Q: What is a credit report? A: Your credit report is a record containing

some information about your dealings with credit providers. The report is held by a reporting agency and accessed by credit providers with your consent to find out about your credit history. There is more than one agency – but the largest dealing with loans for personal purposes is Veda Advantage. (You can ask for a free copy of your own credit report – can take 10 days) Credit providers regularly use these agencies to provide one form of assessment as to whether they should give you a loan. It is important that the information on your credit report is accurate.

Q: Are there other options rather than a bank? A: The

Federal Government through the Australian Office of Financial Management (AOFM) will invest through non-bank lending up to $3.4 billion in Residential Mortgage-Backed Securities this year – there has never been a better time to try a non-bank. The big banks have advertised standard variable home loan rates over 1% higher than the SV rates currently on offer from some nonbanks and the gap between bank and non-bank mortgage rates has never been wider.

Q: What benefits can I gain from Refinancing? A: Aside from the benefits of securing a

reduced interest rate, the ability to put through a home loan refinance can be beneficial in a number of ways. You can access hidden cash by taking out a home equity loan; borrow extra in order to buy an investment property; consolidate outstanding debts and credit card debt with your home loan in order make only one, more easily managed, payment. You can even refinance to secure approval to purchase a larger house or renovate and improve your existing home.

Q: When do contracts become binding? A: In NSW, Contracts for the Sale of Land are not binding until Exchanged. Exchange is where both the Vendor and Purchaser have signed Contracts, their Conveyancers meet, check that both are exactly the same, then Date and ‘exchange’ copies. Only then has Exchange been effected and contracts are binding.

Q: Should I pay a Holding Deposit? A: Often, a Purchaser will be asked to pay a holding deposit. This can be seen as a gesture of good faith but is NOT binding. Remember that until contracts are exchanged they are not binding. Either party can still legally change their mind, regardless of the holding deposit. In this case any holding deposit must be refunded.

Q: What is the difference between Joint Tenants and Tenants in Common? A: When there is more than one owner of a property a Tenancy must be noted on the Certificate of Title. Joint Tenants is where the parties have equal shares with the right of survivorship, if one party passes away, their share will be transferable to the surviving party. Tenants in Common is where the parties can specify the percentage of their share and if a party passes away, their share is dealt with via their will or estate.

Q: How much notice do I need to give a tenant to vacate a rented property?

A: Under the changes to the

Residential Tenancies Act 2010, a landlord must give 90 days notice for a no-grounds termination when a lease is a periodic or continuing lease. If the tenant is on a Fixed Term Lease, then the notice period is 30 days prior to the end of the lease. Notice periods for the tenant have not changed and they are still required to give 14 days notice prior to the expiry of a Fixed Term Lease and 21 days notice if the lease is a periodic or continuing lease.
