So 2012 was a funny year, lots of very busy spells, but some property stock still didn’t succeed in gaining viewing activity or a sale – often no matter how hard you tried. I have read various industry reports with predictions on what 2013 is likely to bring for home buyers & sellers. Every analyst is screaming about how price sensitive the housing market is. Giving the advice that if you are serious about selling your property then you need to be looking seriously at your price rather than blaming the market conditions. In fact many reports suggest the market conditions of 2012 weren’t as bad as everyone made out and that they were only made to look worse by unrealistically priced sellers causing stagnant property stock. Buyers who have been forced to be more money conscious are doing their homework before even venturing out to view. With access to a wealth of information about properties and property prices it is much easier for them to find out statistical information for themselves about where a property should be priced, what was paid for it, how long it has been on the market, when it was last sold & what price similar properties have sold for. With this in mind the days of putting your property on the market at a ‘test the market level’ are long gone. A recent rightmove website survey reported that many buyers searching for properties will completely disregard any properties that they feel are over priced regardless of whether they meet their criteria. Giving a reason for potentially low viewing figures on properties and the need for sellers not to lose buyers at that initial search stage by overpricing. Buyers will be looking for a property that offers value for money based on all their research. A lot of predictions also lean towards an improvement in the mortgage lending market with availability of mortgages improving during the year. Whilst the emphasis this year is most definitely on ‘price it right or lose out’. I do believe there is also a need for many agents and sellers to up their game. I can still often take on a property that another agent has been trying unsuccessfully to sell and give it a fresh approach with better pictures, add a floorplan and highlight some perhaps overlooked key selling features and prove that a bit of thought and effort on the marketing material from the start can make a hell of a difference in improving activity and leading to a sale. Plus communication is key – I am amazed how many sellers out there put up with agents who don’t ever bother to ring & update them on how the marketing is going. But at the same time there are also many good agents trying to do their job & give advice to sellers to help improve & refresh their marketing – with sellers who ignore the advice or get offended by it. Remember you want us agents to be honest with you – so you need to start listening, there are too many sellers out there who don’t want to listen to the truth. Honesty on both parts is vital so that the agent knows the sellers financial boundaries & the agent can advise realistically, then they can work together to advertise the property as effectively as possible. Get that relationship with your agent working! Any seller serious about getting a sale on their property will take all this well in mind. Legal Advice: Fosters Law Q&A By Jo Wheatley-Johnson, Fosters Law Q. Thank you for your advice on Conveyancing but I’m still confused about the costs involved in buying a home. Please can you help? The cost of conveyancing can be divided into two parts: the legal fees (which is the actual fee the solicitor charges for doing the work) and the disbursements, which are the expenses incurred on your behalf, and are paid to third parties. These include Land Registry fees, Stamp Duty Land Tax if applicable and the cost of searches. There are very clear rules as to what is a legal fee and what is a disbursement, so you need to make sure that there are no additional hidden ‘legal fees’ disguised as disbursements. The most common examples are additional charges raised by Solicitors for storing your file (as solicitors, we are required to do so anyway by the Law Society and by mortgage lenders, for at least six years after completion); or for “petty disbursements” (postage etc); or for completing the Stamp Duty Land Tax return form, which we have to do anyway. These “extras” can significantly increase the cost of your transaction, and often occur in cases where the “headline” fee quoted for conveyancing work is quite low. I can only speak for my firm here, but it is good practice for a solicitor to provide a clear and transparent quote before you instruct us. This will include a breakdown of all fees, including the standard disbursements for your transaction based on the information we have at the time. By way of example, at Fosters Law, our conveyancing fees start at £345 for first time buyers and go up from there in stages, and any disbursements are then added to this. Fees and disbursements will only ever change if something comes to light during the conveyancing process which was unforeseen at the time the quote was given. A solicitor should always contact you before incurring any additional expenses on your behalf. On top of the legal fees and disbursements, there are other costs that you need to consider: - Mortgage administration fee – Charged by most mortgage companies, this is basically a processing cost and can vary from a few hundred pounds to a few thousand but should be made clear to you at the outset of arranging your mortgage - Mortgage valuation fee –They have your property independently valued, you pay for it. Normally a few hundred pounds. - Moving costs – Whether you do this yourself to save money, or employ a professional will depend on the amount of furniture you have and how much stress you want on completion day. Q. Do the searches explain where a property’s boundaries lie and will they help resolve a boundary dispute? Boundaries and boundary disputes are an extremely complex area of property law. Boundaries are illustrated on the Title Deeds and the Land Registry plans, however this does not make the illustrations definitive or legally binding. Many people believe that the boundary between theirs and the neighbouring properties is defined by the Land Registry plans. However these are not intended to determine the actual line of boundaries. They are drawn generally and with thick lines separating the properties. It is therefore often difficult to ascertain boundaries, and they cannot be relied upon to move or re-establish boundaries. There is also a common misconception that the boundary runs in a straight line between the properties. However, this is often not the case: boundaries differ and vary over time; moving slightly or changing direction due to the removal and/or replacement of the physical boundary, agreements between previous owners of the property and various other factors. The general lack of any definitive boundary representation means that most boundary disputes have to be resolved by the instruction of an expert (usually a surveyor) who will consider the Title Deeds the properties concerned and various other indicators such as old photographs, witness evidence and the actual property itself (including any old boundary markers such as posts) to determine where they believe the boundary is. However, it is of course possible that one person can instruct an expert who determines that the boundary is in a particular place, only for the neighbour to find another expert who believes it is in fact somewhere else. This ‘grey area’ is why a lot of these cases end up in the Courts, leaving it to a Judge to make a decision based on all of the evidence as to where the boundary is - the legal declaration by the Judge as to the location of the boundary is only then definitive. However, litigation through the Courts should be used as a last resort. It is often better for most boundary disputes to be resolved through mediation or a ‘meeting on site’ of experts. If you are thinking of moving a boundary or you wish to object to your neighbour doing so, specialist advice should be sought. Disputes with neighbours should be avoided, and boundary disputes can be arbitrary, stressful and can last a number of years - and importantly, they can cost thousands of pounds to resolve. Therefore, it is always wise to check the position with regards to your boundary before making any changes. A good property solicitor is the best place to start.

The Market House Photography will shortly be launching their latest competition entitled Historical Lincolnshire. The competition is open to anyone, cash prizes will be awarded. All pictures entered into the competition will be displayed at our annual exhibition which takes place on the 7th & 8th September. On the 10th March we will be visiting Greenwich to see the Ansel Adams Photography Exhibition at the National Maritime Museum and there will also be opportunities to view other museums in the area.
