RESORTS WITHIN A RESORT Like separate communities within the community as a whole, Quinta do Lago is home to a varied selection of zones or “mini resorts”, positioned in such a way throughout the resort that they all possess their own set of qualities. The various zones reflect the careful planning of the resort, with the studied positioning of properties, evenly spread over the entire site, to ensure the initial low-density vision formulated back in the early 1970s is preserved. This strategic planning has meant that the resort has maintained its overwhelming feeling of space and large dimensions, where wide avenues, large open spaces and generous individual property plots give Quinta do Lago its much applauded signature design. No matter where the individual zones are located within the resort, or what style of property they contain, they all focus on one or more of Quinta do Lago’s redeeming features, whether it’s the sea, golf courses, lakes, or pine groves. So, let’s take a tour of Quinta do Lago’s resorts within a resort, heading down through the development, from North to South, and discover the secrets each one has to reveal. Lodged between roundabout 1 and 2, near the entrance to the resort, the Zona Noroeste occupies the North Eastern sector of the resort, just south of Quinta Shopping. Comprising mature plots, the villas here enjoy a quiet, secluded atmosphere, nonetheless well served with convenient access to the nearby shopping centre. The majority of plots here back on to the fairways of Quinta do Lago North golf course. Enjoying the same benefits, on the other side of the 9th and 10th holes stand the generous plots of Pinheiros 1. Completing this quiet corner of the resort, the properties of Golfe Norte, which back onto the 5th hole of Quinta do Lago South course. Cross the Avenida André Jordan, following the golf course layout and we find the same feeling of calm and seclusion in the zones of Cavado and Gondra. Taking roundabouts 3 and 4 as a reference point more or less marking the centre of Quinta do Lago, there are a number of resort zones that radiate out of this popular area, generally positioned around the fairways of both Quinta do Lago North and South. The facilities located in this part of the resort, including the golf club, tennis club, driving range, post office, bank, bistro and much more, combined with the central location, make property hunting in this area particularly alluring.
Featuring some of the resort’s most mature areas, zones here include: Golf Poente; Monte do Lago; Plan Alto; Golfe; Golfe Leste; and Monte Golfe. Sharing a similar central location, the recently released zone of Encosta Poente, on the far west of the resort, is mirrored on the far east with one of the last zones yet to be released, Ria Formosa, which is surrounded by five holes of the South golf course. Heading further south, below roundabout 5, the zones find new foci of attraction, with water playing as much a role as golf. Reflected in the name of the resort, where ‘Lago’ translates to “Lake”, the main lake area, with its stunning views over the water to the lagoon beyond and eventually to the sea, is one of Quinta do Lago’s most exclusive locations. Served by the water sports centre and by the Casa do Lago restaurant, and tantalisingly close to the Ria Formosa and the beach, it’s no wonder that properties here are high on the list of resort favourites. The zones located around the lake include Lago, Beira Lago, and at the lake’s southern end, Palmeiras. The small zone of Atlântico Sul, nestled between the Hotel Quinta do Lago and the beautiful lagoon of the Ria Formosa Nature Park, is home to properties with memorable sea views, ideally placed to take full advantage of the Atlantic’s presence. Cross the neighbouring wooden bridge, right over the lagoon, and you reach the vast stretch of sandy beach. The final series of resort zones is blessed with a choice of attractions, both sporting and natural. The four different zones stand inside or on the edge of the twin circles making up the layout of San Lorenzo Golf Course, one of Europe’s finest golf challenges. As the course snakes its way down to the lagoon, revealing some of the finest golf holes to be played in Europe, the prime golf front properties of Atlântico follow it, sharing some of the best sea views to be had in the resort. To the north, the generous plots of Atlântico Norte hug the manicured fairways of San Lorenzo, while to the south, watching over the final six holes of the course, São Lourenço radiates a peaceful charm. BUYER’S GUIDE There are many issues that can – and often do – arise regarding the interpretation and implementation of a contract between the builder and the owner of the property being built. In general terms, most common problems derive from defects in the construction and failure to comply with what was agreed between the parties. A construction contract should define very clearly the timeframe of the project for each stage and for final completion and handover. Equally important are the conditions of payment: how much is to be paid and when – and whether the prices quoted include VAT or not. The budget figures should always be taken into account. Another relevant aspect is the treatment given in the contract to changes to the project as originally commissioned or any new works requested by the owner. In order to avoid any conflicts in the future, these changes or new requests should always be confirmed in writing, with specific confirmation that the changes in the works (or the new works requested) will imply a change in the final price and an indication of new prices. These additional clauses should be signed by both parties. There are specific periods in which to complain about defects in construction, as well as asking for compensation. In case of defective construction, the owner has the right to request that the defects be corrected, if possible. If they cannot be corrected, the owner can request a reduction in the price paid, the termination of the contract or even, in certain circumstances, a new construction. These rights do not exclude the possibility of asking for compensation. Construction contracts should always include an arbitration clause, in order to give the option of going to arbitration if there is any conflict between the parties. This is a better alternative to the judicial courts, in several perspectives, mainly because of the confidentiality and speed of the proceedings, but also because of the specific technical knowledge of the arbitrators. The normal timeframe for a final decision (the award) is six months from the hearing of the arbitration court, and this award carries the same legal force as a judicial decision. A significant advantage is that arbitrators normally have specific knowledge of the issues presented to them, which the judge of a judicial court generally does not have. An arbitration court can have one single arbitrator or a team of three: the former option is more cost-effective if the disputes are not that high in value, as it avoids large costs with the court. The arbitration clause should stipulate if the arbitration is ad-hoc or institutional, if it is national or international, and should also define the place of arbitration, the language to be used and the possibility of an appeal. With regard to appeals, the parties can renounce the possibility of presenting an appeal to any award, although in specific cases, it is possible to obtain an annulment of the award. These are the main minimum points to be included in any arbitration clause. However, depending on the type of contract and construction and potential disputes that may arise, it is possible – and, indeed, advisable – to include various other clauses as well.
NEW RULES FOR TOURIST ACCOMODATION The approval and publication of the new law relating to the setting up and running of tourist developments in 2008 saw the creation of a new type of establishment for tourist purposes, called local accommodation. Included in this category are villas, apartments and other properties which are licensed to provide temporary accommodation but which do not meet all the requirements laid down for them to be considered tourist developments. These local accommodation establishments may be promoted for tourism by the owners themselves, as well as by travel and tourism agencies. However, they all have an obligation to be registered with the relevant municipal authority and to comply with the minimum requirements in respect of security and hygiene as defined by law. The law also provides for the definition of different types of local accommodation establishments. A villa is defined as any establishment of local accommodation made up of an autonomous building with single-family character. An apartment is defined as an establishment of local accommodation made up of autonomous fractions of a building. The register at the local authorities presupposes that the villas and apartments of local accommodation have the relevant permit or other valid title of use for the property, with the exception of establishments within properties built before 1951. The register of establishments of local accommodation at the local authorities is executed by means of the submission of an application form, which is available at all relevant municipal services, and which should be accompanied by the following documents: I - Proof of legitimacy of the person filing the application (e.g.real estate registry certificate); II - Statement by an authorized technician that electric, gas and water heating systems meet legal requirements; III - Plan of the property with an indication of the accommodation units involved; IV - An urban property tax registry certificate. The stamped duplicate of the application form constitutes valid permission to open to the public, although the local authority can, within a period of 60 days from the presentation of the application, conduct an inspection to verify if all necessary requirements have been met.
With regard to the setting up and running, in addition to the minimum general conditions set for establishments and for individual units, there are minimum requirements for security and hygiene. These include, for instance, an obligation to provide cleaning and tidying services for the unit and the existence of fire extinguishers and blankets accessible and available in sufficient quantities. All establishments that provide such services have to provide their guests information about the rules applicable to local accommodation establishments. In particular, a complaints book meeting the legal requirements must be made available: this implies an obligation, in the event of a complaint, to refer such complaint to the authority that supervises such matters (ASAE). LEGAL INFORMATION Because we know Quinta do Lago so intimately, nobody else is better placed to offer a fully professional, comprehensive service in all areas of buying and selling property here. Speaking with us will give you access to knowledge of available properties; assurance that the properties are fully licensed; information about the necessary steps in the buying process and, above all, a credible and trustworthy agent. Although we will assist you through the process, we recommend that you have an independent English-speaking lawyer representing you. We will give you initial guidance and assist you through the whole process, before and once you have found the property you wish to purchase. Your legal advisor should require full information about the property, which we will be happy to provide. Taxes and legal fees are paid by the buyer. If you could not find the property you are looking for, please do not hesitate to contact our services. Your deal should be easy and without any risk! It is very important to clarify what is included in the price agreed, exchange and completion dates and ask the agent for a written document (reservation deal or letter of intent) – this document should be reviewed by lawyers representing both parties. This is an important part of the purchase, as it may avoid delays and difficulties in the future. NON-RESIDENTS If you are a non-resident, you will need to apply for a Portuguese tax number (número de contribuinte) from the local Tax Office (Finanças) and to appoint a tax representative.
It is also advisable to open a bank account, as it is required to pay any costs related to the property. Once again, your lawyer will be of great help to guide you through all bureaucratic procedures. RESERVATION DEAL OR LETTER OF INTENT Signing a reservation deal confirms that you are a serious buyer, which allows the vendor to take the property off the market. Normally, you will be asked for a deposit cheque (usually 10% of the price), which should not be presented for payment until all parties are ready to sign the Promissory Contract (usually up to 30 days after reservation). DOCUMENTATION Giving your lawyer a Power of Attorney to sign the documents on your behalf will make the whole process much easier but, for your knowledge, you must obtain the following documents from the vendor: • Certidão do Registo Predial (certificate issued by the Real Estate Registry; confirms the description and ownership of the property and advises whether there are any outstanding mortgages or other loans or encumbrances on the property). • Caderneta Predial (issued by the Tax Office; confirms the description and taxable value of the property). • Licença de Utilização (issued by the Town Council; confirms that the property is duly licensed for habitation or other purposes). • Plantas (plans of the property, as approved by the Town Council). • Ficha Técnica da Habitação (applies to all properties licensed for habitation purposes from March 30, 2004; provides comprehensive information about the property – builders’ details, materials used and equipment, suppliers, condominium rules, building guarantee, etc). Identification of the vendor and his Portuguese tax number. ENERGY PERFORMANCE CERTIFICATE As of July 2008, all new houses are required to have an EPC before building can start, and a Certificate of Conformity is required before Habitation Licence is issued, after completion. As of January 2009, the need for an EPC will also apply to existing houses, if they are to be sold, bought or rented out. PROMISSORY CONTRACT Once all documents are available, the parties will
normally enter into a promissory contract – a legally binding contract between vendors and buyers, under which the parties undertake to complete the transfer within a given deadline – signed in the presence of a Notary or other entity allowed to certify the signatures and the existence of the relevant construction or use licence. The promissory contract should be prepared or reviewed by a lawyer to ensure that all agreed items are clearly specified, thus reducing the risk of future problems. Basically, it normally includes the following: • Identification of the parties and their representatives (if applicable); • Identification of the property (registration number, description, details of construction licence, etc); • Price agreed for the sale and terms of payment; • Deadline for execution of the final deed of transfer and any conditions parties must comply with; • Usage conditions of the property by the parties before the final deed is signed; • Collaterals – compensation due for any delays in the completion of the sale and remedies in case of default on the contract. Normally, parties agree in making a down payment, on account of the purchase price, upon execution of the promissory contract (frequently, it corresponds to the deposit made when signing the reservation deal). Such a down payment functions as collateral given by the purchaser and, also, as compensation standard in case of breach. Except otherwise provided, should the buyer default on the Contract, the down payment will remain with the seller, but if the seller defaults, he is required to refund the buyer twice the amount of the down payment. FINAL DEED The final deed formalises the completion of the purchase and sale. The balance of the price is normally paid at this stage. It can be executed by public deed before a Notary or, as of January 1 2009, by private deed, authenticated before any entity allowed to do so (notably, a lawyer). REGISTRATION Registering the purchase of a property in the Real Estate Registry is mandatory. The registry application should be filed by the entity before which the final deed has been executed. COSTS Costs related to the purchase (legal fees, notary,
registration) are normally borne by the buyer. TAXATION Like in any country in Europe, in Portugal there are also several taxes related to property: possession, income, transmission, etc. To fill a correct tax return in Portugal can actually save you money. Always ask your lawyer to advise you in detail about every tax and duties you should comply with, as well as on the applicable rates, allowing you to take informed decisions. PROPERTY TRANSFER TAX Formerly known as Sisa, IMT (Imposto Municipal Sobre as Transmissões Onerosas de Imóveis) is payable by the purchaser and is levied, notably, when property is bought and sold. STAMP DUTY The transfer of property is also subject to Stamp Duty (Imposto do Selo), payable by the purchaser. AS OWNER After completing the purchase, you should contact the various utility companies. Your agent should be able to assist you all along this process. PROPERTY TAX IMI (Imposto Municipal Sobre Imóveis) is payable annually and is assessed based on the property taxable value. PERSONAL INCOME TAX If you have income related to your property, you or your tax representative must report any earnings on an annual tax return, for IRS (Imposto Sobre o Rendimento das Pessoas Singulares) purposes. Non-residents can normally obtain double taxation relief through a foreign tax credit in their home jurisdiction. AS SELLER - CAPITAL GAINS TAX Capital Gains taxation is levied on the gain derived from the sale of a property. There are a few exemptions though: take advice as to whether you qualify for any of those, as well as to what costs are eligible for deduction. Be aware that only costs duly supported by proper invoices are deductible for tax purposes (informal receipts are not valid). OTHER COSTS - ANNUAL MAINTENANCE Condominium rates are normally due and cover the maintenance and conservation of common areas, gardens, swimming pools, security, etc. This
varies from property to property, depending on the level of service provided. In addition, you will need to pay for insurance and utilities (gas, electricity and water supply). It is usual to pay for these services by direct debit. LAWYER FEES Lawyer fees vary according to each situation. Always ask for a quotation. We can supply a list of lawyers, when required. AGENT FEES Real estate agents are normally paid by the vendor. Always agree on the agent’s fees beforehand. Estate agency fees, properly supported by document, can be deducted as costs for capital gains taxation purposes. PROJECT MANAGEMENT To have a good project manager in place can avoid many worries and difficulties for you. He can appoint the architect, work with the design team, ensure the desired quality of materials, select the builder and mediate between you and the builder, ensure the control of quality, coordinate all suppliers and so on. A project manager may charge you a percentage of the total project cost for his services or a monthly fee for the duration of his services.
