Phoenix Rents Up, Vacancies and Concessions Down By Pete TeKampe, Marcus & Millichap The April issue of Apartment News reported ‘Valley Rents Set to Increase’; subsequently, Phoenix area rents posted their fourth consecutive YOY rental increase and the period marked the fourteenth consecutive quarter in which area vacancies were lower than the same quarter of the prior year. Second quarter 2013 was also the thirteenth consecutive quarter in which concessions declined over the same period of the prior year. “The April issue of Apartment News reported ‘Valley Rents Set to Increase’; subsequently, Phoenix area rents posted their fourth consecutive YOY rental increase.”

RENTS In second quarter 2013, Phoenix area rents stood at $760, up $13 compared to second quarter 2012. In the last three Trends updates, future rental increases were forecast. Previously, Trends reported that ‘rental rate increases will be augmented and potentially accelerated by the demand manifested in the latest eviction information.’ As of the writing of this article, all indicators are pointing toward increasing rental rates in theremaining two quarters of 2013. rental rate is $38 higher than the average rent recorded for the submarket in second quarter 2012 and it was accompanied by a half of a percentage point increase in vacancy over the same time. New construction in the area is bolstering rental rates and increases in vacancy are likely in the near- and intermediate terms as the area absorbs the newly constructed units. South Scottsdale was ranked second in the high rent category for the period posting the Valley’s largest percentage rental increase since second quarter 2012. Chandler rents stood at $906 during second quarter 2013, breaking the previous high rent record for the submarket of $905 set in third quarter 2007. Central Black Canyon and West Central Phoenix were the only two submarkets with rents below $600 in second quarter 2013 and each had respective increases of $10 and $5 over second quarter 2012 levels. Vacancies in these submarkets are relatively high, however, as demand for affordable rental housing within proximity of employment and transportation increases, vacancies in these submarkets will mollify and the areas will see modest rent growth. VACANCY Valley vacancies during second quarter 2013 stood at 8.4 percent, compared to 9.2 percent recorded in second quarter 2012. Second quarter 2013 was the fourteenth consecutive quarter that vacancies were lower than the same period of the prior year. All Eyes on the Multifamily Market By Robert Hicks, Alliance Residential President of the Board of Directors, AMA Arizona’s path to recovery in the real estate market has drawn international attention. For a fast growing real estate market, we experienced the worst of the bubble’s burst, in the early phases, and we are have come out, stronger it seems, earlier than other comparable markets. The market report put together by Marcus & Millichap’s Pete TeKampe this month helps us all put this back into a historical context, with a glimpse ahead in the possibilities and the opportunities. Looking at rental rates, occupancy rates and most importantly evictions, we can use this data in our own communities to predict rental pricing and ab-

sorption rates of new communities coming online here. The construction planning and development here is the result of an active market and one that is bringing new jobs to the area. The mayors’ panel at Perspective and Projections focused on the regional impact of new companies locating to Arizona, in particular to the East Valley, and the demand this economic development creates in our industry. The ripple effect for services, retail, restaurants and others gives us all a reason to be hopeful about our future. Preparing for changes in healthcare One of the biggest national issues that is dominating our employment conversations is healthcare. The new national healthcare mandates affect each and every one of us and our employees. This month, we have shared

a bit about the plan, released by the federal government, to offer some introductory information to your employees. There are many resources for information on these changes but we thought it was important to offer some information here too. Turn down that music One more article to draw your attention to this month is the piece by the Law Office of Scott M. Clark P.C. on music copyrights. The music that is carried over the radio, through the speakers in our offices, is copyrighted. And even when it’s simply broadcast for the enjoyment of staff and residents, there are regulations that we all need to be aware of so we are not violating copyright laws. Many major management firms have been contacted about this issue and it’s important that we are aware of the rules that govern how we share music in our public settings. q

Use of the Radio and The Unknown Risk of Copyright Infringement By Christopher R. Walker, Esq., Law Offices of Scott M. Clark, P.C. Whether you enjoy using the radio in your car, at the gym, or at your place of employment, the use of the radio is widespread. While many take for granted the free use of the copyrighted material that is broadcasted through their personal radios, some uses of the same copyrighted material can subject the radio operator to liability for copyright infringement. In the arena of copyright enforcement for the performing arts, SESAC, ASCAP, and BMI, known as performance rights organizations (“PROs”), hold licenses from the various music recording companies and seek enforcement of the copyright code. In the context of the property management, many major property management firms have been approached by one or more of these PROs regarding the operation of radios in various areas of their residential rental communities. For those who refuse to purchase a license, they often receive stern letters threatening the use of litigation

to protect the copyright holders’ rights. While copyright laws are complex, they are not as strict as the PROs would lead you to believe. Certain exceptions, which if applicable to your organization, serve as a defense to a copyright infringement claim. However, the use of music derived from any other source (e.g., iTunes, CDs, etc.) will almost certainly subject you to liability for copyright infringement, unless you obtain a license for its use. Copyright Law Under 17 U.S.C. § 106, “The Copyright Act,” the owner of the copyrighted work has exclusive rights with respect to the copyrighted materials. Among the exclusive rights granted to the owner are the rights to (1) publically display the work, and (2) publically per-

form the work. In almost all of these cases, the PROs allege that the use of the radio equates to a public performance. While the Copyright Act affords the copyright holder control over the copyrighted work, it does not give the copyright holder control over all uses of his copyrighted work. Since enacted, there have been several court cases which sought to interpret the Copyright Act as technology advanced and copyrighted works became more easily transmitted to the public. The most important of which is the Supreme Court’s decision in Twentieth Century Music Corporation v. Aiken, 422 U.S. 151 (1975) which upheld a café owner’s use of a small personal radio for the benefit of his patrons and employees. In the aftermath of Aiken, Congress has taken action to amend the Copyright Act

to address various technological advances and new uses of copyrighted materials. Exemptions to Copyright Liability Found in 17 U.S.C. § 110(5) (A), the “home-style exemption”, applies to performances and displays of all types of works in small commercial spaces. Its purpose is to exempt from copyright liability anyone who merely turns on, in a public space, an ordinary radio or television receiving apparatus of a kind commonly sold to members of the public for private use. While the use of radios in certain commercial establishments is permissible, there are limitations to their use. Found in 17 U.S.C. § 110(5) (B)(i), the broadcast of a radio transmission is exempt from copyright infringement liability so long as the performance is audio only and communicated through no more than six loudspeakers, of which not more than four can be in any one room or adjoining outdoor area. North Central Phoenix was the only submarket with vacancies above 15 percent during the period. Central Black Canyon typically has the Phoenix area’s highest vacancy but in second quarter 2013 it was edged out by Northwest/Southwest County and North Central Phoenix. Fundamental improvements are occurring in the Central Black Canyon, East Central Phoenix and Glendale submarkets as all recorded lower vacancies in second quarter 2013 compared to second quarter 2012. difficulty in keeping non-infill located apartment communities full and on a rising rent schedule. Area properties typically need to offer high concessions. Rental rate reductions for the area will continue later this year to stem the Phoenix metro area’s second highest vacancy rate. Of the remaining submarkets that lowered rents for the period, Ahwatukee is the only one with increased vacancies. This suggests that further rental rate reductions or increased concessions may be necessary.

North Paradise Valley recorded vacancies below 5 percent in second quarter 2013 while recording the Phoenix metro area’s fifth highest average asking rental rates. Every submarket ranked in the lowest vacancy category for second quarter 2013 had lower vacancies for the period compared to second quarter 2012 except Ahwatukee. Ahwatukee has seen a reduction in rents over the same period.

Every submarket, except Northwest Mesa in the highest concession ratio category in second quarter 2013, is located on the west side of the Phoenix metro area. Every submarket in the highest concession category ranking effectively utilized concessions as each saw lower vacancies in second quarter 2013 versus second quarter 2012.

CONCESSIONS Second quarter 2013 was the thirteenth consecutive quarter that the percentage of communities offering concessions declined compared to the same quarter of the prior year. Concessions stood at 66 percent in second quarter 2013 compared to 70 percent in second quarter 2012.

Central Valley again had the Phoenix area’s lowest concession ratio in second quarter 2013. The Phoenix Metro Light Rail transit system serves the area and demand for rental units within proximity of convenient, low-cost and environmentally conscious transportation is so high that concessions are unnecessary for 75 percent of apartment properties in the area. Northwest/ Southwest County landlords are dealing with falling rents and rising vacancies and it is extremely likely that concessions in this submarket will increase later this year. Concession offerings in Ahwhatukee are likely to increase as well to stem rising area vacancies. North Scottsdale/Fountain Hills landlords have enjoyed rising rents, falling vacancies and relatively low concessions. As previously reported in Trends, concession offerings would mollify further this year and market conditions in several submarkets are indicating a need for newly con-

Trade Show because it is just plain fun and is well attended which means we get to see a lot of people over a short period of time. • Maintenance Mania because this event is dedicated to the maintenance staff and housekeepers and I love to see their enthusiasm, appreciation and energy. • Dinner meetings feel like a quarterly homecoming. Good to see people and touch base. How have the AMA events helped your business? Your team? Attendance and participation at the events provides a wonderful opportunity for us to stay connected, interact and show our support for the AMA and the industry. For example, it helps my team to reconnect with each other as we come together and work on our trade show booth. It is a terrific team building opportunity. Have any of your team members become personally involved in the partnerships or programs? Certain team members seem to gravitate to an area and they sort of

adopt it as their own. For instance, we have one person who spearheads our booth creation and, I do mean creation. We typically build our own booths. While many team members contribute, he has adopted the role as “head booth maker” and works with others to pull it all together. On the other hand, I usually have the same people work our Trade Show Booth, Maintenance Mania Booth, P&P booth. Those people who feel comfortable with that and like meeting people. One lady in our office is in charge of any costumes and she takes care of all of that. Kowalski’s team is known for being really creative and having fun during major events. How does your team plan for those major events with the AMA? We usually begin by a meeting to review the event, the theme and any parameters. Sometimes some brainstorming takes place, but usually we set another time to get together to discuss and do our brainstorming then, after everyone has had a little time to digest it. We preach that no idea is a bad idea so as not to stifle creativity, we then allow the best ideas to “float” to the top. Once we feel harmony with a concept, we then set a follow up meeting to develop the concept, throwing out more ideas around the

concept that resonated with us. We don’t try to rush things, that is why we try to start the process early. To be honest though, it often comes down to the last minute before the ideas are developed. We joke that we work best under pressure... How do you find this builds team spirit/team engagement? It provides a platform for us to work together against the clock. We always want to try to do our best to create something that will be memorable and for our clients to enjoy. Sort of like the “Big Hairy Audacious Goal” concept by James (Jim) Collins in his books, Built to Last & Good to Great. It gives us something to focus on that is bigger than any one of us. q

The area as of second quarter 2013 had 628 units scheduled-for or under construction with an additional 2,008 units in its planning and zoning pipeline. NEW CONSTRUCTION In second quarter 2013, there were five projects totaling 970 units built. This compares to one project totaling 224 units in second quarter 2012; one project of 82 units in second quarter 2011; no new units in second quarter 2010; 1,504 units in six projects in second quarter 2009; 1,754 units in seven projects in second quarter 2008; 1,945 units in seven projects in second quarter 2007; 914 units in four projects in second quarter 2006; 2,170 units in eight projects in second quarter 2005; 1,200 units in seven projects in second quarter 2004; 1,545 units in six projects second quarter 2003; and 2,684 units in thirteen projects in second quarter 2002. As of second quarter 2013, there were 32 projects comprising 6,772 units scheduled for- or under construction Valleywide.

As of first quarter 2013, North Tempe had the most number of units scheduled for- or under construction. The submarket had 926 units in four projects being built. All of the remaining submarkets in this category comprise mainly Class ‘A’ apartment units. The future development pipeline is composed of 18,909 units in 73 projects. Not all of these will be added to the Phoenix area’s housing stock simultaneously. The operation of several facilities will not jeopardize the applicability of this exemption so long as each facility conforms to the speaker limitations discussed above. While there is no bright line rule to the home-system defense, some important considerations are the type and sophistication of the

equipment used, size of the area in which the broadcast is audible, and whether the equipment has been altered, augmented, or integrated in some fashion to be something other than what is commonly used in private homes. In at least one case, the court found that a restaurant’s stereo system, consisting of a single receiver and nine speakers, did not qualify for the Copyright Act’s “home-style” exception. the receiver and the greater the complexity of the receiver itself will likely contribute to the court finding the configuration to be outside the “home-style exemption.” WHAT ACTION SHOULD YOU TAKE? What is clear from the case law is that there is no “one-sizefits- all” formula and that each case must be determined on a case-bycase basis. Property management firms must be cognizant of these issues when they utilize radios in their facilities. By providing this amenity to your residents, you may be subjecting yourself to liability under the Copyright Act. Property management firms who employ radios at their communities are strongly encouraged to contact their legal counsel to see

if they qualify for the exemptions discussed above. This discussion should include the size of the facility, the number of speakers in each room, and the type of receiver used to operate the radio. LATE – Lacking Attitude to Excel By Tod T. Grice, BG Staffing Being on time for work means showing up a few minutes early. Why? So you have time to go inside, put your coat away, use the restroom, get your cup of coffee, etc. in time to be at your desk a couple of minutes early, ready to go. When you are there on time, it shows dependability, reliability and, most importantly, trustworthiness. It also shows that you care about your job and that you are a team player, ready and willing to get to work with your coworkers. Showing up early/on time shows that you respect yourself and your boss, as well as your co-workers. It shows you care about doing your job and doing the best you can and that you are not just there for the paycheck.

at 32 percent, didn’t get enough sleep at 19 percent, bad weather at 9 percent, and 8 percent say their kids made them late to work. Other excuses include “the line at Starbucks was long,” “my ex stole my car and I had to find a ride to work” or “I was trying to get my gun back from the police.” More than a quarter of managers are skeptical of their employees’ excuses, and 24 percent of employees choose to make up an excuse rather than tell the truth. And what happens once you arrive at work? When most people arrive at the office, it takes them an additional 14 minutes before they actually start to work. A quarter of the people make coffee, 40 percent eat breakfast, 25 percent check their personal emails and 20 percent chat with coworkers. What is the cost of being five minutes late to work? The formula is:

BY THE NUMBERS It is estimated by HR Magazine that more than 15 percent of the U.S. population is late to work every day, costing businesses more than $3 billion in lost productivity. The most popular excuse is traffic delay

If Angie makes $6.75 an hour, the overhead cost is $13.50. If she is regularly five minutes late, multiply $13.50 by 1/12 (.083) of an hour, then multiply that number by 255, the number of days she works in a year. Angie being habitually late costs her employer $286 in production annually. However, if an employer has 100 to 500 employees making $9.50 an hour, using the five-minutes-late formula, the estimated cost is $38,100 to $190,500 in lost production. One study shows that an employee earning a $60,000 salary arriving 15 minutes late every day equals $5,000 in lost production in a year. WHAT YOU CAN DO If tardiness plagues your office, a few steps that can help deter the problem. In my office, everyone is allowed to be late by five minutes once a week. Why? Because life happens. If the person is late again during the week, even by one minute, a $5 late fee is charged for every minute late. Five minutes late on a Monday is free, but 10 minutes late on a Tuesday just cost 50 bucks! The money is given to the person who wasn’t late to work during the week.

If the tardy person is unable to pay the total amount of the late fees, she can choose to be “On Call” for the weekend. While I would like to use the carrot to reward positive actions, I find that the stick is much more of a motivator, so I reward with the carrot and discipline with the stick. One of the best ways to curb tardiness is to lead by example. If that doesn’t help, have a meeting explaining the tardiness policy, discipline the repeat offender and reward those who are to prompt to work. Being chronically late to work is a sign of disrespect to one’s boss and peers. To be on time to work is to plan your life and live the life you want to live. Access and Entry By Andy M. Hull, Esq., Hull, Holliday and Holliday, PLC. Access can be one of the most difficult areas a landlord has to deal with. The landlord can enter the tenant’s residence for almost any valid reason. Always give two (2) days written notice to the tenant when you plan to enter unless an emergency exists, and then enter only at reasonable times. Notice again can be delivered in person or sent certified mail (keeping in mind the five day mail rule). The statute does not define what a reasonable time is, but presumably it is during regular business hours, or in the evening or weekends at a time the tenant can be expected to be home. The state legislature amended A.R.S. § 33-1343, the statute governing access, a few years ago. With the amendment, a tenant who requests service or maintenance under A.R.S. § 33-1341, waives their right to receipt of the two (2) day notice. Landlords should still enter only at reasonable times, and as a courtesy, still notify the tenant of when entry will be made. Even though the landlord can enter in the case of an emergency without notice or if it is impractical to give notice, what authorizes an entry under these circumstances is again a factual determination. While

a broken water pipe would clearly constitute an emergency, an entry to deliver a five day notice to a tenant who works nights and sleeps days would probably be unauthorized. A landlord should always keep notes in the tenant file as to why the residence was entered and what steps were taken to notify the tenant. The tenant cannot unreasonably refuse entry to the landlord. If a tenant refuses to let the landlord enter without a valid reason, the landlord can obtain a court order to enter or can terminate the rental agreement (see A.R.S. § 33-1376). If the tenant has abandoned the unit or vacated it, the landlord would need to follow the procedures for abandonment before they access the property. Care should be taken to follow the statute prior to any entry. Failure on the part of the landlord could result in the tenant terminating the rental agreement immediately or recovering actual damages in an amount not less than one month’s rent (see discussion under A.R.S. § 33-1376). Both the landlord and the tenant have remedies for abuse of access and refusal of access. A.R.S. § 331376(A) allows the landlord, in the case of a tenant who refuses to allow the landlord access to the rental property, to either obtain a court order to enter or to terminate the rental agreement. It is normally quicker and less

expensive to terminate the rental agreement through proper notice and then evict the tenant through a forcible detainer action. Regardless of which choice is made, the landlord may recover any damages sustained. The choice should be contingent on whether the landlord wishes to keep the tenant, or desires to terminate and rent to a more desirable tenant.

A.R.S. § 33-1376(B) provides the tenant remedies for the landlord’s unlawful or unreasonable entries or entries that have the effect of harassing the tenant. Should the tenant be able to prove the landlord’s intent is not lawful or that the entries have been made in an unlawful, unreasonable or harassing manor, the landlord can be enjoined from entering or the tenant may terminate the rental agreement effective immediately. In either case, the landlord can be liable for at least one month’s rent in damages. Care should always be taken by the landlord to only request entry for valid reasons. q Andy M. Volunteers gather weekly at UMOM to read to children who participate in UMOM programs and live in their rental housing, giving parents a brief rest and give children an opportunity to learn from other caring adults.

Attendees of the program also receive books to take home so they can continue reading with their parent at home. This program impacts hundreds of families in the Phoenix area and the donations during the AMA Bowl a Thon will directly benefit those families. The crowd also raised a record breaking $27,260 dollars for Big Hearts for Little Hands.

New Report Shows Benefits of the Affordable Care Act for the People of Arizona Highlighted from US Department of Health & Human Services Recently, the Obama Administration issued a new report highlighting the benefits of the Affordable Care Act for the people of Arizona. Thanks to the health care law, the 82% of Arizonans who have insurance have more choices and stronger coverage than ever before. And for the 18% of Arizonans who don’t have insurance, or Arizona families and small businesses who buy their coverage but aren’t happy with it, a new day is just around the corner. “Soon, the Health Insurance Marketplace will provide families and small businesses who currently don’t have insurance, or are looking for a better deal, a new way to find health coverage that fits their needs and their budgets,” said Health and Human Services Secretary Kathleen Sebelius. The health care law is already providing better options, better value, better health and a stronger

Medicare program to the people of Arizona by:

Open enrollment in the Marketplace starts October 1, with coverage starting as soon as January 1, 2014. But Arizona families and small business can visit HealthCare.gov right now to find the information they need prepare for open enrollment. Better Options The Health Insurance Marketplace Beginning Oct 1, the Health Insurance Marketplace will make it easy for Arizonans to compare qualified health plans, get answers to questions, find out if they are eligible for lower costs for private insurance or health programs like Medicaid and the Children’s Health Insurance Program (CHIP), and enroll in health coverage. By the Numbers: Uninsured Arizonans who are eligible for coverage through the Marketplace. • 947,878 (18%) are uninsured and eligible • 695,083 (73%) have a full-time

worker in the family

As many as 2,794,358 non-elderly Arizonans have some type of preexisting health condition, including 410,684 children. Today, insurers can no longer deny coverage to children because of a pre-existing condition, like asthma or diabetes, under the health care law. And beginning in 2014, health insurers will no longer be able to charge more or deny coverage to anyone because of a pre-existing condition. The health care law also established a temporary health insurance program for individuals who were denied health insurance coverage because of a preexisting condition. 4,861 Arizonans with pre-existing conditions have gained coverage through the PreExisting Condition Insurance Plan since the program began.

• 338,111 (36%) are 18-35 years old 44,266 (57%) are male 866,371 (91%) of Arizona’s uninsured and eligible population may qualify for either tax credits to purchase coverage in the Marketplace or for Medicaid if Arizona takes advantage of the new opportunity to expand Medicaid coverage under the Affordable Care Act. Arizona has received $30,877,097 in grants for research, planning, information technology development, and implementation of its Health Insurance Marketplace. New coverage options for young adults Under the health care law, if your plan covers children, you can now add or keep your children on your health insurance policy until they turn 26 years old. Thanks to this provision, over 3 million young people who would otherwise have been uninsured have gained coverage nationwide, including 69,000 young adults in Arizona.

Clearing the Air on Smoke-Free Arizona and Multihousing

By Sue Bergquist, Multi-Unit Housing Liaison Maricopa County Department of Public Health Do you know Arizona’s law and regulations about signage when it comes to smoking in multi-unit housing communities? In November 2006, the citizens of Arizona passed the Smoke-Free Arizona Act (A.R.S. §36-601.01.), a landmark statute that prohibits smoking in most enclosed public spaces, places of employment and within 20 feet of entrances, open windows, or ventilation systems. The law was passed to protect non-smokers from secondhand smoke, mainly a mixture of the smoke given off by the burning ends of a cigarette, pipe, or cigar, and the smoke emitted at the mouthpiece and exhaled from the lungs of smokers (mainstream smoke). About 4,000 chemical compounds have been identified in secondhand smoke, 200 are identified as poisons and at least 40 cause cancer. Private residences are one of the exemptions of the Smoke-Free Arizona Act, except when the residence

is used as a licensed child care, adult day care or health care facility. This means smoking inside individual multi-unit housing communities such as apartments, condominiums, or duplexes is allowed under the statute. Each individual unit is exempt from the Act because they are considered private residences, which includes their balconies, patios or decks even if it is within 20 feet of a neighboring unit. However, a proprietor has the right to designate their rental unit as non-smoking. Enclosed Common Areas Smoking is prohibited inside and within 20 feet of entrances, open windows, or ventilation systems of enclosed common areas of multifamily housing such as the main office, laundry room, fitness center, activity center or clubhouse. Outdoor Common Areas Smoking is allowed outdoors as long as smoking occurs at least 200 feet away from entrances, open windows, or ventilation systems of enclosed common areas where smoking is prohibited. Carbon Monoxide Alarm Requirements for New and Existing Apartment Buildings in Arizona By Courtney LeVinus and Jake Hinman, Capitol Consulting As reported last year in Apartment News, apartment owners and managers in Arizona need to be made aware of the new Carbon Monoxide (CO) alarm requirements that have been adopted in several Arizona cities and will likely be adopted in most of the major jurisdictions around the state within the next year. All new and existing apartment buildings with fuel burning appliances located inside of the apartment unit and/ or buildings with attached

garages will be required to install single-station Carbon Monoxide alarms. The new requirements are contained in the 2012 International Building Code (IBC) and the 2012 International Fire Code (IFC). The IBC and the IFC are part of the standardized building codes developed by the International Code Council (ICC) that regulate the design, construction and modification of new and existing buildings. Most jurisdictions throughout the country, including Arizona, have adopted some version of the ICC family of codes. The 2012 editions are the most current code

editions. Carbon Monoxide alarm requirements are becoming more common around the country. With the CO requirements now part of the IBC and IFC standardized building codes, these requirements will likely be the new standard for all cities across the country. The base codes do allow battery operated devices and the CO alarms will not require hardwiring or interconnection in existing apartment buildings. The CO alarms will only be required in apartment units with fuel burning appliances and/ or attached garages.

Driving Safely By SCF Arizona Many employers have no driver safety training for their workers, but whether your employee is on the road a lot or just runs down to the corner store on a company errand, he or she is exposed to the dangers of the road, street and highway. There are good reasons why employers may want to create and implement a safe driving program for their employees:

• Traffic collisions, especially fatal ones, can have a huge impact on the business’ human and financial resources. • Driver safety training can minimize potential company and personal liabilities related to crashes involving workers who are driving on company business. • Driver training can help save lives and reduce the risk of serious injuries among your workers. According to Bureau of Labor Statistics, fatal work-related events accounted for nearly two out of every five fatal work injuries in 2010. In Arizona, transportation deaths remained the leading cause of workrelated fatalities in 2011, accounting for 38 percent of the state’s 65 occupational fatalities. Employers who use drivers should consider these steps suggested by the National Institute for Occupational Safety and Health (NIOSH):

• Conduct a driver’s license background check before hiring a driver. • Require all drivers and passengers to use their seat belts.

Already, 2,091,000 people in Arizona, including 769,000 women and 570,000 children, are free from worrying about lifetime limits on coverage. The law also restricts the use of annual limits and bans them completely in 2014.

Arizona has received $3,000,000 under the new law to help fight unreasonable premium increases. Since implementing the law, the fraction of requests for insurance premium increases of 10 percent or more has dropped dramatically, from 75 percent to 14 percent nationally. Telephone Consumer Protection Act Dos and don’ts to simplify compliance

By Nick Frantz, One Call Now With Telephone Consumer Protection Act (TCPA) claims on the rise, now is a good time to review what’s going on and how it affects businesses and organizations. TCPA Snapshot The TCPA was enacted to protect consumers from aggressive telemarketers. TCPA provides a variety of restrictions. Most recent claims relate to promotional marketing calls using automatic telephone dialing systems (ATDS also called “robocalls”), artificial or prerecorded voices and calls to cell phones. Two primary factors complicate TCPA compliance:

• Broad interpretations of the law’s provisions by the courts and the FCC, and • Technologies that have been developed since the law was enacted in 1991.

For example, the FCC interprets a “call” to include the sending of a text message. However text messaging is not specifically mentioned in the TCPA.

Important TCPA Facts • TCPA does not prohibit message notification services, ATDS, artificial or prerecorded voices, or automated calls and text messaging to residential and cell phones. • FCC regulations exempt calls that don’t include unsolicited advertising and calls that are made to those with whom the caller has an established business relationship. • CPA requires that prior written consent be received for ATDS and artificial or prerecorded voice telemarketing or advertising calls to cellular and residential phones • TCPA requires that ATDS and artificial or prerecorded voice telemarketing or advertising calls have opt-out mechanisms.

Best Practices DOs and DON’Ts • DO feel free to use a message notification service. It’s an efficient, inexpensive and highly-effective way to keep groups of all sizes informed. • DO get written consent from those on your contact list allowing you to send messages using ATDS, artificial or prerecorded voice technologies, and text messages to their land lines and their cellular phones. • DO use a notification service that provides recipients with opt-in and opt-out mechanisms. • DO make sure that contracts for marketing campaigns with outside vendors expressly exempt you from potential TCPA violations. • DON’T send promotional notifications, advertisements or any unsolicited messages that can be construed as advertising to anyone without first securing their written consent.

And lastly, don’t be tempted to over react to concerns about TCPA compliance. Provisions in the law make message notification services a good fit for businesses and organizations of all sizes. Periodically review your communication policies and practices and make sure your staff understands the dos and don’ts. q
