This section was incorporated in the Act after India’s ratification of the International Labour Organisation (ILO) Convention No. 89. Certain industries fall outside the purview of the Factories Act like the Information Technology (IT) and Business Process Outsourcing (BPO) industries. However, in recent years, some state governments have exercised their authority to prevent women from working in night shifts in these industries too.
