Streamlining the closing process By Riki Markowitz

n Aug. 1st, the feds are tightening real estate regulations again. The Consumer Financial Protection Bureau (CFPB) is creating more red tape and even though the trend over the past several decades has been going in the direction of tight, quick closing schedules, the question is, can the industry streamline a closing process that is more bloated than ever? Back before the Great Recession and even before a housing bubble or two between Y2K and now, it could take about three months

to close on a home. This was in the 1980s when automated underwriting, DocuSign, and document sharing services like Dropbox were still science fiction. Along come these advances, coupled with loose regulations, and closings were whittled down almost 50 percent. For more than a decade, 20 to 35 days became the norm. In recent years, as the government piled on regulation after regulation, not to mention the scrutinization of prospective buyers’ bank statements and credit scores – almost to the point of absurdity – real estate professionals are anticipating transaction times ratcheting back up 35 to 40 days. The onus to streamline the closing process can only fall on the shoulders of those in the trenches, not legislators working to shelter consumers. REALTORS, lenders, and title agents have no choice but to be compliant with new regulations. So it’s important that everyone work together to establish protocols that won’t cut corners or add new layers to a process already

inundated with paperwork, policy redundancies, and for some agencies, drastically reduced manpower. This summer when title agents will be required to receive signed disclosure documents from buyers three days prior to closing, it will be just another bureaucratic snarl to deal with. And then there’s the threat of restarting the entire process if a single document is unaccounted for or an impossibly tight deadline is overlooked. So it’s no wonder industry professionals are at their wit’s end. It’s not that anyone is rallying to get buyers into their dream home within weeks. That may never be realistic. So now, there’s a push to cautiously bulldoze through the pre-closing stages. A few insider suggestions for streamlining the closing process include partnering with trusted colleagues and utilizing file-sharing tools.

agree on is for agents and mortgage loan originators (MLO) to establish professional relationships with one another. This type of partnership can reduce communication and paperwork glitches. Also, when you work with someone you know, transactions tend to be friendlier and less adversarial. “The lender is really the one that has control over almost all parts of the transaction,” says Shawn Rooker, a sales consultant with Realty Austin. “The lender is the pivot point where all problems can come from,” but also, ultimately, where the solutions are addressed and han-

he housing market this year is off to a hot start. 2015 is already on a record-setting pace going into the busiest selling season of the year. I know you’re busy, so I’ll get right to it!

April is Fair Housing Month This month marks the 47th anniversary of the 1968 Fair Housing Act, the landmark fair housing law that promises equal professional service to anyone looking for a home. Talk to your office about the importance of Fair Housing Month, especially in our local market. You can find more information on the Fair Housing Program, including ways you can promote the cause at bit.ly/FairHousingMonth. Also, the City of Austin’s “source of income” ordinance is now in effect. The ordinance applies to all professionally-managed properties, and prohibits discrimination against any housing voucher holder (i.e. Section 8) by refusing to rent or show property to someone on the basis of their source of income. The ordinance also prohibits any advertising or notice

that a rental property does not accept prospective tenants based on source of income. You can find more about this new ordinance at bit. ly/ATXincome.

Make it a “green” Spring According to NAR, green homes and energy efficiency continue to grow as an important factor for those looking for homes. Among some of the energy efficient features that were highlighted as most important: heating and cooling costs, energy efficient appliances, and energy efficient lighting. Stay tuned to the ABoR Academy calendar for chances to learn more about how to become a “Green” REALTOR. NAR recently released an infographic with more info on the green movement; you can download it at bit.ly/GreenInfo.

Putting a Face on Real Estate since 1995

President’s Column By Jack Stapleton • 2015 President

Williamson County is not Austin Travis County Judge Sarah Eckhardt said “the Austin area has reached a point where growth is becoming a con.” Has Austin continued to meet or exceed the expectations of the consumers and businesses looking to relocate here? This is an important question, and needs to be asked. TomTom's annual worldwide traffic index was released this week. Austin, Texas is ranked the 13th worst city for traffic in America. TomTom’s report ranks 86 out of 146 major world cities in terms of rush-hour congestion. Austin is now grouped in the top 13 with the likes of Los Angeles, San Francisco, Miami, Chicago, and Houston, which are cities notorious for traffic. The growth Austin has continued to experience has pushed the limits of its city and its longterm residents. Austin is struggling to stay ahead of the curve in terms or infrastructure, affordable housing, roads, water, education, and quality of life. The growth Austin is experiencing is taking its toll. The most important take away from this

www.myRealtyLine.com article is that Williamson County is not Austin, Texas! Williamson County is poised to continue to support its growth and arguably has exceeded the expectations of its residents. Williamson County continues to offer quality education, roads, affordable housing, and strong quality of life. So, let’s talk about housing in Williamson County! The growth of Austin has certainly benefited the region. Many employers are setting their sites on Austin, Texas but ending up in Williamson County. We have the land, the affordable housing, and the infrastructure including roads and water, and the ability to continue to support its growth long into the future. In terms of Real Estate in Williamson County, let's look at some of our major areas of new construction growth. The great news is Williamson County has attracted quality builders and unrivaled master planned communities for traditional and especially the luxury homebuyers. Travisso is the new luxury master-planned community with a nine-acre amenity complex located off 1431 in Leander. Prices ranging from the low $300s to the $800s. The premiere builders in Travisso are Taylor Morrison, Toll Brothers, Drees, Grand Haven, and Highland homes.

April 2015

7

Cimarron Hills is a premiere private golf course community located north of 29 in West Georgetown offering luxury custom homes from the $300s to the $900s. According to Chris Hill with the Cimarron Hills Community, the community will consist of a total of 898 home sites. The new homestead section includes 60 lots between 1- to 2- acres where the homes will be selling over the $1million mark. Teravista; Crystal Falls; Santa Rita; Regans Overlook; Rancho Sienna; Sorrento; Pearson Place; Paloma Lake and Sienna, are just a few of the amazing examples of choices for lifestyle choices and affordability. I am proud to be a resident of Williamson County. I appreciate our diversity, our cities, the beauty our landscape has to offer. We have excellent schools, good roads, and affordable housing, and the land to continue

supporting

Austin’s

growing

pains long into the future. So when the reports mention the problems with growth in Austin, smile and say, “Have you been to Williamson County?” RL

once read somewhere that growth is the No. 1 killer of business. At the time, it seemed counterintuitive. It would seem growth is what businesses need to survive. However, after some thought, it begins to makes sense. A business’s ability to succeed is in direct proportion of its ability to meet or exceed the expectations of its audience. When a business or entity’s growth outpaces its ability to deliver on its core services, the consumers are left feeling unsatisfied, and assuming the consumer has choices on the provider of the services, they tend to look to a solution elsewhere that will “wow” them. The dangers inherent with rapid growth does not just affect business. It affects any entity that provides a service such as cities and municipalities. It is certainly no secret that Austin is experiencing rapid growth. I am not sure if we are at the point of labeling it “hypergrowth”, but I believe we are getting close. In fact, according to US Census Bureau, the rate at which it is increasing is even more challenging than the fact that it’s increasing.

RE/MAX isn’t for everyone, but it is for problem solvers. Which would explain why nobody sells more real estate than RE/MAX. Others might shy away from daunting circumstances, but we push on. And we succeed. Find yourself at RE/MAX.

Front Page: Continued dled. In fact, Rooker and Dominik Kilpatrick, a senior loan officer and retail lending expert with CMG Financial, have a professional alliance that goes back about three years. “We lasted so long because Dominik consistently does a good job and he is always available to me – night and day,” says Rooker. That’s an extraordinary compliment considering the fact that brokers and agents rely on lenders to get paid and retain relationships with customers. When buyers come to Monica Hampton, a REALTOR at Realty Austin, with a lender she’s unfamiliar with, Hampton wants to be sure the MLO has an incentive to close in a timely fashion. After more than three years in the business, Hampton prefers partnering with independent lenders and brokers because they have an incentive structure that encourages a fast-paced working environment.

Unifying the Team with Technology Recent regulations may have created a pool of more qualified buyers while also protecting many others from purchasing homes they only temporarily qualify for. These are the same regulations, however, that have weighed title agents down in reams of paperwork that, for some, has decimated their earning potential. Overworked and understaffed title companies are at risk for making errors that can postpone a closing date. On the other hand, Rooker praises title agents for being one of the first links in the industry chain to go paperless, thereby connecting and unifying every individual responsible for dotting an I and crossing a T on a real estate transaction, including the customer. According to Steve

Benet, a senior loan officer with 20-plus years in the lending business, and Kilpatrick’s partner at CMG Financial, there can be at least 15 different hands in just one closing transaction. And that’s being conservative.

Like their relationship with a trusted lender, agents also have alliances with specific title agents. Rooker once had an irate client on his hands when the customer noticed an escrow bill that was higher than expected. If the closing team were using Google Drive, Rooker would have had access to the client’s Tax Certification document and a chance to catch the error – and possibly even correct it, or at least warn the customer he was on it. Instead, he had an agitated buyer to placate and an overworked escrow officer to sort out. While it’s not ethical to steer a customer toward a specific MLO – or any service provider – agents can have working relationships with more than one lender and title agent and then explain to clients how it’s beneficial to work with professionals that have closed deals together in the past. For now, no one is expecting things to get easier or regulations to scale back on any of the processes that are jamming the closing timeline. It’s nice to feel nostalgic for the way things were – a time when buying a home was a breezy 20-or-so days. But before current regulations, too many unqualified buyers found their way into the housing market. That’s a mess we’re still cleaning up today. President’s Column By Walt Elias • 2015 President

You’re invited to the HBA Crawfish Boil Builder/ REALTOR Mixer

I

t’s that time again! The Home Builders Association (HBA) of Greater Austin’s Sales and Marketing Council in partnership with the Austin Board of REALTORS, is gearing up for this year’s Crawfish Boil Builder/REALTOR Mixer, the largest of its kind in the greater Austin area and one you won’t want to miss it. On Thursday, April 23rd, Brookfield Residential is hosting the event at its new Austin masterplanned community, Addison. Conveniently located just 15 minutes from downtown Austin in the gateway corridor of southeast Austin, Addison embraces the rolling hills and creekside trails that shape the community, and features beautiful landscaping, modern amenities and award-winning homebuilders. Learn more at liveaddison.com. The 11th annual event will kick off at 6 p.m. with live music by the one and only Jean Pierre and the Zydeco Angels setting just the right mood with its Louisiana Cajun flare. Guests will enjoy a sea of freshly boiled crawfish with all the potato, sausage and corn boil fixins’ you can stand. The HBA’s Crawfish Boil is the only area

event where REALTORS can come together to mix and mingle with a variety of local homebuilders—large volume production builders and custom homebuilders alike. Visit Addison at this don’t-miss event to widen your network, meet new people and explore key opportunities to grow your business. REALTORS are invited to attend for just $20 per ticket. Bulk discounts bring that cost down to $15 per REALTOR if you purchase 10 or more. Non-REALTORS can attend for $25 per person or $20 per person if 15 or more tickets are purchased. This event is a great way to “bulk up” on tickets to give to your staff, colleagues, and other industry professionals. Tickets can be purchased at www.hbaaustin.com/event/crawfish2015.

Jodi Gregg, center, of Independence Title thanks Greg Klar and Amber Hart, both of Keller Williams, Cathi Boortz of Keller Williams Commercial and Kay DeSilva of Avalar Austin Real Estate for attending the open house in Lakeway to help her celebrate her new business development position.

etting a client through a successful transaction is one of the most rewarding things in our business. Having our clients thank us and grab those keys is the culmination of weeks, if not months, of hard work. What if we could help them to easily arrive at a decision earlier, or even feel better about the decisions they are making? Here are a few techniques I have learned from those who came before me and still work with clients today.

Buy photo: RL_041215_I.JPG at www.myRealtyLine.com

The Solidarity Close Talk about the transactions or clients that are similar to them. Tell them how this client overcame similar challenges and concerns and by following a particular course of action they are now very happy.

Valerie Lyday and David Pruit, both of Coldwell Banker United, REALTORS, celebrate friends and colleagues at the company’s annual meeting and awards program at ABoR headquarters.

The Assumption Close Act as if they have already chosen you to be their agent. Use phrases like “when” you help them find a house, or “because they chose you to be their agent.” Assume the relationship.

The Take Away

Buy photo: RL_040315_J.jpg at www.myRealtyLine.com

Offer them what fits their needs, and then pose a problem with the offer, removing it from the possibilities. Then they will fight to get it back on the table. You might find they're interested enough to pay full price, sign your contract now, or work towards your solution much easier.

The Opportunity Costs Close This close takes your client to the pain of not doing what they already stated to you they wanted to do. They want to sell their house or to buy a house. Highlight the cost of not selling or buying (i.e. – can’t move closer to family). Remind them that costs are not just monetary but also include hassle, dissatisfaction and problems. Time, in particular, is a great motivator. Hopefully these techniques for closing will bring you success. Each client deserves a different close that suits their personality and needs well. Have a few in your pocket and use them for the best interests of your clients. Each client deserves to be smiling happily at the closing table. RL

or those seeking the tranquility of a small town with the excitement of a larger city, Clearwater Ranch is a new community conveniently located 30 miles northwest of Austin in Liberty Hill. Owned and developed by the Lookout Development Group, Clearwater Ranch features spacious lot sizes where homeowners can create their own unique, personalized properties from a select group of builders. “Clearwater Ranch is an all estate community with custom homes scaled for a larger acreage setting,” says Bill Hinckley, president of the Lookout Development Group. “No homesite is smaller than an acre and many are much larger. Compared to many other master-planned communities, Clearwater Ranch homes are wider in design and not what you would find on the typical subdivision lot.” Within the Clearwater Ranch community, residents can choose from a select group of builders that includes Giddens Homes, Sitterle Homes and Drees Custom Homes. “All of our builders have designed architecture that is specific to the lot setting in this community, so the homes are unique to the property and not just a typical production home on a larger lot,” Hinckley says. When it comes to choosing the right Clearwater Ranch home, Hinckley says the possibilities are endless. Not only does the community

boast a variety of lot sizes and views, but each of the three builders offers a variety of distinct home designs and options for homeowners to choose from. “Realtors love the fact that we have some homes for immediate move-in as well as homes that are completely customizable by the buyer,” Hinckley says. “Clearwater Ranch

www.myRealtyLine.com are artful, and the common areas are as nice as any master-planned community in Austin. Clearwater Ranch has polish, which can be rare in large acreage communities. Currently, the largest demographic living in Clearwater Ranch is families with children who are attracted to the community’s value and convenient location to the Liberty Hill Independent School District. “The resounding comment that I hear from residents is, "Why would we buy a smaller home on the traditional neighborhood lot when we can get more on an acre at Clearwater Ranch? The kids have room to roam here, and we get more home for the money spent,” Hinckley says. “People are also blown away by the new Liberty Hill High

Clearwater Ranch is an all estate community with custom homes scaled for a larger acreage setting... has something for virtually every buyer, but on a larger home site.” Throughout the community, residents can enjoy the great outdoors with a spacious 12acre park with playground, lengthy nature trails and an abundance of dense greenery. “Many of our homesites are on heavily wooded lots, and some properties have views of the creek,” Hinckley says. “The street scenes

School down the street, as it looks more like a college campus than a high school.” While the community’s rural feel is attractive to buyers looking for a calmer, more tranquil lifestyle, its close proximity to Austin and the new 183A Toll Road makes it easy for commuters traveling into the city for work. Additionally, the city of Liberty Hill continues to open new businesses, retail and commercial

properties. “Clearwater Ranch offers a great quality of life to raise a family, in the shadow of the big city,” Hinckley says. Lookout Development Group, which owns and develops the Clearwater Ranch community, has been the largest developer in the Liberty Hill area for nearly 20 years. Other Lookout Group communities include Austin’s Crystal Falls and the upcoming Esperanza community in San Antonio. In addition to its large lot sizes, spanning views and great school district, Hinckley notes that one of Clearwater Ranch’s main differentiators is the experience of its developers. “No other developer has delivered more high-acreage communities in Central Texas than the Lookout Group,” he says. “Clearwater Ranch benefits from Lookout’s vast experience in delivering a community that will grow in property value through elaborate covenants and deed restrictions, strong HOA governance and an artful approach to the street scene and home elevations. ocated northwest of downtown Austin in Lago Vista, Tessera on Lake Travis is an 875-acre master planned community with a focus on an exceptional lifestyle and first-rate schools. Bordered by Lake Travis and the beautiful Texas Hill Country and within minutes of Austin’s major employers, residents are able to reside in a relaxing, community-focused environment. “As Austin’s job market continues to expand in the north to northwest direction, we believe Tessera on Lake Travis is well positioned to support this growth and provide an opportunity for families to live in a truly unique community,” says Duke Kerrigan, a director with Hines, the firm that owns Tessera on Lake Travis who is responsible for the development activity. “Tessera on Lake Travis is located on the north shore of Lake Travis and is surrounded by thousands of acres that will remain undeveloped,” he says. “Furthermore, the community gradually stair-steps from FM 1431 down to Lake Travis, which allows for expansive views of the Hill Country and Lake Travis while at the same time providing a more efficient development approach.” When developing the concept for the community, Hines focused on the word “tessera,” which is an individual piece of tile used to create a mosaic. “From trails and parks to schools

and scenic views, all of these smaller pieces will come together to create a great community,” Kerrigan says. “While each component provides special attributes on a stand-alone basis, we believe that when those components are brought together it will translate into a

‘true mosaic community.’” Some of these community features include an infinity edge pool overlooking Lake Travis, a splash pad for kids to enjoy, interconnecting trails and numerous park areas. “We spent a tremendous amount of time thinking through how we can enhance the open space feel throughout the community,” Kerrigan says. “We layered in interconnecting trails to take people around the entire community, which is something very near and dear to us as people will have the opportunity to discover something new each day within Tessera on Lake Travis.”

So far, Kerrigan notes that many of Tessera’s early residents are families seeking an attractive home value in a great school district as well as couples seeking high-quality home designs in a unique setting. The Lago Vista ISD has an enrollment of 1,275 students in its elementary, middle and high schools. Recently, the Lago Vista High School opened a new campus, which doubled the campus size and included an auditorium, football stadium, five science labs, band hall, art room and much more. More recently, Austin Monthly ranked the Lago Vista High School the 12th best public high school in the Austin Metropolitan Statistical Area.

“In our minds, it’s one of the best kept secrets in the entire Austin market.” says Kerrigan. “It’s a school district where the principal knows everyone—the kids and their families—and the students are able to thrive both in and outside of the classroom.” While the excellent school district and community-centric focus are major attractions, homebuyers have the added benefit of finding a home to fit their individual needs. In Phase I A, there are 50’, 60’, 70’ and 80’ lots with a minimum depth of 130’ each, which give buyers the opportunity to select multiple options in terms of lot locations and home siz-

es. Also, both Highland Homes and Wilshire Homes offer an extensive set of plans and more than 90 options across the various lot sizes that a buyer can chose from when selecting a home to build. In addition, each builder has available inventory ready to meet a movein buyer’s needs. While Hines has more development planned for future phases, several milestones have been achieved thus far. In September 2014, Tessera on Lake Travis completed its first phase of infrastructure, which included over 200 residential lots, a community pool, an open-air pavilion, entryway features, community landscaping and the initial sections of its trails system. More recently, on March 28-29, the community hosted a grand opening event to the public. “Our team is excited to offer the initial phase of Tessera on Lake Travis to the market place but we’re even more excited to be part of a great community and excellent school district” Kerrigan says. RE/MAX Donates $8.75 M for Children’s Hospitals in 2014

Legacy Mutual Mortgage opens new branch in Austin With branch locations throughout the Lone Star state and in both Denver and Nashville, Legacy Mutual Mortgage recently capitalized on the healthy Texas housing market by adding a fully-operational branch in Austin in late February. The need for a standing branch location arose from Legacy’s success in merging the two metropolises along the IH-35 corridor. New Braunfels, a highly-desired, semi-Hill Country destination, has been a strong loan and referral market for Legacy for several years and business has continued to follow the northbound path into the Capital City. In addition to a strong Real Estate market, Austin offers additional divisions of new construction loans from several of the homebuilder accounts Legacy Mutual services. New offices and a fully staffed Austin branch location just made sense. Legacy is a full service mortgage loan com-

pany with an experienced staff offering expertise in every area of home and commercial lending, from purchase to refinance to construction lending. Legacy provides access to a full range of mortgage sources and all of our lending specialists are dedicated to finding the right loan--with the best rates, terms and costs--to meet your unique needs. Led by Melanie Taliaferro and her outstanding team, Legacy President Dan Diepenhorst comments, “we could not be more excited that Legacy has entered the Austin market. This team’s extensive background in the Austin market is allowing Legacy to hit the ground running. Legacy’s success is built through our desire to work with Top Producing Loan Officers that thrive in a team atmosphere and with Melanie and her group, we have this. We are very proud to have the opportunity to work with this group and look forward to Legacy’s Austin future.” RL

Texas RE/MAX agents and offices, with hearts as big as the Lone Star State, were awarded their eighth consecutive RE/MAX CMN Region of the Year award at the RE/MAX International Convention in Las Vegas last month. “There’s a lot of talk about ‘culture’ in real estate offices, and we’re proud that ours is one centered on both great community citizenship as well as highly productive real estate professionals,” said Tim Kress of RE/MAX 1 in Cedar Park, winner of Houston’s ‘Miracle Maker Award’ for his firm’s donations to Dell Children’s Hospital. RE/MAX agents across North America raised more than $8.75 million in 2014 for Children’s Miracle Network Hospitals – most of it by mak-

ing donations after each property sale. “RE/MAX agents’ contributions to children’s hospitals are incredible,” said John Lauck, president and CEO of Children’s Miracle Network Hospitals. “Agents raise funds for hospitals year-round while bringing awareness to the importance of supporting children’s hospitals in their communities. We're grateful for their 23 years of support and look forward to continuing our partnership.” "RE/MAX agents change lives every day when they help people buy and sell real estate, but they don't stop there," Kress concluded. "They know they can help save lives, too, by supporting this incredible organization." RL

The Society marketing sessions are held every other month in a different city in North America and attendance

is by invitation only. Real Estate counselors and brokers from all across the country were in attendance. “Attending the society’s marketing sessions allows me to seek opportunities to enhance my clients’ portfolios and apply creative problem solving formulas to address the challenges some clients are experiencing with their real estate investments.” said Jerry Seay. “It is an excellent way for local properties to get expanded national exposure in the commercial real estate equity market.
