‘BOOM’, you say? By Anthony Simon According to a couple of headlines in the mainstream media, Australia’s mining boom may only have a couple of years left in it.

Agency Bookings Hogan Media: 08 9381 3991 Sale Representatives Melissa Jonsson: 0450 592 584 Breda Ryan: 08 9185 5570 Anita Smith : 08 9185 5570 Editorial Alan Richardson Graphics Westy Sabrina Hansen Susanne Braithwaite

This came about due to a report predicting that the mining boom was running out of steam because fewer new massive mining projects are commencing. So why, then, would you want to invest in an infrastructure boom town? • Putting aside the approximate $250 Billion dollars in a 100 per cent committed investment that’s rolling over within the next few years. • And putting aside any new billion dollar projects that will be announced in the next 1 to 5 years. • And putting aside the massive amounts of Iron Ore, Coal, Gas etc. that’s still yet to be dug up or extracted in Australia. There’s another reason our resource powerhouses have a strong future, which is rarely discussed in the media, that thrives on sensationalist headlines & superficial analysis. Sure, it’s partly because of the tremendous growth of China

and India. No news there, but there’s another reason that few in the media truly understand. Let me explain. Global energy forecasts have been radically changed since the March 2011 tsunami in Japan, which resulted in the world’s second worst nuclear reactor incident. This was a tipping point, because then in May 2011, Germany announced it would immediately shut down eight of its 17 nuclear reactors, and close the rest over the next decade. Finally, in May 2012, just 3 months ago, Japan announced it had shut down the last of its 50 nuclear power plants. 50! This heralds a new era in how the world will be powered. Why? Because LNG is now the frontrunner to replace nuclear in the future. And many countries are looking to Australia to meet their needs because we have an abundant supply and a stable economy. That’s why right now there are seven mega LNG projects under construction in Australia. Three of which are located in the Surat Basin in Queensland. What’s most amazing is that these projects haven’t even come online yet. So if you think property prices in that region have

already soared, you ain’t seen nothin’ yet! Even if gas prices drop this doesn’t matter - LNG is contracted on long term contracts. This means that the volumes are fixed by both buyers and sellers – which is called ‘offtake’ agreements. With ‘off-take’ agreements, the pricing mechanism is designed to take the volatility of price movements. Example, one of the LNG proponents Santos/ ConocoPhillips said that it can break even and still meet its debt repayments, even if oil prices plummet to as low as US$35. Since oil is linked to LNG price calculations, it means that oil prices could collapse to half of today’s values and they could still weather the storm. This is very positive for Australia. As we’ve always said, we’re not just seeing a ‘boom’ in Australia. Booms come and go. What we’re seeing is an economic revolution to a new economy where energy & mineral supplies are a central driver. Does that mean you can buy anywhere in the Surat Basin? Does that mean you should be blasé about the price you pay in a resource boom town? Of course not. Truth is, there are better opportunities than

others. Some towns represent better value than others. Some towns are earlier in their infrastructure growth cycle. Stay tuned over the next weeks as we’re going to you give detailed specifics of where we see the best opportunity today. So you take advantage of this new economy. A FINAL WORD. It’s important to mention that nobody I know, and I mean nobody, got rich by following mainstream media. For years I wondered why that was the case. Then it hit me, it’s because their job is not to inform you and I. Their job, for the most part, is to sell lots of newspapers and make millions (even billions) for the publisher. And the way they do that is by ‘dramatising’ things. ‘If it bleeds, it leads’ is their motto. Just look at the recent debacle of Murdoch’s publishing empire as a case in point. I’m not saying to ignore mainstream media. Never ignore anything. But don’t depend on them for insightful investing advice. After all, if the journo’s had all the answers they’d likely be retired, living off property income, not writing newspapers under blood boiling deadlines. Apartment living – the quiet revolution in the Pilbara property market By Ryan Crawford The next time you visit major regional centres in the Pilbara region of Western Australia, you will see a quiet revolution taking place in the property market. Currently under construction in major population areas such as Karratha are high quality apartment developments, which only a few years ago would have seemed unimaginable. The construction of these apartment developments shows the property market in the Pilbara is maturing and now offering residents a diversity of housing options. Overall, apartment living in Western Australia is gaining popularity simply because more people are now living alone and do not require large homes.

The latest Census figures indicate that around one in four people in the state now live alone. For astute property investors, these apartment developments offer a low entry price point to enjoy the high rental returns and capital growth rates that the Pilbara market can offer. For example, you can now purchase a one bedroom, one bathroom apartment in a quality development for around $550,000 in major regional centres such as Karratha, and still achieve rental returns equivalent to purchasing a much more expensive stand-alone home. New apartments also give investors generous depreciation benefits as well as lower maintenance costs compared to purchasing older style houses. As part of this trend towards apartment living in the Pilbara, Crawford Realty is currently marketing The Baynton ‘five star’ apartment development in Karratha.

When The Baynton is completed in September 2013, it will compare favourably to some of the most expensive apartment developments currently being constructed in Perth. Designed by leading Perth architects and with a 6-star energy rating, The Baynton will appeal to both owner occupiers as well as astute investors seeking quality tenants. Stage one of The Baynton has just been released for sale and consists of 10 apartments ranging from one bedroom, one bathroom, two bedroom, two bathroom and three bedroom, two bathroom apartments.

Renting If you rent a property, you may feel you are powerless to make substantial energy-saving changes to the home you live in. But there are a number of actions you can take. Think about your lifestyle when you are looking for a rental property. Choose a location that is near to your work and any facilities you need, or is close to public transport. Choose a location that will allow for short, easy travel to all the places you frequent. Consider sharing with other people to save money and resources. Talk to your landlord about making changes to your property - including insulation, water heating or lighting. These changes will save

energy costs and will also improve the capital value of the property, creating a winwin situation. Research rebates and assistance available to landlords. Let them know about assistance and how much they can save. Remember that your behaviour can make an enormous difference to the amount of energy you use or waste in your home. Don’t rely on capital improvements to make living in rental properties more sustainable. Even making some simple and easy changes to the way you live can have a big impact, without reducing comfort.

The one bedroom, one bathroom apartments are priced from $550,000 and are expected to deliver an annual return of over 11%, with over 50% of stage 1 already sold. All the apartments will have quality fittings such as stone bench tops and are very spacious, ranging from 57 to 106 square metres.

Exmouth, a great place to invest From the red, rugged Cape Range, to the white sand of the beaches and the bluest ocean you’ve ever seen, Exmouth has something for everyone. The Ningaloo Marine Park stretches for 260 km

along the coastline and in parts the reef is within 10 metres of the shore. Eco tourism keeps Exmouth going these days, and the population swells from over 2,400 to around 6,000 in the tourist season. The lifestyle of Exmouth

is what people are chasing now. The fishing is fantastic. Northwest snapper and red emperor are hooked regularly and charter boats do half and full day trips. You can even have a go at mud crabbing.

But even if you don’t feel like catching your own dinner, the town is equipped with good facilities. For wining and dining there are cafes, restaurants, resorts and a tavern to spend a lovely relaxing time.

Over 20 properties have sold in Exmouth these past few months

Exmouth possesses a modern hospital and multipurpose health service and the schools in this area cater for children up to year 12. There is a public swimming pool, a public library and community resource centre. With the oil and gas industry growing in the area to the north and east of the town, Exmouth is looking at different opportunities for expansion. Fly-In, Fly-Out employment opportunities are being offered to people living in Exmouth by Rio Tinto, which would be a great place to come home to for a break as well as being close to the mine sites. The Exmouth Marina Village boasts a new canal development, where blocks have access via a private jetty. The Marina will have hospitality and retail outlets situated on a residential canal development.

Did you know? •

With so many fabulous opportunities within the area, why not grab your own piece of paradise?

Just a two-and-a-half hour flight from Perth (or a two-day drive), it’s the ideal base to explore the World Heritage Listed Ningaloo Reef and Cape Range National Park. Exmouth has a resident population of 2,400 in the period April to October, annually the numbers swell to approximately 6,000 with the influx of many tourists that travel north for the beautiful climate and conditions that we are fortunate to have.

Exmouth, located 1,270 kilometres north of Perth, was originally a military base for the Americans.

It is now more recognised for the astounding Ningaloo reef, and is the place to go to swim with the Whalesharks or to get away to that tropical paradise we all dream of.

Tourists flock to Exmouth in the winter months to escape the cold down south and to enjoy the year round warm weather.

Master Builders visit Pilbara to examine workforce and housing challenges Master Builders will head to the Pilbara from August 23 to 25 to see first-hand how the resources sector is contributing to Australia’s economy and job opportunities.

Director of Master Builders Western Australia, Michael McLean, said the rapid investment in resources has delivered signifi cant benefits for Australia, but has also created challenges for government and the building industry. “More than $260 billion has been invested Executives from Master Builders will meet to boost the capacity of Australia’s mining key stakeholders from the resources sector, industry in the six months prior to April 2012 building and construction industry and the WA and further investment is in the pipeline,” Mr Government to witness how the mining boom McLean said. is impacting on the non-resource side of the “This rapid investment has created a building and construction industry. particular challenge for governments and the industry to provide the economic and social infrastructure, as well the number of workers, to meet the needs of the resource projects and the regional communities in remote areas like the Pilbara.” National CEO of Master Builders, Pty Ltd Wilhelm Harnisch, said his office

has been working with Federal and State Governments for more than five years to address the opportunities and challenges created by the mining boom. “For the building industry, the rapid investment in resource projects and the accompanying construction boom, as well as the combined need for skilled workers, is proving a unique challenge,” said Mr Harnisch. “Recruiting a skilled workforce, willing to work in remote areas, is a big test for both the mining and construction industries.” The construction industry has been working with both federal and state government to address this issue, but one of the immediate challenges is to find adequate skilled workers to meet the capacity requirements. “Despite the controversy, the short term answer lies in the use of Enterprise Migration Agreements and overseas workers,” said Mr Harnisch.

“Our National Board will travel to Karratha and Port Hedland to get a comprehensive ‘on the ground’ perspective. “We will be meeting with stakeholders, to see how the current policy is working in these remote mining communities. “It will allow us to make an informed, evidence based assessment of any policy gaps and further policy action that may need to be taken by Federal and State governments. “There will be a particular focus on skills, getting the balance between Australian versus overseas workers and the need for ongoing and accelerated investment in apprenticeship programs. “We will also look at the need for housing accommodation and urban infrastructure for remote areas where the fly in, fly out (FIFO) workforce is a dominant feature and how the current approach could be improved,” Mr Harnisch concluded.

Instant Granny Flats for Karratha A win-win for homeowners and the housing shortage The Roebourne Shire has released a draft building code enabling Instant Granny Flats to be installed in backyards to provide a solution to the critical accommodation shortage being experienced throughout the region.

The Instant Granny Flats are the brainchild of Leimac’s managing director Gavin Leiper, WA’s “Flying Builder”, who travels the state by air overseeing the construction of framed homes across every region. Each of the flats is suitable for two people to live in and provides a particularly comfortable environment for miners to spend their off duty hours. Leimac has a special introductory offer for Karratha residents interested in earning rental income within 72 hours of the Instant Granny Flat arriving on site. Simply phone 1300-LEIMAC before the end of September to get a free initial site assessment before committing dollars and time to a formal site survey. Leimac will also assist buyers in structuring their finances so the flats can be totally paid off within two years. Many backyards in the Pilbara are neglected patches of red earth. The Leimac plan turns them into a financially productive resource for their owners. Sydney investor Joe Bavaro was among the first to see the financial benefits of the flats. A recent purchaser of a Pilbara property, Joe says that once council approval was gained, the flat was up and ready to be occupied within seven days. Joe says tenants moved in immediately. “They are absolutely thrilled with the accommodation, which they describe as being ‘like living in Hollywood’.” Joe says it is a great option to be able to so easily put a granny flat on the back of the property. He says the units are “beautifully” finished with quality workmanship by a very professional company. Leimac is looking to expand its sales to Newman, Tom Price and Onslow in coming months. Prospective purchasers should contact Caroline Cuthbertson on 0428 978 702.

FAQ’s on choosing an agent An important function of a licensed agent is to take care of the time consuming functions related to the promotion of the property. This includes providing advice on the best way to sell a home, dealing with buyer inquiries at all hours, attending to home inspections, and ensuring that the conditions applying to the sale of the property are also quickly attended to. The real estate agent also plays an important role in the negotiation process between buyers and sellers. This is often underrated, however most people would feel more comfortable negotiating through a third party because emotional links to the property can interfere with the negotiation process. What is a sales representative? A sales representative is a person who has been authorised by the Real Estate and Business Agents Supervisory Board, after achieving the required educational requirements, to conduct real estate transactions on behalf of a real estate agent.

into various contractual relationships for real estate transactions. These real estate transactions include the: • Introduction of buyers to owners who wish to sell property • Introduction of property to buyers who wish to purchase property • Management of property that is available to lease Only people who have received a license can assist in the buying selling and management of property that they do not own. To be granted a license a person must: • Have completed formal educational requirements whereby the duties and obligations of the Act are fully understood • Be of good character and repute and be a fit and proper person to hold a license • Have attained the age of 18-years-old • Possess sufficient material and financial resources to enable the agent to comply with the requirements of the Act

What are the services of a real estate agent? The service of a real estate agent will be dependent upon the type of agency appointment. What is a real estate agent? An act of the Western Australian Parliament- The types of agency appointment include: the Real Estate and Business Agents Act 1978 • Acting on behalf of a seller (the Act) makes provisions with respect to the • Acting on behalf of a buyer regulation and supervision of certain persons acting in respect of real estate transactions or • Acting on behalf of an owner The services of an agent acting on behalf of a certain business transactions. A real estate agent is a person who has seller may include: received a license from the Real Estate and • Inspecting the property Business Agents Supervisory Board to enter • Providing a market appraisal • Researching comparative sales evidence 614 acres for • Research the Certificate of Title sale in the lovely and any documents relating to Frankland River encumbrances area • Provision of a marketing plan We are open to off that would consider the price, the ers... • An hour from Albany most suitable type of promotion, • 44acres of this is hardwood trees the attributes of the property • White gum, red gum, jarrah, wildflowers & wildlife • Tranquil and attractive bush block • Recommend ways to optimise the • Perfect for a weekender, build permanantly appeal of the property • Tracks for horse riding, quad bikes etc • Recommend the most appropriate • Amenities close by and sealed road types of advertising 0427 552326 $400,000 Phone: Email: • Determine and research any existing tenancy arrangements • Liaise with the occupiers to coordinate inspections • Arrange suitable signage • Arrange photography • Design, produce, and lodge advertising and promotional • Lease out for livestock/cropping and gain income material immediately. • Promote the property to • Excellent fertilizer history. prospective purchasers • Creek and undulating landscape. • Promote the property to • Close to amenities. inspections • Provide reports on the level of buyer interest and market feedback • Qualify prospective purchasers • Recommend suitable level of deposit • Determine any special conditions required by the seller • Negotiations with prospective purchasers • Prepare the Offer and Acceptance and draft any appropriate special conditions • Present any written offers • Explain the Contract for the Sale of Land by Offer and Acceptance and the Joint Form of General Conditions for the Sale of Land • Receipt deposit to be held in the real estate agent trust account • Explain the effect of any variations to the contract that may be requested by the seller How do I choose an agent? Prior to entering into a selling agency agreement it is important you understand the level service that the agent will be providing for the agreed selling fee. While it is reasonable to expect that sellers will be price sensitive it is very important to understand what you will be receiving for the agreed fee. Ask questions about the marketing that will be undertaken, who will be conducting the promotion of the property, the frequency of home opens and the level of feedback from the agent. Is it the agent you are dealing with or one of the team members? It is also important to understand the agent’s view of the market price of the property and how that has been obtained. While a high price always sounds attractive, if the price is above market then the property is unlikely to sell and the marketing and promotion could be a waste of money. Is there a cooling off period if I list a property with an agent? No there is not any period of time in which you can change your mind after you have appointed the selling agent. What are the Duties of real estate and business agents under Common Law? Under common law the duties of an agent include: • To perform obligations under the agency contract and follow instructions • To perform duties with due care and skill • To act in good faith in the principal’s interest • Not to divulge confidential information acquired in the course of the agency appointment • To keep clients moneys separate from the agent’s moneys and to account to the principal for moneys received or expended on the principal’s behalf What fee is paid to the real estate agent for the service provided? Government regulations do not fix fees

❚ Be sure to choose your agent wisely charged by real estate agents. The level of fees is by agreement between the real estate agent and his principal. The fee will be dependent upon the quality and quantity of the services that the principal requires and are appropriate to the property for sale. The aim is to ask for and receive those services that you are most comfortable with, and those which are most likely to find a buyer or tenant for your property in a reasonable period of time, at a reasonable cost, and at the best possible price. Will different agents quote different fees for the same type of service? Yes, because there is no limit on the maximum fee that you can agree to. However, to compare the fees of various agents you need to compare the services that are being agreed. Your agent will discuss the range of services available to you, and suggest the most appropriate package to match your requirements. How do I know that I am receiving value for money for the agreed service? Research on a national basis shows that more than 90% of sellers are more concerned with getting the right service from a professional, reputable agent than simply agreeing to the lowest price. Remember that with agents services, as with most things, you get what you pay for. When is the agreed fee paid to the agent? Where the service is the sale of a property or a business, then the agent’s selling fee is paid at settlement, where settlement is defined as the legal entitlement to the property passing from the owner to the buyer, or upon the buyer taking possession of the property. Where the service relates to the management of property, the agreed fees are normally paid monthly. What do I do if I am not happy with the fee that I have agreed? First, you should discuss your concerns with the real estate agent or sales representative. If you consider the behaviour of the agent in the process of agreeing to the fee has been unjust, then you may contact the Department of Consumer Protection (08 9282 0777) or REIWA. Source: REIWA

Getting your bond money back this results in a dispute. In these situations the Property Condition Report (PCR), which has its contents agreed to by both the owner and the tenant at the start of the lease, is relied upon to determine whether any damage was caused during the tenancy. It’s possible that some damage may have occurred prior to the tenancy, but if this is not correctly noted in the PCR, then it’s impossible for the tenant to disprove responsibility. In the end, the Magistrate’s Court will decide on the allocation of bond monies where there is unresolved dispute. To avoid this situation, it’s always best for tenants to ensure the PCR is accurate at the commencement of their lease and make every effort to return the property to the owner in the best possible condition at the end of the tenancy. This should ensure a full refund of the bond.

The RSPCA reports that the second biggest reason people have for handing over their animals is due to rental homes not allowing pets. Most often when this happens it’s because the tenant didn’t advise the property manager or landowner about the pet before moving in, or they obtained a pet after moving in even though the lease did not allow. It can be a similar situation in strata buildings, even if the resident is the owner of their particular unit or villa. If the strata by-laws don’t allow

Every now and then you might hear a heart-breaking story about a tenant who had to relinquish their pet to the RSPCA because they were not permitted to keep it in their rental property.

property managers will advise them to keep an open mind, provided the dwelling is suitable for the animal. Land owners can require a pet bond of $260, and in addition to this any repairs to damage caused by the animal, that is not rectified by the tenants at the end of their lease, will be deducted from the main bond. Animals that are unclean, unsafe or a nuisance can be removed and/or the tenant’s lease can be terminated. Tenants must understand that if they are approved to have an animal on the property, such approval is only for that animal. Further approval must be sought for additional animals or a replacement pet if the original dies or vacates.   To help give confidence to both land owners and pet owners, REIWA has produced a Pet Lease Agreement used exclusively by our property managers, which has been well received by the community.   Hopefully our furry friends and their owners now will find WA more accommodating.

pets, then you must abide by that and be aware of the by-laws before moving in. Pet owners have a responsibility to be up-front about their companion animals when applying for a rental or purchasing into a strata complex. That will help prevent future conflict. However, it’s also the case that land owners and body corporates need to relax a little and give more consideration to allowing pets. It can be hard for tenants with pets to find a home that will accommodate them. Pets in rentals and strata complexes are much more common overseas and interstate. In WA we seem to be resistant to change. The reality however, is that an increasing number of people are keeping pets for companionship or security, and most pet owners are responsible about the care and behaviour of their animals. Concerned land owners are usually worried that an animal might cause damage. Under the Residential Tenancies Act, property owners have the right to refuse pets, although most

The purpose behind the bond is to provide the land-owner with the means to cover off any losses that might be triggered by the tenants, including damage to the premises or a failure to pay the rent. The bond must be paid into a real estate agent’s dedicated tenancy bond trust account or to the Bond Administrator, which is a specifi c government-managed trust account. There are severe penalties for landlords or agencies which fail to comply with this requirement. When your tenancy comes to an end or is terminated, then the owner or their property manager will inspect the property to ensure it has been left in the same state and condition it was at the commencement of the lease.

Naturally, they must take reasonable wear and tear into consideration. Sometimes there might be a disagreement between the departing tenant and the owner in terms of what exactly constitutes ‘fair wear and tear’, and where this happens it is likely to result in a disagreement as to how the bond money is disbursed.   If, after a fi nal bond inspection it is revealed, for example, that the tenant has failed to scrub the shower, mow the lawn or clean the carpets, then the tenant may be given the opportunity to address this but the owner is under no obligation to grant further access to the property.  Alternatively, the tenant may acknowledge those issues and simply leave them to the owner to address and is happy to have the costs of making those things made good deducted from their bond. Occasionally, however, agreement cannot be reached over the manner in which the bond is disbursed and

If you are renting a residential property the landowner will require the tenants on the lease to pay a security bond, which is usually the equivalent of four weeks’ rent.

Property Council hosts industry power players By Tamara Binamat Lots of locals said it couldn’t be done, and wouldn’t be done, but here it is, a high-rise apartment complex that would fit right in at East Perth. The Property Council hosted 35 property professionals at Pelago this week, including developers, construction companies, consultants, banks, real estate agents and lawyers from around Australia. The professionals landed in Karratha with the aim of discovering what opportunities may lie in our resource rich region. Stage One of the Pelago building is now built, with 90% of apartments and commercial properties leased or sold. Stage two, Pelago East, has now started construction, an indication that corporate investment in the area may be richly rewarded. Peter Agostino of CBRE, international commercial property agents, sees clear potential in Karratha. “Obviously there’s a lot of great aspects with the ocean being so close,” he said. “If we can get all the infrastructure in place to create more community facilities and build the town centre I think it’s got an

exciting future. “To go to the next level we’d get employment centers outside of mining. When you get sizable hospitals and schooling, upgrade the town centre with retails, cafes and bars they all become employment centres and really help the town grow” he said. Mr Agostino said he is impressed by the potential and the lifestyle it can offer compared to other mining towns that are away from the coast. John Williams, managing director of Jones Lang La Salle looks after a group of real estate agents, property managers and consultants. The property services company intend to find out what the potential for property services in the region would be. “The potential has got to be out of the energy sector and the employment that it’s going to create. The question is, how long is it going to last?” he said. “The risk is that it doesn’t last for a longer time. If you’re going to invest you need a return over a period of time. “The fact that Finbar, a listed company, is investing hundreds of millions of dollars up here, that is a good sign for the area” said Mr Williams. Adrian Fratelle, Director of Fratelle Group

z An artists impression of the future Karratha City Architects, is investigating the Pilbara’s potential for his list of investors interested in Karratha and Port Hedland. “I think whats happening here now, especially with Pelago’s development, is fantastic” he said. “I can just see, with three or four of these type developments up here, the interest is going to grow tremendously. “If there was a hotel complex which was very similar, it would be phenomenal for tourism.” Mr Fratelle said that from an architects point of view, challenges to the regions development is in construction costs. The key lies in designing buildings that bring down the construction cost and designing buildings that can withstand harsh climate conditions. Although North West properties need

to be cyclone resistant, Mr Fratelle said aesthetics are an important consideration. “The aesthetics of the suburb is paramount to attracting people to places like Karratha. “I’ve noticed in the new areas now there’s landscaping and median strips providing nice aesthetics to the street. “I think it’s really important, and getting rid of the old, ugly cyclone shutters is part of that” he said. The new technologies and building materials mean a lot more options to ensure building to cyclone standards. “You can see by driving through the new estates, buildings are looking a lot different to how they did 10 years ago” said Mr Fratelle. Although there are unique challenges to building and developing in the Pilbara, the professionals seem to agree that Karratha is an exciting place to live and invest.
