Regolamento Generale per l’igiene del Lavoro (1927) Artt. 4 e5: obbligo per il datore di lavoro, a seconda della natura e della importanza dell’azienda, del pacchetto di medicazione, della cassetta del pronto soccorso, o, per le aziende con più di 5 operai con rischio di scoppio, asfissia, infezione o intossicazione, della infermeria. Art.7: tutte le aziende industriali soggette all’obbligo dell’assicurazione contro gli infortuni devono esporre un cartello con l’indicazione di un medico che possa essere chiamato in caso di pronto soccorso e talune di esse devono disporre di un infermiere o, in difetto, di persona pratica di infermeria.

The role of the corporate rescuer is not defined by the current legislation, which can only be referred to the State Regions guidelines in which the role of ATTESA ATTIVA is defined to avoid the aggravation of already established damages and avoiding excessively interventionist attitudes (?) . The lack of a precise definition of the role, moreover foreseen in the legal systems of other EU countries, generates difficulties in defining the obligations and responsibilities of the non-professional corporate rescuer.

As a minimum criterion, the number of 1 worker in the company and the type of accident risk has been proposed, the number of 1 rescuer for every 30 employees. Furthermore, the number of employees present at the same time must be equal to 2 per work shift and must be provided with a substitute with equal skills to be used in case of any absence.

According to other guidelines we should also consider a relationship with the extension of the production plant, for example 1 rescuer every 5001000 / m2. According to other guidelines this number could be raised to 1 in every 50 employees. -
