Who Really Owns It?

Why title insurance may be a smart investment. You have bought a property, and one day you come home to find a legal notice that someone is claiming to have rights to your property. The property that had a proper title search and was sold to you as free and clear of all encumbrances... What to do?! Besides becoming highly excited (understatement of the year!), you pick up your phone and call the attorney that handled your closing. His first reaction will be to say “I will get back to you” and “I am glad I encouraged you to buy the Fee Title Insurance Policy!” What are we talking about here? Welcome to the little understood world of title insurance. Poorly understood because many may be aware of its existence, but few really know how it works. Even seasoned Realtors are willing to admit they are shaky on what title insurance does and why you, as a buyer, might need it. This form of insurance is not well understood except by those that deal directly with it; that being attorneys, title examiners and others that deal with the behind-the-scenes workings of getting a property to close. This is a topic Realtors will refer (with relish) to attorneys, when asked about it. Truth is, this topic rarely ever comes up between a Realtor and their client. So, what is title insurance exactly? Title insurance is insurance that protects you, the owner and the mortgage holder (if there is one) of a certain property against defects in the title to that property. There are generally two policies which buyers must be made aware of: owner’s (“Fee” - a legal term derived from English common law dating back to medieval times) and lender’s (“mortgagee”) title insurance. Lenders, (aka “the bank”), will require that a title insurance policy be purchased at the time of closing to protect their interest in the property, (aka the loan amount). Home buyers mistakenly assume this insurance protects them too, when actually, it does not! During the home buying process, it is mandated by law that the buyer be offered the opportunity to buy an owner’s “fee” title insurance policy only if they are obligated to buy the mortgage title insurance. Buyers in this position are supposed to be made aware of what these insurances are, what they cover during the buying process, and at least once, will be expected to sign a document attesting to the fact that they were informed. Additionally, if a buyer buys both the fee and mortgagee insurance at the same time, they will get a discount on the mortgagee insurance! Not all attorneys recommend that buyers purchase Fee Policies and as a result they only quickly cover the details as required by law, leading the buyer to think it is not neces-

sary to buy a policy to protect themselves. In fact, when I was a fledgling real estate sales person, I remember this topic being covered in a class. We were told that, in most cases, this is an unnecessary cost for the buyer. But, as I matured into the profession, I see now that I would never buy a property without this insurance, because of the low cost and high potential value. Title insurance is unique in that it protects against past events, not future events like your home owners insurance policy. For example, you take out home-owners insurance to cover possibilities such as a fire destroying your home, and with it, your investment. Title insurance covers what may have already happened, but that you and others involved with your closing, may not be aware of. There is a large gamut of possibilities that could affect your ownership in a property you buy. There may have been a failure to notify all creditors in a prior foreclosure action, gaps in the chain of title, forged deeds, wills that were not probated, mortgages that were not discharged and many other legalities which can and do fill legal books! James A. Marino, Esq., a Rochester real estate attorney, also noted “in this day and age of identity theft and internet fraud, the claim being made on the property may not even be valid, but a title insurance policy will cover the attorney fees and legal costs of defending such claims.” Further, he stated that “In a large number of cases, it’s the attorney fees and costs that are financially and emotionally destructive rather than the claim itself.” One example of the need for this protection is of an uncle who gave a quit-claim deed to his home to a nephew, and the deed was never recorded. Subsequently, the uncle died without a will, but the nephew was unaware of his death. Probate was initiated and the property disbursed to the presumed heirs. The home was given to the heirs, since there was no knowledge of the deed to the nephew. The heirs sold the home and eventually the nephew found out. He actually had some

claim to the property and that would need to be settled in court. This is when title insurance comes into play. The buyer purchased the property with a mortgage. Their mortgage company required title insurance, and a mortgagee policy was bought. (Here is where home buyers normally come into trouble.) The buyers did not know or understand that the mortgagee policy covered only the mortgage holder’s losses. (Most buyers assume that this policy protects them. It does NOT. This policy only covers the mortgage company.) Fortunately, the buyer in this story had an attorney that highly recommended they purchase what is known as a Fee Title Insurance Policy. Besides recommending his clients buy the Fee Title Insurance Policy, the attorney made the buyers aware that there was also a Fair Market Value Rider available. (This is purchased at the same time as the “Fee Title Insurance Policy” and covers home value increases over time. If you do buy the “Fee Title Insurance Policy” I highly recommend you include a Fair Market Value Rider.) While Fee Title Insurance is mandated by some attorneys, especially when 10% or more is put down on the property, not all attorneys mandate this additional rider. Luckily, the buyers in this story bought the additional rider. So, having lived in this home for ten years, the homeowners were stunned to learn that the nephew had a legitimate claim on the property. A court battle ensued, costing thousands in attorney fees, but the buyers were covered due to having bought both forms of title insurance. Unfortunately for them, the court decided that indeed, the nephew did own the home and that it was improperly sold. The nephew, suddenly having a nostalgic bend towards his uncle, decided he absolutely MUST live in the home and the buyers had to leave. The buyers mortgage company was paid the money that they insured for. And because the buyers bought the Fee Title Insurance Policy, they too were covered, and were paid

the money that they put down on the property. Since they also bought the Fair Market Value Rider, they were also covered for equity in the property. Because they were covered, they were able to put their lives back together and buy another property quickly and get on with their lives. Had they not bought the Fee Title Insurance Policy, they would have lost their down payment and closing costs, which can be considerable in some cases. Having additionally bought the Fair Market Value Rider, the buyers were able to capitalize on the large increase in value over the ten years they lived in the property. The Market Value Rider covers increases in value due to market increases (inflation) but not improvements to the property - so the cost of any improvements such as a new sunroom, would not be recouped. The buyers financial damage was kept to a minimum and they were able to recoup quickly. Wade Radtke, a sales account manager for Chicago Title Insurance Company here in Rochester, told me a story. At an event, a Realtor accosted him, decrying the waste of money title insurance poses to buyers. Wade defended the need for title insurance by recounting to the Realtor a personal experience. Wade is a firm believer in title insurance, not only because he sells it, but because it saved his father from a loss in real estate value. His father had bought a property. Eventually, a property line dispute arose. His father lost and in the process lost three acres. He was covered though, through the title insurance he had taken out and so was able to recover the value of the three acres and was also protected from the legal fees spent defending his position. Now that you have read this article, perhaps you realize you that do not have the Fee Title Insurance Policy or Fair Market Value Rider. It is not too late. You can get these insurances, as long as you are not currently experiencing a challenge to your ownership of title to a property. Contact your trusted real estate attorney and ask them for a recommendation on who to contact to set it up or look online for title insurance companies. There are quite a few companies ready to work on your behalf. If you are unsure whether you have a Fee Title Insurance Policy, contact your attorney and ask them to review your documents. To be fore-warned is to be protected, as long as you take action!

It’s that time of year when everything awakes from a long winter nap - including the ants. We’ve asked our business partner, John Frazier of Castlegaurd Pest Management in Fairport - 585-381-0395 to give us some insight on these pests.

The Icky factor is the general disgust of having small insects taking over a kitchen, den, or bathroom. This aversion is the emotional side of the problem. The Investment factor is the more rational concern that carpenter ants may be destroying the house! They are wood For many of us, a sure sign of spring is the destroying insects that can cost money to return of the black carpenter ant. What repair what they damage. we used to say about the train, we can say about the carpenter ant “Right on Time!” Some are particularly distressed by the sight of carpenter ants in cold weather. We regularly get calls for them in January, February and March. And it doesn’t even seem to correlate with the warm days of those months. We can be in blizzard conditions.  Much more common is a flood of ants when the sun is warm in April and May. Whenever it is they show, the conditions were just right to come out. Temperature gets them moving to find food! So how can you tell if you have a “problem”? Doesn’t everyone get ants?   There are two things that generally drive people to call us with an ant problem what I call the “Icky” factor and the “Investment” factor.

To help put things in perspective, here are what we consider to be the top five signs of a carpenter ant problem that needs fixing:

Fixed vs. Adjustable Rate Mortgages

Fixed-Rate Mortgage A Fixed-Rate Mortgage applies the same interest rate toward monthly loan payments for the life of the loan. Fixed-rate mortgages are more straightforward and easier to understand than Adjustable Rate Mortgages (ARMs), are more secure for the buyer, and are popular with first-time homebuyers. Since the risk to the lender is higher, fixedrate mortgages generally have higher interest rates than ARMs. For example, a lender can offer a 30year fixed loan to a homebuyer at a 7.0% interest rate. The loan is locked in to the 7.0% interest rate, even if the market interest rate rises to 9.0%. Conversely, if the market interest rate decreases to 5.5%, the borrower will continue to pay the 7% interest rate.

At the same time mortgage interest rates are at or near historic lows. Recently, when it looked like the economy was recovering, interest rates reflected the positive move by moving up and would have continued when the economic slowdown drove the rates back down. This was a clear indication that as soon as there is recovery we will not see

these low rates continue. Regarding property values, we believed we had seen the bottom of the market a couple of years ago, and in fact we did. Prices dropped from 2007 through 2010 and have remained relatively stable since. Residential, owner occupied, single family homes are driven by supply and demand. The population hasn’t gone down, so income and unemployment rates become bigger factors. Residential rental property is seeing a boom in many areas. So, if you are in

a position to invest and you are willing to deal with property condition and tenants; that is the place that investors with cash are putting their money. The market is busy for the best Real Estate professionals. So you want them to demonstrate that they will be responsive to you by returning your communications quickly. You want to find and work with a lender who is responsive and has a thorough understanding of the increasing regulations that impact a Buyer’s ability to finance. Expect the process to be cumbersome and messy. The rules are changing regularly. Even the best lenders are continuously required to adhere new underwriting guidelines.
