ach March the National Apartment Association holds the largest advocacy training conference in the rental housing industry in Washington DC. As usual, Utah sent a delegation that attended meetings, discussed federal legislative and regulatory policies and then visited with members of Utah’s congressional delegation. “This year, we were able to visit with both of our U.S. Senators and three out of four of the congressional offices and discuss the issues affecting rental housing,” said Paul Smith, UAA Executive Director. “As usual, our Senators and Representatives seem to be on the same page as us, agreeing that rental housing is a necessary component of a balanced housing policy and needs to be protected from overzealous regulation and too much push toward homeownership at any price. Living in an apartment or another kind of rental housing is a legitimate life choice and needs to be an option for all Americans”, he said.

The Issues This year’s meeting with our congressional delegations were cordial and friendly as usual, Smith noted. The UAA has been building relationships with elected officials and staff for years and both representatives and staff remember us and treat us like old friends, he said. “And so they both know our issues and know us when we sit down with them.” Two main issues were recurring topics in discussions. First was the direction HUD is taking in dealing with discrimination claims brought

through the fair housing act, under a new “doctrine of disparate impact”. Under this frightening new doctrine HUD is proposing for evaluating discrimination complaints if an aggrieved party can demonstrate a neutral policy has disproportionately negative impacts on a protected class then discrimination can be alleged and the rental operator may have to change their policy. Implementation of this policy could create disastrous side effects, like preventing landlords from being able to deny criminals. So NAA and NMHC (the National Apartment Association and the National Multi Housing Council) are working with HUD to ask them to revise this policy while also filing a lawsuit to prevent implementation of the policy. “We are already aware of this issue because the bankers have already brought it to our attention,” said Brian Steed, Chief of Staff for Chris Stewart in the second congressional District. “We are very concerned about it and want to help in any way we can to stop this bad policy,” he said. The other issue UAA members took to congress is the issue of housing finance reform, (Government Sponsored Enterprises that guarantee financing to housing markets like Fannie Mae and Freddie Mac). Since the housing bubble, many lawmakers have been promoting reform, including options that shut down or eliminated most government backing of mortgages. We shared with Congress the fact that not only did multi-family housing not have significant delinquencies or loses, but was an income maker for the Federal

Government of $14 billion dollars while the rest of the housing market was tanking and requiring bailouts. “We told congress,” says Smith, “that any reorganization or change to GSE’s needs to hold multi-family loans harmless because those loans are about 70% of the market and are profitable for the government. We reminded them don’t throw the baby out with the bath water – treat multifamily lending differently if you need to but don’t shut it down because of what the single family loan market did.” Without the funding source from GSE’s, there would not be capital available to build the quality rental housing our country will need as we move forward, hurting the public and potentially causing another housing crisis. Other topics of discussions at this year’s conference included immigration reform and how it would affect housing, energy policy and “green” housing codes and potential tax reform. fees or deposits based on membership in ANY of these protected classes. The single biggest problem, however, is with disability. The UAA has built relationship with all sorts of organizations that work in housing, including the Disability Law Center (DLC). They recently procured $700,000 to do fair housing testing over the next three years. Now, while they seem to be a fair organization and we have a great relationship with them, the best way to avoid problems is to remind yourself of a few rules when answering the phone (most of their screening will be over the phone, followed up by personal visits in some cases). 1 – Understand disability issues. For instance, if someone asks for an

assistive animal remember you CANNOT CHARGE EXTRA DEPOSIT OR FEES. An assistive animal is like a wheelchair. It helps someone with a disability adapt to society. If it does damage to the place you charge them at the time, not before. 2 – Don’t pre-screen on the phone and treat everyone the same. While you can answer questions about your policies (such as do you allow smokers, how many people are allowed in the place, etc) don’t ask questions that could be construed to discourage or prescreen people. For instance, don’t ask if they have assistive animals, children, their race or religion, etc.

President’s Message: UAA Education Programs By Steve Randall, President Utah Apartment Association On the cover of this issue, we honor several individuals who are receiving designations from either the NAA (National) or UAA (local) associations. These individuals worked very hard attending many days of training and passing comprehensive tests to determine they retained the information taught. I personally am very proud and commend each of these individuals for their commitment to their companies, their cus-

tomers and their careers. I love education and try to attend as much as I can. I am always learning things that help me make more money or run a more efficient business. May I encourage each of you this month to set a personal education goal for this year. Two of mine are to complete both my CAM and UPRO exams and join the great group of individuals we honored in this issue as designates. I hope you will consider these two programs. The CAM (Certified Apartment Manager) is geared for on-site property managers and supervisors.

Fair Housing Testing Continues

I

n the Fall of 2013, the Disability Law Center (DLC) was awarded a three-year grant from the United States Department of Housing and Urban Development (HUD) to fight housing discrimination in Utah. Funded through HUD’s Fair Housing Initiatives Program, the award will strengthen enforcement of the Fair Housing Act through investigation and testing of alleged discriminatory practices. The funds will also be used to educate housing providers, local governments, and potential victims of housing discrimination about their rights and responsibilities under the Fair Housing Act. “Ending housing discrimination

requires that we support the law of the land and protect the housing rights of individuals and families who would be denied those rights,” stated HUD Secretary Shaun Donovan. “Ensuring and promoting Fair Housing practices lies at the core of HUD’s mission and these grants enable community groups all over the nation to help families who are denied equal access to housing.” The Fair Housing Act (FHA) prohibits discrimination in the sale or rental of housing against people because of their race, color, sex, religion, national origin, family status and disability. Utah law also prohibits discrimination based on source of income. Simply put, discrimination is treating people differently based on their protected class status. Continued on page 7

A landlord cannot do things like charge more money or refuse to rent to someone because they belong to a protected class. People with disabilities can also ask for a reasonable modification and/or a reasonable accommodation if it will help them use and enjoy their dwelling. Since the passage of the FHA, discrimination has become much more subtle. It usually happens with “a smile and a handshake.” Most of the time in housing transactions, a person experiencing discrimination has no idea that he or she is being discriminated against. One of the only ways to uncover housing discrimination is through testing. In 2012, the DLC and the Utah Antidiscrimination and Labor Division collaborated on a pilot enforcement project to investigate and test for claims of housing discrimination. The project investigated and tested for claims of housing discrimination against each protected class; however, due to limited resources only complaints related to disabilities were pursued. Fair housing testing is much like “secret shopper,” but with apartments and landlords. For example, a test for discrimination based on disability would involve sending both a person with a disability and a person without a disability to the same apartment building to ask about an apartment. The profiles of the two testers are the identical except for disability status, so that if there is a difference in how they are treated, it can be traced back to that protected class. determine if discrimination has occurred. Testing can also be performed over the telephone, with testers calling apartment managers to inquire about available units. The pilot program found that approximately half of testers posing with a disability experienced housing discrimination. Over the past year and a half, the DLC conducted a total of 137 tests on apartment buildings or complexes. Of the sites which were monitored for disability status, 35% showed no signs of discrimination, 14% were inconclusive, and about 51% showed some signs of discrimination. The most common types of discrimination seen in disability related testing were testers who requested an accommodation for a disability were denied the request or else told they had to pay additional fees. This new three-year $700,000 award will enable the DLC to fully represent all protected classes. The DLC will recruit more testers, increase the number of tests performed, file complaints or litigation when necessary, and take the program statewide. The DLC will also expand its education, outreach, and self-advocacy training efforts. The DLC will continue to work with its community partners to address systemic issues, such as programs or policies which discriminate against select groups. This will mark the first time the state of Utah will have a private program dedicated to the enforcement of fair housing laws.
