What is a patent? Points of Discussion A patent is a grant from a government that gives the patent owner the right to exclude others from making, using, selling, offering to sell, and importing the patented invention for a limited period of time. In exchange, the inventor must disclose how to make and use the invention to the public. It seems every couple months someone comes along and explains what a patent is and why you need them.

What are the different types of patents available? There are different types of patents available. The two most common are utility patents and design patents. A utility patent protects functional aspects of an invention. Design patents protect the way something looks. Patents can be granted for a variety of purposes, including product, industrial, software, and service. For example, a patent for a design process might cover methods for designing a widget or a graphical element on a computer screen.

When is the best time to file a patent application? You can file a provisional patent application (PPA) at any time during the development of your product. The PPA gives you one year to file a nonprovisional patent application (NPA), which is the real patent application. It’s important to note that the PPA is not an official patent.Nowadays, a PPA is just used by the guy who wants to protect his idea before he sends it to the Intellectual Property office.
