 Balloon - The interest rate is fixed for a period of time. At the end of that period, your entire balance on your loan is due. (Example. What’s Wrong With Cash? I finally found my dream home after years of searching. The seller accepted my offer and everything was fine until I went to secure a loan (my credit rating is 818).

Through coincidence the seller and loan officer work at the same bank. Apparently there was negotiation between them because I was told by the bank that my plan to put 20 percent down was not acceptable with the seller because the down payment was in the form of cash, which apparently takes 60 days to clear. I reluctantly agreed to the only option I had, which was 100-percent financing. A week or two into the contract I decided that the 52-percent debt-to-income ratio was not in my best interest and dropped out of the deal. The home is still for sale and my cash has since cleared but for some reason the seller refuses to entertain another offer.


: You have exceptional credit, you have the financial capacity to put down 20 percent and yet the deal did not go through because of financing. My suspicion is that something has been misunderstood. Seller’s can pick and choose among buyers and do not have an obligation to accept a full-price offer. The logic is that even a full-price offer may have another requirement that’s not acceptable to the owner, thus dooming the transaction. In this case, however, picking and choosing is not an issue if, as you say, your offer was accepted. What we commonly describe as a real estate “contract” is often a contingent deal, something dependent on financing with no more than a certain interest rate, a professional inspection satisfactory to the buyer or a pre-approval letter from a lender within so many days. Was there a requirement in the agreement that you did not meet? For instance, would your financing require the seller to pay costs that were not part of the sale agreement? It could be that a big down payment and solid credit are not enough to qualify for a mortgage. Imagine that you have $100,000 in savings, have great credit, want to buy a $500,000 house -- but earn $63,500 a year. You would need $400,000 in financing. At 5 percent interest over 30 years your monthly payment for principal and interest would be $2,147.29. Add in $100 a month for insurance and $500 a month for taxes and you have a monthly housing cost of about $2,750 -- that’s 52

percent of your gross monthly income. In this case a lender would have good grounds to decline your loan application -- and you would have every reason to agree. Financing with debt-to-income ratio of 52 percent suggests a very-risky loan. A conventional loan would typically allow just 28 percent of your income to be used for housing costs and a total of 36 percent for all regular monthly debts. Other loans would allow higher ratios. Has there been an appraisal that justifies the sale price? If the valuation was low the lender will not want to make a loan. Ask for a copy of the appraisal so you can review the sale value. Have you tried financing from a different source? Given your ability to put down 20 percent and an exceptional credit score there should be no shortage of lenders who at least would want to see if you qualify for financing. There’s no reason it should take 60 days for a big cash down payment to clear. A typical arrangement is to first assure the seller that the money actually exists. A letter from your bank, brokerage or attorney will usually do the trick. You then bring a certified check to closing or have the money wired from your account. Given your experience, can you do better? You bet. First, speak with various lenders and see how much financing is available to you, and get a pre-approval or pre-qualification letter. This is not a promise to lend, but it does suggest that you’re generally qualified to borrow a certain amount. Second, get a buyer broker to represent you. This is a huge advantage for purchasers, especially first-time buyers. Third, line up a home inspector. Once you’ve taken these steps see if the property you liked is still listed. You might find in a few months that the price has come down and that the owner would again be interested in an offer.


: My sister and her husband are unemployed and face the possible foreclosure of their home. I want to help by assuming their mortgage but do not want to buy their house. Their bank won’t allow a refinance due to their unemployed status or permit a short sale by paying off part of the principal. The lender is willing to shorten the loan period but not reduce the monthly payment. Is there a way that they can transfer their names to me on the title so we can avoid paying unnecessary costs associated with selling the house to us? Is there any impact on the tax issues and from the bank lender if we do this option?


: In the usual case a transfer of title sets off the need for a closing and a variety of transfer taxes and other costs. However, there may be an exception that can lower transfer taxes in some jurisdictions when the change in title is the byproduct of “good consideration” -- a transfer made for love and affection. A local real estate attorney can provide specifics. Would it make any sense to just pay the mortgage until your sister and her husband again find work? While the current loan may not be assumable, you could buy the property with financing from another lender and pay off the current loan. Your sister and her husband could then rent from you. Guidelines under the government’s Home Affordable Refinance Program have been changed so that even if the existing mortgage debt equals 125 percent of the property’s value – if the debt is $250,000 and the value of the home is $200,000 it may be possible to get help. The lender’s offer to shorten the loan term would likely increase monthly payments. Given that the owners are unemployed, the last thing they need are steeper monthly costs. The lender does not want to take a loss with a short sale, a situation where a home is sold for less than the outstanding debt with the lender’s permission. If roles were reversed would you want such a deal? Your sister and her husband could allow the property to be foreclosed. The lender would then have a huge loss and the owners would have woeful credit. However, the threat of foreclosure might cause the lender to re-think modification options. For instance, why not a longer term or a lower rate? Why not waive late fees and prepayment penalties? Such options are more attractive than a foreclosure. If the property is foreclosed then another idea arises. You could make a bid on the property and perhaps buy it at dis-

count. This would get the current lender out of the picture and create a new and lower cost basis. The combination of lost jobs, toxic mortgages and devalued homes now makes foreclosure an actual bargaining chip for distressed borrowers, a way to get some relief from lenders. The problem with this scenario is that mortgage investors who likely own the loan are not responsible for either rising unemployment levels nor declining home values. If a contract really is a contract then loan owners should be fully repaid. There’s no easy solution to the current mortgage meltdown, but to some extent the market has begun a process of self-correction. Option-ARMs are finished, interest-only mortgages are rare, deals with no money down are declining and the use of stated-income loan applications has disappeared except for borrowers with huge down payments. Some recent sale and price data are at least stable – sometimes even up. These shifts are good but they don’t help people already in trouble. A July report from the General Accounting Office said 5.2 million subprime and ALT-A loans from 2000 through 2006 remained outstanding and that “hundreds of thousands of additional nonprime borrowers are at risk of losing their homes in the near future.” Unfortunately, a backlog of toxic loans plus rising unemployment levels mean that high foreclosure levels are likely to Need real estate advice? If you are thinking of selling your home in today's tough market, the experts recommend completing a few projects that will help your home look its best and stand out from the crowd. According to Lou Manfredini, Ace Hardware's home expert, these projects don't have to cost a lot of money or take a lot of time. "There are four easy and inexpensive projects that I recommend every homeowner complete before they stick that 'for sale' sign in their front yard."




Curb appeal is, quite simply, what prospective buyers first see when their car pulls up to your house. According to the National Association of Realtors, half of all buying decisions are based on curb appeal. "Your mother's advice holds true here - nothing is more important than a good first impression," says Manfredini. "Strong curb appeal will help set a positive tone for the rest of the house." Walk out to your sidewalk and take a look at the front of your house, checking for anything that needs to be cared for. A good first step is to update your exterior hardware, including house numbers, which often become dirty and dated over time. Today there are several great options on the market that incorporate some color and style, like HyKo's Large Ceramic Tile Address Plaques, which can be customized to your home.

Another quick project is to replace your mailbox. Choose one with a more modern, sleek design such as the Postmaster Amboy Mailbox in black, which looks great on any house and is easy to install. This updated fixture, although small, can do wonders for the overall curb appeal of your home.

Prospective buyers are searching for outdoor spaces where they can enjoy spending time, so it's important that you tidy up these areas. An easy way to do this is by spreading new mulch.
