Between the Alps and the Padania Plain, close to the Italian and Swiss border, the territory of Lake Como is distinguished by a variety of landscapes. The lake is certainly the most prominent asset in the area: 46 km long, 146 kmq surface area, 410 m at its deepest point, 4,3 km wide and 0,430 km. Around the area you see in succession steep mountains and gentle hills; narrow, solid valleys, while others wide and smooth; highly populated plains and untouched woods; small villages and cities; lake towns and mountain villages; wild currents and the River Adda. This territory has always seen an intense flow of visitors due to its position connecting Central Europe and the Mediterranean world. Lake Como, or Lario, pushes its North-most point into the Valchiavenna and Valtellina regions, it opens up a narrow course, forking at Bellagio into two arms: Como and Lecco. The eastern side is dotted with small towns of rare beauty where tourism, history, art and nature harmoniously come together, protected by the mild lake climate. The western arm il less rough; it has always been the destination for an “élite” tourism. The discovery of these places, thanks to the presence of many important guests, has made towns like Menaggio, Bellagio, Tremezzo and Cadenabbia world-famous. There you can admire stunning villas with English gardens, some of which are enriched with tiny precious museums filled with works of arts. The extraordinary neoclassic villas have welcomed the most famous celebrities of music, and literature, Milanese and European nobilty and today, the modern movie and fashion stars, proof of the endless charm of the Lake Como scene.

When to go - History, art, culture and nature make Lake Como a destination that can be visited all year round. The climate is mild and sunny and in parts sub-tropical, with palm trees, olive trees and bouganvillaes. Azaleas, rhododendrons, camellias make for a stunning display in spring, but there is no shortage of activities to do at any time of the year: water-skiing, sailing, windsurfing, hiking, cycling... or simply soaking up the sun. Shopping - Opening times for shops are usually 9am-12.30pm and 3pm-7.30pm, but some shop are often open nonstop 9am7.30pm. Monday to Saturday. Como produces 80% of Europe’s silk. There are boutiques in the centre selling high-quality silk merchandise along with a few factory outlets. There’s a regular saturday market – food and clothing - in Como town and once a month an antique market on a Sunday. Banking Hours - They are usually open between 8.30am and 1.30pm, Monday to Friday. Most also open for an hour in the afternoon, from about 2.30pm to 3.30pm. All banks close at weekends and for public holidays. Bureau de change are often open all day , usually till late at night. What to eat and drink - As you would expect, fish predominates in the restaurants on Lake Como; you’ll find polenta and gnocchi in the kitchens in the valleys and mountains or meaty stews made from pork and beef. At either elegant or family-run, restaurant or trattorie, you will find a relaxed service and mainly regional cuisine. Taste the “risotto con pesce persico”, or the incredible display of cheeses, prosciuttos and salamis. Try the house wine, usually served in jugs, or the local beer (birra). The best Italian brands are Peroni, Dreher and Nastro Azzurro. There is a wide selection of bottled fruit drinks, milk shakes (frullato) and when really hot, why not going for a “granita”, crushed ice covered with syrup. Plenty of “gelateria” around for an ice-cream fix. Best Unusual Attraction Take the funicolare up to Brunate and walk to the Volta lighthouse, located in a place called San Maurizio. Book a flight over the lake in a seaplane ! Take a mountain bike tour (downhill most of the way!) or go for a hike into the hills. The CavalCalario Club offers a selection of activities around Bellagio: horseriding, canyoning, mountain-biking, kayaking, trekking and even paragliding for first-timers ! There are some great hikes to be had in the hills and mountains around Como.

1) Como’s historic centre, founded by the Romans and still surrounded by medieval walls on 3 sides, is rich in monuments and artworks. The city offers wonderful sacred buildings (the Cathedral, Sant’Abbondio and San Fedele), Museums (Silk Museum, Voltiano Temple, Archaeological Museum, Fabric Study Museum), masterpieces of the razionalist architect Terragni, luxuriant vegetation (Spina Verde Park) and fabulous panoramic spots such as Brunate, which can be reached by way of an antique cable railway. Besides villas and historical parks, like Villa Olmo considered the most famous and somptuous between the historical homes of Como, with a large garden overlooking the lake. The city and the lake are dominated by Baradello Castle, a massive romanic tower. It was previously part of the Castle which was built around the mid 12th century. 2) Cernobbio: The gardens of Villa Pizzo consist of 5 descending levels and are run through by a multitude of paths along which one can admire the ancient trees and exotic plants. Villa Erba was built towards the end of the XIX century and is immersed in a verdant botanical park. 3) Schignano is famous for its funny Carnival taking place according to the Roman Rite. It is the most typical Carnival in the Como area, based on the contrast between the mask of “Beauty” and the mask of “Bad”. 4) Intelvi Valley is famous for its artistic tradition, that you can admire in the Museum of Stucco and Scagliola Intelvese in Cerano d’Intelvi and visible in many others monuments and churches around the valley. It is also a touristic area well equipped for every needs. 5) The Comacina Island is the only island of Como Lake, today uninhabited, but destination of a multitude of tourists coming for the famous restaurant and for walking along the paths next to the ancient ruins. 6) In Ossuccio the monumental construction of the Sacred Monte and of the Sanctuary of the Madonna del Soccorso undoubtedly stands out. It is a spectacular path of faith with 14 chapels dedicated to the Mysteries of the Rosary, built along the winding pathway which leads to the Sanctuary. “UNESCO” declared it as a Heritage of Humanity, 7) Lenno: Villa Balbianello, today a “FAI property, is one of the most famous and scenic villas of the Lake, nestling inside the panoramic terraced garden. 8) Tremezzo: Villa Carlotta, built towards the 1600, is a museum with a collection of statues, pictures and furniture of the neoclassical period. In its garden it is possible to admire trees and plants coming from all over the world. During the Spring time there is a wonderful flowering of azalee. 9) Bellagio, the “perl” of the Como Lake: Villa Melzi, built in the 1800, is surrounded by an enchanting and vast Romantic style park with a wealth of classical statues and ancient and exotic plants. Villa Serbelloni stands on a promontory dividing the Lario into the two branches of Como and Lecco. Built round the 1600, it is surrounded by a wonderful park with decorative elements, terraces and grottos and numerous species of trees. 10) Menaggio: Villa Vigoni, today a private home, has a wide english park decorated with exotic plants, ancient trees and statues. 11) San Siro: the Rezzonico castle, a 14th century castle with crenellated walls, it was built on the ruins of the previous castle. 12) Dongo: a small town famous for the capture of Benito Mussolini and the leaders of the Repubblichino government on the 25th of April 1945. Palazzo Manzi,the city hall, is also the Museum of Resistenza Comasca. 13) Trivio Fuentes: the Fuentes Fort was built in 3 years from the 1609. It was 300 meters long and 125 meters wide,besides it was constituted by the soldiers lodging,the governor’s palace, the church, the mill,the tanks for water, and the stores. 14) Colico: the Montecchio Fort was built in Colico for its position close to the end of Valtellina, the way used by invanding armies. It was finished in 1914 and it represents the most technological italian structure of the first world war. The 4 guns, the biggest in Italy, still work and can shoot with precision till 14 km of distance.


15) The Piona Abbey is situated in a beautiful position at the end of the Olgiasca peninsula,and it is considered one of the most popular monument of the Lake. Today the structure is managed by Cistercian who distill fine liquor and herbal infusions.

16) The Corenno Plinio Castle is characterized by a strong square tower amended in the 1300 with a compact crenellated wall and two other towers. 17) Dervio: The Orezia Castle is one of the most prestigious example of enclosure castle, well preserved and suggestive for its integration in the picturesque village. It was built directly on the lake with the functions of sighting and defense, it is square and the walls are crowned by battlements. 18) The Bellano Ravine is a natural canyon created by the river Pioverna, where giant bowls and incredible caves have been carved out by the water over the centuries. A cement footbridge allows visitors to admire this beauty from an extremely unique location. 19) Varenna: Villa Cipressi is a complex of buildings and gardens rich of history, built between the 1400 and the 1800. Today the villa is a hotel but there is the possibility of visiting the centenary botanic gardens extended over terraces on different descending levels to the lake. Villa Monastero, developed on an ancient Cistercian nunnery Monastery built round 1200,is also a convention center since 1953. The gardens are extended over different terraces rich of various decorative architectural elements with many exotic trees species. 20)The Vezio Castle is an ancient manor of the XI century altered several times. It is a square fortification with high walls and a central tower accessible trough a working drawbridge. The structure is surrounded by more than 1000 olive trees. A peculiarity of the castle is the presence of trained raptors devoted to their falconer, which proposes suggestive shows. 21) Mandello del Lario: The Moto Guzzi Museum offers a very rich collection of more than 150 exhibition pieces between motorcycles, sport bikes, experimental prototypes and motors. 22) The Wayfarer’s Trai is an ancient passageway from the Milan area going up towards Switzerland.This path goes up to Abbadia Lariana, along the coast and in and out of villages, running through the history up to Colico. It is 45 km in lenght and thererfore has to be walked in several stages. In Abbadia Lariana is possible to visit the Civic Museum Setificio Monti, a silk factory for twisting silk thread, preserved as it was in the mid-nineteenth century, restored and enriched with contemporary objects from other spinning mills which have long since disappeared; it was transformeted into a museum in the 1998. Inside you can still see a large, old and striking circular twisting machine with its thousands of spindles on different levels. 23) Lecco: Villa Manzoni was the family home of the Manzonis, an elegant neoclassical villa with a facade displaying sandstone moulding. The Belgiojoso Palace,built at the beginning of the 18th century, had several changes of ownership until 1927 when it become the location of the Civic Museums of Lecco. The Manzonian itinerary starts from Villa Manzoni and stops in ancient villages and at secluded chapels and nobles palaces that are all linked to the characters of Manzoni’s novel “The Betrothed”. In Vercurago there are the ruins of Castle of Innominato has a big tower,reduced in 1902 to a chapel in honour of San Girolamo Emiliani, founder of the Somaschi congregation. 24) Erba: the Pomerio Castle was built on the ruins of a previous fort. The most ancient part consists of the remains of a Lombard style tower( 11th century), while the ‘Salon of the Frescos’ represents the heart of the building and now hosts a number of meetings and events. The foundations of the Monguzzo Caste probably go back to the year 920. It belonged to the Visconti and in the 1527 passed into the hands of the famous adventurer Gian Giacomo Medici. It is now owned by the Hospital Order of S.Giovanni di Dio Fatebenefratelli. 25) The Beata Vergine Sanctuary of Ghisallo is located on the ridge going from Bellagio to Magreglio. In the 1949 the Pope Pio XII declared the Madonna of Ghisallo “The Patron of Italian Cyclist”: since then the sacred image is honored by the international cycling, the little church which hosts relics of this sport. Close to the sanctuary there is the Museum of Cycling that exhibits permanently important memorabilia of the cycling world presenting also the histories ot the people belongig to it.

Board the Bernina Express for a spectacular train journey to St. Moritz. Return by coach over the Maloya Pass. Sport and activities among the Lake surroundings The Lake area offers many possibilities for people who decide to enjoy practicing a variety of sports, such as water sports: kayaking, windsurfing, motor boating, water skiing, wakeboarding and kite-surfing, canoeing, rowing and sailing (the upper Lake area is excellent for all sailing sports due to constant blowing winds). Lezzeno (on the eastern lake shore) is renowned for its water-skiing school, (world famous champions trained here), and the first lake basin hosts prestigious motorboat international races, like the off-shore race in September. You can even take a dive in the deepest lake in Europe and explore the relicts of some boats or try to find the famous “Mussolini treasure”. Another good reason to spend a holiday in the northern part of the lake: sport fishing on the lake or in the rivers of Valtellina and Valchiavenna, or in the nearby St.Moritz (Switzerland). For those of you who prefer to stay on-land, there are plenty of mountain bike, climbing, horse riding and trekking, canyoing, caving, tennis, golfing and (in winter) skiing opportunities. MONTE BOLETTONE and Triangolo Lariano sightseeing

Slope: 600 mt. - Max elevation reached: 1300 mt During this hike we will discover the “Triangolo Lariano”, a hilly area that forms a triangle amongst the two branches of Lake Como. Starting from Brunate, with its liberty-style villas, we will reach the path at about 3000 ft above sea level, along which several huts are located. Our hiking destination is Mount Bolettone, an excellent observation point over the many tiny Brianza lakes, Como lake and the pre-Alps mountains.

COLMEGNONE MOUNTAIN along the path of “Lario mountains”

Slope: 400 mt. - Max elevation reached: 1200 mt During this hike we will discover the west side of lake Como, where it is possible to admire one of the best lake-views in Italy. Along the path we find several huts, ex military barracks, used at the beginning of ‘900 to control the smuggling activity across the nearby Switzerland border. Toward the summit we reach some typical and ancient mountain huts, the work of a good restoration using the famous Moltrasio stone. MONTE GENEROSO - over the Como and Lugano lakes

Slope: 400 mt. - Max elevation reached: 1600 mt The hike starts from the Italian side of the Intelvi valley and reaches the summit, half Swiss, half Italian, from where you enjoy a stunning view over the lakes, the Lombardy plain and the Alps mountain range. Along the path we will notice several signs of the First and Second World War (the famous trenches called “linea Cadorna” ) and the famous “nevere”, typical snow-filled stone constructions, used to store food in the past (in particular butter and milk during springtime and summertime). MENAGGIO HUT and MOUNT BREGAGNO

Slope: 400 mt. - Max elevation reached: 2000 mt We begin with a comfortable hike amongst birch and broom trees and in one hour we reach the Menaggio Hut, a balcony over Lake Como with stunning views on to Bellagio. Proceeding along the less easy second part of the path it is possible to reach the small, ancient Sant'Amate church and Mount Bregagno. We hike down following a different path.

SAN MARTINO AND NAVA MOUNTAINS

Slope: 600 mt. - Max elevation reached: 850 mt We beging the hike from Griante, walking up to San Martino Mountain, where we find a small sanctuary located in such an impressive spot, with a excellent view over the central part of the lake and the surrounding mountains. We climb up along a mule track rebuilt during the first world war, reaching a series of small huts. We return following a different path with spectacular views on the Tremezzo area, Bellagio and the Grigne mountain range.

Le indicazioni relative al pacchetto turistico non contenute nei documenti contrattuali, negli opuscoli ovvero in altri mezzi di comunicazione scritta, saranno fornite dall’organizzatore in regolare adempimento degli obblighi previsti a proprio carico dal decreto legislativo 111/95 in tempo utile prima dell’inizio del viaggio. 5 -Pagamenti La misura dell’acconto, fino ad un massimo del 25% del prezzo del pacchetto turistico, da versare all’atto della prenotazione ovvero all’atto della richiesta impegnativa e la data entro cui prima della partenza dovrà essere effettuato il saldo, risultano dal catalogo, opuscolo quanto altro. Il mancato pagamento delle somme di cui sopra alle date stabilite costituisce clausola risolutiva espressa tale da determinarne, da parte dell’agenzia intermediaria e/o dell’organizzatore la risoluzione di diritto. 6 – Prezzo Il prezzo del pacchetto turistico è determinato nel contratto, con riferimento quanto indicato in catalogo o programma fuori catalogo ed agli eventuali aggiornamenti degli stessi cataloghi o programmi fuori catalogo successivamente intervenuti. Esso potrà essere variato fino a 20 giorni precedenti la partenza e soltanto in conseguenza alle variazioni di : costi di trasporto, incluso il costo del carburante diritti e tasse su alcune tipologie di servizi turistici quali imposte, tasse di atterraggio, di sbarco o di imbarco nei porti e negli aeroporti, tassi di cambio applicati al pacchetto in questione. Per tali variazioni si farà riferimento al corso dei cambi ed ai costi di cui sopra in vigore alla data di pubblicazione del programma come ivi riportata in catalogo ovvero alla data riportata negli eventuali aggiornamenti di cui sopra. Le oscillazioni incideranno sul prezzo forfetario del pacchetto turistico nella percentuale espressamente indicata in catalogo o programma fuori catalogo. 7 – Recesso del consumatore Il consumatore può recedere dal contratto, senza pagare penali, nelle seguenti ipotesi: aumento del prezzo di cui al precedente punto 6 in misura eccedente il 10%; modifica in modo significativo di uno o più elementi del contratto oggettivamente configurabili come fondamentali ai fini della fruizione del pacchetto turistico complessivamente considerato e proposta dall’organizzatore dopo la conclusione del contratto stesso ma prima della partenza e non accettata dal consumatore. Nei casi di cui sopra, il consumatore ha alternativamente diritto: ad usufruire di un pacchetto turistico alternativo, senza supplemento di prezzo o con la restituzione dell’eccedenza di prezzo; qualora il secondo pacchetto turistico abbia valore inferiore al primo; alla restituzione della solo parte di prezzo già corrisposta. Tale restituzione dovrà essere effettuata entro sette giorni lavorativi dal momento del ricevimento della richiesta di rimborso. Il consumatore dovrà dare comunicazione della propria decisione (di accettare la modifica o di recedere) entro e non oltre due giorni lavorativi dal momento in cui ha ricevuto l’avviso di aumento o di modifica. In difetto di espressa comunicazione entro il termine suddetto, la proposta formulata dall’organizzatore si intende accettata. Al consumatore che receda dal contratto prima della partenza al di fuori delle ipotesi elencate al primo comma, sarà addebitata, indipendentemente dal pagamento dell’acconto di cui all’articolo 5/1° comma – oltre al costo individuale di gestione pratica, la penale nella misura indicata nel catalogo o programma fuori catalogo, ovvero il 25% in caso di annullamento entro 45 giorni dalla data di partenza; 50% dal 44° all’11° giorno; 75% dal 10° al 3° giorno. Nessun rimborso possibile dopo tale termine. Nei casi di gruppi precostituiti tali somme verranno concordate di volta in volta alla firma del contratto. 8 – Modifica o annullamento del pacchetto turistico prima della partenza Nell’ipotesi in cui, prima della partenza, l’organizzatore comunichi per iscritto la propria impossibilità di fornire uno o più servizi oggetto del pacchetto turistico, proponendo una soluzione alternativa, il consumatore potrà esercitare alternativamente il diritto di riacquisire la somma già pagata o di godere dell’offerta di un pacchetto turistico sostitutivo proposto (ai sensi del 2° e 3°comma del precedente articolo 7). Il consumatore può esercitare il diritto sopra previsto anche quando l’annullamento dipende dal mancato raggiungimento del numero minimo dei partecipanti previsto nel catalogo o nel programma fuori catalogo, o di casi di forza maggiore e caso fortuito, relativi al pacchetto turistico acquistato. Per gli annullamenti diversi da quelli causati da forza maggiore, da caso fortuito e da mancato raggiungimento del numero minimo di partecipanti, nonché per quelli diversi dalla mancata accettazione da parte del consumatore del pacchetto turistico alternativo offerto (ai sensi del precedente art. 7), l’organizzatore che annulla (ex art. 1469 bis n. 5 codice civile), restituirà al consumatore il doppio di quanto dallo stesso pagato e incassato dall’organizzatore, tramite l’agente di viaggio. La somma oggetto della restituzione non sarà mai superiore al doppio degli importi di cui il consumatore sarebbe in pari data debitore secondo quanto previsto dal precedente art. 7, 4° comma qualora fosse egli ad annullare. 9 – Modifiche dopo la partenza L’organizzatore, qualora dopo la partenza si trovi nell’impossibilità di fornire per qualsiasi ragione, tranne che per un fatto proprio del consumatore, una parte essenziale dei servizi contemplati in contratto, dovrà predisporre soluzioni alternative, senza supplementi di prezzo a carico del contraente e qualora le prestazioni fornite siano di valore inferiore rispetto a quelle previste, rimborsarlo in misura pari a tale differenza. Qualora non risulti possibile alcuna soluzione alternativa, ovvero la soluzione predisposta dall’organizzatore venga rifiutata dal consumatore per seri e giustificati motivi, l’organizzatore fornirà senza supplemento di prezzo, un mezzo di trasporto equivalente a quello originario previsto per il ritorno al luogo di partenza o al diverso luogo eventualmente pattuito, compatibilmente alle disponibilità del mezzo e di posti e lo rimborserà nella misura della differenza tra il costo delle prestazioni previste e quello delle prestazioni effettuate fino al momento del rientro anticipato. 10 – Sostituzioni Il cliente rinunciatario può farsi sostituire da altra persona sempre che: a) l’organizzatore ne sia informato per iscritto almeno 4 giorni lavorativi prima della data fissata per la partenza, ricevendo contestualmente comunicazione circa le generalità del cessionario;

b) il sostituto soddisfi tutte le condizioni per la fruizione del servizio ed in particolare i requisiti relativi al passaporto, ai visti, ai certificati sanitari; c) il soggetto subentrante rimborsi all’organizzatore tutte le spese sostenute per procedere alla sostituzione nella misura che gli verrà quantificata prima della cessione. Il cedente ed il cessionario sono inoltre solidalmente responsabili per il pagamento del saldo del prezzo nonché degli importi di cui alla lettera c) del presente articolo. In relazione ad alcune tipologie di servizi, può verificarsi che un terzo fornitore di servizi non accetti la modifica del nominativo del cessionario, anche se effettuata entro il termine di cui al precedente punto a). L’organizzatore non sarà pertanto responsabile dell’eventuale mancata accettazione della modifica da parte dei terzi fornitori di servizi. Tale mancata accettazione sarà tempestivamente comunicata dall’organizzatore alle parti interessate prima della partenza. 11 – Obblighi dei partecipanti I partecipanti dovranno essere muniti di passaporto individuale o di altro documento valido per tutti i paesi toccati dall’itinerario, nonché dei visti di soggiorno e di transito e dei certificati sanitari che fossero eventualmente richiesti. Essi inoltre dovranno attenersi all’osservanza delle regole di normale prudenza e diligenza ed a quelle specifiche in vigore nei paesi destinazione del viaggio, a tutte le informazioni fornite loro dall’organizzatore, nonché ai regolamenti ed alle disposizioni amministrative o legislative relative al pacchetto turistico. I partecipanti saranno chiamati a rispondere di tutti i danni che l’organizzatore dovesse subire a causa della loro inadempienza alle sopra esaminate obbligazioni. Il consumatore è tenuto a fornire all’organizzatore tutti i documenti, le informazioni e gli elementi in suo possesso utili per l’esercizio del diritto di surroga di quest’ultimo nei confronti dei terzi responsabili del danno ed è responsabile verso l’organizzatore del pregiudizio arrecato al diritto di surrogazione. Il consumatore comunicherà altresì per iscritto all’organizzatore, all’atto della prenotazione, le particolari richieste personali che potranno formare oggetto di accordi specifici sulle modalità del viaggio, sempre che ne risulti possibile l’attuazione. 12 – Classificazione alberghiera La classificazione ufficiale delle strutture alberghiere viene fornita in catalogo od in altro materiale informativo soltanto in base alle espresse e formali indicazioni delle competenti autorità del paese in cui il servizio è erogato. In assenza di classificazioni ufficiali riconosciute dalle competenti Pubbliche Autorità dei paesi anche membri dell’UE cui il servizio si riferisce, l’organizzatore si riserva la facoltà di fornire in catalogo o depliant una propria descrizione della struttura ricettiva, tale da permettere una valutazione e conseguente accettazione della stessa da parte del consumatore. 13 – Regime di responsabilità L’organizzatore risponde dei danni arrecati al consumatore a motivo dell’inadempimento totale o parziale delle prestazioni contrattualmente dovute, sia che le stesse vengano effettuate da lui personalmente che da terzi fornitori dei servizi, a meno che provi che l’evento è derivato da fatto del consumatore (ivi comprese iniziative autonomamente assunte da quest’ultimo nel corso dell’esecuzione dei servizi turistici) o da circostanze estranee alla fornitura delle prestazioni previste in contratto, da caso fortuito, da forza maggiore, ovvero da circostanza che lo stesso organizzatore non poteva, secondo diligenza professionale, ragionevolmente prevedere o risolvere. Il venditore presso il quale sia stata effettuata la prenotazione del pacchetto turistico non risponde in alcun caso delle obbligazioni nascenti dall’organizzatore del viaggio, ma è responsabile esclusivamente delle obbligazioni nascenti dalla sua qualità di intermediario e comunque nei limiti per tale responsabilità previsti dalle leggi o convenzioni sopra citate. 14 – Limiti del risarcimento Il risarcimento dovuto dall’organizzatore per danni alla persona non può in ogni caso essere superiore alle indennità risarcitorie previste dalle convenzioni internazionali in riferimento alle prestazioni il cui inadempimento ne ha determinato la responsabilità e precisamente la convenzione di Varsavia del 1929 sul trasporto aereo internazionale nel testo modificato all’Aja nel 1955; - la convenzione di Berna sul trasporto ferroviario, - la convenzione di Bruxelles del 1970 (CCV) sul contratto di viaggio per ogni ipotesi di responsabilità dell’organizzatore. In ogni caso il limite risarcitorio non può superare l’importo di 2000 franchi oro germinal per danno alle cose previsto dall’art.13 CCV e di 5000 franchi oro germinal per qualsiasi altro danno e per quelli stabiliti dall’art.1783 codice civile. 15 – Obbligo di assistenza L’organizzatore è tenuto a prestare le misure di assistenza al consumatore imposte dal criterio di diligenza professionale esclusivamente in riferimento agli obblighi a proprio carico per disposizione di legge o di contratto. L’organizzatore ed il venditore sono esonerati dalle rispettive responsabilità (artt.13 e 14) quando la mancata od inesatta esecuzione del contratto è imputabile al consumatore o è dipesa dal fatto di un terzo a carattere imprevedibile o inevitabile, ovvero da un caso fortuito o di forza maggiore. 16 – Reclami e denunce Ogni mancanza nell’esecuzione del contratto deve essere contestata dal consumatore senza ritardo affinché l’organizzatore, il suo rappresentante locale o l’accompagnatore vi pongano tempestivamente rimedio. Il consumatore può altresì sporgere reclamo mediante l’invio di una raccomandata con avviso di ricevimento, all’organizzatore o al venditore, entro e non oltre dieci giorni lavorativi dalla data di rientro presso la località di partenza. 17 – Assicurazione contro le spese di annullamento e di rimpatrio Se non espressamente comprese nel prezzo, è possibile, ed anzi consigliabile, stipulare al momento della prenotazione presso gli uffici dell’organizzatore o del venditore speciali polizze assicurative contro le spese derivanti dall’annullamento del pacchetto, infortuni e bagagli. Sarà altresì possibile stipulare un contratto di assistenza che copra le spese di rimpatrio in caso di incidenti e malattie. 18 – Fondo di garanzia E’ istituito presso la presidenza del Consiglio dei Ministri il Fondo Nazionale di garanzia cui il consumatore può rivolgersi (ai sensi dell’art.21 del d.lgs.111/95) in caso di insolvenza o di fallimento dichiarato del venditore o dell’organizzatore, per la tutela delle seguenti esigenze: a)- rimborso del prezzo versato b)- suo rimpatrio nel caso di viaggi all’estero Il fondo deve altresì fornire un’immediata disponibilità economica in caso di rientro forzato di turisti da paesi extracomunitari in occasione di emergenze imputabili o meno al comportamento dell’organizzatore. Le modalità di intervento del fondo sono stabilite con decreto del Presidente del Consiglio dei Ministri ADDENDUM Condizioni generali di contratto di vendita di singoli servizi turistici A - disposizioni normative I contratti aventi ad oggetto l’offerta del solo servizio di trasporto, di soggiorno, ovvero di qualunque altro separato servizio turistico, non potendosi configurare come fattispecie negoziale di organizzazione di viaggio ovvero di pacchetto turistico, sono disciplinati dalle seguenti disposizioni della CCV: art. 1,n. 3 e n. 6; art. da 17 a 23; art. da 24 a 31, per quanto concerne le previsioni diverse da quelle relative al contratto di organizzazione nonché delle altre pattuizioni specificatamente riferite alla vendita del singolo servizio oggetto del contratto. B – Condizioni di contratto A tali contratti sono altresì applicabili le seguenti clausole delle condizioni generali di contratto di vendita di pacchetti turistici sopra riportate: art .4 1° comma, art. 5; art. 7; art. 8; art. 9; art. 10 1 comma; art. 11; art. 15; art. 17. L’applicazione di dette clausole non determina assolutamente la configurazione dei relativi contratti come fattispecie di pacchetto turistico. La terminologia delle citate clausole relativa al contratto di pacchetto turistico (organizzatore, viaggio ecc.) va pertanto intesa con riferimento alle corrispondenti figure del contratto di vendita di singoli servizi turistici ( venditore, soggiorno ecc.).

Availability of triple rooms is limited. • Please note that single rooms in Europe will generally be smaller than twinbedded rooms. • Any special room request will be made on a request basis only. Vivitour cannot guarantee special room request although every effort will be made to request from respective hotels. Tour Director: Escorted tours are conducted in English only by a professional multi-lingual Tour Directors. Meals: Continental or buffet breakfasts in the local style are included as indicated on all tours. Dinners are included as detailed in itineraries. • Any special meal requirements will be made on a request basis only. BOOKING PROCEDURES All reservations requests must be made through the Tour Operator by fax or email with: the foreseen dates the size of the group the type of accommodation required and meal basis the chosen itinerary PAYMENTS Deposit: a 25% deposit of the total is required at the confirmation of the group (non-refundable). Final Payment: At least 45 days prior to departure. Method of Payment: by bank transfer. 1. Reservations will be confirmed on receipt of applicable deposit which must be paid within 7 days of booking. Your reservation will automatically be cancelled if the deposit is not received within the specified period. 2. Payment in full is required at time of booking for reservations made less than 45 days before departure. 3. GENERAL INFORMATION & CONDITIONS Itinerary Variations: If unforeseen circumstances beyond our control (at certain peak periods) make changes necessary, we reserve the right to vary itineraries and to substitute hotels with a similar standard and location whenever possible. Tour Cancellation: Vivitour reserves the right to cancel or reschedule any tour due to circumstances beyond its control. Should this occur, we will offer you an alternative arrangement. If you do not accept this alternative arrangement within 7 days we may treat this contract as at an end. Vivitour, referred to as the Operator shall act only as agent or intermediary for passengers in arrangements for hotels, transportation, or any other service and is not liable for any injury, damage, death, loss, accident or delay to person or belonging due to an act of negligence, strike or default of any hotel, carrier or person rendering any of the services included in this catalogue. 2. All matters concerning this booking shall be subject to the laws of Italy and, unless both parties agree to the contrary, any legal proceedings shall be brought in Italian Courts, Como province. 3. PARTICIPANTS’ RESPONSIBILITIES Participants are responsible for obtaining and paying for all visa and entry documents, for meeting all health and other requirements, and for any documents required by the laws, regulations, orders and/or requirements of the countries you will visit. Participants should attain to all the rules and regulations existing in the visiting countries, keep to all the information and recommendations given by the organizing agency. Participants will be kept liable for all damages or charges the agency should incur due to their negligence. For the benefit of everyone on your vacation, Vivitour reserves the right to accept or reject any participant and to remove any participant whose conduct is deemed incompatible with the interests of other participants.
