ax time can be nerve wracking for anyone—especially in this current economic climate. Folks are looking for ways to pinch pennies anywhere they can: reducing costs on extras like cable television and recreational activities, or even more drastic cuts like turning the thermostat down a degree a two, even during this slightly colder than normal Austin winter. One place you should absolutely never cut corners, not for

any reason, is on your taxes. “Ninety percent of avoiding an audit, surviving an audit, and not having a problem with the IRS – is to assume that you’re going to be audited every single year,” suggests Sandy Botkin, CPA and author of "Lower Your Taxes: Big Time.” The good news is that the taxman only audits about 1 percent of individual returns. On the other hand, professionals in the real estate industry happen to hit a lot of the targets that can raise a red flag at the auditor’s office. “In 2012, one out of

can save yourself in every three people audited earned $50,000 or less,” says Eddie Pietro, a Dallas-based office manager for H&R Block. Considering that in the past year, the average real estate sales rep in Austin earned $40,000 and more experienced agents earned, on average $68,000, a good percentage of the industry are reporting an income

that the IRS examines more than any other earnings bracket. According to the IRS, selecting a return for examination does not always mean you made a mistake, misreported your income, or over estimated your exemptions. A return can be chosen if a filer’s W-2 or 1099 does not match the information provided by someone the taxpayer did business with. In other words, if the amount you claim in commissions does not match the amount your employer is claiming they paid you, the IRS may send you a letter requesting an examination. Incidentally, according to Pietro, a letter of audit can arrive up to seven years after you file. So if you receive a notification in 2014, it’s likely the IRS will be interested in returns anywhere from 2010 to 2012, or earlier. For that reason, says Botkin, also the founder of Taxbot, an application that helps 1099 workers stay organized

Tax time is here!

Q

uite a few changes affect REALTORS filing their 2013 income taxes this month. Be sure you're aware of these changes to keep your hard-earned income. I've never been one to beat around the bush, so let's start with the bad news:

New tax bracket for higher-income households If you’ve had a successful 2013—so successful, in fact, that you find yourself in the highest tax bracket—be prepared to pay more than you did last year. That’s because Congress created a 39.5 percent bracket for taxpayers whose adjusted income is $400,000 for a single filer or $450,000 for joint filers. Last year, the highest tax bracket was 35 percent, so the increase will definitely be felt. The good news is that for 98 percent of taxpayers, their brackets have stayed the same. Under the Bush-era tax structure, there were six brackets, of 10, 15, 25, 28, 33, and 35 percent. This new law adds the 39.5 percent as a seventh bracket to that.

New 3.8 percent net investment tax For 2013, there's a new 3.8 percent tax on net investment income. The tax is part of the big health insurance reform law passed in 2010. Under the tax, households with adjusted gross income of $200,000 for a single filer or $250,000 for joint filers are potentially subject to the tax if they have a certain level of investment income. Calculating the tax can be complicated and is best done with the assistance of a professional tax advisor. The good news is with the sale of a primary residence, you have the added factor of the $250,000 to $500,000 capital gains exclusion, important to know for determining whether the tax would apply to you. If you sold your house for a gain of more than $500,000 (that’s gain, not sales amount), then you automatically deduct the $500,000 capital gains exclusion from your gain ($250,000 for a single filer). That means if your gain was, say, $530,000, only $30,000 is considered investment income under the tax.

0.9 percent Medicare tax increase

Simpler home office deduction

The health reform law also added a 0.9 percent Medicare tax, also known as the “additional Medicare tax,” because it sits on top of the existing 2.9 percent Medicare tax, which applies to your wages, compensation, or self-employment income. The additional tax is based on a threshold amount for your filing status, generally $200,000 for a single filer and $250,000 for joint filers. Thus, if your income is at that threshold, your Medicare tax is raised to 3.8 percent, not to be confused with the 3.8 percent net investment income tax.

You now have a choice on how you determine the deduction for your home office. You can calculate your deduction the way you always have, by determining the square footage of your office space, and dividing the other costs with the rest of your home. Or you can use the IRS’s new simplified method, under which you take a straight $5 per square foot deduction for up to 300 square feet for a potential maximum deduction of $1,500.

And now for some good news!

Increased mileage deduction For your 2013 filing, the per-mileage rate has been increased a penny to 56.5 cents, from 55.5 cents, per mile. That doesn’t sound like a lot but, you no doubt spend a lot of time in your car and those miles can add up quickly.

Health Insurance Deadline Uh-oh, and don't forget March 31! That's the deadline for getting federally approved health insurance. This doesn't affect your 2013 taxes, but you could be penalized $95 by the IRS in 2014 if you miss the deadline to get insured this month. While I have tried to be as informative as possible, I always encourage REALTORS to seek professional tax advice. As painful as tax time can be, remember the wonderful opportunities your income has provided for yourself and your family throughout this past year. RL

Build habits that stick

A

s we move through our daily lives, desirable habits can often be difficult to establish, as there are many distractions that can lead us away from our target and right back to our old ways. This month, I share author Gregory Ciotti’s research on motivation, discipline, and habit building, and look at how to break down these findings to actionable steps.

You should make “micro quotas” and “macro goals” In a study on motivation, researchers found that abstract thinking is an effective way to help with discipline. In simple terms, “dreaming big” is actually effective. Additionally, there is also a lot of research showing that being motivated internally rather than through punishments or rewards (self-determination theory), is essential in building habits that stick. Therefore, it is important to find a way to balance this desire to dream big with your day-to-day activities, which usually does not result in quick, dramatic changes. One solution is to create “micro-quotas” and “macro-goals.” Your goals should be the big-picture items you wish to accomplish; and the quo-

tas should be the minimum amounts of work that must be accomplished every day to make the bigger goal a reality. In other words, chunk it down. Quotas make each day doable, resulting in achievable goals.

Create behavior chains Developing habits that stick is far easier when we make use of our current routines, rather than fighting them. “If-Then Planning” (If “X” happens, then I will do “Y”) is built around environmental “triggers” that we can use to let us know that it’s time to act on our habit. This tactic involves picking a regular part of your schedule and then building another “link in the chain” by adding a new habit. Here’s an example: rather than “I will get more listings,” you could say, “Every morning, I will contact 10 people I know and discuss who they know that may be wanting to sell.” This activity makes your habit measurable. Instead of “eating healthier,” go with “If it is lunch time, then I will only eat meat and vegetables.”

Eliminate excessive options Self control is the power to be boring. Take, for example, President Obama’s insistence on never wearing anything but blue and grey suits. To quote him, “I’m trying to pare down decisions. I don’t want to make too many decisions about what I’m eating or wearing; because, I have too many other decisions to make.” This belief is well supported by research on self-control, which finds that making repeated choices deplete our mental energy, even if those choices are mundane and relatively pleasant. According to the Harvard Business Review, if you want to maintain long-term discipline, it is best to “identify the aspects of your life that you consider to be mundane and then “routinize” those aspects as much as possible. In short, make fewer decisions.” Lasting change occurs when the steps taken ultimately change both your environment and schedule. Stop buying snacks if you want to stop snacking, pack a very similar lunch every day of the week, and embrace the power of routine to get the necessary done each day.

Process plan (but don’t fantasize!) Why do you want the change to occur? It may seem like a small detail, but this plays a huge role in keeping motivated over time. Excessive fantasizing about results is usually detrimental to sticking to a habit. According to a UCLA study, the mistake is in what we visualize. Those who engage in visualizations that include the process of what’s needed to be done to achieve the goal (learning another language, by visualizing practice every day after work), are more likely to stay consistent than those who visualize speaking Spanish while visiting Mexico. Visualization works for two reasons:

1. Planning: visualizing the process helped focus attention on the steps needed to reach the goal; and 2. Emotion: Visualization of individual steps led to reduced anxiety.

Eliminate “ah-screw-its” New habits are usually fragile. Therefore, we must eliminate any source of friction that may lead us astray. The “ah-screw-it” moments occur specifically when you find yourself saying “Screw this; it’s not worth the effort!” The solution? Examine your habit and find exactly where things begin to break down. For example, Author/Speaker Ramit Sethi explained how he improved his gym attendance by finding where things would slip. “When I sat down to analyze why I wasn’t going to the gym, I realized: my closet was in another room. That meant I had to walk out in the cold [to] put on my clothes. It was easier to just stay in bed. Once I realized this, I folded my clothes and shoes the night before. When I woke up the next morning, I would roll over and see my gym clothes sitting on the floor. The result? My gym attendance soared by over 300 percent.” Incorporate an “if-then” scenario once you find the culprit. If fatigue is stopping you from calling 10 people about real estate needs after work, set up a system of “If I’m feeling tired after work, then I will take a 20-minute nap and then read about someone successful for five minutes to get myself motivated. Make sure you have receipts for everything you do.” These days, programs like Taxbot, as well as services provided by H&R Block, make saving and organizing your receipts easier than ever. The IRS is notorious for not divulging the number of individuals who receive a notice of audit each year. But as the experts Reality Line Austin spoke with revealed, because real estate professionals tend to have a fluctuating income and more exemptions and deductions than salaried W-2 workers, it’s important to take note of the following tips and tricks (in no specific order) just in case a notice of audit shows up in your mailbox. Hire an accountant. Both Pietro and Botkin could not be more adamant about this point. Everyone makes mistakes. If you did your own taxes for the year you’re being examined, have your taxes reviewed by a tax professional. While there’s a chance you underpaid, “there’s also a chance you left money on the table,” says Pietro. Remember, the IRS is looking for inconsistencies – not necessarily an underpayment. Save every receipt. Sure, those tiny tabs of paper showing how much you spent on gas and business meetings could get out of hand by Jan. 7th. But since you’re likely one of the 61 percent of adults who own a smartphone, you can easily take a snapshot of your receipts for instantaneous file and storage by any number of the specialized tax apps, including those mentioned here. Never talk to the IRS. Your accountant should handle all of your IRS correspondence. Not only will she fill out and file your examination forms, if for any reason the IRS wants to make a field appointment (in-person meeting),

your accountant will go for you. Additional tip: According to Botkin, if you do choose to go to your field appointment, you have the right to record the meeting. Though, he suggests doing this only if you feel like the agent is behaving in an unprofessional manner. File an extension. Simply receiving a notice of examination does not mean you’re in trouble or that you owe anything, but not filing the paperwork within a 30 to 60-day window could result in steep fees or penalties. If the reason for your audit is due to filing late in the first place, by requesting an extension right away, which you are entitled to do, you’re less likely to miss your deadline. Do your due diligence when you hire a new accountant. If you hire a tax professional who suggests inflating or taking improper deductions, you’re the one who will be held accountable. Each year the IRS publishes a list of accountants that have been disbarred. About 40 years ago, that list would consist of about two or three accountants. “Today I’m seeing 40 or 50 at a time,” says Botkin, who also notes, “most accountants are very ethical.” Typically, when someone receives a letter of examination from the IRS, they know if they tried to hold back a few extra dollars. The best course of action is to make the adjustment and pay the money you owe. “The IRS is not sympathetic in the slightest. If you’re making the money, you’re required to file estimated tax returns and you’re required to send the money in,” says Botkin. The penalties for failure to file or failure to pay, including underpayment, can be harsh. According to Pietro, one of the penalties for underpaying your taxes is losing your right to claim certain tax credits (such as the earned income credit) for anywhere from two to 10 years. RL

What is the purpose of a business?

I

f you ask people the question, “what is the purpose of a business,” the majority will say “to make money.” Granted, there are a few business owners in our society, sad to say, that actually believe this, but I am convinced they are in the minority. Most start a business to have more freedom, to make their own decisions, determine their own destiny or to develop and sell a product or service that improves the lives of others. If you don’t have money, or don’t have enough money, making money is a good goal. But after we make more money than we need every month, most people develop a different perspective. We realize there is more to life than just making money. A business has three purposes: 1. To give you your life! What do most agents do? Give lives to the business! They work for years and years and finally leave with nothing of value to sell, they have put nothing of value in their asset column and they have very little life because

they gave most of it away; they gave their life to their business. Remember, if you don’t design your life, someone else will gladly do it for you! Design your life first, then design the business to give you that life. Here are six questions to ask yourself when designing your life: 1. What do I want? 2. Why do I want it? 3. How bad do I want it? 4. Am I willing to do whatever it takes to have it? 5. Can I have it? 6. How will I know when I have it? 2. To solve a problem. Observe your own buying habits. Most of what we buy solves a problem we have. Cars trump horses. Cell phones trump land lines. E-mail trumps “snail” mail. Grocery stores trump farming. Air conditioning trumps heat. On and on this goes. We don’t want to care for and ride horses, be tied to a tele-

phone cord, write letters, then stamp and mail them, grow our own food, or be hot in summer. So we buy cars, cell phones, email service, food and A/C systems. So if you want your business to thrive, it needs to solve a problem people are having. The bigger the problem we solve, the more money we make! Money is the byproduct. Money tells you how good your problem-solving skills are and how well you are strengthening and servicing others. The marketplace will tell us how well we do this by voting for us and each dollar is a vote. This is why Bill Gates, for example, is worth so much; he solved a huge problem, we bought it because it improved our lives and he was well paid. Take a few minutes and look at your business; what problems do your customers have? How big are they? Are you solving them? What, if anything, could you do better? As humans, we are designed to be information gatherers and problem solvers by nature. In business, that’s how we get paid. The bigger the problem, the bigger the check. 3. To add value. How does a business add value? Businesses add value to their customers by doing more with less. Blockbuster had a great selection of videos. But they were put out of business by Netflix because Netflix added more value to the customer than Blockbuster. How? It’s simple really. Netflix does more with less! Instead of going to Blockbuster to get a movie, strolling up and down the aisle searching for the one they want, then standing in line to pay, then paying extra for fines for being late, then finally going

home and sitting on the couch and watching their movie, they went straight to the couch and kept the movies as long as they wanted with no late fee ever. So here’s the question: Are you Blockbuster or Netflix? How much value do you add to your customers’ lives? How do you do more with less? How do you make it possible for them to do more with less? How many barriers are there between you and your customers? What do they have to go through to reach you? Talk to you? Buy from you? Refer people to you? How hard is it to do business with you? Look at this with all the companies you do business with. Observe your experience with them. Does their product or service solve a problem you have? Do they do more with less? Do they make it easy for you to find them, get to them, talk to them or ask them questions? Do they educate you? What do they do to wow you and make you want to return? What could they do better? Do they have a product or service that you really need or want but the experience is so bad that you dread going there? Do you go anyway because they have a solution to a big problem you have? What if they had a solution and wowed you with an incredible buying experience? As you observe these companies you do business with, look for ways they could improve the processes, the systems, the logistics, the ease with which they could do business with you. Do you see how this may apply to real estate? A real estate transaction is rife with problems! Talk about a target-rich environment. If your business is the kind that wants to solve problems, you should thrive in this environment. RL
