there will be runoff elections in December, so you will need to get out and vote for the candidates of your choice at that time as well. Thanks for taking the time to read this, and thanks for your continued support of our association and the staff that works so hard on your behalf. Please let me know if there is anything I can be doing for you, and I hope to see you soon. RL

2014 a buyer’s market for haunted listings

W

hile much of the US real estate market has recovered in 2014, it is still a buyer's market for these haunted homes. Also known as stigmatized properties, these legendary houses were all placed on market in 2014, but remain unsold. An online MLS ad for 1217 Marion St, Dunmore, PA reads: "Built in 1901, this Victorian home in the Hollywood section of Dunmore features 1850 sf of living space. Original hardwood floors. 4 bedrooms, 2.5 bathrooms. Off-street parking. Freshly painted. Slightly haunted. Nothing serious, though. E.g. The sounds of phantom footsteps. A strange knocking sound followed by a very quiet (hardly noticeable, even) scream at 3:13 a.m., maybe once a week. Twice a week, tops. And the occasional ghastly visage lurking behind you in the bathroom mirror. Even still, this occurs very rarely and only in the second floor bathroom." 108 Ocean Avenue is a "pristine, charming 3-story waterfront Dutch colonial with commanding views of the Amityville River. Renovated boat house." Wait a second… did you say

‘Amityville’? Yes, this house that has been the subject of 11 horror films since Ronald DeFeo, Jr. shot and killed six members of his family and it can be yours for just under $1 million. On 306 French St, Fall River, Massachusetts sits a fine 14-room Queen Anne Victorian home. The property features two sunrooms, seven fireplaces, original parquet floors, tin ceilings and mahogany moldings. The previous owner was a quiet librarian named Lizzie Borden. None of these houses were sold in 2014, and they have since been removed from the market, but there are some tips you should know when trying to sell a stigmatized property. Believe it or not, the NAR has done some research on the topic of haunted houses which can be found at: http://www.realtor.org/field-guides/fieldguide-to-dealing-with-stigmatized-properties. Forty-one percent of respondents said they would buy a home with reported ghost sightings, but only 15 percent would pay the full market value. The Williamson County Association of RE-

Banker United, REALTORS. “ Homebuyers might also receive a letter from the tax office asking how much was paid for their property. REALTORS should advise their clients not to disclose this information because Texas is a non-disclosure state and sales prices are not considered public information.

Loan Documentation Fraud Primary residence disclosure is the most common example of loan documentation fraud. “People who tell lenders that they plan to reside in the house and don’t are committing fraud,” says Easter. “Stated loans are used to purchase high dollar properties and then the ‘angel investor’ drops out of the deal after the agent(s) involved and the loan officer pocket the money. The bank is left holding the bag.”

Predatory Lending Fraud “A company that tells the homeowner: ‘You better sign now because this deal will not be offered later’ is untrustworthy, says Easter. Companies that take liens on properties in exchange for over half of the potential equity are also suspect. “These companies disguise this fee as a prepayment penalty so there is no cap on the interest,” says Easter. “I had a client who lived in a property for over 20 years and an ‘investor’ showed up with an offer that would make the client current on his taxes and back payments,” says Easter. After reading his proposal, the investor was supplying the client with $30,000 (to be used towards the taxes and back payments) so that he could take half of the equity in the property when the client was selling within six months. This equated to over $40,000 in profit for the inves-

tor for a $30,000 investment. “I told my client to hire an attorney and not sign the proposed documents. Luckily, his family loaned him the money and he was able to repair the house and not have to share the profit,” says Easter. Easter continued, “If the same people who create these schemes would put the same amount of effort into an honest business, they could be extremely good REALTORS but they will not stay on the straight and narrow.”

Legitimate Resources Any third party website that is not governed by the real estate commission is susceptible to fraud. “Every time I post a property on Craigslist, I am bombarded with junk mail from people in Nigeria asking for money,” says Hepp. “The most credible website for marketing property is www.Realtor.com because it is associated with the National Association of REALTORS, (NAR) which is synched with our reliable MLS system.” Checking specific phone numbers and names of previous satisfied clients is a good way to determine a company’s credibility. “If they can't provide some examples of these relationships, they are not credible,” says Easter. “The MLS is the most credible resource, a REALTOR's own website or the Broker Underground on Facebook works well too. It is all about informing other REALTOR members about a potential home.” Educating the client should be a REALTOR’S priority throughout the entire process. “It is our moral and ethical duty to supply our clients with effective resources, such as websites, organizations, title officers, lenders and inspectors, that help them make the most effective, educated decision,” says Nunez. To ensure that the perfect home is created, Jimmy Jacobs Homes has developed a five-stage process. First, an initial meeting is held to identify building requirements, build a timeframe and budget, and identify the de-

tate-of-the-art designs, a dedication to every detail and exceptional customer service have made Jimmy Jacobs a pre-

mier luxury homebuilder for Central Texas for nearly 30 years. In 1985, the company was started by Jimmy Jacobs, whose passion for the construction industry led to a desire to deliver a high-quality, unique product. “A Jimmy Jacobs Home has a lot of personality and custom touches,” says Rebecca Bitter, marketing director for Jimmy Jacobs Homes. “We have signature options, such as our ‘drive-thru’ master luxury shower, that are special to our brand. The homes are designed with custom touches, but developed as a plan line-up to make the selection and build process much easier for buyers.” Currently, Jimmy Jacobs has presence in Austin, San Antonio, New Braunfels Georgetown, and Leander. In Sept. 2013, the company was purchased by Century Homes,

lot. With an inventory of more than 75 home designs to choose from and new property additions every day, buyers can purchase an available home that meets their specific design and layout needs while residing in their ideal living community—from family friendly or active adult to lake access or country club. “The homes’ style and design vary based on the wants and needs of that area,” Bitter says. “For example, in Rim Rock we offer ranchstyle home designs because the home sites are located in the Hill Country, and the home sites are more than an acre in size, which helps to really maximize the views. In Avalon, the homes are more geared toward budget-conscious families who seek properties that give them ample room to grow. These communi-

sign features important to the homeowner. Next, a home site evaluation will take place, and consultants will assess the property site to determine the best placement for the home and uncover unforeseen costs. Jimmy Jacobs’ in-house architectural design department will then work with buyers to customize one of its home plans based on their needs and desires. Throughout the plan design process, homebuyers are able to review and perfect the home’s details before the plan is finalized. Finally, a builder is assigned and will oversee all aspects of the construction process, from the initial pre-construction meeting to the final property walk through. Additionally,

Homebuilding activity is well underway at Tessera on Lake Travis, Austin’s newest master-planned community located on the north shore of Lake Travis in Lago Vista. The 875-acre community, developed by awardwinning real estate development company, Hines, offers an oasis of outdoor recreation and resort-caliber amenities with all of the conveniences of city living. Tessera is framed by Lake Travis to the south and the vast Balcones Canyonlands Wildlife Refuge to the west and north, which helps explain the active, vibrant outdoor-centric vibe of this new community. Tessera on Lake Travis’ first phase of development will include homes priced from the mid-$200’s by well-established builders, Highland Homes and Wilshire Homes, featuring

scenic lake and Hill Country views. Complementing Tessera on Lake Travis’ exceptional home offerings is a wealth of family-friendly amenities that have been tailored to take advantage of the community’s scenic surroundings. Tessera on Lake Travis’ first community pool and pavilion overlook Lake Travis and features a negative edge pool and patio where adults can relax and socialize while children cavort in the splash pool. Residents can also take advantage of more than four miles of dedicated trails with many more to come. Tessera on Lake Travis is located on FM 1431. Village Builders celebrates new luxury model in Rim Rock Village Builders announces the grand opening of its newest model home in the popular Rim Rock community, in Driftwood. The home is part of its Provence collection, and its design captures the essence of pure Texas Hill Country with such features as metal accents and high roof pitches. Visitors are welcomed into an enclosed front courtyard that is defined by a covered approach and a front bedroom or study that can be an optional Casita. A combination of stone and stucco on the exterior with a brickaccented façade and simple massing creates a classic and welcoming persona in this 3,200-square-foot, 1 1/2-story home. The current phase in Rim Rock has just 35 homes, all on 1-2 acre lots with abundant trees. Each home includes attractive ameni-

ties such as stone and stucco exteriors, expansive outdoor living areas with fireplaces and kitchens, three-car garages, bonus rooms and luxury laundry rooms. Inside, these Village Builders homes include full hardwood flooring throughout, Kent More cabinets and topquality finishes in every room. Village Builders’ luxury homes in Rim Rock start in the $430s and range in size from 2,548 square feet to 3,599 square feet, plenty of room for any family. RL
