Jump Start Your Spring with Some Home Maintenance Essentials By Bill LeBlanc, President, Acadian Home Builders Association

Warmer weather and longer daylight are approaching which makes it an ideal time to check on areas in your house and yard that may need attention. Once you tend to the wear and tear from winter, you’ll be ready to sit back and enjoy your home when spring is fully underway.

Outdoors: •

Walk around the entire perimeter of your home and check the condition of any glazing compound, caulk, and exterior paint. Replace or touch up wherever needed.

Inspect your deck. Replace any popped nails and re-secure loose boards. Check for boards that are decaying and need to be updated. Sweep and gently clean the decking material. If your deck is made of wood, you may need to reseal it. To determine if your deck needs to be resealed, try sprinkling the surface with water and let it stand. If the water soaks in, it is time to reseal to protect the wood from future rain and humidity

Wipe down or hose off your outdoor furniture. Check cushions to see if they need cleaning, repair or replacement

Reinvigorate your yard. Seed and feed the lawn, plant annuals and cut back any perennials that need pre-growth pruning.

Check your roof for any signs of winter damage from heavy snowfall or debris. Consider cleaning out your gutters even if you already did it in the fall in preparation for early spring rainfall. Remember to take special care when using a ladder. Read and follow directions carefully. Check for overhead power lines, set up the ladder at a safe angle and never stand on the top rungs.

Indoors: •

Hire a professional to clean and inspect your air conditioning system. If it has a filter, make sure it’s been replaced within the last three months to keep everything working efficiently.

Test your windows to see if they open and close properly. If you have window screens, gently wash them with soapy water. If not, install screens and storm doors for added protection from the elements.

Refresh carpets and rugs from outdoor debris tracked in from boots over the winter. A good cleaning will freshen the look of the whole house.

Prepare your screened porch or sunroom to handle outdoor allergens. If your porch takes in a significant amount of pollen when spring is in full swing, cover furniture until pollen season is over. When you’re ready to open windows, carefully remove the sheets coated with pollen.

Find signs of termites early. These insects are one of the most harmful household pests. Warm weather brings out termites. Check for sagging floors and ceilings and note any dry, brown tunnels in the ground near your home’s foundation. Eliminating terminates now can save you money in the future.

WHY WOULD ONE WANT TO “RESERVE” MINERAL RIGHTS? Q: WHAT IS A MINERAL RESERVATION? MY FATHER SAYS THAT HIS COUSINS HAVE MADE A LOT OF MONEY FROM SELLING THEIR LAND WITH MINERAL RESERVATIONS. DO THE BIG OIL COMPANIES PAY YOU FOR MINERAL RESERVATIONS IF YOU SELL YOUR HOUSE OR YOUR LAND?

A: What you father is referring to is the retention or “reservation” by your cousins of the mineral rights in the land that your cousins sold. Basically, when someone sells their land, they sell all of their rights, title and interest in the land, which includes the rights in any minerals that could be extracted from that land. However, one may retain or “reserve” his rights in those minerals, among other things, in the sale of the land from which they are derived, and this is known as a “mineral reservation”. In this case, whoever owns the mineral rights, not necessarily

the landowner, would be entitled to any profits from the sale or lease of those minerals or those mineral rights. In this case, an oil company may have paid your cousins for entering into a lease for the extraction of those minerals. It is worth mentioning, as well, that even if someone sells his land with a mineral reservation, he will not necessarily own those rights forever until he decides to sell them. In fact, in some cases after the passage of 10 years, any rights in minerals that he may have reserved at the time he sold the land can revert to the current landowner. If you are considering leasing the mineral sin your land and/or want to find out more about your mineral rights, in general, I suggest you consult a real estate attorney who will be able to determine your rights in the land you own now and any land you have owned in the past, and you can find out more about any options available to you with regard to your mineral rights.

A: Before answering your questions, it’s important to point out that as long as you hire an experienced probate attorney when the time comes, that attorney will tell you what you need to do. You should also be able to find reading materials on Louisiana’s probate procedure at your local book store. If your parents lie in Louisiana, you should try to find a book written specifically about Louisiana probate, rather than one that covers

probate proceedings in other states. Depending on the size of your parents’ estate, the probate succession may be rather simple. And, you don’t really need to ask your parents for a list of their assets, bank accounts, etc. currently. After all, what they own today may differ from what they will own when they both dies. Plus, they may not want to provide that information to you at this time. Some people are very private about this type of information, even when it is a close relative asking. However, you should ask your parents where they keep all their records (i.e. life insurance policies, bank account information, etc) so that you can quickly find the information you need to probate her estate. To make your job easier, you might want to ask your parents to prepare a listing of their critical information, including the names of their accountant, lawyer, and financial planner, as well as all the passwords on her accounts and computer programs. They don’t need to give the information to you just yet, but it would be useful for you to know where this information is kept so that you can find it when they pass away.
