hen buying or a selling a home, the MLS listing is typically one of the first, and often most impactful, opportunities to showcase property. Whether viewed by the REALTOR or prospective homebuyer during a property search, the listing discloses a variety of essential informa-

tion from location to square footage to price, all factors that can attract and deter a prospect. Aside from the essential criteria, the MLS listing can be a driving factor in whether a home buyer is interested in a property. This has led many agents to get creative with their listings, specifically regarding the descriptions and photography, to enhance a property’s charm and appeal. Additionally, many real estate companies and REALTORS alike create professional websites to market their services, areas of expertise and accolades. Like the MLS listings, these websites utilize content and imagery to better portray their brand and offerings to potential clients. While often unintentional, many MLS listings and professional websites are in violation of copyright infringement laws because of the photographs used. According to the U.S. Copyright office, “copyright is a form of protection grounded in the U.S. Constitution and granted by law for original works of authorship fixed in a tangible medium of expression ... including literary, dramatic, musical, and artistic works.” Penalties for copyright violations can be steep. “Even if the copyright owner cannot show they have been damaged, the federal law pro-

vides a penalty range from $200 to $150,000 for each work infringed, plus court costs and attorney’s fees,” says Joe Babb, General Counsel for the Austin Board of REALTORS and their MLS, ACTRIS. “Under some circumstances, though typically unusual in the real estate community, the infringer can even go to jail.”

Copyright Challenges But what mistakes are the real estate community making when choosing and using photographs online? As described earlier, the issues typically arise within an MLS listing and professional website. MLS Listing Liabilities There are a few ways to produce photographs for a listing, such as through an MLS employee, REALTOR, homeowner, or third-party photography. Often, to ensure a high-quality product, a third-party photographer is hired; however, even in lieu of a contract, copyright laws may still be broken. “The rights some REALTORS obtain from photographers are often insufficient for them to comply with their MLS rules,” Babb says. According to the MLS rules, to be compli-

ant, the REALTOR must “warrant,” or promise, to the MLS that they own or have obtained all rights to the images and content within the listing. Additionally, they must grant the MLS the right to use the listing content “for any purpose consistent with the facilitation of the sale, lease and valuation of real property.” “Where REALTORS slip up is in the license from the photographer,” Babb says. “Often, it is only valid through the marketing period of the property, which means they are in violation of the MLS rules and their warranty to the MLS because the listing content must also be available after the sale, for use in the valuation of other properties.” When valuing comparable properties, REALTORS utilize data, including photographs, from previously sold properties. Because of this, the MLS repository serves as an important valuation tool. “Even if the license is no longer valid based on the contractual agreement from the photographer, the MLS doesn’t know and is relying on the warranty from the REALTOR that their rights are sufficient to comply with the

The importance of CodeNEXT CodeNEXT, the rewrite of Austin’s Land Development Code (LDC) is a hot topic in Austin. That’s because it has the potential to change what can and can’t be built on a given property, affecting your business and clients. Most projections show the Austin region continuing its historic pattern of strong growth and CodeNEXT presents a critical opportunity to be proactive in managing the effects of that growth. ABoR is reviewing the current proposal with an eye toward whether it lives up to this opportunity and delivers a transparent, simplified code that property

owners can understand. For the first time in 30 years, this is our opportunity to put Austin on the right track to managing growth responsibly. I encourage you to take time and educate yourself on the proposed change and share your comments online at bit. ly/AustinCodeNEXT. The deadline to comment on the maps is Friday, July 7. While comments on the online code are closed, you can contact the Planning Commission at AustinTexas.gov/ PlanningCommission to share your opinions. Look for more information from ABoR on opportunities to engage with CodeNEXT. In the meantime, share stories about your experience with Austin’s current code at CodeNEXT@ ABoR.com.

exus. It’s a word we’ve all heard before, but do we really know what it means? Merriam-Webster defines nexus as (1) a connection or link (2) a connected group or series and (3) center or focus. For the past seven years, the WCREALTORS board of directors has been working on making the Williamson County Association of REALTORS the nexus of education and the voice of real estate for Williamson County; it is so important to the board of directors that it is the first task in our strategic plan. “WCREALTORS will be the nexus of real estate education and be the ‘Voice of Real Estate.'” As many of you know, the Association has joined forces with the Four Rivers Association of REALTORS and the Temple-Belton Board of REALTORS® in the first true Regional MLS in Central Texas. Since the inception of this partnership in August of 2016, the MLS has grown leaps and bounds! In July we will begin to see the addition of the entire Fort Hood MLS system into the CTXMLS. Shortly after Fort Hood comes on

board, we will see the addition of the entire Victoria Area MLS system! Once the data from the newest shareholders have been loaded into Matrix, the member count will be over 4,000 members and will service over 15 counties. In addition, CTXMLS is one of the first MLSs to work with CoreLogic to utilize Trestle, a groundbreaking IDX management tool! Once this service launches in August, it will allow subscribers to request a feed through an approved IDX vendor and a brokerage can request a direct feed as desired. Over the past couple of weeks, I’ve received a lot of questions about CTXMLS but the most interesting question centers around a large misconception that the other Associations are still running their old MLSs. The Four Rivers MLS and Temple-Belton MLS completely went away and ALL their historical data has been converted into CTXMLS. When the Fort Hood Area Association of REALTORS® joins this summer, the same will happen with them! We truly have 4+ MLSs in just one system. From the first day we went live, we encour-

www.myRealtyLine.com aged our members to join CTXMLS as an additional MLS to the one you’ve been using for years. WCREALTORS is the only shareholder who joined CTXMLS without historical data. As of June 1st, CTXMLS has just under 4,000 active listings across Central Texas. In addition, there were 3,600 members in the system—a number that continues to expand. Currently, the CTXMLS covers over 5,809 square miles; after FHAAR and VAAR join, the total square footage of market space will be over 12,000 square miles. For more information about CTXMLS, visit http://wcmls. live or contact one of the Association Shareholders. Stay tuned for more information on the explosive growth of CTXMLS. Earlier this year, the Association announced a partnership with the Austin Relocation Guide to publish the Williamson County Newcomer & Relocation Guide which will launch its inaugural issue in August. We all have seen, listened, and read the reports about how Williamson County is one of the fastest growing counties. In late May, the U.S. Census Bureau released a list of the fastest growing cities in America! Two of the growing cities in America are right here in Williamson County, Cedar Park at number 11, and Georgetown at number 5. There are more new families mov-

ing to Williamson County than ever before, and the Association is working diligently to ensure that you have a chance to work with our county’s newest residents. This magazine, in connection with WCLife, will cover everything from relocating to living in Williamson County. It will explore new home communities, education, transportation, shopping and dining, as well as tips to getting settled. Not only will the content be published in print, but an interactive digital edition will also be available on wclife. org. The Williamson County Newcomer and Relocation Guide provides an essential guide to educate and assist families and individuals through the complete moving process and will be a valuable resource to our community. Special advertising opportunities for the Relocation Guide are available to members of the Williamson County Association of REALTORS, contact Hannah Poyo at (512) 2556211 for more information on getting in on the ground floor of this amazing opportunity. The future is now at WCREALTORS, and we are working diligently to stay abreast of the ever-changing technology and advancements in the industry to help you help your clients even better! RL

That’s a wrap: HBA 2017 Parade of Homes™ goes out with a bang

he Home Builders Association (HBA) of Greater Austin just wrapped up its 2017 Parade of Homes™ in The Peninsula at Rough Hollow in Lakeway. This year’s Parade was absolutely spectacular with each home boasting panoramic views of Lake Travis and the surrounding Hill Country. Open from May 12th through the 29th, thousands of visitors poured in to take a look at five multi-million dollar homes fully furnished and on display. Five of Austin’s top builders: Arbogast Custom Homes, Jenkins Design & Build, Lake Travis Builders, Laurel Haven Homes and Triton Austin custom crafted each home outfitted with amazing details and features that inspired each visitor as they explored the halls looking for design ideas to infuse into their own homebuilding, remodeling and decorating projects. Visitors were encouraged to vote for their favorite home on the Parade route. After all the votes were counted, it was Jenkins Design & Build who was honored with the coveted People’s Choice Award. If you missed the tour, here’s a quick over-

view of each home, some of which are still on the market looking for that perfect buyer: 599 Vendemmia Bend by Jenkins Design & Build (People’s Choice Award Winner) A classic approach to a traditional German farmhouse evokes a timeless sense of style and comfort to this home. This four-bedroom, four and a half bathroom home with three-car garage boasts extensive interior luxury amenities, soaring Hill Country views and a refreshing pool and feels like a resort. When the Jenkins design team first walked the empty lot at this homesite, the vast size of the lot and its proximity to the front of the neighborhood seemed to call for an expansive four-bedroom, four and a half bathroom, one-story home. The design team wanted the architecture to blur the lines between indoors and out. The breezeway starts that journey, giving way to the well-appointed courtyard. The home is decked out in modern appeal with its clean lines and high-tech conveniences. Earthy materials like 100-year-old reclaimed wood floors and native stone create a feeling of warmth and help bal-

ance its bright natural light. An outdoor pavilion connects the front yard to the back and the front courtyard is large enough to host neighborhood parties. 618 Vendemmia Bend by Laurel Haven Homes Nestled in the Peninsula of Rough Hollow in Lakeway, you will find 618 Vendemmia Bend overlooking beautiful Lake Travis. Inspired by the grand mansions and villas of the 30s and 40s this modern vintage villa features cutting edge design and finishes woven with the charm and grandeur of an era gone by. Seamlessly transition from indoors onto the gorgeous resort-like outdoor living area to be awed and transported by both the lakeside hilltop views and the tantalizing infinity pool complete with swim-up bar and outdoor kitchen. This is the lush living you have been dreaming of. This 2017 Parade home features five bedrooms, four full bathrooms, two half bathrooms and a four-car garage within 6,600 square feet. Special features include a two-story master bedroom closet, catering kitchen, two-story study and panoramic views of Lake Travis. 622 Vendemmia Bend by Triton Austin Hilltop Transitional Barn – that was the inspiration as the Triton Austin design team began the process of transforming this one-acre lake-view lot into an unforgettable experience. This hand selected site allowed for expansive Lake Travis views, as well as 270 degrees of lake and Hill Country views. As the team worked through the layout of this home, contemporary luxury was the central message that served as the guide. This house features 5,755 square feet of heated area, and 9,000 square feet of total covered area. Included are three living areas, a fourcar garage, five bedrooms, five full bathrooms,

15

and two half bathrooms. 605 Vendemmia Bend by Arbogast Custom Homes (Sale Pending) This timeless “farmhouse” was inspired by Old World German architecture and the subtle elegance of a Texas Hill Country home. A perfect blend of rustic and modern accents are found throughout. A towering vaulted great room with exposed trusses and extensive use of wood beams welcomes guests into the main living area. Rift Sawn White Oak cabinets and a custom hand-crafted steel vent hood accentuate the Sub-Zero and Wolf appliances in this Master Chef ’s kitchen. Showcasing the finest in luxury amenities and soaring Hill Country views, this spacious and luxurious home will satisfy the most discerning buyer. Sitting on nearly an acre, the home boasts over 5,000 square feet of exquisite living space with five bedrooms, a one-of-a-kind bunk room, and four full bathrooms along with onehalf bath. 609 Vendemmia Bend by Lake Travis Builders (SOLD) An entertainment dream home, this stunning, custom crafted five-bedroom, four-bathroom luxury home from Lake Travis Builders was designed to enjoy the gorgeous views of Lake Travis and the surrounding Hill Country. As you enter this estate, the dramatic foyer leads you to an outdoor living and dining space with custom fire pit and relaxing negative edge pool overlooking expansive views of Lake Travis, and a full grill for the ultimate grill master. The home also includes a spacious professional kitchen that is open to the living and dining areas, a private master suite and opulent master suite spa bathroom. Whose photo is it anyway? Copyright laws and your business

aybe some of you have experienced a story like this: A few years ago a REALTOR sold a house in just a few days. Two days after closing, the buyer’s REALTOR called to say the buyer was very upset to see that the home they just bought still had pictures on the internet. Of course, they demanded the listing REALTOR take the pictures down immediately. They didn’t want others to know what their house looked like. They felt it was an invasion of their privacy. The listing REALTOR explained they had already taken their posts down but in the world of Internet, once other websites pick up your listing they think they own the photos. This has been a problem for us. All our seller clients want us to syndicate their properties to get the utmost visibility. Unfortunately, there is always a different side to every action. This story has probably happened to all of us in some form or fashion. So here is the real question, who owns the photos and how do they hold the reins on how they are published? In November, Chloe Hecht, NAR Associate Counsel, gave us some

insights on this issue. “It is crucial to know what rights you own in photographs and how those rights permit you to use the photographs. To reduce your risk of copyright infringement, you should: “Basically have a permit agreement with the owner of the photos and maintain records of all assignments and licenses.” In the case of a third-party photographer being used, there are again, two options, a license, or an assignment of rights for addressing this issue. The participants should be made aware of this issue so that they can properly address it in their agreements. Knowing what copyrights protect is key. Copyright law protects any original creation, and grants the holder of the copyright exclusive control over when, how, and by whom their work may be copied, distributed, or exhibited. This includes literary works, paintings, photographs, drawings, films, music (and its lyrics), choreography, sculptures, and many other creative works. There are only 367 pages to the Copyright Law of the United States and Related Laws Contained in Title 17

President’s Column By Rela Manigsaca • 2017 President

I

Talk real estate policy to your U.S. Senator and Representative

was part of the 150-plus member advocates of the Asian Real Estate Association of America who went to Washington, D.C. for the 2017 AREAA Policy Summit last month. There were three policy points that we delivered that can boost homeownership for the Asian American and Pacific Islanders (AAPI) community. 1) Removal of the 1 percent rule for deferred student loans. The 1 percent rule is taking 1 percent of a student loan and factoring it in as monthly payment in the debt-to-income ratio calculation. With a significant percentage of AAPIs pursuing undergraduate and higher education, and incurring student loans, eliminating the 1 percent rule for those whose loans have been deferred would allow them to start early in their wealth building without forgiving the loan. 2) Adopting alternative credit scoring as a predictor of one’s ability to repay a loan. First generation immigrants, specially AAPIs, are culturally debt-averse so traditional FICO scores are an inaccurate or incomplete measure. Delinquency in periodic payment items such as rent, utilities, medical payments and insurance typically negatively affects the credit score. Should not the same

items, when paid regularly and on time, be considered to reflect positive ability to repay a loan? 3) Language access reform supports the effort to increase language access in real estate transaction documents. First generation immigrants, including AAPIs, who don’t speak English sign on the dotted line without understanding document specifics. FNMA and FRMC has a proposed redesigned URLA (1003) that includes the addition of a preferred language data field. In reality, these policies will benefit all immigrant and non-immigrant communities, not just the AAPI. So we all need to pull together on this. What do you need to do, you may ask? For No. 1 and No. 3, have your U.S. Senator and Congressman tell HUD, FRMC, FNMA and the FHA about these! For No. 2, tell your U.S. Congressman to support bringing these two bills on to the floor - HR 123 was introduced by Rep. Al Green and HR 898 introduced by Reps Ed Royce, Krysten Sinema and Terri Sewell. Help us get the word out! Find your U.S. Congressman here: http://www.house.gov/representatives/find/. ocused on providing custom homes that merge comfort and functionality, Hill Country Artisan Homes offers luxury properties throughout the Texas Hill Country. Hill Country Artisan Homes is a member of the Qualico family of homebuilders, which has more than 65 years of homebuilding experience in Canada. In 2007, Pacesetter Homes was established by Qualico to build properties in the Austin market. In 2016, Qualico created Hill Country Artisan Homes to further its reach and brand. “Hill Country Artisan Homes has access to all the resources of Qualico and Pacesetter at our disposal, such as funding, marketing administrative support and more, but we are operated and managed independently,” says Roy Edmiston, senior project manager. Edmiston and Spero Stavros, new home and custom specialists, oversee the management of the local operations. Today, Hill Country Artisan Homes has presence in two gated communities: La Ventana in Driftwood and Rio Rancho in Liberty Hill. Soon, building will take place in the Marbella community in Leander and a 2018 Home Builders Association (HBA) of Greater Austin Parade of Homes property in Travisso. With close in proximity to Austin, Hill Country

Artisan Homes communities boasts excellent shopping, schools and entertainment within a nearby vicinity. “La Ventana is one of the more sought after Hill Country neighborhoods,” Stavros says. “A meadow filled with Longhorn cattle welcomes you into a community offering custom homes on secluded 1.5 to 2.25-acre properties, ranging from the $600s to more than $1 million. Located within a short drive to several Hill Country wineries, as well as two popular area restaurants, Trattoria Lisina and Salt Lick Barbecue, and boasting fantastic amenities and an equestrian trail for horseback riding, it’s not surprising why it’s is so highly regarded.” Hill Country Artisan homeowners in La Ventana will have access to an array of features and amenities, such as a neighborhood pool, playground, clubhouse with commercial kitchen, weight room and gym, sauna and spa, volleyball and tennis courts, driving range,

www.myRealtyLine.com picnic areas and more. Homeowners in Rio Ancho Ranch will enjoy a community pool, clubhouse and acres of parkland along the banks of the San Gabriel River in the highly popular area of Liberty Hill. In addition to the expansive neighborhood features, Hill Country Artisan Homes offers a variety of custom home offerings for any style. When choosing a home design, homeowners can choose from three options: Hill Country Artisan Homes’ portfolio of home plans, their own blueprints, or plans from one of their partner architectural firms. This year, Hill Country Artisan Homes was recognized by the HBA of Greater Austin with two honors at the 2017 MAX Awards: Best Design over $600K and Best Interior Merchandised Model over $1 million. “Homeowners can expect excellent service throughout the building and design process at Hill Country Artisan Homes,” says Edmiston. “We provide services to assist with home design, blueprint consultation, floor plans and architectural oversight, as well as professional interior designers, to ensure our homeowners create the home of their dreams.” Unlike other custom homebuilders, Hill Country Artisan Homes has an average build timeframe of approximately eight months,

which is less than the one-year and more timeframe of other builders. “Homeowners in La Ventana will save thousands of dollars with a lower tax rate of 1.86 percent, compared to nearby competitor’s 2.9 percent rate,” says Stavros. “Additionally, no interim financing is required, and homeowners enjoy a one-time closing.” RL

Front Page: Continued rules,” Babb says. “To protect themselves from penalties for infringement claims and MLS rule violations, REALTORS need to secure a license broad enough to cover all MLS uses.” Protecting a Professional Website Whether a business or IDX website, stock imagery is often used. Possibly pulled through a web search or from another webpage, it’s illegal under copyright laws to use third-party photographs without the appropriate permissions. In recent years, many businesses across a variety of industries have been receiving demand letters from photo licensing businesses and photographers, such as iStock or Getty Images, requesting that their images be removed, and in some cases request compensation, due to copyright violations. The companies who created the photographs own them, and even though they can be obtained online, they cannot be used without payment and agreement. Additionally, it’s important to recognize that the website owner is always liable for the violation, regardless if a third-party web developer assisted in the creation and production of the website.

How to avoid Copyright complications There are three ways to ensure copyright compliance to protect your business. 1. Understand the MLS Requirements If you are using a third-party or outsourced photographer for MLS listings, it’s imperative to review the contracts to ensure they meet the requirements of the copyright law and MLS rules. “I advise that REALTORS should obtain the full rights and ownership over the photographs, or at least an exclusive license that

covers all MLS purposes, not just the marketing period, in a written agreement with the photographer,” Babb says. 2. Audit the website Review the website in question and identify all images. If you cannot confirm where the photographs came from and that you have the appropriate permissions to use them, you should remove them from the website, either until you obtain documentation or replace them with compliant images. To ensure you are using approved, legal images, take pictures you used or hire a photographer (with a contract) to take the photos for you. If you use a third-party website, pay the licensing fee to use the photo legally. 3. Limit Liability with the DMCA To help protect a business or individual from lawsuits related copyright infringement, the Digital Millennium Copyright Act (DMCA) provides "safe harbor" provisions against the accidental or inadvertent publishing of copyrighted materials online. “Any display of a copyrighted photo, without obtaining the proper rights from the photographer, is a copyright violation, but we believe the DMCA gives you an ‘out’ to avoid the penalties if you comply with its provisions and take down infringing photos upon request,” says Babb. Ultimately, using or publishing photographs online, either on a website or MLS listing, should be closely monitored by REALTORS. Whether you, a vendor or colleague was responsible for the actual upload of a copyrighted image, any and all parties can be liable. Before your next posting, make sure you’re in compliance with copyright regulations and ensure all previous materials aren’t in violation to avoid future demand letters, fines and even jail time. RL

To show its commitment to furthering its commitment to education, Santa Rita Ranch donated $20,000 to the Georgetown and Liberty Hill independent school districts as part of its annual Santa Rita Ranch Days celebration. The development donated $10,000 to each school district last year as well for a total of $40,000 to date through its education fund. Santa Rita Ranch developers and builders have pledged $1,000 for each home sold in Santa Rita Ranch toward the community’s education fund. By the time the ranch is completed, this fund will have contributed a total of $6 million to Georgetown and Liberty Hill ISDs. Developer Ed Horne said providing residents access to a quality education is tantamount and one of the pillars of Santa Rita Ranch. “Learn from the land is Ranch Code No. 1 here in Santa Rita Ranch, and we want to give children growing up here every chance we can to learn,” he said. “We also want to go above and

beyond what our taxes provide and hope our donations give the school districts the opportunity to further their educational approaches and offerings.” Mariner Real Estate is developing the 3,100acre master-planned community, located north of Austin in Liberty Hill, with a distinctive Hill Country style. Horne said residents are drawn to the community for its location, family-oriented vibe and the variety of available homes. Brookfield Residential, CastleRock Communities, David Weekley Homes, Highland Homes, Pulte Homes, Scott Felder Homes, Westin Homes and Wilshire Homes offer designs priced from the $200s to the $700s in Santa Rita Ranch. A dozen model homes are open for touring. Opening late this summer is The Green, a new recreation complex that will include a splash zone, sport courts, a playground anchored by a pavilion, an outdoor fitness yard and an event lawn. “Everyone benefits from the excellence in instruction offered in the area. Children thrive in top notch schools, housing prices are positively affected and the community becomes stronger and more connected.” Learn more about Santa Rita Ranch at http://santaritaranchaustin.com.
