n January 10, 2017, the 85th session of the Texas Legislature convened here in Austin. For less than 140 days, after distracting weekends and holidays, leaders from Texas Association of REALTORS (TAR), Austin Board of REALTORS(ABoR), Williamson County Realtors (WCREALTORS), and Texas Association of Builders (TAB)

have the chance to advocate for more than a dozen important issues. Some of the globally supported initiatives include reducing new fees and costly regulations, pushing for transportation and infrastructure funding, promoting affordable housing strategies, and mandating tax transparency.

Hidden Property Tax

The Problem: Hidden property taxes have been a threat to housing affordability in Austin, as well as Dallas, Houston, and San Antonio, the last several years. Between 2004 and 2013 property owners watched tax revenues shoot up by 46 percent, according to TAR, which comes out to $14.29 billion. “Part of the increase can be attributed to new property added to the appraisal roll and higher property values,” says Daniel Gonzalez, TAR’s director of legislative affairs. What we can do: Demand transparency. Help owners recognize when their home value goes up but their tax rate stays the same or only lowers slightly, but not enough to cover their increased property appraisal. Sound confusing? As a result, many homeowners all over the spectrum have been forced to sell because they were unable to afford their tax liability.

Linkage Fees A top concern for TAB, one that trickles directly down to agents, brokers, and buyers, is the notion that Austin has been considering charging developers linkage fees. Those advocating for charging these impact fees say that earnings will fund affordable housing programs. But more likely, says Ned Muñoz, vice president of regulatory affairs at TAB, is the risk that more fees will put housing out of reach for potential buyers. Thousands in Austin alone would be priced out and won’t qualify for a mortgage. What is it: Linkage fees are a per-square-

foot assessment on all new development and is charged to builders. “The concern we have with the fees are that you’re raising the price of housing for everyone in the name of affordable housing for the few. We feel that it is counter intuitive,” says Muñoz. If there’s a $2 fee on a 2,000-square-foot home, a linkage fee adds $4,000 to the cost of that home. TAB crunched some numbers and came to the conclusion that for every $1,000 added to the price of a starter home, 20,000 potential buyers are priced out of home ownership. “It just doesn’t make sense,” says Gonzalez. While legislation on linkage fees has not yet been mandated in Texas, more than 900 TAB members from 28 chapters felt compelled to attend an organized rally at the Capitol in mid-February. What we can do: There’s a balanced way to do this, says Muñoz. For example, using existing revenues, float bonds, or offer incentives like waiving other regulatory fees.

The City of Austin’s current land development code was written in the 1980s, so a rewrite is overdue. Politics and the busy REALTOR


o you ever think about the many ways government impacts our industry? Mortgage financing regulations, local sign ordinances, real estate licensing requirements, what actions clients are required to take—these are just a few of the many ways government has a say in our business. That’s why it’s so important for REALTORS to engage at every level of government.

What’s happening in D.C.? The National Association of REALTORS (NAR) is the more powerful advocate for real estate consumers and REALTORS in Washington, D.C. At the Texas REALTORS Winter Meeting, February 10-14, NAR’s Deputy Chief Lobbyist Jamie Gregory explained issues NAR is watching in D.C., including tax reform. Gregory discussed the strong representation Texas has in Congress and reassured REALTORS that NAR is committed to protecting incentives that promote property ownership, including the mortgage-interest deduction and 1031 like-kind exchanges.

At the state level Your Texas Association of REALTORS (TAR) volunteer leaders and governmental affairs staff are always working to promote good public policy that supports private-property rights and the real estate industry. TAR reads every single bill that’s filed to ensure nothing gets through that could negatively affect your business. The association is also monitoring bills that may directly or indirectly affect Texas real estate. Currently TAR is monitoring almost half of the 3,500+ bills already filed. Visit to see TAR’s legislative priorities for the 85th Texas Legislature. Priorities this session include eminent domain, infrastructure, HOAs and sales-price disclosure.

Policy is SEXY!

n 2013, I attended my first Asian Real Estate Association of America (AREAA) Leadership Summit. One of the AREAA speakers was encouraging participation to the AREAA Policy Summit in Washington, D.C. His opening line was “Policy is not sexy,” perhaps comparing it to the action and glitz at the other AREAA events such as the Global Luxury Summit and the National Convention. The purpose of the summit was to meet directly with Congressional leaders and government officials to raise awareness about Asian American and Pacific Islander (AAPI) housing issues and advocate for policies that will help increase and protect AAPI homeownership. As the fastest growing segment of the U.S. population, and as the largest minority participant in the mortgage market, AREAA deemed that creating effective housing policy strategies for the AAPI community should be a priority for policy makers and business leaders. Fast forward to May 2016. I participated in my first AREAA Policy Summit in Washington, D.C. Our three policy points were 1) The Disaggregation of AAPI data in quarterly

homeownership reports, also known as the “No Other” campaign, 2) Alternative credit: support H.R. 123 reauthorizing the FHA’s alternative credit pilot program, and 3) 1031 Exchange reform: Reject any language limiting or repealing section 1031 in FY2017 Budget. It was good to talk to Congressional representatives face-to-face about our policy points, be heard and hear their insights as well. It was a very empowering experience knowing that we can be part of the process, however small our contribution is, and however slow the process was. Policy is important because while a policy document is not a law, it will often identify new laws needed to achieve its goals. And that is a great way to make a difference. So yes, policy is sexy! n 2002, two brothers in Missouri set out to help veterans take advantage of their VA home loan benefits. After dominating the online mortgage market, Veterans United Home Loans started opening retail branches across the country in 2010. In 2014, a statewide proposition was passed to fund road and highway construction in the state. To this day, however, the program is still lacking the finances needed. TAR explains that perpetuating monetary shortages is the underperforming gas tax, which at 20 cents has not been raised since 1991. According to Muñoz, the current insufficient transportation network and poor infrastructure impedes commerce, inflates the cost of goods and service, and decreases viable housing options. What we can do: ABoR has come up with several ideas for travel demand management that can help alleviate congestion until there’s funding for construction projects. Brandy Guthrie, 2017 president of ABoR, says that travel demand management techniques would go a long way in relieving travel problems, including flexible work arrangements and telecommuting. “If we work more collaboratively from a more global perspective with other businesses, it can help ease congestion and traffic for everyone.”

tation are hot topics for everyone in Austin, there are some mandates supported by just one or a combination of associations. For instance, Darian Rausch, treasurer for WCREALTORS and a member on the board of directors, says they’re “laser focused on watching bills that can negatively affect property rights.” Another concern is streamlining city ordinances regarding open house signs. Until that happens, REALTORS in Williamson County may need to file an open house event plan with one or more cities, provide a map with the location of every open house sign, and pay a steep fee for every event. ABoR’s Guthrie says that while there are no water shortages right now, drought conditions are a potential reality. “We encouraged local municipalities and board officials to be more involved in research and implementation of projects that would add to current water resources.” Texas REALTORS are also supporting the implementation of the State Water Plan, which outlines how Texas will provide water for the next half century, by way of conservation and infrastructure improvements. The best way to help get a bill introduced or to stop those that are a nuisance to real estate professionals, is for members to actively support TAR, ABoR, WCREALTORS, and TAB and get familiar with issues these organizations are monitoring. Also, consider familiarizing yourself with state lawmakers. Texas REALTORS are hosting a REALTOR Day at the Texas Capitol on April 4. Members of the real estate community from across the state are invited to meet with lawmakers and discuss this years’ legislative priorities. Forging positive relationships with legislators is one of the best ways to help promote REALTOR and homeowner policies. RL

Join us for a variety of networking opportunities coming up

ebruary was a very full month. We experienced one of the largest turn outs in years at our District A meeting at ABOR. And what a meeting it was! William Edge gave us tips on how to better serve our clients no matter what the industry; whether it is real estate or hair salons, we are in the service industry and our high level of service and confidence is what sets us apart. We also heard from Jim Nunn with an excellent CE class “From Fixer Upper to Dream Home” and very helpful information on the Starkey Mortgage Renovation Loan product. The meeting was a collaborative effort from eight different networks coming together to make a successful day. Winter Meeting was also full of learning opportunities and a fun night for our Women’s Council TREPAC event “Romancing the Stone Mystery Theater.” Who would ever have guessed Ms. Ethel O’Dell would turn out to be our murderer. All in fun! We successfully raised $16,000 for TREPAC. On February 13th, Women’s Council, Austin hosted a RPR (REALTOR Property Resource) Intro and Advanced three-hour CE

class. Points on understanding how to use the hundreds of options for reports on your property to the amazing app for your phone to search information for your clients on the fly. We are very excited about our upcoming events and would very much like to invite you to join us. On March 20th, 2:30 p.m. to 4:30 p.m. in the Canyon View Event Center at ABOR, we will be hosting a Panelist discussion called “A Tale of Three Cities: What REALTORS need to Know to Sell.” The panel guests include Georgetown Mayor Dale Ross, Round Rock Mayor Pro-Tem Craig Morgan, and Leander Mayor Chris Fielder. The event is followed by an offsite happy hour. We are very excited about this class and hope to see a lot of you there. Education is a core value to Women’s Council, Austin. For our March 28th class, we will have Kim Barnes presenting her twoHour CE Media Class at Precision Camera in West Anderson Plaza at 2438 W. Anderson Lane B-4, Austin, TX 78757. This class will fill up fast so look for our sign-up event on WCR Austin Facebook page. April Cakes bring TREPAC Dollars. Our annual TREPAC Cake Auction will be Thursday, April 13th in the Canyon View Event Center at ABOR from 4:00 p.m. to 7:00 p.m. This is a little different from our past meetings. You will enjoy networking more with your colleagues while enjoying hors d’oeuvres with your glass of wine. Then the auction begins with it a lot of fun bidding wars— all for the cause of property rights and our businesses. Just a teaser for some of our upcoming classes to be held at venues that will also serve as our Mixer Happy Hours, places like Baby A’s and Cover 3 just to name a couple. More information on our future classes and speakers is to come. After attending a “CodeNext’ open house at Lanier High School, I am sure there will be some information given in some

form after the maps of the proposed zoning comes out in April. It is very important to our clients and prospects to understand the everchanging communities we live in. Sixty years as a network makes Women’s Council, Austin a proven organization that works hard to be a force of support and education for others in our industry.
